Comparative Study on Legal System on Cybersecurity Stages in South Korea and the United States (한국과 미국의 사이버보안 단계별 법제도 비교 연구)

  • Existing comparative studies on legal system of cyber security just listed and introduced several laws of Korea and other countries and presented comprehensive comparison. These studies makes it difficult to know that which part of the cyber security activities has insufficient legal system from a practical standpoint because it is not easy to figure out. So cybersecurity stages are chosen as comparison criteria. And the legal system of United States are chosen as the target comparing one of South Korea. Then the legal system on cybersecurity stages in South Korea is compared with one of United States. Therethrough many problems of the legal system of South Korea is identified, for example, the absence of regulations, the lack of clarity, lack of effectiveness, and overlapping regulations, in prevention, detection, response, the recovery in cyber security. And many ways are suggested to improve the legal system for the resolution of such problems.

  • As 4th industrial revolution has emerged as a hot topic, the blockchain technology capable of enabling super intelligence as a premiere has been an attracting attention. With the interest in blockchains, various platforms using blockchains are emerging. Reflecting this trend, several countries including US, EU, China, and Japan are preparing blockchain and related laws or amending existing laws. In Korea, the platform business based on blockchain is being done, but the related laws are insufficient. In this study, we first present the legal system of the blockchain, examine each component, and then compare the current state of the legal system in US, EU, China, and Japan based on the blockchain legal system. Finally, we propose a brief improvement plan of the legal system for industrial development by commercialization of blockchain. In the future, we would like to study the individual legal system about the blockchain.

  • Improving the legal system is one of the key points in strengthening the control of environment . The coordination of economic development with environment protection and the legislation in Guangdong since 1980 is described. Some proposals for stimulating the economy by enhancing the environment protection in accordance with the law are offered.

Due to the characteristics and importance of SI industry, SI contract between developer and outsourcer is very much important. SI contract have the specific legal characters of undertaking, trust, mandate and etc. However, this paper attempts to establish the particular legal system of SI contract.

  • International factoring is very useful to transfer credit risk, to promote cash flow, to collect debt and to reduce cost and expenses. However, International factoring system in china shows imperfection especially in gap of legal vacuum and its limit to be developed. Here I suggest a practical alternative for development of International factoring system in china as follow. First, legal environment in China for factoring system should be rearranged. Even law and contract law have relative clauses for factoring system there are many difficulty to be applied. It is necessary to prepare legal ground for factoring system. Second, without recourse for International factoring system should be fixed. Without recourse is the essential point for factoring system in international trade. In fact chinese factors are partially applied only for those big global companies. However International factoring system is especially useful for small-medium companies lacked of a good credit rating. It is necessary to promote special factors by combining financial organizations as it does in developed countries. Third, they need to make legal ground to prohibit unlicensed factoring companies. Forth, they need to educate usefulness of factoring system. The settlement system in China is to be developed by systematic researches and promotion for International factoring system.

  • The forestry development policies and projects in Korea have been implemented under various related acts. These acts include the Framework Act on the National Land and Framework Act on Forestry enacted by each administration. However, there are some limitations to encourage a variety of mountain villages and forestry development policies due to duplication and overlap between the relevant acts. Nowadays, the fields of local development have evolved and become integrated not only by infrastructures but also in various fields such as multi-functional industries including tourism, green care, cultural welfare, etc. Therefore, the current legal system may not effectively accept and support various mountain village development policies and projects. This study tried to determine the necessity of reorganizing th-e related legal system through a field survey of planners, residents and analysts regarding the correlation between legal systems and projects. For these reasons, this study tried to determine the problems of the current legal system and then, suggested alternative methods related to the legal system for integrated rural development. The scope of the study is as follows: 1) correlation analysis between relevant laws and development projects and 2) field survey to determine the legitimacy and validity for the reorganization of the legal system.

  • This study proves that the quoted legal text functions as the index which represents the contents of the text because of the characteristics of legal information, the automatic indexing in the secondary legal full-text databases can be possible without the assitance of the experts. In case of the establishment, amendment or repealing of law, change of words of index can be possible through revising the legal text quoted in the secondary legal full-text databases. Even when we dont input the full-text about retrospective documents, automatic indexing is also possible, and the establihment and the practice of expert knowledge and integrated databases are possible in case of the retrospective documents. This study indicates that it is necessary to have characteristic information the information experts recognize - that is to say, experimental and inherent knowledge only human being can have - built-in into the system rather than to approach the information system by the linguistic, statistic or structuralistic way, and it can be more essential and intelligent information system.

  • Legal deposit system is an important legal instrument for national libraries. But the law or act based on print materials in many countries predates the current information age and requires a new legal framework in order to encompass electronic publications. Many national libraries, therefore, are seeking to encourage their governments to establish legal deposit for publications in the whole range of formats. The purpose of this paper is to analyse a world-wide trends of the legal deposit system for on-line publications as well as off-line materials. The result of this analysis will be used to develop a new model of legal deposit system in Korea.

  • All publications of a country is a cultural heritage with the spirit of humanity, each National Library has to collect and preserve all publications produced in each country. Acquisition activity(Collection development) of each National Library is supported by a powerful legal deposit system. Therefore, this study has analyzed the legal deposit systems of the world countries, especially focussed whether or not the compensation for legal deposit, whether or not any sanction against not-depositing, Fine collection procedures against not-depositing, and the specific process for legal deposit. Based on these investigations, this study was to seek ways to contribute the legal deposit rates of National Library. It has proposed the following suggestions; Performing of legal deposit duty by itself, developing the system for supporting the legal deposit, establishing newly of legal deposit department, and improving the compensation for the legal depositor.

  • The National Library of Korea recently proposed a draft of an Act on Legal Deposit and Use for the Online Digital Products and researches about deposit system and remuneration of the digital products are in progress. Based on the law of library and copyright, remuneration of deposit and use products is paid. A draft of a proposed law include information about the remuneration payment. For these reasons, the method for efficient remuneration management is required. In this paper, we propose effective remuneration management system which follows a draft of an Act on Legal Deposit and Use for the Online Digital Products.
