A commercial advertisement is not only a way of competition but also a medium of communication. Thus, it is under the constitutional protection of the freedom of business (article 15 of the Constitution) as well as the freedom of press [article 21 (1) of the Constitution]. In terms of the freedom of business or competition, it should be noted that an unfair advertising (false or misleading advertisement) can be regulated as an unfair competition, while any restraint on advertising other than unfair one might be doubted as an unjustifiable restraint of trade. In terms of the freedom of press or communication, it is important that article 21 (2) of the Constitution forbids any kind of (prior) censorship, and the Constitutional Court applies this restriction even to commercial advertising. In this article, the applicability of these schemes to advertising of the so-called learned professions, especially physician, are to be examined, and some proposals for the reformation of the current regulatory regime are to be made. Main arguments of this article can be summarized as follows: First, the current regime which requires advance review of physician advertising as prescribed in article 56 (2) no. 9 of Medical Act should be reformed. It does not mean that the current interpretation of article 21 of the Constitution is agreeable. Though a commercial advertising is a way of communication and can be protected by article 21 (1) of the Constitution, it should not be under the prohibition of censorship prescribed by article 21 (2) of the Constitution. The Constitutional Court adopts the opposite view, however. It is doubtful that physician advertising needs some prior restraint, also. Of course, there exists severe informational asymmetry between physicians and patients and medical treatment might harm the life and health of patients irrevocably, so that medical treatment can be discerned from other services. It is civil and criminal liability for medical malpractice and duty to inform and not regulation on physician advertising, to address these differences or problems. Advance review should be abandoned and repelled, or substituted by more unproblematic way of regulation such as an accreditation of reviewed advertising or a self-regulation preformed by physician association independently from the Ministry of Health and Welfare or any other governmental agencies. Second, the substantive criteria for unfair physician advertising also should correspond that of unfair advertising in general. Some might argue that a learned profession, especially medical practice, is totally different from other businesses. It is performed under the professional ethics and should not persue commercial interest; medical practice in Korea is governed by the National Health Insurance system, the stability of which might be endangered when commercial competition in medical practice be allowed. Medical Act as well as the condition of medical practice market do not exclude competition between physicians. The fact is quite the opposite. Physicians are competing even though under the professional ethics and obligations and all the restrictions provided by the National Health Insurance system. In this situation, regulation on physician advertising might constitute unjustifiable restraint of competition, especially a kind of entry barrier for 'new physicians.'
One hundred representative species of fungi in Korea were selected and their Korean names were proposed to increase interest in fungi among Korean people. This task was performed under the supervision of the Committee of Mycological Terms, under the Korean Society of Mycology. First, the committee established the criteria for selecting 100 representative species of fungi in Korea and then selected the candidate fungal species accordingly. To ensure the uniformity and stability of Korean fungal names, the principle of naming fungi in Korean was established, and the candidate Korean fungal names were presented accordingly. Finally, the candidate Korean fungal names were posted online to collect opinions of the members of the Korean Society of Mycology. The candidate Korean names of the plant pathogenic fungi and mushrooms were reviewed by the Korean Society of Plant Pathology and the Korean Society of Mushroom Science, respectively. After their opinions were considered, the Korean names for 100 representative fungi in Korea were finally determined. The 100 fungi comprised 41 common molds and yeasts, 28 plant pathogenic fungi, and 31 mushrooms.

An off-site consequence analysis is used to calculate the risks when hazardous chemicals that is being used on-site has been exposed off-site; the biggest factor that impacts the risk is the risks of accident scenarios. This study seeks to calculate risks according to accident scenarios by applying OGP/LOPA risk calculating methods for similar facilities, calculate risk reduction ratio by inspecting applicable IPL for incidents, and propose an appropriate risk standard for different risk calculating methods. Considering all applicable IPL when estimating the safety improvement of accident scenarios, the risk of OGP is 8.05E-04 and the risk of LOPA is 1.00E-04, According to the case of IPL, the risk is 1.34E-02. The optimal risk level for accident scenarios using LOPA was $10^{-2}$, but the appropriate risk criteria for accident scenarios in foreign similar studies were $10^{-3}{\sim}10^{-4}$, the risk of a scenario can be determined at an unacceptable level. When OGP is applied, it is analyzed as acceptable level, but in case of applying LOPA, all applicable IPL should be applied in order to satisfy the acceptable risk level. Compared to OGP, the risk is high when LOPA is applied. Therefore, the acceptable risk level should be set differently for each risk method.
In order to investigate the cytotoxic effect of hexavalent chromium ($Cr0_3$) and the protective effect of Nelumbo nucifera GAERTN (NNG) extract, cultured cerebral neuroglial cells (C6 glioma cells) were treated with $4{\sim}55{\mu}M$ concentrations of $Cr0_3$ for 48 hours. Cell viability was measured by XTT assay. The superoxide dismutase (SOD)-like activity for the antioxidant effect was also examined on the extract of NNG stamen. In this study, $Cr0_3$ significantly decreased cell viability dose-dependently. The cytotoxicities of $XTT_{90}$ and $XTT_{50}$ determined with $10{\mu}M$ and $55{\mu}M$ of $Cr0_3$, respectively, showed that the $Cr0_3$ had highly toxic effect on cultured C6 glioma cells by the cytotoxic criteria. In the protective effect of NNG extract, the cell viability was significantly increased by the treatment of NNG extract, and NNG extract increased SOD-like activity. From these results, it is suggested that $Cr0_3$ showed highly toxic effect on cultured C6 glioma cell s and NNG extract was very effective in the protection of $Cr0_3$-mediated cytotoxicity by antioxidative effect in these cultures.
By analyzing informed consent and the refusal of emergency medical treatment (called patient dumping) under the current Emergency Medical Service Act, this study suggests that an emergency medical professional is only liable for patient dumping if their duty to protect the patient's life takes precedence over the patient's right to self-determination. In emergency medical situations, as in general medical situations, medical treatment should be performed after the emergency medical professional informs the patient about the medical treatment, including its necessity and methods, and obtains consent from the patient. Refusing or evading the performance of emergency medical services on the excuse of the informed consent not considering a waiver or alteration of informed consent requirements without reasonable reasons violates the Emergency Medical Service Act and thus makes an emergency medical professional liable to administrative disposition or criminal penalty. In other words, depending on the existence of a waiver of alteration of the informed consent, patient dumping may be established. If the patient is a minor or has no decision-making ability, and their legal representative makes a decision against the patient's medical interests, the opinion of the legal representative is not unconditionally respected. A minor also has the right to decide over their body, and the decisions of their legal representatives should be in the patient's best interests. If the patient refuses treatment, in principle, the obligation of life protection of emergency medical professionals is the top priority. However, making these decisions in the aforementioned situations in the emergency medical field is difficult because of the absence of explicit regulations regarding these exceptional problems. This study aims to organize the following precedents of the Supreme Court of Korea. The court states that, when balancing the conflicting interests between the duty to provide emergency medical service and the duty to inform is unavoidable for emergency medical professionals, they should put the duty to protect the patient's life ahead of the duty to inform if the patient's life matters. Exceptionally, when a patient has seriously considered whether they should receive treatment before the emergency medical situation, their right to self-determination can be considered equal to the obligation of emergency medical professionals to provide emergency medical treatment. This research also suggests that an amendment of the Emergency Medical Service Act should include the following. First, the criteria for determining the decision-making ability of emergency patients should consist of medical content. Second, additional consent from a medical professional is unnecessary for first-aid treatment. Finally, new provisions for emergency medical obligations for minors, new provisions for the decision standard when there are conflicting opinions about the treatment of a patient, and new penalty provisions for professionals who suspend emergency medical examinations and treatments need to be established.
In line with future changes in the marine environment, Aids to Navigation has been used in various fields and their use is increasing. The term "Aids to Navigation" means an aid to navigation prescribed by Ordinance of the Ministry of Oceans and Fisheries which shows navigating ships the position and direction of the ships, position of obstacles, etc. through lights, shapes, colors, sound, radio waves, etc. Also now the use of Aids to Navigation is transforming into a means of identifying and recording the marine weather environment by mounting various sensors and cameras. However, Aids to Navigation are mainly lost due to collisions with ships, and in particular, safety accidents occur because of poor observation visibility due to sea fog. The inflow of sea fog poses risks to ports and sea transportation, and it is not easy to predict sea fog because of the large difference in the possibility of occurrence depending on time and region. In addition, it is difficult to manage individually due to the features of Aids to Navigation distributed throughout the sea. To solve this problem, this paper aims to identify the marine weather environment by estimating sea fog level approximately with images taken by cameras mounted on Aids to Navigation and to resolve safety accidents caused by weather. Instead of optical and temperature sensors that are difficult to install and expensive to measure sea fog level, sea fog level is measured through the use of general images of cameras mounted on Aids to Navigation. Furthermore, as a prior study for real-time sea fog level estimation in various seas, the sea fog level criteria are presented using the Haze Model and Dark Channel Prior. A specific threshold value is set in the image through Dark Channel Prior(DCP), and based on this, the number of pixels without sea fog is found in the entire image to estimate the sea fog level. Experimental results demonstrate the possibility of estimating the sea fog level using synthetic haze image dataset and real haze image dataset.

The purpose of this study is to present the effective smoke control flow rate and mode for securing safety through quantitative risk assessment according to the smoke control flow rate and mode (supply or exhaust) of the platform when a train fire occurs at the subway platform. To this end, a fire outbreak scenario was created using a side platform with a central staircase as a model and fire analysis was performed for each scenario to compare and analyze fire propagation characteristics and ASET, evacuation analysis was performed to predict the number of deaths. In addition, a fire accident rate (F)/number of deaths (N) diagram (F/N diagram) was prepared for each scenario to compare and evaluate the risk according to the smoke control flow rate and mode. In the ASET analysis of harmful factors, carbon monoxide, temperature, and visible distance determined by performance-oriented design methods and standards for firefighting facilities, the effect of visible distance is the largest, In the case where the delay in entering the platform of the fire train was not taken into account, the ASET was analyzed to be about 800 seconds when the air flow rate was 4 × 833 m3/min. The estimated number of deaths varies greatly depending on the location of the vehicle of fire train, In the case of a fire occurring in a vehicle adjacent to the stairs, it is shown that the increase is up to three times that of the vehicle in the lead. In addition, when the smoke control flow rate increases, the number of fatalities decreases, and the reduction rate of the air supply method rather than the exhaust method increases. When the supply flow rate is 4 × 833 m3/min, the expected number of deaths is reduced to 13% compared to the case where ventilation is not performed. As a result of the risk assessment, it is found that the current social risk assessment criteria are satisfied when smoke control is performed, and the number of deaths is the flow rate 4 × 833 m3/min when smoke control is performed at 29.9 people in 10,000 year, It was analyzed that it decreased to 4.36 people.
This paper examines the concept and process of heritagization, as well as other measures for the value enhancement of food culture as heritage, through the case of the gastronomic meal of the French, which has a long history as a socially constructed heritage. Heritage refers to what a society perceives as worthy of being transmitted. Thus, a heritage is something that a society or group chooses to preserve and that represents its identity. In the 19th century, France began to designate and protect heritage through a policy of preserving historical monuments, and heritage became both a social construct and creation with the purpose of preserving and enhancing values. Interest in heritage spread around the world with globalization, and has grown even greater since the 1972 UNESCO Convention. This interest has progressively extended to nature, urban landscapes and intangible cultural heritage. In 2003, the UNESCO Convention for the Protection of the Intangible Cultural Heritage was adopted, and this has strengthened the interest in intangible cultural heritage worldwide. Food-related heritage has been excluded from the list due to difficulties in establishing inscription criteria and concerns about the potential commercialization of heritage. However, in 2010, the food cultures of the Mediterranean, Mexico, and France were inscribed on UNESCO's Representative List of the Intangible Cultural Heritage of Humanity, which prompted interest in food culture and efforts to inscribe the food heritage of a number of other countries, including Korea. France has a long history of interest in gastronomy as a cultural heritage and part of its national identity. Efforts to preserve and popularize gastronomy as a part of the national identity and heritage have been made at both the private level, by gourmets and associations, and at the governmental level. Through these efforts, the culture of gastronomy as a heritage has been firmly established through theoretical discussion, listing of food-related heritages, and policies. Sustainable development of the heritage is pursued through certain ongoing institutional approaches, including the City of Gastronomy network, the National Food Program, and the promotion and labeling of the Year of the French Gourmet.

Long-term rainfall-runoff modeling is a key element in the Earth's hydrological cycle, and associated with many different aspects such as dam design, drought management, river management flow, reservoir management for water supply, water right permission or coordinate, water quality prediction. In this regard, hydrologists have used the hydrologic models for design criteria, water resources assessment, planning and management as a main tool. Most of rainfall-runoff studies, however, were not carefully performed in terms of considering reservoir effects. In particular, the downstream where is severely affected by reservoir was poorly dealt in modeling rainfall-runoff process. Moreover, the effects can considerably affect overall the rainfallrunoff process. An objective of this study, thus, is to evaluate the impact of reservoir operation on rainfall-runoff process. The proposed approach is applied to Anseong watershed, where is in a mixed rural/urban setting of the area and in Korea, and has been experienced by flood damage due to heavy rainfall. It has been greatly paid attention to the agricultural reservoirs in terms of flood protection in Korea. To further investigate the reservoir effects, a comprehensive assessment for the results are discussed. Results of simulations that included reservoir in the model showed the effect of storage appeared in spring and autumn when rainfall was not concentrated. In periods of heavy rainfall, however, downstream runoff increased in simulations that do not consider reservoir factor. Flow duration curve showed that changes in streamflow depending upon the presence or absence of reservoir factor were particularly noticeable in ninety-five day flow and low flow.

Although the landscape architectural facilities need to be repaired according to historical and authentic techniques, the repair criteria of the standard specification for repairing cultural heritages still remain at a theoretical level, and there are little research analyzing detailed techniques from specific cases. This study discussed the repair techniques based on historical facts, around terraced flower beds, ponds, waterways and pavement in the government-managed spaces in the Joseon Dynasty. It analyzed the materials and finish of stone wall elements, the structural reinforcement and backfill materials, and topsoil surface protection measures, and drew out stones for foundation reinforcement, plastering material for agglutination, and stone processing techniques for the terraced flower beds. It examined the materials and structures of the rock revetment, foundation reinforcement and waterproofing techniques and drew out the outstanding characteristics of the foundation work, the recycle of used elements and the management of water quality, for the ponds. It primarily investigated the materials, foundation reinforcement and waterproofing techniques and discovered the repair techniques such as cover stone finishing methods, foundation and backfill materials, and flow reduction methods, for the waterways. Finally, it provided actual cases of the foundation composition, auxiliary materials and tools, and the use of cyperaceae and highlighted the existence of professional craftsmen called Bangjeonjang(方磚匠), for the pavement. This study is expected to be a staring point for discovering the repair techniques for landscape architectural facilities and used as basic data for revising specifications in the future.
