Grope for a Summary Program about a Traditional Medical Database for Intellectual Property Protection in WIPO (지적재산권 보호를 위한 전통의학 DB 구축에 관한 고찰)

  • Objectives : In the WIPO conference about the protection of intellectual property for traditional knowledge (TK) and genetic resources (GR), there was a demand concerning the necessity of recognizing the invention of TK and GR and the foundation of a related database. Methods : In the standard of the foundation of a database, the content and resource identification standards, the technological standards and the security and transmission standards were discussed. In a decision on intellectual property, it means the protection and recognition as a technology precedent of the materials of the database. Results : Massive material on traditional medical care technology in Korea has existed in many areas. However, it is hard to make a database because it is difficult to organize and find the data. In addition, a database demanded by WIPO is not only the material of images or texts of simple technology information, but also the use of patent decisions about traditional knowledge technology and the public sharing of information in related areas. A traditional medical care database would consist of the core of a subject and the related areas. The core part is the medical herb resource and Oriental clinical technology. Conclusions : These are necessary to detail the kind of medicines and prescriptions, their use, and their processing. In the related areas, it needs to detail PIAS and clinical data in regarding the industrialization. These DB have to protect the TK and the GR of Korea.

  • 독점금지법과 지적재산권 양자간에는 항상 긴장관계가 존재해 왔다. 이러한 근본적인 대립관계에도 불구하고, 양자는‘소비자 복지의 극대화’와‘창조적 활동과 공정한 경쟁의 촉진’이라는 공통된 경제적 목적을 공유하고 있다(WARD S. BOWMAN, JR.,PATENT & ANTITRUST LAW: A LEGAL & ECONOMIC APPRAISAL 1-14 (1973). 그럼 과연 독점금지법이 지적재산권자 의 권리행사를 제한할 수 있을까? 만약 그것이 가능하다면, 어떤 경우에 지적재산권의 행사가 금지되는 것인가? 이하에서는 최근의 ‘마이크로소프트(MS)의 끼워팔기(tying) 사건’과 특허권자에 의한 거래거절행위의 위법성 여부가 문제됐던 미국의‘코닥사건’을 살펴봄으로써 이러한 궁금증을 해결하고자 한다.

Quantitative Analysis of LTE Essential Patents (LTE 표준특허의 정량적 분석)

  • Patent information, which is generated under a specific, objective rule for a prolonged period of time, has the properties of technology, right, and management. Because of these characteristics of patents, patent analysis is used to identify R&D capacities and performances, and management strategies of a given nation or enterprise. In this paper, we analyze LTE essential patents which are key IPRs for implementing standardized LTE technology and major weapons in a global patent war. Total of 2,307 LTE essential patents, published and registered applications from European Telecommunications Standards Institute(ETSI)'s online IPR database as of January 2011, are analyzed in quantitative methods. The analysis results present status and statistics of LTE essential patents by major countries, applicant companies and technical fields. And a comparative study is done using 4 patent indices limited to the LTE essential patents issued in the United States. It is expected that results herein are useful for not only figuring out the technological competitiveness of countries and companies in LTE market, but also suggesting a guide to strategic IPR management for related industries.

A Study on the Measurement of Technological Impact using Citation Analysis of Patent Information (특허정보분석을 이용한 기술파급효과 측정에 관한 연구)

  • Nowadays it is more important to measure the technological impact of a concerned R&D technology on others, when deciding or selecting strategically, under the environment such as more complex, more uncertain and more costly. But there was very few of proper methods to measure quantitatively. So we studied on measuring the technological impact of one group of technologies on others, which means the flow of disembodied knowledge, using patent citation analysis. We reviewed the prior art of the measurement of technological impact, and designs the effective citation analysis method using patent information, analyzing the prior art of patent citation analysis method and ie index. Finally, we developed the disembodied knowledge flow matrix between technology groups, counting citation frequencies between them, using KISTI's US patent database(USPA) and the index to represent the technological impact to others using the developed matrix as well as the intrinsic nature of the technological groups clustering by network analysis. The results of this study is to present the insight of a technological impact on the others quantitatively and this study aims at using them to refer to R&D budgeting and decision making in case of R&D planning or to the basic information to understand technology conversion or fusion.

  • Among biological information, GenBank, provided by the National Center for Biotechnology Information (NCBI)of the United States, is a representative database on genetic information and is the most widely used by researchers around the world. Korea Institute of Science and Technology Information (KISTI) visits NCBI on a regular basis and downloads the latest version of GenBank to reorganize the information gathered there into a database. This database is provided for Korean researchers of science and technology through the Bio-KRISTAL search engine, developed by KISTI. This study aims to design a service model that links information on papers, patents, and biodiversity and other contents of NDSL, an integrated service on scientific and technological information run by KISTI, with GenBank's reference and organism fields and to develop a prototype system. For this purpose, this paper explores the possibility of a linkage and convergence service between heterogeneous content by: (a) collecting GenBank data from NCBI's FTP site; (b) dividing GenBank text files into basic and reference genetic information and restructuring them into a database; (c) extracting article and patent information from the GenBank reference fields to generate new tables; and (d) leveraging data mapping technology to implement a prototype system where GenBank and NDSL data are interlinked and provided.

Trend for Waste Plastic Recycling Technology by Patent Analysis (특허분석(特許分析)에 의한 폐플라스틱 재활용(再活用) 기술(技術) 동향(動向))

  • The patents were searched to investigate the trend of recycling technologies about plastic waste. Database was collected from WIPS site and the range of the search was limited to patents opened in U.S.A (US), European Union (EU), Japan (JP) and Korea (KR) to september 2009. In this paper, 4,795 patents were selected by investigation abstracts and the trend of the recycling technologies relating to waste plastic were investigated through the analyzing by the years, countries, companies. The patents were occupied 65% by Japan and the most of the patents were about chemical recycling. In the case of Korea, material recycling was major in the patents of waste plastic recycling.

A Function-Based Knowledge Base for Technology Intelligence

  • The development of a practical technology intelligence system requires a knowledge base that structures the core information and its relationship distilled from large volumes of technical data. Previous studies have mainly focused on the methodological approaches for technology opportunities, while little attention has been paid to constructing a practical knowledge base. Therefore, this study proposes a procedure to construct a function-based knowledge base for technology intelligence. We define the product-function-technology relationship and subsequently present the detailed steps for the knowledge base construction. The knowledge base, which is constructed analyzing 1110582 patents between 2009 and 2013 from the United States Patent and Trademark Office database, contains the functional knowledge of products and technologies and the relationship between products and technologies. This study is the first attempt to develop a large-scale knowledge base using the concept of function and has the ability to serve as a basis not only for furthering technology opportunity analysis methods but also for developing practical technology intelligence systems.

Functional Annotation and Analysis of Korean Patented Biological Sequences Using Bioinformatics

  • A recent report of the Korean Intellectual Property Office(KIPO) showed that the number of biological sequence-based patents is rapidly increasing in Korea. We present biological features of Korean patented sequences though bioinformatic analysis. The analysis is divided into two steps. The first is an annotation step in which the patented sequences were annotated with the Reference Sequence (RefSeq) database. The second is an association step in which the patented sequences were linked to genes, diseases, pathway, and biological functions. We used Entrez Gene, Online Mendelian Inheritance in Man (OMIM), Kyoto Encyclopedia of Genes and Genomes (KEGG), and Gene Ontology (GO) databases. Through the association analysis, we found that nearly 2.6% of human genes were associated with Korean patenting, compared to 20% of human genes in the U.S. patent. The association between the biological functions and the patented sequences indicated that genes whose products act as hormones on defense responses in the extra-cellular environments were the most highly targeted for patenting. Present Status of Scientific and Technical Information Activities in Russia (러시아의 과학기술정보활동 현황)

  • This paper outlines recent conditions after the collapse of former Soviet Union and presents activities in eight major information-related organizations including International Center for Scientific and Technical Information, Russian State Central Scientific Medical Library. Russian National Public Library for Science and Technology, All-Russian Institute for Science and Technical Information, Natural Sciences Library of Russian Academy of Sciences, Scientific and Technical Information Center of Russia, Russian State Library and All-Russian Scientific and Research Institute of State Patent Examination. All of these organizations face economic difficulties brought about by financial crisis and inflation as well as shortage of the state budget. In addition, the domestic information processing technology using computers and computer networks is generally inferior to that of developed western countries due to lack of growth of information infrastructure in Russia.

An Analysis of the Control and Defrost Patents for Heat Pump (압축식 열펌프의 제상${\cdot}$제어 특허기술 분석)

  • A technical analysis was conducted to predict the development trend for heat pump system. The study was based on a submitted patent from 1983 to 2002 in Korea, U.S.A. and Japan. The total number of raw data from the registered database was 19,261 and the obtained data to be analyzed through the filtering process was 5,143. Technical development of compression type heat pump was more dominant than the other types, absorption, adsorption, and chemical heat pump. The patents for compression type made up over $80\%$ in each country, Most of patents were developed for the defrosting and controlling technology of the compression type heat pump system. Approximately $24\%\;and\;62\%$ of the patents about compression type heat pump were for defrosting and control technologies, respectively.
