A Study on the Obligations and Liabilities of Advising Bank in UCP 600 (UCP 600에서 통지은행의 의무 및 책임에 관한 연구)

  • This work intends to study the obligations and liabilities of advising bank in UCP 600. An advising bank has two big obligations as follows : by advising the credit or amendment, the advising bank signifies that it has satisfied itself as to the apparent authenticity of the credit or amendment and that the advice accurately reflects the terms and conditions of the credit or amendment received. An advising bank may utilize the services of another bank("second advising bank") to advise the credit and any amendment to the beneficiary. If a bank is requested to advise a credit or amendment but elects not to do so, it must so inform, without delay, the bank from which the credit, amendment or advice has been received. An advising bank has some problems in connection with the delay of advice and the advice of forged letter of credit.

A Study on the Household's Debt and its Determinants (가계의 부채보유여부 및 부채액에 대한 영향요인 분석)

  • Even if holding debt may be a rational means for household to maximize utility under any circumstance and any time through the family life cycle most households have some difficulty to determin and keep the moderate debt amount. The purpose of this study is to identify the characteristics of household's debt and the factor associated with debt. Data used in this study consisted of 4,009 households. The results of this study were as follows; Among 4,009 households 1,400 housholds?(34.9%) owed. Age education and occupation of household header liquid and real asset and housing ownership had significant effects on whether household having debt. The real and liquid asset had significantly positive relation with the liabilities of financial agency whereas the occupation of household header liquid asset and unearned income with private liabilities. Finally age education and occupation of household header home ownership and liquid asset had significantly negative effect on the total a ount of debt while earned and unearned income and real asset had positive one.

the Applying Differences of Excepted Perils in the Rotterdam Rules (로테르담 규칙하에서의 면책사유의 적용상 특징)

  • International maritime law conventions concerned with cargo liabilities have sought to achieve solutions which will be acceptable to a wide range of states. The Rotterdam Rules was approved by the UN Assembly on 11 December 2008. The Rotterdam Rules are intended to replace The Hague and Hamburg Rules. This paper is comparing The Rotterdam Rules with The Hague and Hamburg Rules for the carrier' liabilities and exceptions in order to find carrier' liability System, the burden of proof and exceptions in the International maritime Rules. The purpose of this paper is considering the carrier's principal recourse for defending himself inmost cargo claims. The first area analyze the transfer of carrier's fundamental Liability system in the International Rules. The second is the matter on the appointment of proof in order to establish liability or to be relieve of liability. And the third is the change of the carrier's possible exclusions from liability in the International maritime Rules. From the result of the said analysis, my paper suggests differences of the exclusions in the Rotterdam Rules comparing with the Hague and Hamburg Rules, and features of the Rotterdam Rules appling exceptions on the basis of the Hague and Hamburg Rules with regard to carrier's liability and burden of proof. The former is the inclusion of three exclusions, the deleted natural fault, and The provision making the carrier responsible for the acts of its servants or agents in the 'fire on the ship' of the Rotterdam Rules. The latter is deleting the principle of overriding obligation related to carrier's obligation of seaworthiness in the Rotterdam Rules, the burden of proof being diverted from the carrier to the carrier and the shipper in the cargo damage caused by two factors(one for which the carrier was liable and the other for which it was excusable) in the new rules.

Hospital's Financing Behaviors Based on Comparative Analysis of Trade-off Theory and Pecking Order Theory (상충관계이론과 자본조달순위이론에 기초한 병원 자본조달행태 분석)

  • Based on a previous literature about hospital capital structure(Shyam- Sunder & Myers, 1999), this study attempted comparison and analysis on whether the forecast of trade-off and pecking order theory could be validated in hospital's capital structure. First, this study analyzed whether hospitals follow the priority for each capital source as suggested by pecking order theory under lack of capital running in hospital. Next, it analyzed whether debt level is regressed on the average to target debt level so as to verify the validity of trade-off theory. Finally, it also analyzed possible associations between debt level and determinants of capital structure as adopted in static trade-off theory, so as to verify relative advantages of these two theories about hospital capital structure. The analysis over whole period showed that both trade-off theory and pecking order theory isn't supported particularly. This mean that each hospital's financing behaviors is different and that has not dominant financing behaviors. In the midst of separation of dispensary from medical practice, medical institutions in Korea first finances funds required using retained earnings and then use liabilities. however pecking order theory is supported, the preference of long-term liabilities and short-term liabilities is not clear. In addition, considering that debt level is in no average regression to target debt ratio, it is found that hospital capital structure following trade-off theory turns into that subject to pecking order theory via the separation of dispensary from medical practice.

Asset-Liability Analysis of Baby-Boomer Households: Comparison of year 2006 and 2011 (베이비붐세대 가계의 자산.부채상태 분석: 2006년과 2011년 비교)

  • This study gives an account of the state of baby-boomer households in regard to assets and liabilities utilizing the 2006 Household Asset Survey and the 2011 Survey of Household Finances. Using the data gathered from each year, this study examined the proportion of households who had each type of asset and liability, and the amount of them. This study also compared the amount of assets and liabilities of baby-boomer households with those of non baby-boomer households in 2006 and 2011 respectively. Finally, this study examined the amount of change and composition ratio of assets and liabilities of baby-boomer households between 2006 and 2011. Selected financial ratios were also presented for both years. Major findings are as follows. The average asset amount for baby-boomer households was approximately 296 million in 2006 and 392 million in 2011. Of total assets, 78% and 76.5% were real assets in 2006 and 2011 respectively. The average financial assets of 2006 baby-boomer households were approximately 66 thousand and the average amount of debt was 42 thousand. For 2011 baby-boomer households, the average amount of financial assets was 92 thousand and the average amount of debt was 73 thousand. Results from the 2011 survey showed that baby-boomer households had a significantly higher proportion of total assets, total debt, and net worth than non baby-boomer households. The proportion of savings, saving insurance, stocks, and mutual funds were significantly higher for baby-boomer households than non baby-boomer households in 2011. In regard to financial ratios, the emergency fund index and debt burden index were appropriate to the guidelines of asset quality, although the propensity to investment indexes were not.

  • This paper analyzes the firm's financial characteristics, influence over the adoption of the ISO 14001 adoption in our analyses. We used the T-test, a logistic regression analysis. We chose 112 Steel Enterprises from Korea Accreditation Board. The independent variables are current ratio, debt ratio, fixed assets to net worth and fixed liabilities, gross margin on sales, total assets turnover, net sales growth rate. This study tests three hypotheses on management performance of adoption of ISO 14001. The main findings are as follows. The first hypothesis is supported in terms of debt ratio, fixed assets to net worth and fixed liabilities, net sales growth rate at the 1%, 5%, 5% significance level. The second one is supported in terms of current ratio, debt ratio, fixed assets to net worth and fixed liabilities at the 10%, 1%, 1% significance level. The third one is supported in terms of gross margin on sales, total assets turnover at the 1%, 10% significance level. These findings have important implications
