아세안의 보호무역조치 연구: 비관세조치 및 특정무역현안을 중심으로 (ASEAN Protection Trade Measures: Focusing on Non-Tariff Measures and Specific Trade Concerns)

  • This study examines the trends, current situation and implications of non-tariff measures (NTM) and specific trade concerns (STC) on the protection trade measures of ASEAN. ASEAN's non-tariff measures and the share of specific trade concerns are very significant as they are the second and third largest, respectively, of the major countries. This means that protection measures using non-tariff measures are a strong feature of ASEAN's trade policy. Also, in the future, ASEAN should try to prevent unnecessary disputes caused by exporting countries' specific trade concerns in the implementation of non-tariff measures. Activating trade policy cooperation is likely to reduce conflicts and costs caused by these trade disputes.

Discourse Analysis of News Articles on the U.S and China Trade War in Korean Press

  • In the global economy, trade is not confined in geological boundaries, enhancing the international relation among countries. However, the trade tension between the largest economy and the second-largest economy raise concerns among the world economies, enhancing the uncertainties around world. In particular, the trade tension between the two countries is highly related with South Korea's trade balance, because the country is highly dependent on the trade with the two countries. Given this, we analyzed the news editorials published in Korean quality newsaper, with related to U.S. and China Trade War by looking at the ideological perspectives of news outlets or journalists to the issue within the framework of critical discourse analysis. In particular we gave a special attention to the attitude to each country in order to investigate their ideological stance to the country, following van Dijk (1998)' ideological square. The results are as follows: first, the Chosun Ilbo emphasized 'their' bad properties directly and aggresively, while the Hankyoreh designated the U.S. as a member of an out-group, thus mitigating 'our' bad quatilies; Second, the two strategies of emphasis and mitigation enabled both newspapers to reinforce in-group homogeneity and out-group exclusion. Thus, we could conclude that the editorial is a clear indicator to show the news outlet's ideological stance to each country in regard to the trade issue.

  • 국제교역흐름은 경제적 요인들 뿐 만 아니라 세계의 사회, 정치, 문화적 환경에 의하여 결정되어 왔다. 세계화와 더불어 국제교역환경도 빠르게 변화하고 있으며, 이러한 변화는 국제교역의 흐름에 상당한 변화를 주고 있다. 본 연구의 목적은 경제의 세계화가 국제교역의 흐름에 미치는 영향을 파악하고자 하는 것이다. 우선 국제교역에 나타나는 변화를 특히 경제적, 사회적, 정치적으로 국제적 연계가 강화되면서 나타나는 경제적 결합에 초점을 두어 산업 입지와 투자, 그리고 그 밖의 교역환경들과 연결하여 종합적으로 파악해 보았다. 특히 산업 입지에 변화를 주어 상품의 수요와 공급의 공간적 분포를 재편하는 역할과 함께 기업내 교역흐름을 확장시켜 결과적으로 국제교역패턴에 영향을 끼치고 있는 다국적 기업들에 의한 해외직접투자의 영향을 분석하였다. 기업내 교역은 해외직접투자의 흐름에 의해 결정되므로 본 연구에서는 해외직접투자의 기원지와 대상지의 지리적 특성을 분석하였다. 또한 해외직접투자와 기업내 교역의 공간적 분포에 나타나는 변화를 분석하였다.

ICC 국제공산물매매 모델계약서의 주요 내용 및 실무상 유의점에 관한 연구 (A Study on Main contents and Practical Implications of the ICC Model Contract for International Sale of Manufactured Goods)

  • This study primarily concerns the Model Contract for International Sale of Manufactured Goods recently published by International Chamber of Commerce in 2020. To this end, this study examines the importance of the ICC model contract and its main characteristics, and considers in what form the contract is composed of and the scope of its application by classifying it according to the object of the contract, the subject and type of the transaction. In addition, this study divides the main contents of the ICC model contract into special conditions and general conditions, and attempts to scrutinize details of each condition in connection with the United Nations Convention on Contracts for International Sale of Goods(1980) as a governing law taken by the ICC model contract. Furthermore, this study puts forward, on the basis of the detailed examination of main conditions of ICC Model Contract, practical implications on what the parties to the contract should be aware of when using the ICC model contract.

물류정보화 수준이 물류성과에 미치는 영향에 관한 연구 - 농산물을 중심으로 - (An Empirical Study on Information system for Performance of Phisical Distribution - by Agricaltural Products -)

  • 농산품의 물류관리 정보시스템의 최적화로 물류 정보수준에 따른 성과를 실증 분석하여 물류관리의 효율성과 효과성을 높이는 측면에서 개선방안을 제시하여 물류효율성을 향상시키는데 본 연구의 목적이 있다. 본 연구의 분석방향은 첫째, 조직특성 및 조직전략에 따라 정보기술수준은 물류성과에 영향을 미칠 것인지를 분석하였다. 물류성과는 고객물류서비스 향상과 판매물류비용절감으로 나누어서 측정을 하였다. 둘째, 물류정보시스템 활용수준과 정보기술은 직접적으로 물류성과에 어떠한 영향을 미치고 있는가를 분석하였다. 연구 결과에 의하면, 농산품 물류정보시스템 도입을 물류기업의 경쟁력 강화요인으로 인식하는 기업들은 비교적 물류정보기술 활용수준이 높았고 물류 정보시스템이 농산품 물류서비스 향상과 물류비 관리의 통합망을 구축하는 링크관리를 실시함으로서 농산품 물류 효율성을 높이고 있었다. 그러므로 농산품 물류기업의 물류경쟁력을 높이기 위하여 물류정보기술수준을 높여야 하고 농산품업체의 물류관리와 관련된 의사결정자의 정보마인드가 필요하고 물류업무의 표준화, 정보시스템의 구축전문 인력의 양성과 함께 물류교육이 뒷받침되어야 할 것이다.

초량왜관(草梁倭館)의 창건(創建), 수리(修理) 및 중수(重修)에 관한 연구(硏究) (A Study on The Construction of Choryang-Waegwan)

  • This study concerns especially Choryang-Weagwan which was the largest Japanese House left in Pusan through Chosun Dynasty. Choryang-Waegwan was known to have been jointly constructed by Korean and Japanese carpenters. Therefore, Weagwan was a place for exchange of architectural tradition (special features such as sliding door and straw mat) between Korean and Japan. Judging from this point of view, It is certain that mutual influences helped to shape architecture of Choryang-Weagwan. After establishment Choryang- Weagwan was gradually extended, owing to the prosperity of trade with Japan. But since late 18th century government of Chosun did not give as much care to maintaining Choryang- Weagwan as a result of deteriorating condition of commercial and diplomatic relations with Japan. From the beginning of Choryang- Weagwan construction, Superintendents of the construction were called Hun-do and Byl-cha, who acted as official interpreters as well. And, during construction works, they were called Gamdong-gwan, At the start of construction, Weagwan was built partly in Japanese-style by the carpenters from Tokugawa Shogunate. But as time passed, the participation rate of Japanese carpenters diminished gradually. After 1831, Japanese technician vanished extremely and repairing construction was continued by the Korean workers only.

FTA 국내보완대책의 평가와 과제: 농·축산업분야를 중심으로 (Evaluation and Tasks of FTA Domestic Supplementary Measures in the Area of Agriculture and Livestock Industry)

  • This study closely examines domestic supplementary measures implemented for Free Trade Agreements (FTA) concerning the agriculture and livestock industry and finds out their problems and put forward improvement measures in terms of their system and contents. The systematic problems with previously established supplementary measures are as follows. First, the existing short and long term measures does not comply with each FTA's special and unique economical, political and legislative purpose. Secondly, they focus on improvements for individual FTAs. They must be holistic and integrative considering all FTAs, thus producing synergy to reach better policy overall. Lastly, FTA policies and the measures must reflect the expanding size and scope of regional economic integration. Problems or concerns in existing supplementary measures include first, flexible financing. The government hands out loans to players in the industry based on assets but these loans must be flexible to market interest changes and must include reduced mortgage rate options. Secondly, rigid standards that trigger direct loss prevention, establishing maximum and minimum loan limits, and developing a comprehensive standard for identifying crops to support are all problems that need to be addressed. Thirdly, education of next and future agricultural generation is paramount in building a competitive workforce. Fourthly, the government must identify industries lacking in performance or short in supply to cease or reducing funding. Last but not least, the government should actively search for new markets for export and produce long term road maps for export growth.

남북중재규정 제정의 기본방향 (Basic Direction for the South and North Korea's Aybitration Rules)

  • Since the Agreement on Commercial Arbitration was signed by the Governments of South and North Korea last year, there has been quite a few discussions on the way for implementing the Agreement in both public and private sectors. The Department of Justice of South Korea was quite active in making the draft of arbitration rules representing the South Korean views in alliance with the Department of Reunification of South Korea and recently held an informal seminar to preview their draft. On the other hand, the Korea Arbitration Association, a main body of commercial arbitration which are composed of professors and lawyers, were carefully watching the steps and the draft made by the Department of Justice. The reasons are to assure that not only shall the commercial arbitration rules comply with comment norms of international arbitration but shall it be made to meet the needs of enterprises investing in the Special Economic District of Kaesung City in North Korea. The concerns of the Korea Arbitration Association can be accomplished if the Department of Justice would modify the provisions pointed out in the seminars. Five general principles shall be brought into the attention in promulgating the commercial arbitration rules. First, it should comply with the Agreement on Commercial Arbitration signed by South and North Korea. Second, it should accept common rules contained in UNCITRAL arbitration rules. Third, it should boost the promptness of proceedings when a case was filed. Fourth, it should feature unique aspects of trade between South Korea and Korea by differentiating it from purely international trade between a country and a country. Lastly, it should combine the respective rules of both South and North Korea, currently in effect. With the above five principles accomplished, it should be noted that the Agreement on Commercial Arbitration the upper authority of arbitration rules, mandates the following features. It declared that arbitration be processed by three arbitrators. Single arbitrator is not permitted. Arbitration can be adopted even if an arbitration clause does not exist in an agreement by the parties, provided that the dispute arose out of the scope of the Agreement on investment Guarantee signed by South Korea and North Korea. It excluded quick and simplified procedures even if the amount of claim in arbitration is minimal. All the procedures should take a formal procedure. It let the double administration offices operate. One is to sit in Seoul of South Korea and the other is to sit in Pyongyang of North Korea. This would intimidate the fastness of procedures. With the above principles and the features considered, each provision in the draft by the Department of Justice should be reviewed and suggested for change.

초량왜관의 조영활동에 관한 연구 (A Study on The Construction of Choryang-Waegwan)

  • 1678년에 설치된 초량왜관은 조선 역대왜관 가운데 가장 큰 규모로 오랫동안 존치되었으며, 10여 만평의 기지를 배경으로 동관 삼대청과 서관 삼대청 그리고 외측사조가사 등이 복합된 양상으로 구성되어 있었다. 특히 200여 년의 존치기간 동안 창건공사와 21건의 수리공사가 이행된 사실은 주목할 만 하다. 조정은 조선의 땅에 세워진 왜인 거류지인 왜관의 감독과 관리에 관심을 가지고 있었으며, 그 결과 왜관기지 내의 여러 건물을 조선측 조영건물과 일본측 조영건물로 조영주체를 구분하고, 차왜와 소통할 수 있는 역관을 감동관으로 삼아 양국의 의견을 조정하는 등, 일반적인 관아건축과 다른 인력조직과 공사체제를 편성하였다. 왜관창건공사에는 왜목수와 조선목수가 함께 동원되었다. 이러한 사실은 조일 양국이 왜관을 통해 서로의 공사기술과 방법을 체험하고 교류하는 기회였음을 시사한다. 이에 녈 연구는 조선시대 왜관 가운데 규모가 가장 크고 , 존치기간이 길었던 초량왜관을 대상으로 왜관공사의 실체를 규명하는 것을 목표로 한다. 두모포왜관의 공사체제를 전례로 하는 창건공사와 공사의 체제정비가 이루어진 수리공사를 나누어 각 공사의 공사내용과, 집행정도, 역가지급, 공사주체를 살피고, 200년 동안의 추이를 살펴 왜관이라는 독특한 장소에서 이루어진 공사의 성격을 규명하여, 초량왜관에서 일어난 조일양국의 조영활동에 대한 교류를 건축생산사적 측면에 초점을 두어 고찰하고자 한다.
