전자상거래의 문제점과 분쟁사례 연구 (Arbitration Dispute Resolution Study upon e-Commerce Issues)

  • This study is to analyze e-commerce issues and how to settle arbitration dispute resolution. Considering internet related business spread out worldwide, the dispute is incurred in variety areas. To resolve the dispute of e-commerce, government has been released several laws for protecting legal transaction, information exposure, and internet security, etc. However, internet related technology is changing rapidly and dispute issues are coming out at many different models. Upon that environments, law and rules could not be followed to meet the technology change. That issues are made for this study. In this study, outlook of e-commerce, status of domestic and overseas of internet business, e-commerce and security issues were analyzed, and empirically comparative analysis was driven out and variety dispute cases were studied. Upon that study the resolution methods were suggested and arbitration settlement was proposed prior to legal sue. This study results are how to minimize the disputes and the method of dispute settlement. Therefore, a role of arbitration proposed and emphasized. To protect the dispute in advance, it's suggested to revise rules timely following on technical changes, and emphasized that the dispute has to lead to arbitration settlement not for consuming unnecessary time and finance for enterprises and consumers.

  • As the Internet settles down as a general means, every year the domestic e-commerce transaction using the internet rapidly increases in its scale, and the conflicts occurred from the e-commerce largely grow as well. However, it is true that the clear settlement means to work out such conflicts is not established yet. Considering the feature of e-commerce, it would be better to resolve them by ADR rather than by lawsuits in the court, and in addition to it, the ODR system having sweetness as its advantage will be the optimized model. But to make the ODR settled down, there are many assignments to be improved in many aspects afterwards. In case of our country also, since the ODR system is still its early developing step, it is not activized yet due to its weak technical, lawful environments. Thus, currently, it is unavoidable to operate the dispute mediation system, carrying out a system by the existing Off-line together, and thereby, as we replace the parts worked out by the Off-line with by the On-line, we must try to develop it into a quick, cheap, and reliable dispute settlement system.

  • 낙동강은 그 하구 근처에서 김해평야하고 부르는 델타지역을 형성하였다. 김해평야에 퇴적된 점성토는 다른 나라의 점토층에 비해 유달리 두껍다 (최대 60m). 이 지역의 일부는 새로운 공업단지의 개발을 위해 연직 배수재를 설치한 후 평균 5-7m의 높이로 매립하였다. 연약 지반 위에 매립작업을 수행하면서 침하량을 측정하였는데, 실측침하량은 이론적으로 예측한 침하량보다 현저히 크다는 것을 알게 되었다. 이 논문은 김해점토의 퇴적환경의 관점에서 과다침하가 발생되는 이유를 기술하고 있다.

  • This paper reviews depositional environments of marine deposits along the Nakdong river and then analytical solution of self-weight consolidation considering artesian pressure is made to find consolidated state. It's known that this area is in the under-consolidated state by the artesian pressure(u$\_$a/=0.3kg/$\textrm{cm}^2$) and the distribution of the artesian pressure is not linear but parabola. In predicting consolidation settlement for soft grounds improved by vertical drain, it is emphasized that the self-consolidation by sudden dissipation of artesian pressure should be considered.

Performance Test of Asynchronous Process of OGC WPS 2.0: A Case Study for Geo-based Image Processing

  • Geo-based application services linked with the Open Geospatial Consortium (OGC) Web Processing Service (WPS) protocol have been regarded as an important standardized framework for of digital earth building in the web environments. The WPS protocol provides interface standards for analysis functionalities within geo-spatial processing in web-based service systems. Despite its significance, there is few performance tests of WPS applications. The main motivation in this study is to perform the comparative performance test on WPS standards. Test system, which was composed of WPS servers, WPS framework, data management module, geo-based data processing module and client-sided system, was implemented by fully open source stack. In this system, two kinds of geo-based image processing functions such as cloud detection and gradient magnitude computation were applied. The performance test of different server environments of non-WPS, synchronous WPS 1.0 and asynchronous WPS 2.0 was carried out using 100 threads and 400 threads corresponds client users on a web-based application service. As the result, at 100 threads, performance of three environments was within an adjacent range in the average response time to complete the processing of each thread. At 400 threads, the application case of WPS 2.0 showed the distinguished characteristics for higher performance in the response time than the small threads cases. It is thought that WPS 2.0 contributes to settlement of without performance problems such as time delay or thread accumulation.

농촌 정주형 역사환경 보전방법론 고찰 - 외국 선례를 중심으로 - (Conservation Methods for Historic Rural Settlements - with focus on foreign precedents -)

  • Now, the conservation policy of historic environments in Korea which started in early 1980's, is in a danger. In addition, because of economic crisis started last year, the concerns for historic environments are growing weaker. However, this situation can be a good opportunity to prepare for the coming conservation works, The purpose of this study is to find clues for conservation of historic environments by considering foreign precedents. For concrete results, this study selects historic rural settlements as a case and focuses on the relationship among related people in the light of the their rights. Based on the consideration of foreign precedents, three different characters in the conservation process could be identified compared with korean cases; 1) Except partial works of public sector, generally the conservation process is under the control of nonprofit groups and residents themselves, 2) Conservation methods include with the proper change process for the sustainable settlement, and avoid the unconditional past-oriented approach, 3) Conservation methods are composed of not only the preservation of external forms such as assets but also the continuous participation and management of the community. And the most important clue which has been extracted is that the diverse rights of related people in the historic rural settlements should be kept in balance thoroughly.

한국 농촌자연부락의 녹지체계에 관한 연구 (A Study on the Open Space System in Korean Rural Settlement.)

  • The concept of ‘Open Space’ is conceived to be very valuable subject of interest in developing modern settlement system. In Korea, many new and old residential sites have been developed or renewed to fulfil the housing demands. And such trends seem to continue for the time being. What is more, the requirments for more comfortable residential environments, that is deeply concerned with ‘Open Space’, inorease gradually. As a basis for designing more efficent residential environments to fit Korean morden life style, self - grown, traditional and agricultural villages are studied. This study is concenturated on the Open Space System with its socio - cultural and physical backgrounds. For this, data and materials are some widely collected and are analysed focused on the systems and structures of ‘Open Spaee’. Some results from this study are summarized as follow ; 1. It is assumed that the number of houses per village is around 60, and that its area reaches to the radious of 3-4km. 2. ‘POONGSU’is a generally adopted theory based on natural elements like mountians, waters, and orientations when locating villages and composing their spatial structures. As a result of this, the basic structures of villages and Open Space are defined. 3. Circulation system is integrated to the hierachyal order system ; that is, Passing Road \longrightarrowEntry Road\longrightarrowCentral Read\longrightarrowDisperse and Access Road. 4. The natural and agricultural land uses are overlapped with diverse outdoor activities - religious services, play and recreation, relaxation, etc - without any physical modification. 5. At each villages, several artificial and spot - like green facilities are found. And distinctive functions, meanings, and locationalities are given to each of them. On that, they become a visual and psychological centers of each village. 6. In addition to its basic function of circulation, Central Road takes the sence of place for outdoor activities. Because of this charactor, it plays an important role of activating the village life and binding the various Open Space elements.

Standards of architectural design for the ecological certification of the rural settlements

  • Before the industrial revolution architecture has been shaped by the natural and cultural inputs. Local constraints become more effective determinants of architecture in the rural contexts because by being disengaged from the webs of transportation and communication, rural settlements have achieved sustainability in difficult conditions. The examples of rural settlement and architecture have provided sustainability through integration with natural inputs within the geographical context because they have reached the goals of ecological design within the local constraints. Although this feature of the rural cultural landscapes has been emphasized frequently, tangible standards could not be developed in order to interpret their ecological design principles from the perspectives of the contemporary building sector and planning. However, the historical experience indicates that the sustenance of ecological performance can be possible as a result of integrated planning at the overall scale of the settlement. Therefore, the existing standards are not qualified for interpreting the rural contexts. This study develops a method for analysing, interpreting and evaluating traditional rural settlements and certifying new implementations in the rural environments in the light of the given literature review, discussion and methodological proposal.

실내실험에 의한 수평보강재로 보강된 터널막장의 거동 (Behavior of a tunnel face reinforced with longitudinal pipes - laboratory investigation)

  • 본 논문에서는 수평보강재로 보강된 터널막장의 거동에 관한 내용을 다루었다. 터널막장 보강공법에 있어서 보강조건이 막장의 수평변위 및 지표침하에 미치는 영향을 고찰하기 위해 축소 모형실험을 수행하였다. 실험결과 수평보강재로 터널막장을 보강할 경우 막장의 변위 및 지표침하가 현저히 감소하는 것으로 나타나 도심지 터널시공에 있어서 지반거동 억제를 위한 보조 공법으로서 효과적으로 적용될 수 있는 것으로 나타났다. 아울러 지반거동 억제 효과는 보강조건에 따라 현저히 차이를 보이는 것으로 나타났다. 본 고에서는 연구결과를 종합하여 실무 적용시 주안점을 고찰하였다.

Changes in body weight and food security of adult North Korean refugees living in South Korea

  • BACKGROUND/OBJECTIVES: Relocation to new environments can have a negative impact on health by altering body weight and dietary patterns. This study attempted to elucidate changes in body weight, food security, and their current food and nutrient consumption in adult North Korean refugees (NKR) living in South Korea (SK). SUBJECTS/METHODS: This study analyzed data on 149 adult NKR from a North Korean refugee health in SK cohort at four time points (leaving North Korea, entering SK, first examination, and second examination). Body weight was self-reported at the two earlier time points and directly measured at the two later time points. Food security, diet-related behaviors (dietary habits and food consumption), and sociodemographic information were obtained using a self-administered questionnaire. Nutrient intake information was obtained by one-day 24-hour recall. Statistical analyses were performed with SPSS ver 23.0. RESULTS: Body weight increased during relocation by an average of 4 kg, although diversified patterns were observed during the settlement period in SK. Approximately 39.6% of subjects maintained their body weight between the first and second examinations, whereas 38.6% gained and 22.1% lost at least 3% of their body weight at the first examination by the second examination. Food security status improved from 12.1% food secure proportion to 61.7%. NKR showed generally good food and nutrient consumption (index of nutrient quality: 0.77-1.93). The body weight loss group showed the most irregular meal consumption pattern (P < 0.05), and eating-out was infrequent in all three groups. Consumption frequencies of food groups did not differ by group, except in the fish group (P = 0.036). CONCLUSION: This study observed considerable body weight adjustment during the settlement period in SK after initial weight gain, whereas food security consistently improved. More detailed understanding of this process is needed to assist healthy settlement for NKR in SK.
