Silicon Valley's legal foundation in recent years has surfaced on the radar of policy planners who model Silicon Valley's information and communication technologies (ICT) industry. Precisely, the prohibition of covenants not to compete (CNCs) is linked to firm-to-firm knowledge spillovers by way of mobile workers positioned as nodes in a system of innovation. Meanwhile, traditional frameworks support enforcement of CNCs as a way to encourage R&D activities to the worker and to prevent the worker's tacit knowledge and know-how from fleeing. Amidst the battle for the restraint or release of human capital, we present an industrial approach to reconcile the ostensible strife between enforcement and prohibition frameworks. Theoretically, we contend an industrial approach can maximize the policy tools of discorded planners. Moreover, this article newly compares the ICT industries of Silicon Valley and Route 128 to argue that California's law is a unique factor in the greater success of Silicon Valley firms.

This article examines the ICT industry in Silicon Valley and Route 128 to argue that California's unique law is a key factor in the success of Silicon Valley firms. Theoretically, we reconcile the ostensible strife between enforcement and prohibition frameworks by presenting an industrial approach. We contend that selective enforcement by industry can maximize the policy tools of discorded planners.

Policy planners in Asia readily covet high technology districts and regional systems of innovation such as Silicon Valley. We examine the law's role, by way of covenants not to compete (競業禁止條項) in the development of Silicon Valley by reviewing the literature from 1999 through 2013. The research suggests that in certain high-tech districts such as Silicon Valley, there are greater gains in the innovation of a region by prohibiting CNCs. While we emphasize CNC law as the main legal determinant to Silicon Valley's success, the application of trade secret law and the inevitable disclosure doctrine are also factors that can aid or restrict the mobility and knowledge spillover of a region. Even with much explored, perspectives are lacking from a regional innovation systems analysis, and more so in the context of Asian nations. To tackle these gaps, three analytical frameworks are presented that entails labor law, law and economics, and law and innovation. And from within the law and innovation framework, research is introduced in the hope that future discussions on Asian regional innovation systems consider the legal foundation of Silicon Valley.

최근 글로벌 시장에서 플랫폼 산업이 급격히 성장함과 동시에 경쟁이 심화되고 있으며, 향후 다양한 산업분야와 접목하여 플랫폼 산업의 영역과 범위는 더욱 확대될 전망이다. 따라서 플랫폼 시장에서 국내 플랫폼 기업들이 글로벌 경쟁력을 갖추기 위해서는 플랫폼 비즈니스 생태계 및 성공요인에 대한 연구가 필요하다. 그러나 최근 플랫폼 관련 연구는 플랫폼 비즈니스 현황분석, 플랫폼 경제, 플랫폼의 간접 네트워크 외부성 등의 특성에 관한 이론적 연구가 대부분을 차지했다. 따라서 본 연구는 기존 선행연구들에서 제안되고 있는 실리콘밸리 기업생태계의 성공요인들을 통합적으로 분석하고, 동시에 실제 실리콘밸리 플랫폼 기업생태계의 이해관계자들을 대상으로 추출된 성공요인들을 분석하였다. 그리고 이러한 요인들을 기반으로 플랫폼 기업생태계 이해관계자들에게 성공방안을 제안하기 위한 방안으로 IPA분석과 심층인터뷰(in-depth interview)를 진행하였다. 분석 결과, 선행연구들을 통해 수집한 성공요인들 중 비교적 현재 실리콘밸리에서 중요도와 만족도가 모두 잘 유지되고 있는 요인은 인력, 자본, 도전문화가 확인되었다. 결국 현재의 실리콘밸리가 우수한 인적자원과 풍부한 자본을 바탕으로 이를 활용해 마음껏 도전해볼 수 있는 환경과 문화가 조성된 것이 실리콘밸리의 플랫폼 비즈니스의 성공에 가장 크게 기여하고 있다는 것을 알 수 있다. 한편, 실리콘밸리의 플랫폼 기업생태계에 있어서 중요도는 높지만, 현재 이해관계자들의 만족도가 상대적으로 낮게 나타나는 요인으로는 '활발한 기업 간의 학습과 벤치마킹', '구성원 간의 강한 유대감과 협력관계'임을 확인되었고, 향후 해당 요인들을 강화하기 위한 관심과 노력이 필요한 것으로 분석되었다. 마지막으로 최소한의 관리만이 필요한 요인들은 시장의 자율경쟁에 필요한 제도 및 정책들과 '기업지원 서비스 산업', '네임밸류', '분사창업' 등이었으며, 이러한 요인들은 문헌조사에서는 중요하게 지적되었지만, 시대와 환경의 변화로 인해 그 중요도와 만족도에 있어서 우선순위가 낮아졌다는 연구결과가 도출되었다. 본 연구는 기존 선행연구들에서 제안되고 있는 실리콘밸리 기업생태계의 성공요인들을 통합적으로 분석하고, 동시에 실제 실리콘밸리 플랫폼 기업생태계의 이해관계자들을 대상으로 추출된 성공요인들을 분석하였다는데 이론적 의의를 찾을 수 있다. 또한, 추출된 다양한 요인들을 기반으로 IPA 분석을 통해 중요도 및 만족도를 동시에 살펴보았다는 점에서 또 다른 학문적 의의가 있다 하겠다. 실무적인 시사점으로는 정부 및 기업에게 국내 플랫폼 기업의 성장을 위한 이론적 근거와 플랫폼 기업 생태계의 성공요인에 대한 구체적인 정보를 제공함으로써 국내 플랫폼 생태계 형성에 기여하였다는 점에서 의의를 가진다.

혁신클러스터는 기반조성기, 형성기, 성장 및 안정기에 따라 그 성공의 요인이 다르다. 경기도 혁신클러스터는 현재 기반조성기 또는 형성기 단계로서 지속적인 성장과 발전이 필요하다. 이 논문의 목적은 자생적으로 발전하여 관련 다양성까지 나타나고 혁신클러스터의 가장 대표적인 지역으로 손꼽히는 미서부 캘리포니아에 위치한 실리콘밸리 혁신클러스터 대표기관 방문을 통해 현황을 파악하고 시사점을 도출하여 혁신클러스터 발전을 위한 정책을 제시하는 것이다. 이를 위하여 인프라 조성, 인력양성, 산학연 연계협력, 창업지원, 지자체 등 관련 대표기관을 방문하여 지자체로서 지역혁신체계 구축을 위해 경쟁력 있는 역할을 수행하고 있는 경기도를 대상으로 클러스터 기반의 바람직한 과학기술정책을 위한 시사점과 정책과제를 도출하였다.

Monte Carlo simulations of electron impact ionization in silicon utilizing simple spherical band approximation including L valley are presented. The mean energy of electron at high electric field is lowered and the threshold energy of electron impact ionizaiotn is smeared out to $E_x$ by including L valley. This work also presents the importance of the modeling of L valley by calculating the electron population rate of it over the threshold energy of eletron impact ionization, which is higher than 10%

Convergence is now the trend of knowledge information society. Information technology and knowledge transfer are main sources of convergence. There are many articles which studied outcomes of convergence while there are few articles that try to study the process of convergence. The purpose of this study is to investigate how convergence is dynamically formalized. For the analysis, we used Institutional Analysis and Development(IAD) framework from the point of convergence. IAD framework could synthetically study the origin and the process of convergence. We investigated the case of sillicon valley whether or not dynamics of ICT convergence could be explicable by IAD framework. The results shows that ICT technology and knowledge could be the enabler for the formation of convergence. ICT technology accelerates convergence and knowledge convergence from information converge different technologies and industries. This article provides a theoretical foundation for future research to analyze dynamics of ICT convergence by the IAD framework. For the future work, it is recommended that a study is to be empirically analyzed the dynamics of ICT convergence.

미국의 실리콘밸리와 대만의 신주공업단지는 종종 첨단 산업집적단지의 성공적 모델로 불리어진다. 이들 두 지역의 성공 및 경쟁력에 대한 지배적 설명은 전통적으로 경제활동의 공간적 집적이 가져다주는 경제적 이익을 제시하기 위해 사용된 "외부규모의 경제"에 이론적 기반을 두고 있다. 그러나, 외부경제란 개념만으로 이들 지역의 역동적 발전과 모방하기 힘든 경쟁력을 설명하기에는 부족함이 많았다. 본 논문은 이들 지역에서 역사적으로 전개되어진 기업과 외부 경제주체들과의 관계를 사회적 자본, 네트워크 기반 산업시스템 분석, 자원기반이론 등을 토대로 분석하여 이들 두 지역이 첨단집적단지로서의 성공요인과 경쟁우위에 대해서 살펴보고자 했다. 아울러 본 논문은 이들 두 지역에 있어서 발전적 협력관계를 분석함으로서 국내에서 이러한 첨단산업단지를 개발하고 발전시키기 위해 필요한 것이 무엇인지를 검토하고 이에 필요한 정책적 시사점을 몇 가지 제시했다.몇 가지 제시했다.
