A Study on the Nurse's Due Care in Medical Malpractice (의료과오시(醫療過誤時) 간호사의(看護師)의 주의의무(注意義務)에 관한 연구(硏究))

  • There are some new trends in judgments concerning medical malpractice. which include emphasis on medical professionals' explanation duty in order to materialize patient's rights of self-determination. Now, patient is not a mere subject of medical and nursing care any more, but a subject, participating in medical practice on equal terms with medical professionals. Legal accountability is no limited to nurses in advanced practice: it is a recognized fact of life for every practicing nurse. whether she is an RN employed as a staff nurse in a hospital, a Certified Nurse-Midwife in independent practice or a patient's home. Therefore, it is essential for nurses to be as familiar as possible with the legal guidelines that govern their patient care responsibilities. However there are only a few studies focused on nursing negligence. To define nurse's civil liability in medical malpractice, it is necessary to indentify both legal nursing behaviors and nurse's due care in those nursing behaviors. So this paper focused on nurse's due care, especially in nursing malpractice. To clarify nurses' due care. chapter II has focused on nursing behavior and the scope of nursing practice based on the medical law and health care related study results. Chapter III deals with the content and scope of nurse's due care. Generally. negligence is defined as not doing something which a resonable person. guided by those ordinary considerations which or dinarily regulate human affairs. would do. or doing something which a resonable and prudent man would not do. Next. it describes how we can set the standard of due care in nursing practice. There is objective factors and subjective factors. And we also discuss about the limitation of due care in nursing practice. Finally. chapter IV deals with the case studies related to nursing negligence in the situation of determination. So this paper focused on nurse's intravenous injection. post operation nursing care. blood transfusion. and patient nursing care. The result of this paper is as follows. First. there are several cases dealing with nurse's negligence in nursing practice. however, those cases didn't judge nurse's due care based on individual -specific standard but general-objective standard. Second, there is a tendency to put an emphasis on the principal of belief to distinguish who has the liability in the case of medical malpractice among medical care team. So nurses shoud practice nursing care more actively to protect themselves and patients because there is an effort to form professional nurse system and the scope of nursing practice will be deeper and broader. Third, standard of care is a necessary element in establishing negligence. If a nurse is able to meet the standard of care, no breach will be found.

Analysis of Task Importance and Task Performance for Medical Insurance Review Nurses' Using the IPA Method (IPA를 활용한 보험심사간호사의 직무 중요도와 수행도의 인식차이)

  • Objectives : In this paper, we proposed a method to comprehensively examine the roles of medical insurance review nurses' by analyses of task importance and task performance. Methods : For the analyses, we used the responsesof 268 nurses who completed a questionnaire for members of the Medical Insurance Review Nurses Association in 2015, and analyzed task importance and task performance using the IPA method and the standard task guide. Results : There were significant differences in task importance and task performance according to task position. In the category of 'Keep up the good work,' 'Calculate benefit standard' was indicated only in administrative positions, and in the category of 'Concentrate here,' 'Manage hospital resources' and 'Process after appeal results' was demonstrated only in general positions. There were differences in the 'Low priority' and 'Possible overkill' categories by task performance according to task position. Conclusions : Our results indicate the necessity of a new education system and task reassignment according to task importance and task performance as perceived by medical insurance review nurses.

  • Safflower is a world-wide plant for multiple uses. flower of safflower is honghwa(紅花) which has been used for heart disease in oriental medicine. but its seed was not used in oriental medicine. after the publication of "Shinyak(神藥)" - the late 1980s, its seed(紅花子, hongwhassi) was known as good for bone fracture, osteoporosis and menopausal disorders. so many researchers studied hongwhassi and delivered lots of papers. the concern of each paper is different. this paper is a review paper. this paper studied documentary records about hongwhassi, and analyzed hongwhassi research trend. the trend consists of cultivation, ingredient analysis, osteoporosis, atherosclerosis, periodontal ligament and phytoestrogen. many papers lack of information about plant origin. so this paper supplements the standard form of plant origin(when sowing, where grow up, which direction, what kind etc).

  • By the development of medical devices, high-frequency medical devices are becoming widely used. Imaging diagnosis in hospital and clean treatment by high-frequency medical devices and cancer treatment through high-frequency heaters around us, all serve as the examples. However, it still lacks the measures to the problems of the RF(Radio Frequency) mutual interference between the high-frequency devices. In order to prevent the problematic factors for technical and industrial development, a new reasonable and suitable test method is required. In this paper, we study a standard test method for EMC evaluation to solve the RF mutual interference.

  • For suddenly encountered emergencies, most people embarrass, and can not often deliver the correct message when they report. Recently in the commonplace smart software environment, it is important that they can transmit the correct individual emergency situation efficiently and can receive the best service, and can provide the efficient emergency medical services to real-time around the other emergencies. In this paper, we design a standard protocol for the rapid and accurate technology for transmitting XML-based structured messages to provide an efficient emergency medical services, and offers a emergency medical services protocol to make them available more efficiently.

On the Use Factor Analysis and Adequacy Evaluation of CyberKnife Shielding Design Using Clinical Data

  • Although the current internationally recommended standard for the use factor (U) applied to CyberKnife is 0.05 (5%), the CyberKnife shielding standard is applied more stringently. This study, based on clinical data, was aimed at examining the appropriateness of existing shielding guidelines. Sixty patients treated with G4 CyberKnife were selected. The patients were divided into two groups, according to whether they underwent skull or spine tracking. Based on the results, the use factors for each wall ranged from 0.028 (2.8%) to 0.031 (3.1%) for the intracranial treatment and 0.020 (2.0%) to 0.022 (2.2%) for the body treatment. Excessive barrier thickness resulted in inefficient use of space and higher cost to the institutions. Furthermore, because the use factor is influenced by the position of the robot, the use factor determined based on the clinical data of this study would facilitate more reasonable treatment room design.

  • This study gives an account of the collateral standards in IEC 60601-1-3: 2008 specifying the general requirements for basic safety and essential performance of diagnostic X-ray equipment regarding radiation protection as it pertains to the production of X-rays. The collateral standards establish general requirements for safety regarding ionization radiation in diagnostic radiation systems and describe a verifiable evaluation method of suitable requirements regarding control over the lowest possible dose equivalent for patients, radiologic technologists, and others. The particular standards for each equipment can be determined by the general requirements in the collateral standard and the particular standard is followed in the risk management file. The guidelines for radiation safety of diagnostic radiation systems is written up in ISO 13485, ISO 14971, IEC 60601-1-3(2002)1st edition, medical electric equipment part 1-3, and the general requirements for safety-collateral standards: programmable electrical medical systems. Therefore the diagnostic radiation system protects citizens' health rights with the establishment and revisions of laws and standards for diagnostic radiation systems as a background for the general requirements of radiation safe guards applies, as an international trend, standards regarding the medical radiation safety management. The diagnostic radiation system will also assure competitive power through a conforming evaluation unifying the differing standards, technical specifications, and recognized processes.

Identification of Novel Standard Compounds for Standardization of Sinbaro3 Pharmacopuncture (신바로3 약침의 표준화를 위한 지표물질 검색)

  • Objectives To investigate and validate potential standard compounds for standardization of Sinbaro3 pharmacopuncture prepared at OO Hospital of Korean Medicine. Methods Sinbaro3 pharmacopuncture was prepared by extraction, purification and hydrolysis of Harpagophytum procumbens, and various potential standard compounds were quantified through HPLC-UV and HPLC-MS analysis. Validation was examined by assessing specificity, linearity, precision, and accuracy. Results The retention time of harpagide and cinnamic acid were 15.2 min and 28.2 min, respectively, and both showed good linearity in analysis by concentration at 0.9999 and 0.9998, respectively. Intra-day variation of precision was 0.0015~0.0045% and 0.0058~0.1629%, while inter-day variation of precision was 0.0011~0.0243% and 0.0098~0.1629%, and that of accuracy was 99.53~99.89% and 99.50~99.91%, respectively. Conclusions Harpagide and cinnamic acid, which are hydrolyzates of harpagoside within Sinbaro3 pharmacopuncture, were both validated using HPLC-MS and HPLC-UV analysis, and Sinbaro3 pharmacopuncture contained 78.41 ug/ml harpagide, and 2.05 ug/ml cinnamic acid.

Report on the Survey for the Necessity of Korean Standard Differentiation of the Symptoms and signs for the Stroke (한국형 중풍변증진단 표준안의 필요성에 대한 설문조사 보고)

  • This survey was accomplished in order to find out the necessity of creation of Korean standard differentiation of the symptoms and signs for the stroke(KSDS) in clinical practice. The survey questions were developed by the consensus from the professors who major in internal traditional Korean medicine(TKM). May 11th to July 31th 2005, the questionnaire was given to 800 TKM doctors in the whole country of Korea listed on the National Korean Medical Hospital Associations address book dy postal mail. Total of 358(44.7%) questionnaires were retrieved out of the 800 subjects. The 311 (86.9%) of 358 TKM doctors given an answer to the survey responded to need development of KSDS, and 176(56.6%) of 311 TKM doctors who answered to need development of KSDS responded to have to consider consensus of clinical experts on the stroke for creation of KSDS. These results support a role for new KSDS might be usefully applied in diagnosis and treatment of the stroke.

Comparison of Short Curved Stems and Standard-length Single Wedged Stems for Cementless Total Hip Arthroplasty

  • Purpose: The purpose of this study was to compare the clinical and radiographic outcomes with use of short-curved stems versus standard-length single wedged stems over a minimum follow-up period of five years. Materials and Methods: A retrospective study of primary total hip arthroplasties performed using the Fitmore® stem (127 hips, 122 patients) and the M/L taper® stem (195 hips, 187 patients) between October 2012 and June 2014 was conducted. The clinical and radiographic outcomes were obtained for evaluation over a minimum follow-up period of five years. Results: In both the Fitmore® and M/L taper® groups, the mean Harris hip score improved from 52.4 and 48.9 preoperatively to 93.3 and 94.5 at the final follow-up, respectively (P=0.980). The mean Western Ontario and McMaster Universities Osteoarthritis Index scores also improved from 73.3 and 76.8 preoperatively to 22.9 and 25.6 at the final follow-up, respectively (P=0.465). Fifteen hips (Fitmore®: 14 hips; M/L taper®: one hip, P<0.001) developed intraoperative cracks and were treated simultaneously with cerclage wiring. Radiography showed a radiolucent line in 24 hips in the Fitmore® group and 12 hips in the M/L taper® group (P=0.125). Cortical hypertrophy was detected in 29 hips (Fitmore® group: 28 hips; M/L taper® group: one hip, P<0.001). Conclusion: Similarly favorable clinical and radiographic outcomes were achieved with use of both short-curved stems and standard-length single wedged stems. However, higher cortical hypertrophy and a higher rate of femoral crack were observed with use of Fitmore® stems.
