부유식 초대형 해상구조물의 건설을 위한 법제도 개선에 관한 연구 (A Study on Improvement of Legal System for Construction of Very Large Floating Structure)

  • In this thesis the legal systems related to real estate and sea area utilization are studied in order to improve them for construction of Very Large Floating Structure. Main research subjects are as follows: 1) Whether can Very Large Floating Structure be accepted or not as real estate like house and land\ulcorner 2) How can the sea area which is occupied by Very Large Floating Structure be utilized\ulcorner As the conclusion, the Very Large Floating Structure can be registered as real estate even though it is not specified by Korean law for the present. The design concept of Very Large Floating Structure can be interpreted as satisfying enough necessary conditions and factors for Very Large Floating Structure to become real estate. In the near future, we have to make improvement on the laws related with the construction of Very Large Floating Structures so that private sectors can joint the construction. In additions, a new law for various floating structures should be made as soon as possible.

  • The purpose of this study was to analyze legal characteristics and issues of an underground pedestrian connection, which is a very useful tool to create 3D pedestrian networks and the vibrant underground environment. To do this, this paper explored the related laws to install the connection and analyzes 74 cases of Jung-gu, Seoul to find major issues. Then, it defined the legal characteristics in terms of not only the laws but also property law in Korea, thereby suggesting the improvement schemes. As a result, this paper concluded that the connections can be installed by an Urban Planning Facility or a Road Occupation Permit, but should be considered their public interest. In addition, exactions or fees for the permit should be carefully implemented based on the characters of the connection.

  • 본 연구는 65세 이상의 고령자를 대상으로 하는 '헬스케어기반의 고령친화적 스마트홈' 조성을 위해 현행 관련 법제도의 한계에 기인하여 국내외 법제도를 비교법적인 분석을 통해 개선방안을 살펴보고자 한다. 이를 위해 원격의료 시행을 전제로 관련 법제도는 '헬스케어'와 '고령친화' 그리고 '스마트홈 관련 법제도로 크게 3개 부문으로 나누어 고찰했다. 헬스케어 관련 법제도는 국내 의료법에 의해 원격의료를 시행하고 있지만, 의료진과의 정보교환(원격자문 역할)으로 제한을 두고 있다. 국외사례를 토대로 원격의료(모니터링)를 위한 개념 및 제반 사항에 대한 정의 등을 규정할 필요가 있으며, 고령친화 관련 법제도 분석 결과, 고령자에 대한 정의가 불분명하며 보건의료체계에 대한 정비가 필요하다. 이러한 분석 결과를 토대로 관련법제도 개선의 필요성을 인지하고 현행 관련 개별법에 대한 개정을 통한 법제도의 정비와 신규 법률 제정을 통한 개선방안을 제시하였다. 본 연구는 국내외 관련 법제도의 비교법적인 분석을 통한 개선방안을 제시하는 것이지만, 두 가지 대안은 각각의 장단점을 가지고 있어 어느 것이 최선의 선택이라고 결론을 내리기 어려운 것이 본 연구의 한계이다.

블록체인 기반 서비스 확산을 위한 개선 방안 연구 (A Study on Improvement for Service Proliferation Based on Blockchain)

  • 본 연구는 블록체인 기반 서비스의 확산을 위한 방안 연구로서 블록체인 기술에 대한 한계요인과 이를 개선하는 방안에 대해 전문가의 의견을 수렴하는 델파이 기법으로 연구하였다. 한계요인과 개선방안을 기술, 서비스, 법 제도 측면으로 분류하였다. 첫째, 기술측면에서 기술 관련 표준화 부재, 통합성 미비, 확장성 미비, 취소, 정정 정책 부재, 거래 검증비용 과다발생, 보안미비를 한계요인으로 제시했다. 이를 개선하기 위해 각 관련 기관이 협력하여 표준화 확보, 시스템의 통합성 확보 및 확장성 확보, 각 적용되는 데이터에 대한 취소, 정정 정책 수립, 검증비용 효율화와 보안 대비 방안으로 모색하여야 한다. 둘째, 서비스 측면에서 한계요인은 초기단계로 활용성 미비, 보안위협 대응 미비, 전문 인력 부족을 제시하였다. 이에 대한 개선방안으로 다양한 서비스에 적용할 수 있는 지속적인 활용방안에 대한 연구가 이루어져야 하며 서비스에 대한 철저한 보안대응 방안을 준비하고 전문 인력 양성을 통해 시장에서 필요로 하는 인재를 확보할 수 있어야 한다. 셋째, 법제도 측면은 법적대응 미비, 규제의 불확실성 및 관련 규정미비의 한계점이 있다. 서비스 활성화를 위한 가장 중요한 영역인 법 제도는 정부의 관련 부처에서 법적대응 안 마련, 규제의 명확성 및 대응 방안 수립이 필수적으로 동반되어야 한다. 본 연구는 블록체인 기술 관련 연구에 도움이 될 것으로 기대된다.

  • It is noted that the disaster such as fire, explosion, collapse has been rapidly increased caused by strength deterioration of steel structures at petrochemical plant during fire. In this regard, it is stressed out that the legal requirement for fire proofing for steel structures at petrochemical plant should be carefully reviewed since the current legal requirement such as Industrial Safety & Health Law, Architectural Law has a conflict and different way of approach. In addition, it is our point of view that the present law should be revised to consolidate into single law including engineering design criteria to reflect unreasonable legal requirement. It is further our point of view that the performance certificate for fire proofing like UL-1709, basis of maintenance should be appropriately and reasonably provided in line with global practice.

Research on improvement of law for invigorating autonomous vehicle

  • The Korean government announced its goal of commercializing autonomous vehicle by year 2020. With such changes, it is expecting to decrease car accident mortality by half. To commercialize autonomous car, not only worries on safety of autonomous vehicle has to be solved but at the same time, institutional system has to be clear to distinguish legal responsibilities in case of accident. This paper will present the legal improvement direction of the introduction of autonomous vehicles as follows. First, it is necessary to re-establish concept of 'driver' institutionally. Second, it is appropriate to focus on Level 3 autonomous vehicle which is about to be commercialized in year 2020 and organize legal responsibility. Third, we should have a clear understanding on how level 3 autonomous vehicle will be commercialized in the future. Fourth, it is necessary to revise The Traffic Law, Act on Special Cases concerning the Settlement of Traffic Accident, and Automobile Accident Compensation Security Law in line with level 3 autonomous vehicle. Fifth, it is necessary to review present car insurance system. Sixth, present Product Liability Law is limited to movable products (Article 2), however, it is necessary to include intangible product which is software. Seventh, we should review on making special law related to autonomous car including civil, criminal, administrative, and insurance perspectives.

소방업무 제도개선을 통한 심리적 불안 요인 감소 방안 (A Study on the Reduction of Psychological Unrest Factors through the Improvement of Fire Service System)

  • The purpose of this study is to identify psychological anxiety factors related to firefighters' field activities and suggest improvement measures. To investigate the actual status of psychological anxiety factors, a survey was conducted on approximately 3,500 current firefighters, and the responses of 505 people who participated in the survey were analyzed. As a research method, frequency analysis and cross-analysis were conducted according to the general characteristics of the participants to determine the actual level of psychological anxiety in each work field and the results were analyzed. As a result of the analysis, it was statistically confirmed that firefighters feel a lot of psychological burden due to legal and institutional inadequacies during dispatch, return, or field activities, and frequent friction with civil servants is also a major cause of psychological anxiety. Therefore, based on the results of this study, it is proposed to establish a permanent legal support team in each city and province, designate and operate a hospital dedicated to psychological treatment, and establish a special provision for traffic accidents during the return of fire trucks so that firefighters can concentrate on their duties without psychological anxiety. do.

국내 제조업 화재감시자 운영의 문제 확인 및 개선방안 (Identification of Problems and Improvement Measures of Fire Observer Operation in Domestic Manufacturing Industry)

  • Sparks cause most fire and explosion accidents in the manufacturing industry during hot work, which ignites surrounding combustible materials. Such incidents lead to high casualties due to suffocation from toxic gases and lack of evacuation. Therefore, the government recently enacted and revised 'The Occupational Safety and Health Act' to prevent fires and explosions at work sites, incorporating legal standards for fire observers, which are important in preventing accidents and the spread of fire during hot work. However, there are notable shortcomings in conducting professional cause analysis of these accidents and in aligning them with advanced foreign legal standards. Additionally, there is a lack of literature review reflecting the manufacturing industry characteristics. Despite the recent enactment and revision of legal standards, gathering sufficient opinions and professional reviews remains insufficient. To address these gaps, interviews were conducted with safety and health workers, analyzing recent fire and explosion causes in domestic manufacturing industries, and reviewing both domestic and international legal standards. Conclusively, proposed improvement measures were centered on the professionalization of fire observer education, enhancing their roles and authority realistically, and improving fire observer placement and operation standards. Consequently, additional 'Occupational Safety and Health Act' standards are necessary for fire observer education and defining the government's role. Second, precise legal standards outlining the role and authority of fire observers are required. Third tailored fire observer arrangements and management standards appropriate for varying work characteristics and company sizes are required. This study emphasizes the importance of supplementing relevant legal standards to prevent fire accidents in the manufacturing industry.

  • The article is devoted to the issue of the content of legal instruments in terms of tourism business, namely the problems of legal regulation of insurance in tourism. The analysis of the state of development of the problem in question shows that the issue of legal regulation of the insurance contract in general and the contract in tourism services, in general, is insufficiently studied. The article is devoted to topical issues of legal regulation of insurance in the field of tourism, the search for effective mechanisms to increase the liability of both underwriters and insurers. Therefore, insurance can be considered as one of the methods of preventing unfortunate consequences during the implementation of tourism activities. The author's vision of the content of the package of measures that can positively influence not only the development of the tourist industry in general but primarily to help identify those legal segments that need improvement in the future has been stated.

해양안전 확보를 위한 소형어선 법제도 개선에 관한 연구 (A Study on the Advancement of the Legal System for Small Fishing Vessels to Ensure Marine Safety)

  • 대한민국 정부는 해양사고 예방 및 해양안전 확보를 위해 지속적으로 법제도를 개선하고 있다. 그럼에도 불구하고 최근 해양사고는 계속적으로 증가하고 있어, 그동안 정부의 해양안전관련 법제도 개선방안 실효성은 미흡했음을 시사하고 있다. 최근 해양사고의 발생현황을 살펴보면, 전체 해양사고 건수 중 총톤수 10톤 미만의 소형어선이 차지하는 비중은 5년('13~'17년)평균의 44.9 %를 차지하고 있다. 이에 따라 본 연구에서는 해양사고 비중이 높은 소형어선의 해양안전 확보방안을 모색하기 위해, 관련 국내외 법제도의 현황과 특징을 조사 및 분석하였다. 그 결과, 국내 소형어선 관련 법제도는 어선과 비어선의 관련법이 통합('97)되고 분법('09)된 이력에 따라 접목교잡(接木交雜)의 현상을 보이고 있으며, 제도의 개선방안은 안전설비의 비치강화라는 단편적인 개선만 이루어 졌다는 문제점이 식별되었다. 또한, 해외 관련 법제도에서는 어선 소유자 및 운항자의 책임강화 및 자율검사제도 도입 등의 특징이 확인되었다. 본 연구에서는 이를 바탕으로 국내 해양안전 확보를 위해 실효성 있는 소형어선 법제도 개선방안을 제시하였다.
