  • The following contribution deals with the objectives and scopes of the German Act on Environmental Impact Assessment (EIA) and with the procedural implementation of this act. It begins with a presentation of the goal and content of EIA and the scope of its application. It then turns to the procedure of EIA, specially to the five distinct steps by which the EIA is to be carried out under German law. Finally some remarks are made on the rote of EIA in the decision-making process and on the further development of EIA since the entry into force of the Act on EIA.

The Word is not Enough - Arbitration, Choice of Forum and Choice of Law Clauses Under the CISG

  • Form requirements particularly for arbitration clauses are widely perceived as an obstacle for efficiently resolving disputes on an international level. The paper discusses the recent suggestion that the freedom of form principle under Art. 11 CISG extended to arbitration, forum selection, or choice of law clauses in international sales contracts and thus superseded any and all formal requirements in this regard. After analysing national and international form requirements with regard to said clauses, the authors elaborate that while dispute clauses are indeed encompassed by the CISG's scope of application, freedom of form under the CISG was neither intended to nor should it apply to dispute clauses. This result is further confirmed by the interplay of the CISG with other international conventions, first and foremost the 1958 New York Convention, as well as a careful analysis of the so called most-favourable-law-approach.

  • Fuzzy logic rule-based controller has many desirable advantages, which are simple to implement on the real time and need not the information of structure and dynamic characteristics of the system. Thus, nowadays, the scope of the application of the fuzzy logic controller becomes enlarged. But, if the controlled plant is a time-varying and nonlinear system, it is not easy to construct the fuzzy logic rules which usually need the knowledge of an expert. In this paper, an approach in which the logic control rules can be self-organized using genetic algorithm will be proposed and the effectiveness of the proposed method will be verified by computer simulation of the 2 d.o.f. planar robot manipulator.

  • The emergence of generalized square metrics in Finsler geometry can be attributed to various classification concerning (𝛼, 𝛽)-metrics. They have excellent geometric properties in Finsler geometry. Within the scope of this research paper, we have conducted an investigation into the generalized square metric denoted as $F(x,y)=\frac{[{\alpha}(x,y)+{\beta}(x,y)]^{n+1}}{[{\alpha}(x,y)]^n}$, focusing specifically on its application to the Finslerian hypersurface. Furthermore, the classification and existence of first, second, and third kind of hyperplanes of the Finsler manifold has been established.

  • Construction industry, which is a composite industry being performed by organic combination of various tasks, gives birth to a various of information in the stages of planning, designing, and maintenance management. In particular, the drawing information is broad in the scope of use because it contains all information about buildings as wall as bid, materials, contracts. Therefore, the management of drawing information security is one of the most important factors, which determines the success of failure of business. The major findings and result of this study are as follows to control the distributed drawing information in the collaboration environment. 1) Analysis for function and practical use of DRM in the construction industry. 2) Proposal for applications of DRM that can secure IFC model-based drawing information in the collaboration environment. 3) Extraction from additional IFC entities to apply DRM to part 21 physical files 4) Analysis for functions which are necessary in DRM application prototype system and development of the system. 5) Development IFC model-based DRM prototype system.

  • The ISO 90000 Quality System Certification is one of trends over the world. Many companies and organizations want to achieve the ISO 9000 certificate. But, some of companies did not fully consider the needs of certification before the decision of establishing the quality system to ISO 90000. If a company/organization wants to establish its unique quality system, it should consider some of points in the identification of needs, definition of application scope, effective ways of system establishing, top management committement, composition of task force team, practical involvement and development, analysis of process and assigned job functions, adoption of changes of business circumstances, and practical implementation of its unique quality system.

  • KEPCO Research Center is carrying out a simulator(full scope replica type) development project for two nuclear power plants(Kori-2, Younggwang-3,4) and one fossil power plant(Poryong-3,4). In this project, we aim not only the installation of high performance simulators at the power plant sites but also the realization of self reliance of power plant simulation technology in Korea. In the course of preparing procurement specification for the 3 simulators, the present status of power plant simulation technology has been surveyed and is presented in this paper. The fidelity of simulation and the automation of simulation model production has been greatly improved due to the ever increasing computing power of today's workstations. The need and importance of the application of high fidelity simulators to the operator training is refocused since the accident at TMI Nuclear Power Plant, U.S.A.

Analysis of Importance of Search Altitude Control for Rapid Target Detection of Drones

  • Rapidity and accuracy are important considerations when a drone is employed in a wide surveillance area to detect a target. They are more important when the scope of application is a search and rescue operation or the monitoring of natural disasters, which may require prompt warnings and response. During the actual operation of a drone, rapidity and accuracy are associated with the change in the altitude of the drone. The aim of this study is to analyze the characteristics of drones at varying altitudes and prove that altitude is a relevant factor in the performance of drones. Herein, the characteristics of the drone at varying altitudes were analyzed through several search simulations. The results suggest that a high-altitude drone is relatively advantageous compared to a low-altitude drone in a probability-based target search, and that the search altitude is also a very important and fundamental factor in target search by drones.

  • SMART Frame is a composite precast concrete structure system to deliver the advantages of both steel frame and reinforced concrete. Many studies have established to date that SMART Frame is more advantageous than conventional frame-type structure in terms of structural stability, constructability, economic viability as well as reduction of construction schedule. However, such studies have focused primarily on wall-type or flat slab-type apartment housing structures, failing to include Rahmen structures in their scope. Accordingly, this study aims to analyze the benefits of potential application of SMART Frame to RC Rahmen structures. As the structural stability and constructability of SMART Frame is already proven, this study reviews its benefits from the perspective of cost reduction. Conclusion of this study will be used subsequently in predicting the benefits of SMART Frame when it is adapted to RC Rahmen structures.

UNCITRAL의 해상화물운송협약의 예비초안에 관한 연구 (A Study on the UNCITRAL's Preliminary Draft Instrument on the Carriage of Goods by Sea)

  • UNCITRAL considered a proposal to include in its work program a review of current practices and laws in the area of the international carriage of goods by sea, with a view to establishing the need for uniform rules where no such rules existed and with a view to achieving greater uniformity of laws. And UNCITRAL Working Party, as of April, 2003, is reviewing the UNCITRAL's Preliminary Draft Instrument which was originally prepared by CMI. As said above, the Preliminary Draft Instrument has a lot of improved provisions in relation to the scope of application, period of responsibility, obligations and liability of carrier, obligations of shipper and so on, but it has also some provisions which should be reconsidered in light of changed environments. Therefore, UNCITRAL Working Party has to prepare more complete and widely adoptable new uniform rules under the sufficient discussion.
