공공건설공사의 하도급 거래 공정화를 위한 계약변경 제도개선 방향 (Improvement of Contract Change Order System for the Fairness of Subcontracting in Public Construction Projects)

  • 공공건설사업을 수행하기 위해서는 건설 하도급은 필수적인 사항이다. 건설공사의 하수급인은 발주자와 직접 계약을 체결하지 않고 원수급인과 계약을 체결하기 때문에 발주자와 원수급인의 계약에 큰 영향을 받고 있다. 하수급인을 보호하기 위해 공정거래법이 제정되고 건설공사의 표준하도급계약서가 운용되고 있지만 발주자와 원수급인과의 관계를 다루는 국가계약법령체계에서는 하도급계약이 제대로 반영되어 있지 못하다. 특히 하도급계약에서 설계변경이 발생할 경우 금액에 따라 다양한 절차를 거쳐야 하지만 이러한 절차 등이 건설공사 표준하도급계약서에 제대로 반영되지 않고 있으므로 공공건설현장에서는 어려움을 호소하는 경우가 있다. 이에 본 연구에서는 공공건설사업현장에서 설계변경이 이루어질 경우 하도급계약의 제도개선 방향을 다음과 같이 제시하였다. 첫째, 국가계약에서 하수급인의 원수급인에 대한 권리를 강화해야 한다. 둘째, 정보비대칭성을 해소하기 위해 하수급인이 하도급계약과 관련한 정보에 접근할 수 있도록 해야 한다. 셋째, 공공공사의 원도급계약체결시에는 하도급계약의 특성을 반영하여 하수급인의 지위를 보장해야 한다. 넷째, 하도급거래 공정화를 위해 분쟁처리방법을 소송보다 조정이나 중재를 우선하도록 해야 한다.

Climate Warming and Occupational Heat and Hot Environment Standards in Thailand

  • Background: During the period 2001 to 2016, the maximum temperatures in Thailand rose from 38-41℃ to 42-44℃. The current occupational heat exposure standard of Thailand issued in 2006 is based on wet bulb globe temperature (WBGT) defined for three workload levels without a work-rest regimen. This study examined whether the present standard still protects most workers. Methods: The sample comprised 168 heat acclimatized workers (90 in construction sites, 78 in foundries). Heart rate and auditory canal temperature were recorded continuously for 2 hours. Workplace WBGT, relative humidity, and wind velocity were monitored, and the participants' workloads were estimated. Heat-related symptoms and signs were collected by a questionnaire. Results: Only 55% of the participants worked in workplaces complying with the heat standard. Of them, 79% had auditory canal temperature ≤ 38.5℃, compared with only 58% in noncompliant workplaces. 18% and 43% of the workers in compliant and noncompliant workplaces, respectively, had symptoms from heat stress, the trend being similar across all workload levels. An increase of one degree (C) in WBGT was associated with a 1.85-fold increase (95% confidence interval: 1.44-2.48) in odds for having symptoms. Conclusion: Compliance with the current occupational heat standard protects 4/5 of the workers, whereas noncompliance reduces this proportion to one half. The reasons for noncompliance include the gaps and ambiguities in the law. The law should specify work/rest schedules; outdoor work should be identified as an occupational heat hazard; and the staff should include occupational personnel to manage heat stress in establishments involving heat exposure.

공공 도로건설사업에서의 원격 현장모니터링 체계 구축에 관한 연구 (A Study on Development of Remote Site Monitoring System in Public Road Construction Projects)

  • PURPOSES : Efficiency Improvement of a public road construction project management work using the development of a real-time remote site monitoring system METHODS : In this study, we developed the remote site monitoring system using a web camera for road construction projects in the RCMA(Regional Construction Management Administration). We can be monitored a construction progress and a weak point of the situation in real time using this. To achieve this, we tested about 10 road construction projects ordered by RCMA. Then, we verified a applicability for the site monitoring system in future. RESULTS : Take advantage of the remote site monitoring system consists of the Construction CALS System, one of the business systems used in the part of the MLTM(Ministry of Land, Transport and Maritime Affairs) institution-agencies. Was configured to be served through the "Construction CALS System" of "Construction Management System(Contractors)" and the "Construction CALS Portal System". Through this, Benefit analysis through a pilot application of the 10 road construction sites and developing considerations and "Guide for visual information processing equipment installation-operating in construction sites"are presented. CONCLUSIONS : Through the establishment of remote site monitoring system can improve the efficiency of construction management services. In addition, Various disasters and calamities, accidents and illegal construction will be prevented in advance is expected. This is expected to further improve the quality of the facilities.

공공 건설공사 발주방식에 따른 비용성과 비교연구 (Comparison of Cost Performance for Delivery Methods on Public Construction Projects)

  • 공공건설공사 발주제도 운영에 있어 기술경쟁을 지향하는 턴키 및 대안방식 등 설계 시공일괄방식의 경우, 시설물의 품질향상 및 건설기술 발전에 기여하였음에도 불구, 계약되는 공사비가 설계 시공 분리발주방식을 적용하는 공사보다 높아 예산낭비 우려가 있다는 지적과 함께 수주독점, 입찰담합, 심의비리 등의 문제가 쟁점이 되고 있다. 그러나 실제 발주방식별 사업성과와 효과에 대해 정밀 비교분석한 사례가 없는 실정이며, 단순히 낙찰률 등 사업의 한정된 일반적 정보만으로 사업효과를 논의하고 판단하는 것은 자칫 오류를 범할 우려가 있다. 이에 공공 건설공사를 대상으로 계약에서 준공에 이르기까지 실제 집행한 공사비 자료를 광범위하게 조사하여 비용의 투입구조 및 변동추세 등 발주방식별 특성을 비교분석하고 공공건설공사 발주제도의 올바른 이해와 효율적 운영을 도모하고자 한다.

  • PPPs in international development cooperation can be challenging due limited capacities in the country, weaknesses in terms of policy and legislative frameworks, differences in mindsets, values, work ethics and hierarchical structures as well as cultural issues. These can lead to misunderstandings and implementation problems. However, a careful assessment of the situation on the ground, stakeholder analysis and needs assessment can help to identify potential bottlenecks and address capacity constraints that could slowdown operations. A sound understanding of local power dynamics and work practices can help to put in place an exit strategy which will enhance the projects' sustainability. Making sure that goals and objectives are understood in the same way by all partners, establishing an ongoing and respectful dialogue between them, as well as transparent implementation and monitoring mechanisms can also contribute to the PPP's success and increase the likeliness to make a difference in the lives of those in needs.

A Study on the Characteristics of "Early Contractor Involvement Method" in Public Project in Japan

  • In recent years, Owner, Architects, and Contractor are increasingly collaborating with each other from pre construction phase in construction projects, which is called Early Contractor Involvement (ECI). In Japan, the ECI method has been introduced in several public building projects since 2015. The purpose of this study is mainly to clarify the characteristics of the ECI method in Japan and to compare the contract clauses of the ECI method in the UK and the USA. The results of the survey are as follows. (1) the ECI method was supposed to make it possible to achieve appropriate quality, cost, and construction period by reflecting Contractor's technology and know-how in the design documents and specifications. (2) According to the database, there were 27 cases of the ECI method in Japan from 2015 to 2021, of which 13 cases for which bidding information could be obtained had a variety of technical proposals, mainly VE proposals, depending on the project characteristics. (3), Japan's ECI method has very much in common with SBC + PCSA in the UK. On the other hand, ECI Method in Japan differs from in the UK in that Owner, Architect, and Contractor enter into a partnership agreement, which is similar to ConsensusDocs CD541 in the USA. (4) The ECI method in Japan has the following problems: Owner depends on Contractor for cost control, the division of roles among project members is complicated, and more work from Owner than the DBB method are required.

  • A standard of estimation is used as a basis for estimating the predetermined amount of public construction. However, they raise several points of reasonable labor to be presented to a standard of estimation. For this reason, it is difficult to make a reasonable and efficient estimation of the costs, and this situation presents an urgent need for an accurate way of making such a calculation.This study analyzed the productivity of reinforced concrete work by the CYCLONE model, and the estimated optimal labor through sensitivity analysis, and presented the model on the number of optimal labor through sensitivity analysis.

신한옥 시방서 개발을 위한 공종분류 (Classifications of Work Sections for Modernized Hanok)

  • Research on the "Modernized Korean traditional housing" (Hanok) has been actively studied in succeeding to Korean traditional housing and providing the public with housing that required for modernized life style. The purpose of this study is to classify work sections for Hanok specifications. This paper analyzed the concepts and characteristics of existing specifications. It was found that the absence of standard classifications is one of the causes of missing work items and mixed scopes. Also, the contents of carpentry works have low level of details. Therefore, Hanok specifications, in this study, are required to have upper level standards and to encompass traditional and new construction methods. Further research will develop standard classifications, standard codes, and automated systems of Hanok specifications for improving quality and effectiveness.

  • The orders of Design-Build Delivery System (DBDS) in a large and public construction project have been increasing. Single Source Responsibility (SSR) for design and construction, which contributes to quality improvement of design and construction, has been performed. The DBDS performs SSR for design and construction, but, it has not maximized effect because of the dissatisfied alternative analysis procedures which are based on constructability evaluation and the information system in the design step. In this research, Constructability Evaluation Factors (CEFs) that must be evaluated, investigated, and reflected in the basic design step for design-build projects. The CEF proposed and the business process of each conductor has been systematized. To propose constructability evaluation factors, first classify drawing information by the constructability evaluation sphere. CEFs must be proposed to evaluate factors according to interference among work items. Second, applicable CEFs must be classified by preference ranking and weight. Third, the values of constructability factors in accordance with building elements and work items, need to be calculated. Finally, the CEFs proposal will support rational decision making, design cost reduction, and quality improvement through the values for constructability of building elements and work items.
