  • The rapid growth of Korean SI (System Integration) industries have established the largest marketplaces in Korea. Due to the characteristics and importance of SI industry, SI contract between developer and outsourcer is very much important. SI contract have the specific legal characters of undertaking, trust, mandate and etc. However, this paper attempts to establish the particular legal system of SI contract.

  • It is imperative that Schools of Pharmacy push the frontiers of their science. Those professions that do not do their own research are technical fields and not professions. With that imperative it is important to develop a perspective on the historic evolution of research in Schools of Pharmacy, that was in concert with the subject matter of the professional curriculum, and has changed somewhat in modem times to reflect not only our professional program but also our mandate to graduate student education and training and to elevate the status of schools of pharmacy in research intensive universities. • The purpose of this work aims to analyse the principles of good faith under international transaction with CLOUT and UNILEX cases. Article 7(1) CISG sets the stage for the interpretation by promoting a uniform approach using good faith and the international charter of the convention. In other words, article 7(1) defines the purpose and the principle of interpretation and is applied to the Convention as a whole. As such, it also includes article 7(2), which goes beyond the big picture and settles the problems of gap filling. It is also important to understanding that the mandate of the CISG is to look for a solution, which is not only restricted to interpretation but extends to solving a problem. The problem in this work is to find out how gap filling is achieved and, because of the autonomous mandate of interpretation, to explain and understand its relationship with domestic law. The solution to the interpretation of article 7(2) must be found within the four corners of the CISG. To restate, article 7(2) describes two situations where gap filling is needed. First, if the matter is governed by the Convention but not expressly settled, then a gap must be filled in conformity with general principles on which it is based. Second, if the matter is not covered then the gap must be filled taking domestic law into consideration. There are two reasons why a matter may not be covered by the Convention. First and most obviously, it has been specifically exclude from the sphere of Application by the CISG itself, such as validity in article 4. Second, changes in business methods will lead to gaps. The United Nations has established a service known as CLOUT. This contains abstracts of hundreds of selected decisions of both courts and arbitration tribunals. And UNILEX is cosponsored by the Italian Centre for Comparative and Foreign Law Studies and UNIDROIT Contract Principles. The cases are in abstract format, but, when available, the full text of the case in the original language is also supplied.

  • This paper compares the English language programs of two maritime institutes in very different parts of the world, South Korea and Belgium. It will show that although both institutes comply with the minimum standard set by the STCW Code issued by the IMO, course contents and requirements can vary greatly. Method of class delivery, choice of learning tools and testing will be examined to illustrate some of these differences. This paper will show that in order to train new seafarers in the best possible way that will fulfill the IMO mandate of Safer Shipping and Cleaner Oceans, continual review and development of course curriculum should be an ongoing process that focusing on encouraging cadets to communicate in a targeted, efficient and professional way within a nautical context. This paper will show by comparison the huge potential that the Korean Maritime English program has for positive change and growth.

  • We have developed an optimization algorithm based formulation for performing efficient time driven simultaneous place and route for FPGAS. Field programmable gate array(FPGAS) provide of drastically reducing the turn-around time for digital ICs, with a relatively small degradation in performance. For a variety of application specific Integrated circuit application, where time-to-market is most critical and the performance requirement do not mandate a custom or semicustom approach, FPGAS are an increasingly popular alternative. This has prompted a substantial amount of specialized synthesis and layout research focused on maximizing density, minimizing delay, and minimizing design time.

  • Bladder cancer is one of the most common cancers affecting men and women and thus has a profound impact on health care. The majority of patients (75%) with newly diagnosed urothelial tumors have non-muscle invasive disease confined to the bladder mucosa or the lamina propria. The most important risk factors for the development of bladder cancer are smoking and occupational exposure to toxic chemicals. Painless visible hematuria is the most common presenting symptom of bladder cancer. Cystoscopy and urine cytology are currently the recommended tools for diagnosis of bladder cancer. Excluding muscle invasion is an important diagnostic step, as outcomes for patients with muscle invasive bladder cancer (MIBC) are less favorable. For non-muscle invasive bladder cancer (NMIBC), the high rate and frequency of recurrence and the concern for disease progression - especially in patients with high-risk tumors - mandate careful strategies for tumor surveillance. The surveillance strategies should be based on available prognostic factors and in particular data from the EORTC risk tables.

  • In this paper, we design and implement the public key certification the structure of assure information security which play an important role in PKI (Public Key Infrastructure). The structure of assure information security consists of Root-CA, Home-network and Foreign-network. CA will going to gave the mandate to Home-Agent or Foreign-Agent when they request. The structure of assure information security is various characteristic : more then high speed, mobile network, and low cost more then previous structure of assure information security.

  • Koreans are the most avid Internet surfers in the world according to Nielson/NetRatings(Reuters, August 2001) and most Internet connections are made through high-speed connections like Digital Subscriber Lines (DSLs). The result of such internet fervor is a nation that is fertile in both hackers and software companies(over 200 in the field of network security alone). However, by-product of Internet activity is cyber crime and the need to protect innocent users from the dangers of cyber criminals and cyber-terrorists be they are individuals or organized groups. Hence the Cyber Terror Response Team (CTRT) was organized in late 2000 with the mandate to fulfill that role. In these contexts, this study analyzes the actual conditions of cyber terror and suggests the countermeasures against cyber terror in Korea.

  • Fisheries resources, due to their intrinsic biological -density dependent, and socio- economic -common property nature, might yield the sustained benefits to the society involved, depending on the degree to which the social management scheme, pursuing the optimum yield from each of them, is framed. And besides, the success or failure of the management on them would, with no doubt, lead parallelly to the direction on scientific study of "Natural Resource Economics." Thus the objectives of the management, to ensue the best use of these society's resource, should underlie the technical, economic, ana social efficiency all together to meet the maximization of society's benefits from yields, taking account of managerial efficiency. And those multiple conflicts need communications between biologists, social scientists, and managers given tile mandate, tobe coordinated to arrive at a unique value weighed, through the well-ordered system approach and resulting timely decision-making which accommodates dynamical fisheries aspects and varying social purposes. purposes.
