국제우주정거장협정의 법제도에 관한 고찰 (A Study on the Legal System in the Inter-Governmental Agreement on the International Space Station)

  • 본 논문은 1998.1.29. 체결된 국제우주정거장(ISS : International Space Station)에 관한 정부간 협정 (IGA : Inter-governmental Agreement on International Space Station 이하 '신IGA' )의 법제도에 관한 연구로써 1) 국제우주정거장의 개요 2) 국제우주정거장 협정의 주요 기본원칙, 3) 국제우주정거장 협정의 법제도의 순서로 크게 3부분으로 나누어 고찰하였다. 첫째, 국제우주정거장의 개요에서는 (1) 국제우주정거장의 정의, 특징 및 기능과 (2) 국제우주정거장의 구성에 관하여 다루었다. 둘째, 국제우주정거장 협정의 기본원칙으로써 (1) 파트너쉽(Partnership)원칙과 (2) 평화적 이용원칙에 관하여 설명하였다. 셋째, 본 논문의 주제인 국제우주정거장 협정의 법제도에 관해서는 (1) 등록제도, (2) 관할권 제도에서 일반적 관할권 및 통제권과 형사관할권에 대하여 연구하였고, (3) 소유권 제도 중 지적재산권과 지적재산권 이외의 소유권에 관한 제도, (4) 손해배상책임제도에서 손해배상청구권의 상호포기와 손해배상책임의 제요소, 제3자에 대한 책임, 마지막으로 (5) 분쟁해결제도를 살펴보았다. 국제우주정거장 협정은 종래의 우주법에서 볼 수 없었던 새로운 법제도의 내용과 적용을 포함하고 있다. 또한 동 협정은 우주개발에 있어서 국가간 국제협력의 중요한 선례로서 하나의 Model Law가 될 것으로 보인다. 따라서 ISS상에서의 우주활동은 전체적으로는 신 IGA 법제도의 틀 안에서 규제를 받지만, 참가국과 이용자 간에는 당사자 간의 계약에 맡겨져 있기 때문에 철저한 검토가 이루어져야 한다. 또한 앞으로의 우주개발사업은 많은 중요사업에서 국제협력의 형태로 이루어질 것으로 예상되기 때문에 신 IGA의 의미는 더욱 중요하다고 할 수 있다. 본 논문을 기초로 하여, 앞으로 각 부분별로 더욱 깊이 있는 연구가 행해져 우리나라 우주개발사업의 법제도 수립에도 기여할 것을 기대한다.

How to Strategize ROO Schemes for Korea-Indonesia CEPA

  • Nine FTA like Korea-Chile FTA, Korea-Singapore FTA, Korea-EFTA FTA, Korea-ASEAN FTA, Korea-India CEPA, Korea-EU FTA, Korea-U.S.A. FTA, Korea-Peru FTA and Korea-Turkey have been concluded and implemented in 46 countries as of May, 2013. In addition to these nine FTA, Korea has been negotiating FTA or CEPA(Comprehensive Economic Partnership Agreement) with China and Vietnam and Indonesia. Now Korean government is about to conclude FTA agreement with Indonesia which is one of crucial trading partners in Asian countries so the objective of this paper is to suggest how to design ROO schemes properly in such upcoming FTA agreement since more activation of trade and more utilization of FTA can be depend on the details of ROO schemes. As a result, this paper suggests well-design of ROO schemes as follows ; First, self-issuance origin proof system can be considered because authority-issuance origin proof system may reduce the utilization ratio of FTA. Second, combination of indirect and direct verification system in terms of origin verification system will be more preferable because this will be more fitting to Asian countries as considering trading environments and characteristics of Asian market. Third, criteria to determine origin can be based on wholly obtained plus substantial transformation system which contains CTC plus VC along with some percentage of de minimis. In addition to this, the number of products stipulated in PSR should be minimized and applied similar manner to avoid complexity of deciding origin.

지역사회보건기획과 지역보건체계 강화: MAPP 모형의 사례 (Community Health Program Planning and Local Public Health System : The MAPP Model)

  • Objectives: This paper aims to describe a public health planning model, Mobilizing for Action through Planning and Partnership(MAPP), and to discuss its application in Korea with a specific focus on the Local Public Health System (LPHS) component of MAPP. Methods: Literature content review was performed on research papers on MAPP development and application, MAPP handbook and guides, the guidelines for the 5th Phase Community Health Plan, and a research report on public health center evaluation system. Results: MAPP has been applied to public health planning (the 5th Phase Community Health Plan) and a performance evaluation system for public health center in Korea. The current application is limited to the early stages of the MAPP. Limited or partial application affects the integrity of the model. Follow-through should be strengthened especially for evaluation planning. Conclusion: Systems thinking approaches should be considered for the development of LPHS and strengthening logical and practical linkage between planning and evaluation of community health planning.

주거복지 공적 전달체계 개편방안 연구 - 통합적 지역거점 구축방안을 중심으로 - (A Study for the Reform of Public Housing Welfare Delivery System)

  • In era of lowbirth, aging population, low growth and social polarization, the effective welfare delivery systems are taking on added significance than past years. Public housing welfare resources, such as public rental housing, housing voucher, affordable housing loan, are more diversified and expanded. These programs could work effectively by the comprehensive interlink and community based delivery system. From the standpoint of recipients, how effectively the substantial benefits of welfare resources being delivered to each individual is more important than how much welfare resources being produced totally. This study aimed to explore the reform of public housing welfare delivery system. For this purpose, diagnosed the current states and key issues related to public delivery system, and analyzed what kinds of housing welfare services should be strengthened, and finally suggested the collaboration among the public sectors (local government, LH, HUG, HF etc.) and the partnership with non-profit organizations. Main research implications are as follows. The main housing welfare services which could be categorized as the housing welfare center's role are advice & information offering, several public resources interlink and accessibility improvement, community based network construction, etc. And the most important key for successful delivery system reorganization is the collaborative operation of the public sectors and local government, non-profit organizations.

공동모금제도와 민간복지부문의 역할정립 (An Analytical Study of Community Chest for Developing Private Sectors in Social Welfare)

  • The community chest has been known as an effective means for private sectors in social welfare by mobilizing community resources. The purpose of this study is to analyze the process of developing community chest system in Korea and to suggest how Korean community chest system can be changed to develop private sectors in social welfare. To obtain this purpose, the author studied as follows. Firstly, The difference between former Korean community chest law and new Korean community chest law were examined. Secondly, the background of establishment of Korean community chest law and the present condition and state of Korean community chest system for private sectors in social welfare were analyzed. Thirdly, the tasks to be solved about developing Korean community chest system for developing private sectors in social welfare were suggested as follows; 1) activating the demonstration work for influencing the formulation of pragmatic partnership between state and private sectors in social welfare 2) utilizing a variety of communication channels for community participation 3) cooperating and coordinating the relationship between community chest system and the most voluntary social welfare agencies 4) raising as much funds as possible for maintaining autonomy of private sectors in social welfare.

The Unified UE Baseband Modem Hardware Platform Architecture for 3GPP Specifications

  • This paper presents the unified user equipment (UE) baseband modulation and demodulation (modem) hardware platform architecture to support multiple radio access technologies. In particular, this platform selectively supports two systems; one is HEDGE system, which is the combination of third generation partnership project (3GPP) Release 7 high speed packet access evolution (HSPA+) and global system for mobile communication (GSM)/general packet radio service (GPRS)/enhanced data rates for GSM evolution (EDGE), while the other is LEDGE system, which is the combination of 3GPP Release 8 long term evolution (LTE) and GSM/GPRS/EDGE. This is done by applying the flexible pin multiplexing scheme to a hardwired pin mapping process. On the other hand, to provide stable connection, high portability, and high debugging ability, the stacking structure is employed. Here, a layered board architecture grouped by functional classifications is applied instead of the conventional one flatten board. Based on this proposed configuration, we provide a framework for the verification step in wireless cellular communications. Also, modem function/scenario test and inter-operability test with various base station equipments are verified by system requirements and scenarios.

A Study on the Authenticity Verification of UxNB Assisting Terrestrial Base Stations

  • 본 논문에서는 지상 기지국을 보조하는 UxNB의 진본성 검증을 위해, 3GPP TR 33.809에 제시된 시스템 정보(System Information) 보안을 위한 솔루션들을 UxNB 관점에서 분석한다. 3GPP(Third Generation Partnership Project)의 정의에 따르면, UxNB는 UAV(Unmanned Aerial Vehicle)에 탑재한 기지국(Base Station)이며, UAV에 의해 공중에서 운반되며 UE(User Equipment)에게 연결을 제공하는 무선 접속 노드이다. 시스템 정보(System Information) 보안을 위한 솔루션들은 해시(Hash) 기반, MAC(Message Authentication Codes) 기반, 디지털 서명(Digital Signature) 기반으로 분류할 수 있으며, 각 범주별로 대표적인 솔루션을 하나씩 소개한다. 각 솔루션별로 UxNB의 진본성 검증 관점에서 사전 배포 정보 및 업데이트, UxNB의 보안 정보 유출, 추가적으로 요구되는 연산량 및 전송량 측면에서 해당 솔루션들을 비교 분석한다. 분석 결과, UxNB의 진본성 검증을 위한 솔루션은 UxNB에 저장될 비밀 정보가 최소화되어야 하고, 안전한 장소에 저장되어야 하고, 무선으로 업데이트되면 이를 위해서 암호화를 적용해야 한다. 또한 UxNB의 낮은 컴퓨팅 파워와 전원 부족의 특성으로 인하여 연산량 및 전송량을 최소화해야 한다.

대학보건실의 운영체계 및 건강증진 서비스 제공 실태 (Health Promotion Services and Administrative System of the University Health Clinic)

  • Objectives: This study was conducted to analyze problems and priority of university health services through analysis of health promotion programs and administrative system of university health clinics. Methods: In first telephone survey, 349 colleges and universities nationwide were surveyed to find out whether they operate health clinic or not. The administrative system and health promotion services of university health clinics were analyzed in 198 schools which had health clinic in it. Results: 160 schools were included in the final analysis. The most common name of university health clinic was 'health clinic' (35.2%), and heads of 52 university health clinics were non-medical school professors. 20.9% of the school provided details of the rules and implement guidelines of health care service. Health promotion services of university health clinic were set the non-smoking area (90.6%), health counseling (81.8%), providing health information (74.8%), health check-up (65.4%), health education (61.4%), partnership with health institutions in a community (61.4%), and immunization (48.1%) in order of that. Conclusion: It is urgent to establish the regulatory and guidelines for university health clinic. Each member of school should have interests in their health clinic and acknowledge health promotion services which they can get at the university health clinic.

생태관광의 지속가능성 확보를 위한 제도 도입 및 국제협력방안 - 한·중·일 생태관광 인증/지정제도를 중심으로 - (Introduction of a System for a Sustainable Ecotourism and International Cooperation - Focusing on the Korea-China-Japan Ecotourism Certification/Designation System -)

  • 본 연구는 생태관광의 지속가능성과 국제협력 방안을 모색하기 위해 수행하였다. 생태관광의 본래적 의미를 유지하기 위한 방안으로 국외의 여러 국가에서는 생태관광 인증/지정제도의 도입이 활성화 되고 있다. 우리나라에서도 2011년 6월 환경부에서 일정한 수준의 생태관광 상품의 질을 보장하기 위한 "생태관광 지정제" 도입을 추진하기 위해 국회에 상정한 바 있으며, 제도도입을 위한 하나의 방안으로 올해 시범사업을 추진하고 있다. 이에 앞서 일본은 2006년부터 생태관광 프로그램의 지속성을 인증하는 굿에코투어인증 등을 시행하고 있으며, 2008년 생태관광 진흥법을 세계 최초로 제정하여 생태관광의 지속가능성을 확보하기 위한 지자체 인증제도를 시행하고 있다. 우리나라(환경부)는 지속가능관광 국제파트너쉽의 일환으로 2011년 1월 개최된 제 1회 Global Partnership for Sustainable Tourism(GPST) 총회에 참석하여 운영위원회 위원국으로 선출되었으며, 제 2차 총회를 2012년 3월 한국에서 성공적으로 개최하였다. 2차 총회에서는 특히 한국이 중심이 되어 지속가능관광 아 태지역 네트워크를 추진하는 것으로 합의함으로써 아태지역의 생태관광 중심국으로의 위상이 높아질 것으로 예상된다. 자원의 보전과 현명한 이용, 지역의 환경, 문화, 역사자원의 공유와 인식을 기반으로 한 생태관광은 개별 국가차원에서의 노력은 물론 국가 간의 협조와 동조가 무엇보다도 필요하다. 자연자원에 대한 접근수요가 급격히 증가하고 있는 가운데, 생태관광 지속가능성 확보를 위한 지정제와 같은 제도적 장치 마련과 함께 유사한 자연자원과 문화를 공유하고 있는 아태지역의 협력과 네트워크 활성화 방안이 적극적으로 모색되어야 할 것이다.
