A Study on the Matter of Double Contract for Trademark License in China (중국의 상표사용허가계약의 중첩체결에 관한 연구)

  • There are many safeguards and measures available regulating the protection of a trademark and its registered holder, however, the protection of a licensee in a trademark license agreement is also important for protection of a intellectual property. Therefore, there are several measures in place for the protection of licensees' interests in Chinese trademark law. Article 43(3) of the Chinese Trademark Law rules a licensor who licenses others to use his registered trademark shall submit the trademark licensing to the trademark office for file, and the trademark office shall announce the trademark licensing to public. Without filing, the trademark licensing shall not be used against a bona fide third party. It means a licensee can not use an unrecorded license with the relevant trademark authority against third parties - essentially, this means that a licensee should insist on having their trademark license agreements recorded against the relevant trademark authority, so that a licensee's interests are protected as against the assignees, licensees and other types of third parties. Otherwise a third party in good faith can use the registered trademark legally against a licensee even though a trademark license agreement between a licensor and licensee is still valid.

Siyuan Yujian in the Joseon Mathematics (조선(朝鮮) 산학(算學)의 사원옥감(四元玉鑑))

  • As is well known, the most important development in the history of Chinese mathematics is materialized in Song-Yuan era through tianyuanshu up to siyuanshu for constructing equations and zengcheng kaifangfa for solving them. There are only two authors in the period, Li Ye and Zhu Shijie who left works dealing with them. They were almost forgotten until the late 18th century in China but Zhu's Suanxue Qimeng(1299) had been a main reference for the Joseon mathematics. Commentary by Luo Shilin on Zhu's Siyuan Yujian(1303) was brought into Joseon in the mid-19th century which induced a great attention to Joseon mathematicians with a thorough understanding of Zhu's tianyuanshu. We discuss the history that Joseon mathematicians succeeded to obtain the mathematical structures of Siyuan Yujian based on the Zhu's tianyuanshu.

Effect of Water Extract of Schisandra Chinensis on Osteoclast Differentiation (오미자 물 추출물이 파골세포 분화에 미치는 영향)

  • Bone maintains its homeostasis through balance between bone resorbing osteoclasts and bone forming osteoblasts. Thus, unusual balance between osteoclasts and osteoblasts leads to pathological bone diseases, such as osteoporosis, rheumatoid arthritis, autoimmune arthritis, periodontitis. Schisandra chinensis well known traditional herbal has been used for treatment of diseases in China, Korea, Japan, andothers. Recently, research studies have demonstrated that the lignans found in Schisandra chinensis stimulate osteoblasts and suggest that it may be helpful against osteoporosis. However, the inhibitory effect of water extract of Schisandra chinensis on osteoclast differentiation remains largely unknown. In this study, Water extract of Schisandra chinensis markedly suppressed RANKL-induced osteoclast differentiation in cultures of BMMs without cytotoxicity. The mRNA expression of c-Fos, NFATc1, and TRAP induced by RANKL was inhibited by water extract of Schisandra chinensis. It also suppressed c-Fos and NFATc1 protein expression. Taken together, these results suggest that water extract of Schisandra chinensis has the potential to serve as a treatment of bone disease such as osteoporosis.

Molecular characterizations of phosphoprotein of rabies virus circulating in Korea

  • Rabies is a major zoonotic disease that causes approximately 55,000 human deaths worldwide on an annual basis. The nucleocapsid protein and glycoprotein genes of the Korean rabies virus (RABV) have been subjected to molecular and phylogenetic analyses. Although the phosphoprotein (P) has several important functions in viral infection and pathogenicity, the genetic characterizations of the P of Korean RABV isolates have not yet been established. In the present study, we conducted genetic analyses of P genes of 24 RABV isolates circulating in the Republic of Korea (hereafter, Korea) from 2008 to 2011. This study revealed that the P genes of Korean RABVs are genetically similar to those of RABV strains of lyssavirus genotype I including V739 (dogs, Korea), NNV-RAB-H (humans, India), NeiMeng925 (raccoon dogs, China), and RU9.RD (raccoon dogs, Russia). Among Korean isolates, the RABV P genes showed low variability in the variable domains among Korean isolates; they had specific consensus sequences and amino acid substitutions capable of identifying geographic characteristics and retained specific sequences thought to be important for viral function. These results provide important genetic characteristics and epidemiological information pertaining to the P gene of the Korean RABV.

Color Analysis for the Quantitative Aesthetics of Qiong Kiln Ceramics

  • The subjective experience would degrade the current artificial artistic aesthetic analysis. Since Qiong kiln ceramics have a long history and occupy a very important position in ceramic arts, we employed computer-aided technologies to quickly automatically accurately and quantitatively process a large number of Qiong kiln ceramic images and generate the detailed statistical data. Because the color features are simple and significant visual characteristics, the color features of Qiong kiln ceramics are analyzed for the quantitative aesthetics. The Qiong kiln ceramic images are segmented with GrabCut algorithm. Three moments (1st-order, 2nd-order, and 3rd-order) are calculated in two typical color spaces, namely RGB and HSV. The discrimination powers of the color features are analyzed according to various dynasties (Tang Dynasty, Five Dynasties, Song Dynasty) and various utensils (Pot, kettle, bowl), which are helpful to the selection of the discriminant color features among various dynasties and utensils. This paper is helpful to promoting the quantitative aesthetic research of Qiong kiln ceramics and is also conducive to the research on the aesthetics of other ceramics.

A Study on "Naegyeongseupyubangron(內經拾遺方論)" - focused on analysis of bibliographic investigation ("내경습유방론(內經拾遺方論)"에 대한 연구(硏究) - 서지학적(書誌學的) 고찰(考察)을 중심(中心)으로)

  • The "Naegyeongseupyubangron(內經拾遺方論)", written by Nakyonggil(駱龍吉), is an ancient book of Bangron(方論). The exact time period of this book is unknown. To estimate its written time, we compared the contents of this book to other sources on the cause of diseases, the description of symptoms, the transmission of diseases, and treatments. In addition, we analyzed the features of the book by comparing it to other books of Bangron(方論). As a result, we estimated the approximate time period that it was written and gained a better understanding of the ancient medicine. We reached several conclusions through this study. 1. The approximate time period of "Naegyeongseupyubangron(內經拾遺方論)" is that of the Southern Song(南宋) dynasty of China, probably after "Saminbang(三因方)" between 1174 and 1279. 2. Nakyonggil(駱龍吉) was influenced by Wangbing(王冰), Sonsamak(孫思邈), Yuhagan(劉河間), Jinmutaek(陳無擇). and he influenced "Uibanggo(醫方考)". 3. The "Naegyeongseupyubangron(內經拾遺方論)" is the most comprehensive book among the books of Bangron(方論) because of its analysis of the "Hwangjenaegyeong(黃帝內經)" and its connection to the treatment of ancient diseases in Oriental Medical History.

Analysis of experimental studies on Insamyangyoung-tang (인삼양영탕을 이용한 실험연구 분석)

  • Objective : This study aimed to analyze a comprehensive feature of experimental research on Insamyangyoungtang and develop a strategy that can be used for experimental studies on Insamyangyoung-tang in the future. Method : The journal search was performed using six databases : PubMed, Chinese database (China Network Knowledge Infrastructure, [CNKI]), Japan database (Japan Science and Technology Information Aggregator, Electronic, [J-STAGE]) and three Korean databases (Oriental Medicine Advanced Searching Integrated System [OASIS], Research Information Service System [RISS], and Korean Studies Information Service System [KISS]). We used limited keywords and analyzed studies by publication year, experimental models, and the subjects of biological activities. The mechanism of pharmacological activity in accordance with the therapeutic effects of Insamyangyoung-tang was noted. Results and Conclusion : A total of 43 studies (6 domestic studies and 37 foreign ones) were examined according to the inclusion criteria of the experimental study. Research on the pharmacological activities of Insamyangyoung-tang showed its therapeutic effects on the nervous and immune systems, as well as its anti-aging, anti-fatigue, and hematopoietic effects. Additional efficacy and safety assessments and experimental and clinical studies should be performed to evaluate the mechanism of Insamyangyoung-tang. The present review has provided preliminary information for further studies on Insamyangyoung-tang.

  • In 2009, the world dairy industry had the most impressive experience throughout all the experiences it had. The milk price in major regions fell to their lowest level for decades. Including Korea, the world economy is obviously slowing. The nations' export plunged due to the global economic recession, in result reduced industrial output and domestic demand. In Korea, the intake of liquid milk slightly decreased from 45 kg per capita in 2005 to 44.3 kg per capita in 2008. However, production and consumption of milk increased fast in China and India. According to 2008 statistics, total milk volume of the world trade reached 42 million tonnes and the major exporters of dairy products were EU, New Zealand, USA and Autralia. The tropical countries has traditionally consumed buffalo milk. The production of buffalo milk is increasing faster than cow milk. IDF expected that EU milk production would recover the medium term displaying a gradual growth over the milk quotas phasing-out period, while constantly remaining below the quota level.

Structural damage distribution induced by Wenchuan Earthquake on 12th May, 2008

  • Based on the reconnaissance of buildings in Dujiangyan City during 2008 Wenchuan earthquake, China, structural damage characteristics and the spatial distribution of structural damage are investigated, and the possible reasons for the extraordinary features are discussed with consideration of the influence of urban historical evolution and spatial variation of earthquake motions. Firstly, the urban plan and typical characteristics of structural seismic damage are briefly presented and summarized. Spatial distribution of structural damage is then comparatively analyzed by classifying all surveyed buildings in accordance with different construction age, considering the influence of seismic design code on urban buildings. Finally, the influences of evolution of seismic design code, topographic condition, local site and distance from fault rupture on spatial distribution of structural damage are comprehensively discussed. It is concluded that spatial variation of earthquake motions, resulting from topography, local site effect and fault rupture, are very important factor leading to the extraordinary spatial distribution of building damage except the evolution of seismic design codes. It is necessary that the spatial distribution of earthquake motions should be considered in seismic design of structures located in complicated topography area and near active faults.
