Policy Suggestions for Soil Contamination Prevention and Management of Inactive or Abandoned Metal Mines (휴.폐금속광산지역의 토양오염관리정책의 평가)

  • Attempts were made to analyze the national policy of soil contamination prevention and management of inactive or abandoned metal (IAM) mines in Korea. This approach focused on legal systems and legislation, remediation technology development, and the arrangement or distribution of budgets pertaining to national policy since the mid 1990's. Prevention of Mining Damage and Recovery Act enacted. Defines the roles, responsibility and budget of the government when recovering mine damages. However, in 2005 there still remains to improve the national policy of soil contamination prevention and management of IAM mines. Analysis of national and industrialized foreign countries including the United States, the United Kingdom, and the Netherlands suggest the following improvements: i) arranging distinct regulations between strict and non-strict liability criteria for potentially responsible parties; limiting innocent and non-strict liability depending on the period of incurred mining activity, ii) enhancing participation of local communities by enforcing law and legislation, iii) establishing a national database system of (potentially) IAM contaminated sites based on the Website-Geographic Information System, iv) carrying out site-specific risk assessments and remediation of IAM contaminated sites, v) preparation and distribution of clean-up fund at mine sites adequately, and vi) technology development for the cleaning of IAM contaminated sites; awarding positive incentives of a legal nature for participants applying newly developed technology in IAM mines.

  • Under the Korean Marine Environment Management Act (hereunder, the KMEMA), the duty to arrange spill clean-up equipments, including spill clean-up vessels, required by the article 67 of the KMEMA is in essence the provision of public goods since it is a precautionary or preventive measure for the efficient performance of oil spill cleaning up. Also the obligation to control marine pollution and the duty to arrange of anti-pollution measures imposed on polluters is the obligation imposed by the public law in accordance with "the Polluter-Pays Principle". Therefore, the execution of such obligations shall be accompanied by the minimum legal and institutional arrangements. On the other hand, judging whether to form the roles of the public and private sectors in providing public goods is basically a matter of policy decision. However, even if the private sector is allowed to participate in the provision of public goods, it is imperative that a minimum requirement be provided to secure the public interest. Although major countries allows polluters to conclude a preliminary contract with a civil anti-pollution management company, these civilian institutions are in principle constituted by the owners of oil storage facilities. Additionally it is worth noting that it operates as a non-profit organization. In particular, if the practitioner performs pollution control for commercial purposes, their profitability may depend on the size of the pollution, the period spent on pollution control, the size of the equipment and manpower mobilized in the pollution control, and so on. Considering the above problems, caution should be taken to allow marine environmental management companies to be un-limitedly entrusted with the responsibility of arranging measures such as pollution control. In order to allow the marine environmental management contractor to be entrusted for the assignment of duty to protect the marine environment, the marine environment management business should be expanded so that the marine pollutant management capacity satisfies the statutory control capacity. For this purpose, it is necessary to manage and supervise the maintenance and improvement of the control capability of the marine environment management business. It is also necessary to discuss the introduction of the grading system for the control ability of the civil control companies alike in major countries.

Issue Analysis on the Deregulation of Telemedicine in the Digital Convergence Era (디지털 융복합시대에 원격의료 규제 완화에 관한 쟁점 분석)

  • The purpose of this study is to analyze various issues that may arise from the recent deregulation of telemedicine implemented by the government, propose initiative preparations for the implementation of telemedicine policies, and suggest implications for the basic conditions and direction of the deregulation of telemedicine. Recently, deregulation policy cases in telemedicine include that designation of a special zone for regulatory freedom in Gangwon Province, allowing physician-patient telemedicine and telephone counseling and prescription cases in the COVID-19 crisis. There are four main issues that could arise with the deregulation of telemedicine: safety, effectiveness, differences in access to health care and the economic industry, and legal responsibility. As a initiative preparation, this study proposed a pilot project for telemedicine and enhanced support for face-to-face care complementary tools, vitalizing remote co-operation, policy model that do not disrupt the medical delivery system, and legal maintenance. In conclusion, as a suggestion of basic premise and direction in the implementation of telemedicine deregulation, the implementation of initiative measures to address issues concerning telemedicine, the review and regulation of conditions to be considered in the implementation of telemedicine, and the establishment of a close communication and cooperative sturcture with medical providers.

Legislation Status and Legal Issues of Non-Face-to-Face Treatment (비대면진료 관련 입법 현황과 법적 쟁점)

  • An amendment to Medical Law allowing permanent face-to-face treatment has been proposed in the 21st National Assembly, with five different bills introduced. However, each proposed amendment focuses on different aspects, and the issue is currently in a state of 'ongoing review' due to factors such as opposition from the medical profession and political considerations. However, from the perspective that the introduction of non-face-to-face treatment should be institutionalized and legislated prioritizing patient safety, certain directions are proposed. These include focusing on returning patients as the primary target, chronic diseases as the focal conditions, outpatient medical institutions as the implementing agencies, restricting non-face-to-face means primarily to video systems, and legally exempting healthcare professionals from responsibility for incidents beyond their control. The proposed directions also emphasize establishing the right to demand face-to-face treatment. It is suggested to legislate initial standards that ensure a minimum level of safety and gradually expand the scope of non-face-to-face treatment through future research, evaluation, and similar step-by-step approaches.

The Occupational Health and Safety of Migrant Workers and the Migrantisation of Risk: A Case Study of the UK Construction Industry (이주노동자의 산업안전보건과 위험의 이주화: 영국 건설업 사례를 중심으로)

  • This study examines migrant workers' occupational health and safety issues through a case study of the UK construction industry, focusing on structural vulnerabilities. Migrant workers are at the bottom of the hierarchically fragmented labour market, performing outsourced hazardous work. Structural vulnerability focuses on the social structures that create hierarchies and increase risk in the workplace, rather than on individual responsibility or 'cultural' differences of migrant workers. The study considers the structural factors that perpetuate the migrantisation of risk in the UK construction industry, focusing on the structural necessity of low-wage migrant labour, precarious employment and the legal status of migrant workers, and discusses how these three factors interact to increase migrant workers' vulnerability to health and safety. The migrantisation of risk is not only a matter of occupational health and safety or universal workers' compensation, but also of the intertwining of labour migration policies with employment structures that rely on low-wage, low-skilled labour. This calls for proactive measures to address structural risks that go beyond passive declaratory policies that do not exclude migrant workers from education, training or legal systems.

A Study on the Proposal for Extension of Local Autonomy and Financial Atonomy of Local Education

  • The measures to extend local education autonomy are as follows: First, it is necessary to correct the confusion of the legal system of the local education autonomy system. For this, Article 12, Paragraph 2 and 4 of the 「Special Act on Local Autonomy and Decentralization, and Restructuring of Local Administrative Systems」 which state that "The State shall endeavor to consolidate systems for autonomy in education and local government" and "The implementation of autonomy in education and the autonomous police system shall be prescribed separately by Acts" should be deleted. Second, it is necessary to clarify unnecessary legal matters and regulatory measures for unification at the national level and to proactively consider the introduction of the legal trust system, in which education affairs are designated as local governments' own work and the state carries out specific affairs. The decentralization of local education finance is a key factor for the development of local education autonomy, and it requires the transfer of authority and resources to the region, and the enhancement of local autonomy and corresponding responsibility. First, the ratio of special grants must be adjusted further (from 3% to 2%) or the ratio of national policy projects must be lowered. Second, the provision that requires a consultation with a mayor/governor when making a budget covered by transfers from general accounts should be deleted. Third, it is necessary to remove the elements that limit the authority of city and provincial councils. Fourth, it is necessary to integrate the national education tax and the local education tax to create the education autonomy tax (tentative name) for only one independent purpose. Fifth, it is necessary to strengthen the distribution of the total amount of grants and abolish the settlement regulations for the measurement items of standard financial demand. Sixth is the expansion of the participation of stakeholders and experts in the grant distribution process. Seventh, it is necessary to establish a long-term employment system by designating the education finance field as a special field. Eight is the expansion of cooperative governance.

A Study on Consumer Arbitration System by Empirical Analysis on Redemption for Consumer′s Claim (소비자피해구제 실태분석을 통한 소비자중재제도 도입방안 연구)

  • The redemption system for consumer's claim is intended to deal with the conflicts between consumers and firms in their transaction of goods and service ensuring consumer's basic right. In general, the redemption system for consumer's claim requires promptness of redemption, free charge of claim procedure for consumers and constructive response of firms. However, the current redemption system in Korea has some limitations in its authority in the sense that it has only the right for mediation of consultation and agreement and thus the involved consumer should forfeit his/her claim or should go to legal suit which requires high cost and time when the mediation work is failed between two parties. As it is shown in result of survey on empirical cases produced by the Consumer Dispute Mediation Committee in Consumer Protection Board of Korea in 2001, the 20.3% of total claims have failed to reach final mediation, while the BBB case in the U. S. has recorded 19% of arbitration success after its failure in mediation. Therefore, it is strongly recommended for Korea to augment current. arbitration system toward assuring firm's cost liability, the principle of quick procedure through agreement on arbitration upon consumer's request. It is thus prerequisite for firms to be armed with the concrete entrepreneurship of responsibility on cost liability. In conclusion, we suggest restructuring of currently existing institution, rather than establishing new one through substantial augmenting the role of Consumer Dispute Mediation Committee In Consumer Protection Board of Korea and enlarging its business criteria of The Korean Commercial Arbitration Board by progressive development of the consumer protection program through amendment of current law for consumer protection.

  • Became large a problem we were productive movement of information became large and occurring to diffusions of development of public media and Internet use. While the Internet became a generalization, public media had more influences and risks, and a crime to abuse anonymity became large in cyber space. In addition, damage is becoming expanded reproduction that infringe of ' crime victim's rights of portrait'. The point that is most important in order to improve these points is recognition regarding the special situation of crime victim, and the ethic consciousness and independent operation regulation and regulation system that these point was taken into consideration in the public media and Internet operation that are an information producer is necessary, and Internet portal shall be included like Internet newspapers to the arbitration object of the Press Arbitration Commission. Also, a legal system regarding personal responsibility shall have for protection of a crime victim's rights of portrait by personal information activity for protection in cyber space. Suggest to a portrait of a crime victim, and an individual and social rights security effort are required for activation regarding an infringement relief system.

A Study of the Arbitration Issue on the KOREA and the U.S. FTA

  • International legal reviews on ISD, a procedure for resolving disputes under the Korea-US FTA, are examined from the perspective of law. If the ISD system does not exist, even if the investor suffers damage due to the illegal act of the host country, he or she must file a lawsuit through the court of the host country, which is unreasonable from the investor's point of view and makes it difficult to guarantee fairness and transparency. Some of the Koreans pointed out that there are some problems with the KORUS FTA dispute settlement regulations, and that the United States federal courts are taking a friendly attitude to the decisions made by the US Customs in determining the dispute by the KORUS FTA Agreement and the US Customs Act. In cases where the State does not violate international law but results in harmful consequences, the responsibility of one country is borne by the treaty. Foreign investment always comes with many challenges and risks. Therefore, the ISD system is a fair and universal arbitration system, which is considered to be a necessary system even for protecting the Korean companies investing abroad. In the investment treaty, compensation for the nationalization of foreign property and reimbursement under the laws of the host country were dissatisfied with foreign investors. In particular, some Koreans have pointed out that there are some problems in the KORUS FTA dispute resolution regulations and there is a need for further discussion and research. Based on the experiences and wisdoms gained in the course of Korea-US FTA negotiations, the dispute arbitration mechanism is urgently needed to reduce the possibility of disputes and to make amicable directions.

  • Sick House Syndrome(SHS) is the environmental health problem which is difficult to clarify a causal relationship and a responsibility. This paper is focused on a National Environmental Dispute Resolution Commission(NEDRC)'s judgment on SHS and the process of the change of knowledge and policies related to SHS. In the process of the resolving the SHS dispute, NEDRC functioned as a boundary organization, which helps stabilize the boundary between science and policy, and provides space of mutual collaboration and produces boundary objects. NEDRC had necessary characteristics and resources to make scientific knowledge and policies of SHS. First, it was important for SHS to define a problem clearly and to justify the related information whereupon legal authority was effective. In addition, for the procedure of deciding polities, the role of the Ministry of Environment(ME) was essential. However, due to the condition of ME, the discussion of SHS had been limited to the scope of dispute, excluding scientific discussion.
