Medical institutions wishing to install and operate diagnostic radiation generators must complete appointment training within one year of appointment based on the 「Medical Act」 and the 「Rules on Safety Management of Diagnostic Radiation Generator Devices」 which will come into effect on January 1, 2024. Additionally, You must receive supplementary education every three years from the date you received it. The strengthening of safety management for diagnostic radiation generators used in medical institutions means that although the radiation exposure that may occur when using diagnostic radiation generators is low, the risk of carcinogenesis may be higher than previously evaluated. In addition, safety management of diagnostic radiation generators can be said to be an essential requirement because it has been reported that the incidence of leukemia and other diseases is increasing in diagnostic radiation tests. However, the safety management training targets and programs for radiation exposure management operated by other organizations other than diagnostic radiation generators are significantly different. In addition, since the public institutions that are responsible for radiation safety management are divided, there is a risk of duplicative, excessive, and under-administrative application to medical institutions and educational institutions that install and operate diagnostic radiation generators. Therefore, we would like to determine their consistency by comparing domestic and foreign related cases and the provisions of the 「Medical Act」 and the 「Nuclear Safety Act」.
It is not easy to regulate the amount of radiation used for the medical purpose as there usually is more good than harm to the patient's health and life caused by the medical exposure to the radiation. However, the rapid increase of the use of diagnostic radiation involves a high possibility of increasing the radiation hazard exposure. Therefore, it is imperative to implement effective regulations in order to secure the safety of diagnostic radiation. The one and only rule we currently have for the diagnostic radiation is "Medicine Act" with only one clause dedicated to regulate the safety management that does not include any rules for the medical radiation. A set of inclusive rules for the whole medical radiation inclusive of diagnostic radiation and therapeutic radiation need to be based on the "Medicine Act" rather than "Nuclear Safety Act" in order to protect the medical professionals, patients and the guardians of patients from the hazards of diagnostic and/or therapeutic radiation that was not used the purpose of medical treatment. If there is an administrative measure to be imposed to secure the safety of diagnostic radiation, it is considered as exertion of governmental authority of administrative agency. There must be clear and realistic legal guidelines for in-fringe on people's interests. The administrative measures for the safety management of the diagnostic radiation must be clearly and specifically based on the law and the detailed standards for the administrative measures must be dele-gated by the presidential decree or departmental ordinance. Accordingly, the restrictions imposed by the administrative measures to the "Safety Inspection Institute of Radiation along with Radiation Exposure Measuring Institutes" should have clear legal basis as well and the detailed standards for the administrative measures should be regulated by the Ministry of Health and Welfare decree instead of the notification by the Director of Korean Centers for Disease Control and Prevention. While securing the safety of radiation on one side, careful review and up-grade on our legal system for the safety management of the diagnostic radiation is required on the other side to guarantee the legality, interest balance and reliability of the administrative measures.
This study gives an account of the collateral standards in IEC 60601-1-3: 2008 specifying the general requirements for basic safety and essential performance of diagnostic X-ray equipment regarding radiation protection as it pertains to the production of X-rays. The collateral standards establish general requirements for safety regarding ionization radiation in diagnostic radiation systems and describe a verifiable evaluation method of suitable requirements regarding control over the lowest possible dose equivalent for patients, radiologic technologists, and others. The particular standards for each equipment can be determined by the general requirements in the collateral standard and the particular standard is followed in the risk management file. The guidelines for radiation safety of diagnostic radiation systems is written up in ISO 13485, ISO 14971, IEC 60601-1-3(2002)1st edition, medical electric equipment part 1-3, and the general requirements for safety-collateral standards: programmable electrical medical systems. Therefore the diagnostic radiation system protects citizens' health rights with the establishment and revisions of laws and standards for diagnostic radiation systems as a background for the general requirements of radiation safe guards applies, as an international trend, standards regarding the medical radiation safety management. The diagnostic radiation system will also assure competitive power through a conforming evaluation unifying the differing standards, technical specifications, and recognized processes.
The purposes of this study are to analyze the realities after enforcements of safety control regulations for diagnostic X-ray equipments and to suggest means for an improvement of low radiation safety control. A questionnaire survey for medical radiologic technologists was carried out to determine enforcement effects of the safety control regulations. The results of analysis from the survey are as follows. That is, most of the respondents realized the importance of the radiation safety control system, but about a half of them revealed that the regulations were not well observed in accordance with their purposes. Only 43.9% of the respondents took an active part in quality control and safety control of radiation. And respondents responsibility, sex, age, and knowledge for safety control were important indicators for observations of the regulations. Trainings for the safety control regulations are needed to ensure safety control and proper usage of diagnostic X-ray equipments. And management of organizations using diagnostic X-ray equipments have to understand and stress the importance of radiation safety control system.
의료기관에서 진단용 방사선의 이용은 매년 급속히 증가하고 있다. 또한 집단 유효선량도 매년 증가하고 있다. 그러므로 국민에 대한 방사선 피폭을 최대한 적게 낮추어야 하며, 진단용 방사선 안전 관리를 효율적으로 할 수 있도록 제도적으로 확립하여야 한다. 이에 진단용 방사선 안전관리에 대한 법적 규율이 법령체계상 맞지 않거나 내용에 있어서 현실과 괴리가 없는지 문제점을 파악하고 그에 대한 개선 방향을 모색하여 다음과 같은 결과를 얻었다. 첫째, 「의료법」에는 검사·측정기관에 대한 근거 규정도 없고 행정처분에 대한 위임규정도 없다. 그러므로 「의료법」 에 검사·측정기관에 대한 근거 규정과 이들 기관들에 대한 행정처분의 근거 규정을 두어 법적 정당성을 확보해야 한다. 둘째, 진단용 방사선 특수의료장비에 대해서는 「특수의료장비의 설치 및 운영에 관한 규칙」과 「진단용 방사선 발생장치 안전관리에 관한 규칙」을 통합하여 신고 등 행정적 절차를 일원화해야 한다. 셋째, 「진단용 방사선 발생장치 안전관리에 관한 규칙」 상 진단용 방사선 안전관리기준을 위반한 경우에 행정처분 등 제재가 미비된 사항들을 보완할 필요가 있다. 넷째, 의료기관에서 이용하는 진단용 방사선과 치료용 방사선에 대하여 「의료법」과 「원자력안전법」의 이원적인 법령 체계로 규율하는 것은 진단용 방사선 안전관리에 있어서도 효율적이지 못하다. 따라서 진단용 방사선뿐만 아니라 치료용 방사선, 핵의학을 포함한 의료용 방사선 전체를 「의료법」 체계에서 통일하여 규율하는 것이 필요하다고 본다.
국내에 사용되고 있는 진단용 방사선발생장치는 78,000여대에 이르고 있다. 인체 대상의 진단 목적으로 사용할 때에는 의료법의 적용을 받고, 동물 대상의 진단 목적으로 사용할 때는 수의사법의 적용을 받는다. 그 이외의 목적으로 사용 시에는 원자력안전법의 적용을 받는다. 동일한 방사선발생장치라도 사용목적 및 대상에 따라 적용되는 법제가 달라지며, 다원화된 규정이 적용되는 문제점인 법제의 혼란을 방지하기 위해 법제 내용의 분석 및 비교가 필요하다. 본 연구는 질적 조사로, 원자력안전 법, 의료법, 수의사법과 그 하위 규정에 적용되는 진단용 방사선발생장치 도입에 대한 행정절차, 안전성 검사, 인력 관리, 구역 관리, 행정처분에 관한 내용이다. 원자력안전법 하위규정에서는 진단용 방사선발생장치 도입은 허가개념으로 행정절차가 복잡하고 구비요건이 많다. 사용에 따른 안전성 검사는 방사선안전관리 전 분야에 걸쳐 감사 성격의 정기검사를 받게 된다. 안전관리자 및 종사자에 대해 해마다 법정 정기 교육을 받아야 한다. 방사선관리구역을 지정하는 방사선량률 기준이 다르며 방사선량률 측정 의무가 있다. 법제 위반 시 부과되는 행정처분의 양적 차이가 최대 10배에 이르며 전 분야에 걸쳐 원자력안전법 하위규정 적용 시 방사선안전관리 부담이 가장 크다. 동일한 진단용 방사선발생장치의 사용 목적과 촬영대상에 따라 다르게 적용되고 있는 현행 법 제도 하에서는 사용주체에 따라 방사선 안전관리를 위한 법제 내용의 형평성이 결여되어 있고, 혼란의 우려가 있으므로 진단용 방사선발생장치 이용에 따른 법제의 일원화 또는 표준화 등의 대안이 필요할 것으로 예상된다.

In veterinary medicine, most radiographic images are obtained by restraining patients, inevitably exposing the restrainer to secondary scattered radiation. Radiation exposure can result in stochastic reactions such as cancer and genetic effects, as well as deterministic reactions such as skin burns, cataracts, and bone marrow suppression. Radiation-shielding equipment, including aprons, thyroid shields, eyewear, and gloves, can reduce radiation exposure. However, the risk of radiation exposure to the upper arms, face, and back remains, and lead aprons and thyroid shields are heavy, restricting movement. We designed a new radiation-shielding system and compared its shielding ability with those of conventional radiation-shielding systems. We hypothesized that the new shielding system would have a wider radiation-shielding range and similar shielding ability. The radiation exposure dose differed significantly between the conventional and new shielding systems in the forehead, chin, and bilateral upper arm areas (p < 0.001). When both systems were used together, the radiation-shielding ability was better than when only one system was used at all anatomical locations (p < 0.01). This study suggests that the new radiation-shielding system is essential and convenient for veterinary radiation workers because it is a step closer to radiation safety in veterinary radiography.
진단방사선사들의 방사선안전관리 및 직업의식을 조사하기 위하여 1998년 5월 현재 전북지역 소재 의료기관에 근무하고 있는 진단방사선사 273명을 대상으로 설문지를 통하여 조사한 결과는 다음과 같다. 1. 현 근무실의 방사선 방어시설은 $61.5\%$가 잘되어 있었고, 의료기관별로는 종합병원($71.7\%$)에서 비교적 방어시설이 잘 갖추어져 있었다(p<0.01). 2. 방사선사 자신이 방사선에 노출될 경우 방호복을
의료기관에는 진단용 방사선 발생장치를 취급하는 방사선사, 의사, 치과의사, 치과위생사 등 방사선 관계 종사자가 있다. 그리고 간호사, 간호조무사 등 방사선진료를 보조하거나 방사선 검사실로 환자이송 등을 하는 업무 보조자들이 있다. 방사선 관계 종사자는「의료법」 등에 의해 방사선 피폭관리가 이루어지고 있으나 방사선 진료업무 보조자 등은 이에 대한 법적 근거가 없는 실정이다. 또한 진단용 방사선 피폭관리는 의료법령에 의해 규율되고 있고, 치료용 방사선과 핵의학검사에 의한 방사선 피폭관리는「원자력안전법」의 규율을 받고 있다. 이에 진단용 방사선에 의한 피폭관리를 개선하기 위하여「의료법」 상 진단용 방사선 피폭관리에 관한 규정과「원자력안전법」 상 관련 규정들을 비교·검토하여 보았다. 그 결과로 얻은 주요 내용은 다음과 같다. 첫째, 진단용 방사선에 의한 피폭관리 대상으로 방사선 관계 종사자 외에 방사선 피폭 우려가 있는 간호사, 간호조무사, 임상실습 학생 등을 포함시켜 입법적으로 해결할 필요가 있다. 둘째,「원자력안전법」에서처럼 진단용 방사선 관계 종사자가 임신이 확인된 경우에는 피폭선량 한도를 명문으로 규정해야 한다. 셋째,「진단용 방사선 발생장치의 안전관리에 관한 규칙」의 개인피폭선량계의 종류에 관한 규정을 현실에 맞게 개정할 필요가 있다. 넷째, 방사선 관계 종사자, 방사선작업종사자와 수시출입자에 대한 건강진단의 검사항목은 동일해야 할 것으로 보인다. 다섯째, 의료기관에서 진단용 방사선뿐만 아니라 치료용 방사선과 핵의학을 포함한 의료용 방사선 전체를 하나의 법체계에서 통일하여 규율하는 것이 필요하다고 본다.
