본 연구는 유럽, 미국, 일본 등 선진외국에서 시행하고 있는 성능보증계약제도 현황을 살펴보고 이 제도의 국내 도입을 위한 타당성 및 가능성을 검토하기 위해 수행되었다. 이를 위해 성능보증계약제도의 개념 및 필요성, 국내외 성능보증계약제도 현황을 조사, 분석하였다. 특히 이들 나라들의 하자담보책임제도의 보증업무, 설계시공일괄입찰 계약제도의 운영현황, 낙찰자 결정방식, 성능보증수단, 공사계약의 유지관리 업무, 성능보증시방서 및 계약조건을 비교 분석하였다. 그리고 성능보증계약제도를 도입하기 위한 방안으로서 하자담보책임제도 외에 성능보증계약제도 별도 운영, 설계시공일괄입찰계약제도의 수정 활용, 공사낙찰제도의 보완, 성능보증수단 확보, 유지관리업무를 포함하는 공사계약의 필요성을 제시하였다.

성능보증(warranty)계약제도는 아스팔트 포장공사에서 유럽 여러 국가들이 오랫동안 시행해오던 제도로서 미국에서도 유럽에서 시행되고 있는 이 제도 도입을 위한 기대효과 검증작업이 진행되면서 빠른 속도로 적용공사의 수가 증가하고 있다. 또한 일본의 경우, 일본 특성에 맞는 성능계약제도를 정착시켜 시행하고 있다. 본 연구에서는 유럽 여러 국가들과 미국, 일본의 도로포장 성능계약제도 시행현황을 조사하였고 그 장단점을 분석하였다. 그리고 향후 국내 성능계약제도 도입방향을 제시하였다. 본 연구의 주요 결론으로 국내에 성능보증계약제도를 도입하기 위한 성능보증서 제도 및 성능보증기관 제도 수립, 발주방식 정립 등의 필요성을 제시하였다.

건설산업의 재도약을 위해 정부에서는 1990년대 말부터 정부정책을 발표하여 세계수준의 기술경쟁력 확보, 효율적인 생산구조 확립 등을 위해 노력해 왔다. 정부정책의 핵심은 건설산업 전반에 상당한 영향을 미치는 발주, 계약방식의 개선을 통한 건설산업 구조개편 및 기술경쟁체제를 구축하고자 하는 것이다. 해외에서 시설물의 품질향상, 유지관리 및 수명주기비용의 절감, 시공자의 혁신유도 등을 목표로 혁신적인 계약방식에 대한 연구개발 및 시범적용이 활발히 진행되어 왔다. 그 중 성능계약제(Performance Warranty Contracting)는 시설물의 완전한 상태를 보증하며, 결함에 대해 교체 및 보수하는 시공자의 책임을 보증하는 성능기반의 계약방법으로, 민간의 개술개발 유도, 성과물의 품질향상, 생애주기비용 절감, 조기 성능저하 방지, 발주자의 현장 품질보증업무 부담 감소 등의 효과가 있는 것으로 나타났다. 본 연구는 이러한 성능계약제도의 국내 도입을 제안하기 위한 기초 연구로써, 해외 적용현황 분석을 통한 성능계약제도의 개념 정의와 기대효과를 분석하고, 국내 도입시 고려사항을 제시하고자 한다.

Evaluation and comparison for the performance on the contracting-out became possible after the introduction of the performance indicators(PIs) in 2012 in Korea, And local governments and private companies are utilizing them as evaluation data to enhance the performance of the contracting-out. Several revisions on performance indicator were carried out by expert group on contents validity of PIs, But the review of the composition validity of PIs was not sufficient. In this study, the applicability, distinction ability and composition validity of PIs is evaluated by statistical method. From the results, Improvement of indicator is required in order to increase the interrelationship among indicators to enhance the compostion validity of indicators related with operation, sludge and water reuse.

본 연구의 목적은 공공도서관의 운영 활성화에 기여하기 위하여 현행 공공도서관의 민간 위탁의 성과를 분석하는 것이다. 성과의 분석 대상으로는 민간 위탁을 실시하고 있는 3개 공공도서관을 선정하여, 문헌연구, 설문 및 방문조사를 수행하였다. 주요한 고찰사항은 첫째. 공공도서관 민간위탁의 필요성과 배경 및 현황의 검토, 둘째, 민간위탁의 찬$\cdot$반 양론 및 쟁점의 정리, 셋째, 민간위탁의 현행 성과 분석을 포함하였고, 마지막으로 분석에 근거하여 향후 바람직한 공공도서관 민간 위탁 제도 도입과 운영 전략을 제시하고 있다.

최근 도로포장 분야에서는 시공품질을 개선하기 위한 방편으로 성능보증 계약제도에 관한 연구가 진행되고 있다. 성능보증 계약제도는 시공회사에게 자유롭게 재료와 공법을 선택할 수 있는 기회를 부여하고 발주자가 제시하는 일정 수준 이상의 성능을 주어진 기간 동안 유지하게 하는 것이다. 성능보증 계약제도의 도입을 위하여 아스팔트 포장 분야에서는 성능보증 시방서에 포함될 성능인자와 임계한도에 관한 연구가 많이 진행된 상태이다. 그러나 고속국도뿐만 아니라 일반국도에서도 많이 시공되고 있는 콘크리트 포장 분야에서는 성능인자와 임계한도에 관한 연구가 부족한 실정이다. 본 연구에서는 유럽 국가와 미국 각 주의 성능보증 계약제도 사례에 관한 문헌을 검토하여 콘크리트 포장의 성능보증기간, 성능인자, 그리고 임계한도에 관한 조사를 실시하였다. 수원, 의정부, 예산, 충주, 전주, 포항, 남원, 진영, 정선, 영주, 진주, 홍천, 보은의 일반국도 13구간에서 줄눈 콘크리트 포장의 성능에 영향을 미치는 주요 파손을 조사하고 분석하여 해외의 성능보증기간, 성능인자, 그리고 임계한도와 비교하였다.

The Australian construction industry is characterized as being a competitive and risky business environment due to lack of cooperation, insufficient trust, ineffective communication and adversarial relationships which are likely lead to poor project performance. Relational contracting (RC) is advocated by literature as an innovative approach to improve the procurement process in the construction industry. Various studies have collectively added to the current knowledge of known RC norms, but there seem to be little effort on investigating the determinants of RC and its impact on project outcomes. In such circumstances, there is lack of evidence and explanation on the manner on how these issues lead to different performance. Simultaneously, the New Engineering Contract (NEC) that embraced the concept of RC is seen as a modern way of contracting and also considered as one of the best approaches to the perennial problem of improving adversarial relationships within the industry. The reality of practice of RC in Australia is investigated through the lens of the NEC. A synthesis of literature views on the concept, processes and tools of RC is first conducted to develop the framework of RC. A case study approach is proposed for an in-depth analysis to explore the critical issues addressed by RC in relation to project performance. Understanding the realities of RC will assist stakeholders in the construction industry with their investment in RC.

This paper presents incentive application strategies and delay prevention strategies as schematic approaches to improve time performance of highway construction contracts. This research recognizes the importance of improving time performance during highway construction. Strategic solutions of the most core issues on time performance incentive contracting are identified. The suggested incentive application strategies develop criteria for applying time classification to projects, for assigning project time classifications to contractors and designers, and for determining appropriate incentive values in A (cost) + B (time cost) and other performance incentive contracts. The suggested delay prevention strategies develop criteria for determining the appropriate subsurface utility engineering (SUE) level and to develop best practices for avoiding utility relocation delays. A schematic approach for each strategy is developed. This paper also introduces current incentive contracting practices in Florida. The researchers obtained the information from experienced persons in the highway construction industry, including key highway contractors, designers, and Department of Transportation (DOT) and Federal Highway Administration (FHWA) personnel. The major focus of this research is to develop strategies and suggest approaches to improve time performance of highway construction contracts. For future study, practical tools to facilitate implementation of the suggested strategies should be developed, so that the criteria, implementation processes, and best practices developed may contribute to the current industry-wide effort to improve time performance.

Accounts of the development of a successful construction project often stress the importance of team relationship, project environment and senior management commitment. Numbers of studies carried out in the past decades indicate there needs to be a change of culture and attitude in the construction industry. In order for a turn around in the industry, relational contracting approaches have become more popular in recent years. However, not all relational contracting projects were successful. This paper details the fundamental principles of relational contracting. It further reports findings of a research currently taking place in Australia, how effective is relational contracting in practice. The problem addressed in this research is the implementation of relational contracting: • Throughout a range of projects • With a focus on client body staff The context within which the research was undertaken is: • Empowerment, regional development and promotion of a sustainable industry • The participating organisations have experience of partnering and alliancing • Success has been proven on large projects but performance is variable • Need has been identified to examine skill sets needed for successful partnering/alliancing The practical rationale behind this research is that: • Partnering and alliancing require a change of mind set - a culture change • The Client side must change along with contracting side • A fit is required between organisation structure and organisation culture Research Rationale: The rationale behind this project has been to conduct research within participating organisations, analyse, rationalise and generalise results and then move on to produce generic deliverables and "participating organisation specific" deliverables. This paper sets out the work so far, the links between the various elements and a plan for turning the research output into industry deliverables.

도로포장분야의 성능보증(warranty)계약제도는 유럽, 미국, 일본에서 오랫동안 시행되어 왔거나 시행되기 시작한 제도로서 그 효과가 입증되었거나 입증되고 있다. 본 연구에서는 유럽, 미국, 일본의 성능보증계약제도의 도입 및 운영 현황을 조사하였고, 성능보증계약제도의 장단점과 국내 적용가능성 분석을 통해 성능보증계약제도의 국내 도입방안을 제시하였다. 본 연구의 주요 결론으로 성능보증계약제도를 국내에 적용하기 위한 성능기준 개발의 필요성과, 보증보험 수수료 및 보증기간 등을 고려한 적정공사비 산정방안 마련, 국내에 적합한 성능보증방식 개발 등의 필요성을 제시하였고, 국내에 성능보증계약 제도의 도입을 위한 장단기적 적용방안을 제시하였다.
