중복배제의 관점에서 본 우리나라 항만관리에 관한 연구 - 항만 관련법률을 중심으로 - (A Study on the Korean Port Management in a viewpoint of Overlap Elimination - Focused on the Related Port Law -)

  • An understanding of importance of port has increased according to the in and out environment changes surrounding port. And the jurisdiction of physical distribution including port logistics integrated to Ministry of Land, Transport and Maritime Affairs. It is a good time for review the related port law once more. Present related port law has no problems itself. But because there are many laws about port, so overlap is shown in many aspects. According to this viewpoint, this study has focused to reduce the overlap in the contents of the laws and propose the improvement methods. So as to achieve this goal, I divided study fields into three aspects. The first is the subject of port management and second is the object of port management, the third is contents of port management. And also improvement plan provided in three aspects. Improvement plan is as follows. Firstly, the diversity of management subject is reduced considerably due to the integration of government organization but the problem which what laws among the various laws would adopt to same object is still remained. So it is necessary to make into one or two laws. Secondly, in the case of object of port management, it is essential to cover the port, port facilities and port hinterland with one comprehensive law. Therefore it is important to adjust the related clauses in various laws. Thirdly, in connection with the contents of port management, port development plan or other related port business and etc. described in various laws have to cordinated. At the same time, it is desirable that the similar terminology used in various laws would be unified.

  • The managing strategies of each enterprise has been fundamentally changed due to the emergence of digital economics by using the internet. Therefore it is indispensable for each enterprise to be changed their business strategies. With a view to meeting the change of new economic paradigm, they are efforting to build a infrastructure for information and communication, induce foreign capital, reconsider their conditions of location, draw the law concerned and reinforce education for experts etc. In consideration of these change, the Pusan port & the KwangYang port have to introduce e-Business for the purpose of increasing the level of their competition. We - our government, the companies - concerned with port management should recognize and use efficiently our core competence and potentiality of our port management. To achieve it, firstly port industries are to handle not only international logistic system but also communication, finance and sightseeing. Secondly, the developed off-line system have to be harmonizing with the on-line. Therefore, this paper are focused to suggest the theoretic background by analyzing the strategic points of e-port which are divided in 6C - Contents, Community, Connection, Commerce, Communication and Customization.

  • This study deals with legal issues and solutions for a successful management of the Busan Port Authority(BPA) and proposes Busan Metropolitan City Ordinance for the effectiveness of BPA because the role of BPA is to improve Busan regional economy and to strengthen the competitiveness of Busan Port. In order to prepare the ordinance, this paper suggests that the current legislation related to Port Authority(PA), which empowers central government to control the management of port, should be amended to strengthen the port autonomy by allowing PA and local government to control the management and operation on port independently and enabling the building of cooperative system from the City for BPA.

국제해상보안규정(ISPS Code)의 시행이 해상법에 미칠 영향 (Legal Implications of the ISPS Code on Contract of Carriage by Sea)

  • The International Ship and Port Facility Security (ISPS) Code which was developed as the main response of the shipping sector to the miserable event of 11 September 2001 came into effect on 1 July 2004. The ISPS Code designed to detect and eliminate security threats affecting ships and port facilities used in international trade will significantly impact not only on the management and operation of the shipping industry but also on maritime law despite the fact that it is the regulatory framework of public law. It is expected that implementing the ISPS Code will contribute to reinforcement of maritime security on the one hand. However, on the other hand, more intensified security inspection and control measures of port states will also cause delay and additional costs which cause uncertainty in allocating security risk and cost between the contracting parties. Therefore, it is desire to insert new security clause dealing with main security issues or adapt existing clauses to new shipping environments to minimize disputes.

  • 본 연구는 우리나라와 일본의 어항내 마리나 및 피셔리나 개발과 연관된 관련법의 적용, 허가 및 운영 관련 조례 제정, 마리나 개발 및 규제와 관련된 법규 등 그 현황을 비교 분석하고, 향후 국내의 실정에 적합한 피셔리나 모형을 개발하는데 그 목적이 있는 연구의 결과는 다음과 같다. 첫째, 개발비용을 절감할 수 있는 시설을 개발하여야 한다. 둘째, 기존 어항의 유휴시설을 리모델링한 형태로 개발하여야 한다. 셋째, 어업활동의 개선과 해양레저스포츠 활성화로 어촌의 새로운 소득원 창출을 할 수 있는 형태로 피셔리나를 개발하여야 한다.

  • As China, the world's work shop was transformed into consumption market intermediary products and expensive consumer goods are more in highly demand recently. These will tend to diffuse especially to the west coastal cities of China. The economic growth of China needs to develop hub port facilities more and more in these days. We don't need to explain value of hub port in international trade. Furthermore If we are to retain access convenience of merchant vessel we really must maintain hub ports in Korea. This paper aims to vitalize Pyeongtaek port in times of the Pan Yellow Sea in readiness for an increase of trade between Korean, China, and Japan absorbing economic effects. The Rise of China leads to increase of trade of Korea that make necessary to develop a big and wide port to Pan Yellow Sea times. There is a lot of competition to be a hub port to become a center of international trade in the Pan Yellow Sea market. We need to improve the surrounding environment or facilities and industry clusters flexibly of Pyeongtaek port. It will guide to cost cutting and to raise business efficiency. Ultimately Pyeongtaek port should maintain and make advance its competitiveness especially in the Pan Yellow Sea times.

Location Selection Factors for International Distribution Center in Port Hinterland - A Review of Busan New Port Hinterland from User's Perspective -

  • As port functions change to act as an economic catalyst and take on a central position in industries engaged in international trade, port hinterland has become a significant component in international shipping. The success of port hinterland as a strategic base of logistic activities critically depends on location selection factor for international distribution center that links elements of global supply chain management. By examining multi-measurement items empirically, this paper analyzed location selection factor for international logistics distribution center in port hinterland, and evaluated Busan new port hinterland from the user's perspective. Employing exploratory factor analysis, the results revealed that the model structured around five factors incorporating geo-location and accessibility, availability, political supports, cost factors, and quality of business environment is valid and reliable in the context of the location selection factors for logistics distribution center in the context of port hinterland operations. The evaluation of Busan new port hinterland provides useful insights for strategic improvement to accommodate the users' expectation. Further, the model offers both a descriptive and diagnostic strategic management tool for port hinterland development and operations, to guide future improvement.

  • Amidst dynamic business environment, creating competitive advantage, source of competitiveness, is a critical issue for international port operations. To overcome limitations of prior studies adopted cross-sectional approach, this study reviews a way to continually sustain and create competitive advantage, based on the case of Busan port in South Korea. Development plans, operations and management practices from2005 to 2014 were investigated and reviewed. Results revealed that enhancement of infrastructure, new engine to sustainable growth, green and safety, and partnership enhancement were a source of creating competitive advantage. The results help theoretical advances on competitiveness and its durability, and provide useful insights for creating competitive advantages and future improvement in international port operations.

로테르담규칙상 항만터미널운영자에 관한 연구 - 히말라야조항의 적용과 관련하여 - (A Study on Port Terminal Operator's Liability under Rotterdam Rules)

  • The Rotterdam Rules provide that port terminal operator may avoid or limit their liability for cargo loss, damage or delay in delivery or breach of any other obligation under the Rules by invoking the provisions that may provide a defence for, or limit the liability of, the carrier. Consequently the port terminal operator who are involved in the provision of maritime services may avoid or limit their liability for cargo loss, damage or delay in delivery or breach of any other obligation under the Rules. The port terminal operator to be applied for the Himalaya clause under the Rules must show that it has the requisite link with a Contracting State. In addition, the port terminal operator performs service to the period of time between the arrival of the goods at the port of loading and their departure from the port of discharge. The port terminal operator's liability for breaches of its obligation is limited to 875 SDR per package or other shipping units, or 3 SDR per kilogram of the gross weight of the goods. In addition, compensation for delay shall be limited to an amount equivalent to two and one-half times the fright payable on the goods delayed.
