남전 율장의 가사 계율에 관한 고찰 (A Study on the Kasaya Rule of Southern Vinaya-Pitaka)

  • This paper is on the Kasaya that reveals conspicuously the religious meaning among the Korean Buddhist costumes. The Kasaya has the most special meaning among Korean costume culture. It has the most important historical value, for Buddhism is the oldest religion that begins at 4th century A.D.. It has the most unordinary shape that we could not find any other costume culture. It has very important meaning to study on the Kasaya in the religious and cultural history of Korean costume. We have to study Korean Kasaya from surveying Indian Buddhist Kasaya diachronicaly. Buddha establishes himself the rules of weaving, coloring and wearing Kasaya. Bunso costume(분소의)is the first shape of Kasaya that he has worn during his ascetic practice. Bunso costume was a kind of shari. It is made with diapers those clean ordure of baby It symbolizes the life of ascetic practice. However Buddha could not stick to it as the only costume of monks. From his age Buddhist devotees have thought Buddha and monks as sacred beings. So they eagerly want to Provide the sacred beings with foods. clothes and other things that samgha(승가) need to live and accomplish their duties. At that time there are many kings, aristocracies and rich merchants among the devotees. They often offered them the luxurious silk Kasaya. that the ascetic monks could not wear. to express their deep faith. So the rules of the samgha has been distorted. The samgha has enlarged day by day as a great huge religious association. There are many different shapes of Kasaya. The Buddhist samgha need to establish a minute and rigid rules of Kasaya to order living of monks and to teach the moral and educational life to ordinary people. That book of rule is Vinaya pitaka(율장) . There are many kinds of Vinaya pitaka. This paper surveys the rules of Kasaya from Southern Vinaya pitaka(남전율장). This study will be the basic ground to research the Korean Buddhist Kasaya.

노론의 연원과 전개, 철학사상과 현실인식 (An origin and development, the thought and understanding of actual world of Noron)

  • 노론(老論)은 숙종대에 결성된 이후 조선의 정국을 주도한 집권 세력으로서 조선이 멸망할 때까지 지속적으로 조선의 정국을 주도했다. 노론의 학문과 사상의 전개는 크게 네 시기로 나누어 볼 수 있다. 첫째, 17세기 후기에서 18세기 초에 이르는 숙종대의 붕당 정치 시기, 둘째 18세기 중기에서 후기에 이르는 영정조대의 탕평 시기, 셋째 19세기 이후의 세도 정치 시기, 넷째 19세기 후기에서 구한말에 이르는 시기 등이다. 이렇게 구분하여 노론의 연원과 전개 양상을 개략적으로 살펴볼 수 있다. 노론의 전반적인 특징은 노론의 정신적 지주로 송시열을 존숭하였고, 존주자 양이적을 추구하는 조선중화론에 의한 군자당론을 주장하였으며, 일도설(一途說)과 기질지성(氣質之性)에 관한 학설에 대해 율곡 성리학을 보완적으로 계승하였고, 이단 배척과 정학 수호를 중시하여, 결국 천주교 탄압으로 표출된 양상으로 요약 정리할 수 있다. 노론계의 특징적인 학자로는 학문과 정치 양 측면에서 보았을 때 수암(遂庵) 권상하(權尙夏)(1641~1721), 농암(農巖) 김창협(金昌協)(1651~1708), 도암(陶庵) 이재(李縡)(1680~1746) 등이 주목되는 인물이다. 17세기 이후의 치열한 권력 쟁탈 가운데에 사상적 맥락이나 학문사상이 정국 변화의 핵심적인 요인이라고 보기는 어렵다. 조광조의 지치주의 이후 조선시대 공론(公論)은 누구나 동의하는 보편적인 논의를 지칭하지만 사림이 분열한 이후에는 당파적 이해를 반영하는 당론(黨論)과 구분하기 어려워지게 되었다. 이런 가운데 송시열을 추숭한 노론 계열의 학자들은 존주자(尊朱子) 양이적(攘夷狄)을 기치로 삼고 왕이나 권세가들의 권력 남용을 제어하고 강력한 정치적 통일을 이루어 도의(道義) 사회를 구현하려고 했다. 그러나 점차 17세기에 수립한 당시의 정치적 동기와 목표는 상실하고 결국 탕평에 반대한 노론 벽파가 정조(正祖) 사후에 세도정권(勢道政權)을 만들어 내면서 정국을 장악하고 권세를 전횡하는 폐해로 귀결되었다. 노론의 현실 대응 논리와 행적은 정학일치(政學一致)라는 한국 도학정치의 특성이 극단화되어 표출된 모습이라고 평가할 수 있다.

새로운 간호윤리학 방법론;통합된 사례방법론 (An integrated Method of New Casuistry and Specified Principlism as Nursing Ethics Methodology)

  • The purpose of the study was to introduce an integrated approach of new Casuistry and specified principlism in resolving ethical problems and studying nursing ethics. In studying clinical ethics and nursing ethics, there is no systematic research method. While nurses often experience ethical dilemmas in practice, much of previous research on nursing ethics has focused merely on describing the existing problems. In addition, ethists presented theoretical analysis and critics rather than providing the specific problems solving strategies. There is a need in clinical situations for an integrated method which can provide the objective description for existing problem situations as well as specific problem solving methods. We inherit two distinct ways of discussing ethical issues. One of these frames these issues in terms of principles, rules, and other general ideas; the other focuses on the specific features of particular kinds of moral cases. In the first way general ethical rules relate to specific moral cases in a theoretical manner, with universal rules serving as "axioms" from which particular moral judgments are deduced as theorems. In the seconds, this relation is frankly practical. with general moral rules serving as "maxims", which can be fully understood only in terms of the paradigmatic cases that define their meaning and force. Theoretical arguments are structured in ways that free them from any dependence on the circumstances of their presentation and ensure them a validity of a kind that is not affected by the practical context of use. In formal arguments particular conclusions are deduced from("entailed by") the initial axioms or universal principles that are the apex of the argument. So the truth or certainty that attaches to those axioms flows downward to the specific instances to be "proved". In the language of formal logic, the axioms are major premises, the facts that specify the present instance are minor premises, and the conclusion to be "proved" is deduced (follows necessarily) from the initial presises. Practical arguments, by contrast, involve a wider range of factors than formal deductions and are read with an eye to their occasion of use. Instead of aiming at strict entailments, they draw on the outcomes of previous experience, carrying over the procedures used to resolve earlier problems and reapply them in new problmatic situations. Practical arguments depend for their power on how closely the present circumstances resemble those of the earlier precedent cases for which this particular type of argument was originally devised. So. in practical arguments, the truths and certitudes established in the precedent cases pass sideways, so as to provide "resolutions" of later problems. In the language of rational analysis, the facts of the present case define the gounds on which any resolution must be based; the general considerations that carried wight in similar situations provide warrants that help settle future cases. So the resolution of any problem holds good presumptively; its strengh depends on the similarities between the present case and the prededents; and its soundness can be challenged (or rebutted) in situations that are recognized ans exceptional. Jonsen & Toulmin (1988), and Jonsen (1991) introduce New Casuistry as a practical method. The oxford English Dictionary defines casuistry quite accurately as "that part of ethics which resolves cases of conscience, applying the general rules of religion and morality to particular instances in which circumstances alter cases or in which there appears to be a conflict of duties." They modified the casuistry of the medieval ages to use in clinical situations which is characterized by "the typology of cases and the analogy as an inference method". A case is the unit of analysis. The structure of case was made with interaction of situation and moral rules. The situation is what surrounds or stands around. The moral rule is the essence of case. The analogy can be objective because "the grounds, the warrants, the theoretical backing, the modal qualifiers" are identified in the cases. The specified principlism was the method that Degrazia (1992) integrated the principlism and the specification introduced by Richardson (1990). In this method, the principle is specified by adding information about limitations of the scope and restricting the range of the principle. This should be substantive qualifications. The integrated method is an combination of the New Casuistry and the specified principlism. For example, the study was "Ethical problems experienced by nurses in the care of terminally ill patients"(Um, 1994). A semi-structured in-depth interview was conducted for fifteen nurses who mainly took care of terminally ill patients. The first stage, twenty one cases were identified as relevant to the topic, and then were classified to four types of problems. For instance, one of these types was the patient's refusal of care. The second stage, the ethical problems in the case were defined, and then the case was analyzed. This was to analyze the reasons, the ethical values, and the related ethical principles in the cases. Then the interpretation was synthetically done by integration of the result of analysis and the situation. The third stage was the ordering phase of the cases, which was done according to the result of the interpretation and the common principles in the cases. The first two stages describe the methodology of new casuistry, and the final stage was for the methodology of the specified principlism. The common principles were the principle of autonomy and the principle of caring. The principle of autonomy was specified; when competent patients refused care, nurse should discontinue the care to respect for the patients' decision. The principle of caring was also specified; when the competent patients refused care, nurses should continue to provide the care in spite of the patients' refusal to preserve their life. These specification may lead the opposite behavior, which emphasizes the importance of nurse's will and intentions to make their decision in the clinical situations.

조아(曹娥)설화와 문화원형콘텐츠 사례연구 (Cao-e's story and Its Case Study on the culture archetype contents)

  • 중국 고대사회에 있어 효 문화는 가부장제도 아래에서 도덕규범의 실천적 원리였다. 조아(曹娥)는 중국의 대표적인 효의 상징인물로, 원래 무녀(巫女)였으나 한대의 주류 사상인 유가철학의 전파와 함께 효녀의 형상으로 전환되었으며, 이후 지역문화의 발전과 함께 민간의 신앙과 접목하여 수신(水神)의 개념으로 재탄생하기도 하였다. 조아설화의 전파과정 중, 구전과 문학적 가공은 상호적인 작용을 통해 영향을 주고받으며, 미화되거나 신성화되고 체계화 되었는데, 조아도상은 이러한 인류가 추구하는 보편적이며 온전한 사유적 형상의 체현이다. 예컨대, 현대사회에 있어 문화적 정체성과 함께 그 이면의 근본적인 내적 함의의 인식이 중요하다. 그러므로 조아의 효를 주제로 한 사회기반의 문화콘텐츠의 창작과 이를 통해 효가 가진 문화적 핵심가치를 찾는 것은 의미 있는 일이다. 본문은 조아설화와 효사상 그리고 문화원형을 사례중심으로 서술하였으며, 조아의 민간신앙적 신성화 측면에서 문학으로부터 파생된 가공과 도상의 형성 사이의 관계를 이해하고, 이미지의 변화와 조형성을 통한 문화콘텐츠로서의 가능성을 살펴보았다.

에이전시이론과 회계감사에 관한 연구 (A Study on the Agency Theory and Accounting)

  • The primary objective of the agency research in the game theory lives in the maintenance of Pareto is optimal condition for the optimal incentive contract. The basic concepts which are related to this objective are reviewed in connection with the general assumptions to model it, the moral hazard and adverse selection which arised from the information asymmetry, and finally the problem of risk distribution. The demand for auditing and the role of auditor have been addressed by ASOBAC. Issues which an auditor is explicitly introduced in a principal-agent framework have been addressed in this paper. These issues must be confronted to appropriately with the auditor, and to achieve an adequate understanding of optimal confronting arrangement with the auditor. The first step in introducing an auditor into this analysis is to examine the game-theoretic foundation of such a expended agency model. The Mathematical program formulated may not yield solution that are resonable. This arises because the program may call for the auditor and manager to play dominated Nash equilibra in some subgame. The nontrivial natures of the subgame implies that randomized strategies by the auditor and manager nay be of crucial importance. The possibilities for overcoming the randomized strategy problem were suggested; change the rule of the game and or impose covexity condition. The former seems unjustifiable in on auditing context, and the latter promising but difficult to achieve. The discussion ended with an extension of the revelation principle to the owner manager-auditor game, assuming strategies. An examination of the restriction and improvement direction of the basic concept of agency theory was addressed in the later part of this paper. Many important aspects of auditor incentives are inherently multiple-agent, multiple-period, multiple-objectine, phenomena and require further analyses and researches.

TPB, TIB 및 중화기술의 통합적 모형에 의한 디지털 영상물 불법복제 의도에 관한 연구 (A Study on Intention to Pirate Digital Video by an Integrated Model of TPB, TIB, and Neutralization)

  • Despite of continuous efforts to crack down on piracy using penalties and regulations, this unauthorized piracy market is still enormous. Since the moral hazard about this phenomenon is pervasive and continually upsets the major intellectual property markets, an alternative plan is required. The purpose of this study is to provide an objective insight for factors that affect people's digital video piracy behavior. The following two research propositions were the focus: what psychological factors affect piracy behavior and how are these factors related to one another? In order to accomplish the research aims, we reviewed literatures on the current state of piracy in South Korea, characteristics of digital contents, studies on criminal psychology and behavioral theories. Previous research in the fields of criminal theory indicated that neutralization, a form of rationalization, would help explain digital piracy intentions. Thus, this study developed a model that explains effects of neutralization techniques and tested the possibility of an integrated model with other behavioral theory such as TPB and TIB. Empirical results of the study(368 sample collected) showed that all the factors in TPB including Attitude to Piracy(+), Subjective Norm(-), Perceived Behavioral Control(+) had a significant impact on Piracy Intention. Moreover, two neutralization techniques, Condemn the Condemners(+) and Appeal to Higher Loyalties(+), had a significant effect on Piracy Intention. In addition, Past Behavior had strong impacts on Attitude(+), Perceived Behavioral Control(+) and Piracy Intention(+). In terms of Expected Profit, it had an impact on Attitude to Piracy positively. These findings suggest implications for protecting the current intellectual property markets, with many stakeholders in movies and media industries. There are some limitations as followed: first, the study did not consider other neutralization techniques, low level of deterrence and the other expected results despite the possibility of their effects. Second, the study needs improvements through longitudinal research because the cross-sectional research could not rule out the alternative explanations.

A Study on the Legal Consciousness of Female University Students through Information Analysis

  • The Legal Consciousness is a feeling or attitude toward the law from the people. Most Korean had a traditional consciousness that did not consider the law so friendly, also, the perception of law is also very negative is the common result of various investigations so far. This is caused by a distrust of the political power that operates the law than just distrust of law. Moreover, it is a serious problem that these negative attitudes are getting stronger over time. Especially when looking at the situation of the monopoly of government affairs in Park Geun-hye administration, the law was not a means of realizing social justice on the side of the socially weak, it has come to the fact that the law has been recognized as a tool of oppression by the ruling group, which seizes power in a fraudulent manner and accumulates economic wealth. It was a really ridiculous incident. In addition, not all citizens need to be experts in law, but the law is a bowl for society, and filling the bowl is a moral form or value of society in general. And since society has a peculiar law, and the modern state has the rule of law as its basic principle, most human acts have a direct relationship with law. In particular, it is true that the problem of the legal consciousness of college students is frequently mentioned today. Therefore, in this study, through the examine the contents of the legal consciousness of the K university female students in Gwangju and will consider the cause of this.

글로리아 네일러의 『린덴 힐즈』 -억압적 '원장면'과 왜곡된 '가족 로맨스'의 비극 (Gloria Naylor's Linden Hills: A Tragic Saga of the Oppressive "Primal Scene" and Deformed "Family Romance")

  • Gloria Naylor's second novel Linden Hills (1985) explores the issues of self-exploration, empowerment, history, and memory by delineating the communal and familial tragedies and the distortion of values prevalent in a prosperous African-American urban community called Linden Hills. Drawing upon the Freud's concept of "primal scene" and "family romance," this paper aims to focus upon the Nedeed family, the founder of Linden Hills, and investigate the compelling traumatogenic force within the family, which is inseparably intertwined with the inversion of values and moral corruption permeating the entire community. The "primal crime" committed by the Nedeed ancestors serves to preserve and perpetuate a tyrannical rule by ruthless patriarchs who reign by underhanded strategies of purposefully neglecting and abusing others, including their own wives. The imprisonment, by Luther Nedeed, of his wife Willa in the family morgue epitomizes the long legacy running in the family-the oppression and burial of the pre-Oedipal, maternal history. Willa's accidental encounter, at the nadir of the family estate and her personal despair, with the faded records of the forgotten and abused Nedeed women exposes the violence-ridden ground of the family's primal scene and the absurdity of family romance the Nedeeds pursued. As the several lines of poem composed by Willie, Willa's male double, show, the hidden, forgotten history of the Nedeed women, in a sense, is the real, which cannot be assimilated to the social symbolic governed by the inhumane patriarchy of the Nedeed family and the success-oriented Linden Hills society. By portraying a catastrophic downfall of the Nedeed family and the futile outcome of its family romance, the ending of Linden Hills conveys implicitly that the contingent symbolic order and its oppressive control, however solid and invincible they may seem, can be toppled down by the real, its nameless forgotten Other.

21세기 한국의 민주주의와 유가철학 - 타율성과 자율성의 문제를 중심으로 - (Democracy and Confucian Philosophy of South Korea in the 21st Century - Focusing on the issue of heteronomy and autonomy -)

  • 1987년에 제정된 제10호 헌법은 21세기 한국 민주주의의 이론적 토대 역할을 한다. 이 헌법에 내재된 인권 존중, 불의에 대한 저항, 균등의식 등은 유가철학의 내용과 괴리되지 않는다. 이는 21세기 한국의 헌법정신이 민주주의 이념과 유가철학의 영향을 받아 형성되었음을 의미한다. 그러나 제10호 헌법은 유신헌법 때 수용되고 군부세력들이 계승했던 '자유민주적 기본질서'의 사상을 중시한다. 이는 자유와 평등의 양립보다 자유를 평등보다 우선하는 자유주의의 영향을 받은 것이다. 이 때문에 공공의 복리나 민중의 유익보다 부르주아계급의 이익을 확대하는 정책이 많이 펼쳐진다. 특히 이명박과 박근혜 정권 동안에 불균등한 현상이 많이 양산되었다. 21세기 유가철학은 이러한 불평등한 사회를 비판적으로 바라본다. 유가철학은 상대적 박탈감이 인간을 소외시키는 역할을 하는 것으로 생각하고, 균등한 관계의 중요성을 강조한다. 또한 이 헌법은 법치주의를 강조한다. 그러나 법치주의는 자연법을 함유한 헌법정신이 제도를 통해 현실에 적용될 때에 법실증주의의 실정법을 중시한다. 이는 자율적인 판단과 선택을 지양하고, 타율에 의존하도록 유도한다. 이러한 타율적인 법률은 강제성을 동반한다. 이러한 실정법은 인간을 자유롭고 창의적인 생각을 하는 능동적인 존재가 아니라, 이미 정해진 틀에 무비판적으로 적응하게 하는 수동적인 존재로 전락시킬 수 있다. 유가철학은 법치주의를 인간을 수단화하는 제도로 여기며 비판한다. 유가철학은 인간을 도구가 아니라, 도덕적인 존재로 여긴다. 유가철학은 삶의 원리를 자각적으로 깨달은 도덕성을 통해 건강한 사회를 구축하고자 한다. 유가철학은 인간을 본래 자유로운 존재로 생각한다. 따라서 인간은 타율적인 존재가 아니라, 자율적인 존재이다. 유가철학에 의하면 인간은 내면에 함유된 도덕성을 스스로 깨달아 스스로의 판단과 선택을 책임 있게 실행할 수 있는 존재이다. 따라서 인간을 불신의 대상이 아니라 신뢰의 대상으로 여기는 유가철학은 법률을 통한 형벌의 방법보다 교화를 통한 인간다움의 실현을 중시한다. 이는 실정법이라는 타율성에 의해 존엄한 가치가 지켜지지 않고, 자율적인 선택과 판단에 의해 인간의 정체성이 유지될 수 있음을 의미한다. 이처럼 제10호 헌법에 포함된 자유민주주의와 실정법의 문제에 대한 유가 철학의 지적은 현대 한국 사회의 모순을 본질적으로 해결하는 면에 도움이 될 수 있다.

서비스주의 법제도 구조와 운용 연구 (A Servicism Model of the New Legal System)

  • 본 연구는 서비스주의 경제, 정치행정, 사회교육 시스템을 구현하는 바탕이 되는 법제도 모델 도출을 위해 수행되었다. 지난 역사시대 5천여년간 인류의 법제도 운용 경험을 토대로 미래 인류사회를 지속가능하게 할 새로운 법제도 모델을 도출하였다. 인류 역사에서 시도된 여러 법제도 시스템을 통해 현대사회에 바람직한 법제도시스템의 구조를 설계하였다. 좋은 법제도가 인간의 비이성과 비상식에 의해 얼마나 오용되어 왔고 오용되고 있는지를 경험한 인류사회는 실패를 통해 교훈을 얻어 법제도 패러다임 자체를 바꾸는 노력을 할 필요가 있는 것이다. 현재 법제도시스템의 문제점을 근본적 차원에서 분석하였다. 정의와 공정이 바로 서지 못하는 근본 원인을 분석하고, 새로운 법제도 시스템을 설계하였다. 본 연구는 장기적으로 정의와 공정사회를 구현할 수 있도록 법제도시스템의 기반을 도출하였다. 인류사회가 오래도록 행복할 수 있는 법제도 개선 모델을 제안하였다. 이를 위해 사상적 차원에서 법제도시스템의 근본 역할을 분석하고 현재 법제도의 문제점을 제시하였다. 또한 인간의 본성에 대한 근본 가정상의 문제점을 분석하고, 개선된 가정을 제시하였다. 현재 법제도시스템의 구조적 체계를 분석하고 새로운 구조를 제시하였다. 새로운 구조에 의한 새로운 법제도 운용 방안을 제시하였다. 새로운 법제도시스템은 서비스주의 시스템으로 명명되었다. 모든 대립자들간의 철저한 견제와 균형이 중심이 되는 모델이기 때문이며, 단순 선형 1차원 법제도시스템이 아니라 다차원적 법제도시스템이기 때문이고, 또한 인간의 비이성과 욕망을 뚜렷하게 인정하는 관점이기 때문이다. 새로운 시스템은 법치와 비법치의 대립, 성선설과 성악설의 대립, 법제정 운용자와 피운용자간의 대립, 권력자와 일반시민간의 대립 등을 모두 반영하는 모델이다. 현 법제도에서 새로운 법제도시스템으로 전환하는 구체적인 방안에 대한 후속 연구가 필요하다.
