ICC중재에서 중재비용의 결정과 할당에 관한 연구 (A Study on Determination and Allocation of Arbitration Costs in ICC Rules of Arbitration(1998))

  • The Arbitration costs provided in Article 31 consist of arbitrators' fees, arbitrators' expenses, ICC administrative expenses, expenses of experts appointed by the Arbitral Tribunal, and parties' costs. Among them the first three items are independently determined by the Court in accordance with the Scale, while another two items are determined by the arbitrator and each party. The three items determined by the Court are communicated by Secretariat to the Arbitral Tribunal for inclusion in the award following the approval of the draft submitted to the Court. Also the final award may decide which of the parties shall bear them or in what proportion they shall be borne by the parties. According to Article 31(3), the arbitrators have complete jurisdiction or discretion to allocate the costs. Three common approaches are as follows; First, all of the costs are borne by the losing party. Second, all of the costs are allocated in proportion to the outcome of the case. Third, all of the costs determined by the Courts are shared equally by the parties and both parties bear their own costs. But, both parties may include intentions in accordance with the principle of party autonomy. For example, if the parties wish to ensure that the arbitration costs be shared equally and that the arbitrator make no allocation of costs or fees, the following sentence could be added to the arbitration clause in their contract. "All costs and expenses of the arbitrators [and the arbitral institution] shall be borne by the parties equally; each party shall bear the costs and expenses, including attorneys' fees, of its own counsel, experts, witness and preparation and presentation of its case" And also, if the parties wish expressly to link any allocation of costs, and fees to the result of the award the following could be added to the arbitration clauses. "The arbitrators may award to the prevailing party, if any, as determined by the arbitrators, its costs and expenses, including attorneys' fees"

BIBFRAME 기반 복합문화기관 서지데이터 연계 구조 구축 (Construction of BIBFRAME-Based Bibliographic Data Linkage Structure for Multicultural Institutions)

  • 본 연구에서는 복합문화기관의 정보서비스를 지원하기 위해 기존의 복합문화기관에서 사용되는 서지데이터를 상호 연계할 수 있는 방안을 제안하였다. 이를 위해 MODS, EAD, CDWA 등 현재 복합문화기관에서 사용하고 있는 기존 메타데이터를 대상으로, 이들 표준을 FRBR 기반의 BIBFRAME 구조와 연계시킬 수 있는 연계 속성을 구성하였다. 연구 결과, 저작 계층, 인스턴스 계층, 개별자료 계층, 책임표시사항, 주제에 대한 기술요소를 BIBFRAME 기반으로 설정하였으며, 서지데이터의 연계를 위한 총 19개의 상위 요소, 18개의 하위 요소 및 12개의 연계 속성을 도출하였다. 이를 기반으로, 자료 유형에 따라 적용된 이질적인 메타데이터를 상호 연계할 수 있는 서지적 환경을 구축하였다. 이를 통해 복합문화기관의 분산된 서지데이터를 통합적으로 연계함으로써 보다 효율적으로 복합적인 정보서비스를 제공하는데 적용할 수 있을 것으로 기대된다.

디지털헬스케어 시장과 O2O서비스 소비자분쟁 및 보호방안 (A Study on the Consumer Disputes and Protection Measures of the Digital Healthcare Market and O2O Service)

  • The O2O services in the healthcare sector have only been in full swing for about three years, and unlike existing O2O consumer goods, the scale and scope of the dispute are more complicated due to restrictions on medical treatment. In this study, O2O service platform operators and medical institutions' roles and responsibilities were redefined as a countermeasure for resolving disputes in healthcare O2O services and the laws for changing the transaction environment. A change in institutional mechanisms was proposed. This study looked at the types of consumer disputes related to healthcare O2O services as insufficient information problems, problems in the course of medical service implementation, problems with immunity provisions for platform operators, cancellations, and non-compliance with refunds. All the information generated during transactions in the healthcare sector was extensive in scale and included the most sensitive information among personal information, stressing the importance of ensuring security. The area that started in the O2O range before the medical institution visit also proposed a plan to establish a system for the delivery of proven information as a pre-medical person. The scale and growth will grow faster, given that consumers can experience the information they want anytime, anywhere they want. However, the platform broker's role, a link player, will become more important because consumers who use the service will have their first meeting with non-face-to-face product providers. On the other hand, service providers may have side effects of misleading consumers by providing false information or misleading consumers through exaggerated advertisements. The O2O service market is expected to expand beyond distribution and dining out to the entire industry. However, since it is challenging to check accurate statistics on the detailed market, various disputes and consumer protection measures will be required for each detailed market, and comprehensive leading solutions will be essential in the future.

Use of Multimedia Technologies in Extra-Curricular Works in Order to Improve the Quality of Training of Future Specialists

  • The article deals with the role of extra-curricular work by means of multimedia technologies in order to improve the quality of training of future specialists. An important condition for achieving high results in training specialists is the optimal combination of classroom and independent extra-curricular work of students by means of multimedia technologies. Very significant is the development of student independence, the formation of skills of independent search activity, the ability to take responsibility, independently solve a problem, find constructive solutions, a way out of a crisis situation, and so on. Extra-curricular work forms students' ability to master the techniques of analysis, synthesis, generalization, comparison; develops flexibility of thinking; opens up opportunities for the development and stabilization of positive learning motives to activate the process of mastering knowledge by means of multimedia technologies as a means of forming the personality of a highly qualified specialist. The concept of multimedia as one of the priority areas of Information Technology, which plays a particularly important role in the process of informatization of education, is revealed, and its advantages in education are shown. The advent of multimedia systems optimizes transformations in education, in many areas of professional activity, science, art, etc. The necessity of distance learning to improve the quality of training of future specialists using multimedia technologies in extra-curricular work is justified. The effectiveness of pedagogical support in the process of distance learning is achieved by the following conditions, which is revealed in the article. Various forms and types of extra-curricular work of students that are used in the modern practice of the educational environment of a higher education institution are described. Scientific and informational activity is considered a key area of information activity. The analysis of scientific and information activities in the field of education allows us to identify its main functions, which emphasize the growing role of scientific information in the education system, in particular, extra-curricular work using multimedia technologies. Operational, complete, accurate, targeted information that meets objective and subjective needs becomes an important link between the field of management, science and practice.

영업사원의 거래처 수와 영업성과 간의 관계에 관한 연구 (The Link between Number of Sales Accounts and Salespeople's Performance)

  • Purpose - Previous research has shown that a very high level and a very low level of job scope can both be more stressful than intermediate levels of job scope. This study investigates the potential positive and negative effects of the number of accounts handled by sales personnel. The primary objective of this paper is to examine how the number of accounts salespeople handle affects their stress and performance. Research design, data, and methodology - This research conducted the data collection using a survey of salespeople in the pharmaceutical industry. I sent the survey to 420 salespeople, and received 318 usable responses. To assess measurement reliability and validity, I ran an exploratory and confirmatory factor analysis. I also employed structural equation modeling (SEM) to test all hypothesized effects in AMOS and also measured the interaction variable using Ping's (1996) approach. Results - These results show that there are linear and non-linear effects of the number of accounts handled by the salesperson on both role ambiguity and role conflict. First, the number of accounts handled by a salesperson is positively related to role ambiguity and role conflict. Second, the effect of the number of accounts handled on role ambiguity and role conflict decreases as the number of accounts handled by the salesperson increases. Third, as accounts increase from a low level, role stress increases; when the number of accounts reaches an optimal level, role stress decreases; and when the number of accounts increases to a high level, it can be detrimental to the salesperson's role stress. Fourth, while product complexity is positively related to role ambiguity, brand strength is negatively related to both role ambiguity and role conflict. Fifth, the greater the brand strength, the weaker the relationship will be between the number of accounts handled and salesperson role ambiguity. Finally, role ambiguity is positively related to salesperson performance. Conclusion - Too much and too little accounts increase the role ambiguity and role conflict of salespersons. Managers should identify the complex effect of the number of accounts handled by salespeople. Also, when products are complex, managers should provide training to eliminate any complex processes and complex information. These results suggest ways to decrease salespersons' role stress by ensuring an optimal level of the number of accounts and brand strength.

우리나라 고혈압 환자의 병원급 의료기관 외래이용 관련 요인: 한국의료패널자료(2010-2016)를 이용하여 (Factors Associated with the Use of Medical Care at Hospitals among Outpatients with Hypertension: A Study of the Korea Health Panel Study Dataset (2010-2016))

  • Background: As the prevalence of hypertension is increasing in Korea, the government is seeking policy actions to manage patients with hypertension more efficiently. In this paper, we aimed to identify factors associated with the use of medical care at hospitals among outpatients with hypertension. Methods: We analyzed a total of 15,040 cases of 3,877 outpatients with hypertension obtained from the Korea Medical Panel database from 2010 to 2016. The dependent variable was whether a patient with hypertension visited a hospital or not; and independent variables were the patient's various socio-demographic, health-related, and heath-status characteristics. We conducted a generalized linear mixed model analysis with logit link for all the cases and then conducted it stratified by gender. Results: As a result of a multivariable analysis, women were less likely than to visit at a hospital (odds ratio [OR], 0.44; 95% confidence interval [CI], 0.32-0.61) and people aged 65 years and older than those aged less than 65 years (OR, 0.71; 95% CI, 0.57-0.89). Residents in Busan, Ulsan, and Gyeongnam were more likely than those in than Seoul, Gyeonggi, Incheon, and Jeju to visit a hospital (OR, 1.40; 95% CI, 1.05-1.86). The likelihood of visiting a hospital was high in people belonging to a group of: the highest level of annual household income (OR, 1.73; 95% CI, 1.30-2.29); Medical care aid recipients (OR, 1.94; 95% CI, 1.34-2.83); people having three or more complex chronic diseases (OR, 1.59; 95% CI, 1.19-2.11); people having diabetes (OR, 1.81; 95% CI, 1.41-2.32); or people having ischemic heart disease or cerebrovascular disease (OR, 6.80; 95% CI, 5.28-8.76). Also, we found that factors associated with the use of medical care at hospitals among outpatients with hypertension differed between genders. Conclusion: A variety of factors seem to be associated with the use of medical care at hospitals among outpatients with hypertension. Future research needs to find a way to help patients with hypertension visit an appropriate medical institution between clinics and hospitals.

공공R&D 이전기술의 사업화 성공요인 분석 및 성과제고 방안 (Commercialization Success Factors of Transfer Technology from Public R & D and Enhancing Performance)

  • 공공 R&D 연구기관은 기업에게 좋은 기술공급처다. 그러나 낮은 사업화 성공률은 기업에게 고민꺼리다. 어떤 기술을 이전 받을 때 사업화 성공률을 높일 수 있을까? 본 연구에서는 대표적인 한국의 IT기술분야 공공R&D 기관을 대상으로 이전기술의 사업화 성공요인을 로지스틱으로 회귀분석했다. 분석 결과, 이전기술이 기업의 기존보유 제품과 연계성이 높고, 기술적 호환성이 높을수록 사업화 성공률이 높았다. 반면, 예상과는 달리 이전받을 기술의 개발과정에 기업이 공동연구로 참여한 경우보다는 독립적으로 기술이전 받을 때 오히려 상용화 성공률이 높게 나타났으며, 이전기술의 완성도는 유의한 영향을 미치지 않았다.

  • 공공기관의 정보보안에 관한 다양한 지침이 제정 및 개정되는 등의 일련의 절차와 배급 및 지침 준수에 따른 성과 제도 등 다양하고 다변화된 과정을 하나의 일원화된 절차에 적용하여, 한 번의 개정 또는 변화는 전체 정보보안을 위한 일원화된 절차에서 모든 단계적 환경 조건을 기준으로 적용되어지는 연구와 활용이 이루어져 왔다. 다만, 각 기관들의 업무 영역과 보유하고 유지 및 보안성을 확보해야 하는 대상의 차이가 너무 이질적인 형태의 정보로써 이를 하나의 안전성 확보를 위한 절차에 일련의 과정으로 연계하는 데는 아직도 문제점을 나타내고 있는 것이 사실이다. 또한 공공기관이 예산 반영을 기반으로 구성하고 연구한 결과를 지침으로써 고지하고 이를 민간기관에 재배포 및 구성하는 데에도 시간과 추가적인 경비는 연구목적을 달성하는 부분에 또 다른 문제이기도 하다. 따라서 본 논문에서는 유사기관의 정보보안 대상을 선별 및 통계학적으로 분류하고 이를 정보보안 안전성 확보를 위한 일련의 다양성과 다변화 과정을 거친 일원화 절차를 제안하고 제안된 절차에 적용함으로써 최적의 안전성을 확보하는 연구를 하고자 한다.

대학 특성화 사업 성과에 관한 연구-보건의료 데이터 사이언티스트 프로그램을 중심으로 (Achievements of Characterized Education for Healthcare Data Science Initiative)

  • 본 소고는 '대학 특성화 사업'의 헬스케어분야에 선정된 순천향대학교의 CK-1 사업단의 보건의료 데이터 사이언티스트 특성화 프로그램인 HDSI 성과에 관한 연구이다. 현 대학들의 HDSI 데이터 전문인력 양성 활성화를 위한 지원정책은 미진하나 해외 경우 전문인력 양성교육 및 과정 개발등 에 특성화하여 운영하는 경우가 많다. 또한 대부분의 HDSI 국내 인력양성 프로그램은 기업과의 멘토링·사례 공유 등 단기적 콘텐츠 위주로 협업이 이루어지고 있으나, 기업에서 요구하는 기술수준과 직무능력에 맞춘 교육을 제공하기 어려운 실정이다. 본 CK-1 사업단에서는 현재 대학의 HDSI 보건의료의 IT 교육이 급변하는 환경과 현실 간 괴리가 있음을 판단하고, 실무중심의 특성화 산학연계프로그램이 체계적으로 활성화될 필요가 있음을 강조하여 1) 실무형 Field Inside 교육 2) 융합형 트랙교육, 3) 회복탄력성 및 변화대응력 강화 교육의 3가지 특화전략을 갖고 추진되었다. 이는 한국연구재단에서 우수사업단으로 선정되었고, 종합평가에서 A등급을 받아 매우 유의미한 연구 성과로 인정받았다. 더불어, 본 특성화프로그램에 참여 학생들은 설문분석과 결과지표 분석을 통해, 만족도 유의미하게 상향되었음을 알 수 있었다. 이러한 HDSI 정량적 및 정성적 분석을 통해 특성화 사업의 과정, 결과와 성과를 비특성화 사업 참여 대학 및 일반에 알림으로서 CK-1 정책이 대학 경쟁력 강화에 얼마만큼 기여하고 있는지를 제시하고자 한다.

맞춤형 공공서비스제공을 위한 플랫폼 전자정부 구축방안에 대한 탐색적 연구: 행정프로세스와 행정정보시스템 개선측면에서 (An Exploratory Study on Construction of Electronic Government as Platform with Customized Public Services : to Improve Administrative Aspects of Administrative Processes and Information Systems)

  • 현재 우리 정부는 플랫폼 전자정부 도입을 서두르고 빅데이터와 클라우드 컴퓨팅 기술과 시스템을 모색하여 궁극적으로는 공공기관 각각의 이종 대민서비스를 단일창구에서 맞춤형으로 제공하고자 한다. 따라서 이 연구에서는 창구의 프런트오피스 민원인의 다양한 서비스 제공요청에 대응해서 백오피스에서 단일한 방식으로 맞춤형 공공서비스를 제공하기 위해서는 먼저 백오피스 차원에서 공공데이터가 연동되어야하므로 각 행정기관이나 부처의 공공데이터를 기반으로 백오피스에서 통합차원에서 민원인에 대해서 단일한 서비스를 제공할 수 있는 별도의 응용프로그램으로서 앱과 데이터 단위에서 공유를 효율적으로 수행하는 이종서비스 상호 간의 정보시스템 통합이 가능한 새로운 메타데이터정보시스템을 제안하였다. 제안된 시스템이 구현되면, 민원인의 프런트오피스 차원의 생활공간에 존재하는 서비스 수요사슬과 백오피스 차원의 공무원의 사무공간에서 이루어지는 서비스 공급사슬의 일원화를 통한 단일 창구에서의 연동이 유기적으로 되면서, 민원인에 대한 맞춤형 공공서비스 달성을 한발 앞당길 수 있다.
