Currently, the Free Trade Agreement(FTA) promoting regionalism or bilateralism has been increasingly concluded, which is against multilateralism of the WTO. The adoption of the TRS under the FTA carries various issues from the rationale of its existence to its contents. To explain these contradictory issues between the WTO and the FTA, this paper studied on the TRS by analyzing present cases and negotiation results of the TRS under the FTA and comparing them under the WTO. The TRS under the WTO agreement is limited only to antidumping, countervailing duties and safeguard as the agreed concept. When the negotiations of the FTA are on the process, it is necessary to adopt the TRS depending on the negotiating party countries of the FTA after considering fully the economic situations of Korea and the need of protection for the domestic industries. Currently, Korea has entered into the FTA with several countries and most of the agreements with respect to the TRS maintain and observe the right and duty in the WTO agreement and when necessary, in some of the FTA agreements, they have changed parts of the TRS. Consequently, it is needed to establish the basis for application of the TRS. Also, additional application of the SSG provision to some sensitive goods is highly recommended.
Gojong' Birth Anniversary Memorial Banquet in the 1910s was forced to be performed differently from the performance style in Joseon Dynasty period that featured a harmonious majestic beauty of etiquette music. The banquet was separated into three different sessions of ceremony, luncheon and performance', which clearly revealed a distinctive pattern of etiquette music. The performance was accompanied by the dinner party or was lightly implemented as part of evening entertainment. With the use of the term entertainment, the performances belonging to this category fell into nothing but something to enjoy, amusement, fun and play. The contents of such performances were not closely woven into the fabric of the entire banquet but were individualized and scattered in a way of putting the performances in a state of flux in line with the circumstances. Therefore, it became increasingly hard to expect a high degree of completion and solid structure of performances. The items of performance included western music, popular vocal music, popular instrumental music, magic, and film, which were not played in traditional court banquet in the presence of Gojong rather than traditional music and dance performed in court. In other words, the court performance could not maintain its traditional heritage but was transformed into a mixture of popular performance and new forms of art. It was driven by the Japanese imperialism toward the atmosphere of entertainment in oblivion of tradition but not toward the external extension of court performances.
The recent success of populist parties and candidates in the US and European countries leads to a massive amount of empirical research on populism, a deviant form of representative democracy. Much ink has been spilled to define populism and to identify the causes of its rise and continued success in democratic political system. However, little is known about populist attitudes of individual voters. Using a large-scale online survey fielded in the context of the South Korean presidential election in 2017, this study examines (1) what determines populist attitudes of South Korean voters and (2) how populist attitudes are associated with evaluations of political parties, candidates, and political issues. Statistical analysis reveals that people high on populism are more likely to support an underdog left-wing political party and its presidential candidate, and are less likely to support policies implemented or proposed under the auspices of the Park Geun-hye administration. These findings do not necessarily suggest the inherent affinity between populism and left-wing ideology; rather, it implies populist attitudes happened to appear in 2017, in reactions to lack of confidence in the previous government.
The 'Localization' & the 'Popularization' issues always play an important role at the Chinese Marxism. The Chinese Communist Party (C.C.P) is still emphasizing the 'Localization', but the 'Popularization' did not received the Chinese theorists' attention. Therefore a new theory in 'Popularization of Chinese Marxism' is very small. But at the 17th National Convention, C.C.P offered a suggestion that entitled "Lead the popularization of Marxism in China". And diversity theorization involved popularization of Marxism is in motion by Chinese theoretician. Throughout history of Chinese Marxism, the first theoretician who raised an objection of the popularization of Marxism in China is Aisiqi, and his achievements in this field are unequaled. His Popular philosophy is the most typical book on the popularization of Marxism in China. In the 1930s, China faced a serious crisis, Chinese intelligentsia & mass desperately wanted an idea to unify the country. Many intellectuals have latched on to the Marxism, especially Aisiqi was absorbed in the important assignment that how can bring out leadership of Marxism, how can popularize abstract and profound principle of Marx philosophy. Aisiqi's Popular Philosophyis marked by the 'Localization' & the 'Popularization', after this book is published, had a big impact on Chinese Revolution. The purpose of this thesis is a meaning through the Popular Philosophy consideration and evaluation to get to the bottom of that the C.C.P offered a suggestion with 'Popularization of Chinese Marxism'.
The petition movement to Paris peace conference was the movement for 137 Neo-Confucian scholars including Kwak Jong-seok to ask for Korean independence in March, 1919. Kim Bok-han had led all the course of Ho-seo version. Although we don't know the exact contents on the both of Yeong-nam and Ho-seo versions, but Ho-seo version might be more conservative than Yeong-nam version in comparison with other versions. This was because Ho-seo version basically represented the conservative stance of the Neo-Confucian scholars in Ho-seo (Southern Chung-cheong province). However although Ho-seo version had conservative characteristic, the projecting and practicing of petition movement to Paris peace conference shows Kim Bok-han's active attitude. What I would like to explain in this paper is the background of how spontaneously Kim led the movement. Especially I tried to make Kim's historical status be revealed through talking the idealogical history of Neo-Confucianism ignored until now. Although Kim received blames he behaved with barbarians when he led the petition movement from the conservatives, Kim never submitted on those blames. Kim's tolerant attitude was prominent in relation with Hwa-seo school against which Nam-dang school(Kim's party) was a rival, especially from also after 'the problem of Choe Ik-hyeon' in 1903. This attitude was connected to the petition movement in tolerant manner. The tolerant attitude like this was revealed from Kim's historical consciousness attached importance to 'the completion of work'.
This paper is intended to present the philosophical thoughts of Yu Won-Ji who was one of famous scholars in The School of Toegye. He criticized Yi I(Yulgok) and Jang Hyeon-Gwang(Yeohyeon) because they regarded Li and Ch'i as one. Yi was considered an actual founder of their theoretical and political rival party called the School of Yulgok. Jang also refused to accept Toegye's theory and had developed his own theory, which emphasized the unity of Li(principle) and Ch'i(material force). Therefore Yu might well exclude Yi I(Yulgok) and Jang Hyeon-Gwang and criticize their theories severely. First, he was convinced that Toegye's doctrine(Li-Gi-Ho-Bal-Seol) was a orthodox theory accurately succeeding to Jhu Xi's learning. Secondly, he criticised Yi I(Yulgok) for looking upon Li and Ch'i as one thing. Thirdly, he regarded Jang's doctrine as same with Yulgok's. Fourthly, he thought it is necessary to criticize Jang's theory in order to preserve Toegye's learning and establish the theoretical identity of the Toegye School.
The National League for Democracy (NLD) has restored a civilian government since the military had taken political power in 1962 as a result of general elections on 7, November 2015. But Daw Aung San Suu Kyi could not take part in the presidential election due to some restraints in constitution, so new government created the state counsellor position and the ministry of sate counsellor's office against military's resistance. It never publicized whether the military has to back to barracks including abolish of military's occupying the parliament seats. The ruling party is still taking laissez-faire to the military's political and economic role. The National level Ceasefire Agreement called the 21st Panglong conference launched in the end of August for a week, but stakeholders only insisted their demands. Rohingya issue is not involved in the 21st Panglong conference which aims to achieve national unity. The U.S. fully lifted a comprehensive sanction toward Myanmar since 1993, Japan promised huge grant assistance succeeding the former quasi civilian government. China strived to restore alienated relations of two countries. Although Korea kept Official Development Assistance, the summit which was planed two times in 2016 did not hold. The civilian government announced twelve points of developmental agenda in July 2016, instead of destroying the national development policy of the Thein Sein government. This agenda only showed the direction of policy not road map which was the same trend of the former government. The main direction of economic development stressed agriculture but manufacture like light industry was ignored.

After the financial crisis in 2008, the financial market still seems to be unstable with expanding the insolvency of the financial companies' real estate project financing loan in the aftermath of the lasted real estate recession. Especially after the illegal actions of people's financial institutions disclosed, while increased the anxiety of economic subjects about financial markets and weighted in the confusion of financial markets, the potential risk for the overall national economy is increasing. Thus as economic recession prolongs, the people's financial institutions having a weak profit structure and financing ability commit illegal acts in a variety of ways in order to conceal insolvent assets. Especially it is hard to find the loans of shareholder and the same borrower sharing credit risk in advance because most of them usually use a third-party's name bank account. Therefore, in order to effectively detect the fraud under other's name, it is necessary to analyze by clustering the borrowers high-related to a particular borrower through an analysis of association between the whole borrowers. In this paper, we introduce Analysis Techniques for detecting financial loan frauds in advance through an analysis of association between the whole borrowers by extending SNA(social network analysis) which is being studied by focused on sociology recently to the forensic accounting field of the financial frauds. Also this technique introduced in this pager will be very useful to regulatory authorities or law enforcement agencies at the field inspection or investigation.
In the event of a housing sale guarantee accident, the Housing and Urban Guarantee Corporation shall be responsible for the guarantee by refunding the moving-in money unless there are special circumstances to the contractor. The Housing and Urban Guarantee Corporation may refuse to perform the refund based on the Terms and Conditions Regulations Act, but disputes continue to arise between interested parties in this regard. Therefore, the purpose of this study is to study the problems and improvement measures for legal issues related to the implementation of the refund. First, the issue of guarantee effectiveness and scope of guarantee under the Terms and Conditions Regulation Act. Second, the problem of guarantee contract for conditional third parties of Housing and Urban Guarantee Corporation. Third, the problem of the attitude of the existing precedents of the Supreme Court was examined. As a result of reviewing these legal issues, it was confirmed that the interpretation of terms and conditions according to the implementation of the refund is being interpreted in accordance with the principle of good faith, but according to individual cases, precedents can be divided into positive and negative judgments. In addition, despite the fact that the housing pre-sale guarantee is a guarantee contract for a conditional third party, it was confirmed that the buyer suffered damages in good faith through active disputes with the interested parties. Accordingly, the Housing and Urban Guarantee Corporation proposed an improvement plan for roles and cooperation items to meet the purpose of establishment for the stability of the customer's housing.
Governance is valued as a new concept and principle of social operation and public policy management, and its influence is gradually expanding. Among the various governance theories being put into practice and in case analysis studies, collaborative governance embracing various governance concepts has been found to increase interdependence and responsibility beyond participation and compromise, and create new public values by integrating and utilizing optimal social coordination forms. In the field of cultural assets, governance-related research is also being conducted for the efficiency, sustainability, and scalability of public policy enforcement. This study explored the government's role (promotion, arbitration, and condition creation) in collaborative governance, focusing on the "Cultural Heritage Guardians" to understand how collaborative governance operates in the cultural heritage sector. Regarding governance policies in the cultural asset sector, the cultural asset guardians highlighted the status, role, and characteristics of policies by examining their introduction, development, and implementation. The results of the analysis revealed that private-led, horizontal public-private cooperation, collaborative governance, policy introduction, solidarity, professionalism, resource/knowledge imbalance, cooperation precedence, etc., facilitate increased participation. The government has accordingly proposed measures to establish comprehensive legal stability centered on cooperation; strategic reorganization of dedicated organizations; strengthened, supportive intermediate organizations; and individual and multi-party consultative bodies.
