A Study on the Factors for Leveling the Playing Field in Trade Negotiations between the Republic of Korea and the United States: -A Political-Economic Approach to Textile Negotiations(1969 through 1972)- (한-미 통상협상에서의 균등화전략 요소에 관한 연구 - 한-미 섬유협상(1969-1972년)에 대한 정치경제학적 접근 -)

  • This paper investigates the textile negotiations between Korea and the U.S. which Korea, as a weaker party in the bilateral trade negotiation, was recognized as making a good performance by Odell(1985). Using the documents of Korean governments at the time - Ministry of Foreign Affairs and the Ministry of Commerce and Industry - telegrams and reports from various sources the paper picks a leveling factor during the negotiations. In the paper, we used a dynamic concept of power for describing the negotiating power, and showed Korea succeeded in making the negotiation symmetric using the Special Cooperative Relationship(SCR) as one of the most conspicuous leveling factors during the textile negotiations with the U.S. The paper contributes to finding the factors that can be used in the negotiations with power asymmetry as a leveling factor for weaker country. Also, based on the findings from the paper, future negotiators can get insights on which factors be used, and how to use those factors for leveling the negotiations with a stronger counterpart.

  • For the Palestinians, what is the impact of the Arab Spring? The revolution not only dislodged Mubarak from the presidency, but also changed Egyptian policy regarding Palestinians in Gaza. New Egyptian diplomacy has encouraged Hamas and Fatah, which had been in dispute, to seek reconciliation and has loosened the border control on humanitarian grounds. We focus on Palestinian voting attitudes in the wake of the Arab Spring. Despite the vast quantity of literature written about Palestinian politics since the first decade of the millennium, we know little about the determinants of Palestinian attitudes toward the divided governments in the West Bank and the Gaza Strip. The Fatah government, in the West Bank, increased in popularity after submitting a request for UN recognition of Palestinian statehood. In Gaza, the Hamas government lost popularity because of mismanagement but won support through the success of its prisoner swap deal with Israel. However, evaluation of the ruling party does not depend only on one-time events. This research attempts to measure the impact of policy change in Gaza after the Arab Spring. We provide an account of our research on Palestinian attitudes toward the divided governments based on two sets of the original survey data conducted in May 2009 and June 2012. The paper sheds light on Palestinian attitudes and makes clear the effects of "democratization" in the Middle East and the effects of regional context factors on the occupied Palestinians.

A Two-level Game Theoretic Approach to the Successful Korea-China FTA Negotiations (2단계 게임이론에 의한 우려나라의 한.중 FTA협상 성공전략)

  • The study analyzes the optimum Korea-China FTA negotiations by utilizing the Putnam's two- level game theoretic approach. According to the Putnam's theory, the size of the win-set depends on the strategies of the Level 1 negotiators. The size of the win-set depends also on the level 2 political institutions and the distribution of power, preferences, and possible conditions among Level 2 constituents. The basic principles for the successful future Korea-China FTA negotiations should be based on comprehensiveness, substantial liberalization and gradual liberalization with consideration of sensitive sectors. This study concludes that mid-level FTA strategy with comprehensive but low tariff reduction would be of best strategy for Korea. This study also suggests the utilization of the EHP(Early Harvest Program) for the successful Korea-China FTA negotiations.

A Study on 2010 Beijing Convention for Antiterrorism of International Aviation - Compared Beijing Convention(2010) with Montreal Protocol - (국제항공테러방지 북경협약(2010)에 관한 연구 - 몬트리올협약과의 비교를 중심으로 -)

  • The Beijing Convention of 2010 taken together effectively establishes a new broader and stronger civil aviation security framework. This adoption would significantly advance cooperation in prevent of the full range of unlawful acting relation to civil aviation and the prosecution and punishment of offenders. First, the Beijing Convention of 2010 will require parties to criminalize a number of new and emerging threats to the safety of civil aviation, including using aircraft as a weapon and organizing, directing and financing acts of terrorism. These new treaties reflect the international community's shared effort to prevent acts of terrorism against civil aviation and to prosecute and punish those who would commit them. Second, this convention will also require States to criminalize the transport of biological, chemical, nuclear weapons and related material. These provisions reflect the nexus between non-proliferation and terrorism and ensure that the international community will act to combat both. Third, this Convention shall not apply to aircraft used in military, customs or police services. As a substitute, International Humanitarian Law will be applied in a case. Moreover, the National Jurisdiction and the application of the law will be extended farther. The treaty promotes cooperation between States while emphasizing the human rights and fair treatment of terrorist suspects.
