The Comparison of the Impact of IQ and Social Intelligence on the Compliance with Administrative Regulatory Policies. (행정규제정책순응에 미치는 학습지능과 사회지능의 영향력 비교)

  • The purpose of this study is to compare the impact of intellectual quotient and social intelligence on compliance with the administrative regulatory policies. This study found two things. The first one is the correlation between intellectual quotient and social intelligence is not so high. No matter how high is his or her intellectual quotient may be, it cannot be said that his or her social intelligence will be high in proportion to IQ. The second one is the influence of social intelligence on administrative regulatory policies is bigger than that of intellectual quotient. So to execute a policy efficiently, we cannot succeed without consideration to the factors of social intelligence. The result of analysis implies that policy authorities and the concerned citizens should try to get the social intelligence factors involved in all processes of administrative regulatory policies such as agenda setting, decision, implementation, evaluation and feedback.

Analysis of Regulatory Sandbox Usage by IT Companies (IT기업의 규제샌드박스 활용 분석)

  • This study aims to apply the concept of regulatory stringency to the regulatory sandbox with a fresh perspective. The regulatory sandbox is a system that gives opportunities under certain conditions to new technologies or businesses that have not been launched due to inadequacy or insufficiency in legal systems. Previous research on regulatory sandboxes has mainly focused on discussions about their impact on specific technologies or business domains. This study attention to the results according to the evaluations. Among them, whether special cases for demonstration can evolve into official permission has garnered significant attention. For this study, among the cases that passed the regulatory sandbox evaluation from February, 2019, to December, 2022, 162 cases in the field of ICT convergence were selected. The evaluation results were classified into three groups 'positive interpretation (Fast Track)', 'temporary permission', and 'special case for demonstration.' Each case was assigned to one of the three groups. Through the comparative analysis, the common characteristics and differences were summarized. Then, this study explored improvement measures to pass a less restrictive regulatory sandbox. The analysis of the cases revealed that the differences in each evaluation result were attributed to variations in the technological characteristics and user protection features. Considering these differences, as well as the higher weight and importance of the preparation stage for sandbox application, this study suggested a three-step approach to prepare for temporary permission and positive interpretation rather than special case for demonstration. In addition, this thesis discussed the policy limitations of the regulatory sandbox mechanism in South Korea and the limitations of the current study. Hopefully, the results of this study would be beneficial to individuals and companies, particularly venture companies and startups seeking to develop new technologies or businesses and utilize regulatory sandboxes.

OTC Drug Regulatory System of Korea Comparing to Other Countries (일반의약품 허가제도의 국가간 비교 및 발전 방향)

  • This is to examine the OTC regulatory system of Korea in comparison with those of Japan, UK and US, and suggest the possible regulatory actions to harmonize it to international standards. Individual countries have their own regulatory requirements and processes far OTC application based on established drug monographs and safety profiles from clinical experiences. Categories of OTC drug monographs are being expanded with transparent establishment procedure according to detailed guidelines, and public opinions as well as professional experts for assessing appropriateness of wide usage without physician's prescription. In line with trend of self-medication worldwide, the number of OTC drugs is increasing and more efficient and professional drug review is underway in the separate OTC division in regulatory agency. For improving OTC regulatory system in Korea, settlement of optimal drug classification policy and management for encouraging OTC drug use, development of more detailed and specific guidelines for OTC drug application, expansion of OTC drug monographs, transparent process for OTC monographs establishment, and establishment of OTC division in health authority, are suggested.

  • EIA has been introduced as a tool for environment protection into promulgation of the Environment Preservation Act in 1977, which replaced the Pollution Control Act in Korea. EIA system has been improved with the enlargement of project type, public participation, guideline improvement, and regulatory development. Recently, Environmental Impact Assessment(EIA) Act will have an important role for sustainable development. This article deals with regulatory development, implementation order, EIA project type, and EIS preparation guidelines by Act promulgated and amended, also it explains comparison analysis of Environmental Policy Act and Environment Impact Assessment Act Major results are summarized in the table.

The Effect of International Trade on Rule of Law

  • In this paper, we look at the relationship between international trade and the rule of law, using the World Justice Project Rule of Law Index, which include index figures on human rights, limits on government powers, transparency and regulatory efficiency. Based on regression analyses using the rule of law index figures and international trade figures (merchandise trade, service trade, exports and imports as percentage of GDP,) international trade and basic human rights seem to have little relationship; but trade has a close positive relationship with strong order and security. Somewhat surprisingly, regulatory transparency and effective implementation seems to have little or no effect on international trade and vice versa. International trade shows a clear positive relationship with the country's criminal justice system, but the relationship with the civil justice system is not as clear as such. For regulatory implementation and civil justice, services trade positively affect these institutions, but these institutions in turn affect exports more strongly than services trade. Finally, the effect of trade on rule of law is stronger on a medium to long term (10-20 year) time horizon.

A Study on the Certification System of the Unmanned Aircraft (무인항공기 인증제도에 관한 연구)

  • Nowadays, the demand of civil application of an UAV has been being increased all over the world. And many projects are going on to develop a new regulatory system for an UAV to access a national airspace. Especially, to fly UAV over the non-restricted airspace as a standard airworthiness standard, many authority funded research institutes and associations are studying regulatory environment. For the UAV to access civil airspace, the certification system of the aviation regulation have to allow this. FAA of US, CASA of Australia and European authorities are now issuing an experimental airworthiness certificate to a civil UAV. This is the first step of issuing a standard airworthiness certificate. And many people believe that civil UAV can fly over a NAS if some technical issues are resolved. In this study, I would like to present an international trends of a civil UAV regulation system, reliability trend of unmanned aerial system and would like to bring up a our regulatory environment and suggest an UAV regulatory policy.

  • In this article, I summarize the various academic documents and regulatory agency reports on the Zero-Rating, and describes the type classification, major cases, and policy trends of major countries. In the case of Korea, the lack of academic research and the policy making work are relatively late compared to the advanced countries, so I hope that this paper will be helpful for the development of domestic academic research and policy direction in the future.

  • Despite the limitations of existing security policies due to technological development, companies are unable to actively respond to changes by maintaining a closed security policy. This study classified information security policy into three types: regulatory type policy, advisory type policy, and informative type policy. For each classified policy type, the effect on the information security policy compliance behavior of organizational members was investigated by applying the extended theory of planned behavior, and the moderating effect of information security stress was investigated. SmartPLS 2.0 and SPSS 21.0, which are structural equation modeling techniques, were used to analyze the relationship affecting each factor. As a result of the study, regulatory type, advisory type, and informative type security policies affected organizational members' information security policy compliance behavior, and security stress had an effect on information security compliance attitudes and subjective norms on information security, which are prerequisites for planned behavior theory. gave. This study suggests that various types of corporate information security policies can be applied and that security stress can affect information security behaviors of members.

The Impact of GHG Emission Trading System on Air Transport Industry and Implication in View of Regulatory Policy (규제정책의 관점에서 바라본 온실가스(GHG) 배출권거래제가 국내 항공운송산업에 미치는 영향)

  • The emission trading system implemented in Korea is a system in which the government allocates or sells emission rights by setting the emission allowable amount to economic players subject to the emission trading system, allowing companies to freely trade shortfall or extra money through the emission trading market. Korea also had implemented its first emission trading system scheme period of time from 2015 to 2017. As a result of the first planning period in which total of seven Korean airlines were targeted, the emission amount was about 5.51 million KAU, while the quota amount was only about 4.85 million KAU, about 116% of the actual quota was emitted and Domestic airlines have incurred additional costs of about 10.7 billion won. Due to ICAO's implementation of CORSIA, the airlines are expected to have to shoulder additional costs because purchasing exceed quota will be increased in order to offset excess emissions not only on domestic but also on international routes. Thus, this paper had analyzed the characteristics of the carbon trading system of air transport industry and suggested a mix of regulatory policies as an improvement method.
