A Suitability Analysis on the legal standards of the Rural Housing Standard Plans (농촌주택 표준설계도의 관련 법적 기준에의 적합성 분석 연구)

  • The Rural Housing Standard Plans for improving the quality of life and housing stability in rural areas has been developed 87 types from 1994 to 2012. However, some types of Plans do not satisfy the current legal standard in accordance with social and legal changes. Standard plans has the same effect as a building permit, and replace it, so legal suitability of Plans is an important. Therefore, it is required the suitability analysis on the legal standards of Rural Housing Standard Plans. The Purpose of this study is to derive improper types and items of the Rural Housing Standard Plans on the legal standards. In this study, we analyzed its suitability on the legal standards(law on fire-fighting system installation and safety management, energy saving design criteria for buildings, structural checklist for small buildings, the types of drawing for building permit) in accordance with "rules for the operation of standard plans". And we analyzed the utilization of the Rural Housing Standard Plans through downloads from welchon portal.

  • Building Information Modeling (BIM) has the great possibility of transforming the AEC industry. BIM will require increased information exchange and mutual collaboration between all stakeholders. BIM implementation and such increased collaboration can affect legal issues and contract provisions. And some legal issues accompanying BIM Implementation will be raised while a large change also comes in responsibility and role between all stakeholders. However, current standard agreement system is based on fragmented agreement between the architect and the owner, and between the owner and the contractor. Another legal obstacles and considerations associated with BIM implementation will be arose from BlM technology and use of BIM. AEC professionals in Korea have long utilized the standard agreement forms as well and look forward complementation of current standard agreement for BlM implementation. Such complement direction for the standard agreement will be examined by investigating the legal issues and overview comparison between AlA E202 and ConsensusDOCS 301.

  • Corporation had been made by important action rule of business ethics that observes legal standard that is prescribed in each class of administration activity. But it does not keep ethicality of corporation action that conforms law. Law can not include all parts of business ethics because it is forcing essential class for public order preservation and public welfare in right. Moreover, partial corporations are doing to justify unethical action of other evasion of taxes, consultation, manufacturing etc. with legal basis meaning abusing legal standard. For these reason, Insistence that is in point of legal standard and ethical standard is not different each other that is in equal viewpoint is brought.

  • Regardless of which country, all public libraries need facilities, collections, and funds. But how well the library system succeeds depends on the staff committed to providing the highest possible level of service to the community. The public library, therefore, should employ the appropriate number of full-time staff. In order to warrant such a work force, this study analyzed the juridical justification, logical validity, realistic fitness, and usefulness of current legal and recommended staffing standards. This study also suggested the revisions of total space of buildings and collection size as crucial variables for library staffing, division of legal service populations, basic staffing level, and additional staff in proportion to service populations for public libraries in Korea.

  • While Korea does not have any legal statement on surrogacy, treatments are carried out in practice. As a result, every Institutional Review Board (IRB) of each fertility clinic faces an ethical predicament in reviewing each case. There is a need to arrange the institutions' own standards of surrogate pregnancy procedures before the establishment of national or professional regulation. This article examines the legal, social, and medical issues of surrogacy to help IRBs to judge their cases.

Nurse Staffing Levels and Proportion of Hospitals and Clinics Meeting the Legal Standard for Nurse Staffing for 1996~2013 (의료법에 의거한 의료기관 종별 간호사 정원기준 충족률 추이 분석)

  • Purpose: To analyze the proportion of medical institutions meeting the legal standard for nurse staffing. Methods: Data collected from 29,282 institutions between 1996 and 2013 were analyzed. Nurse staffing was measured as daily patient census per registered nurse (RN). The standard for general hospitals, hospitals, and clinics is 2.5 or less, and that for long-term care hospitals is 6.0 or less of the daily patient census per RN. Clinics may substitute nursing assistants for RNs by 50% or 100% depending on their daily inpatient census; long-term care hospitals may substitute nursing assistants for RNs by two thirds of the required number of RNs. Results: The proportion of general hospitals, hospitals, clinics, and long-term care hospitals meeting the standards was 63%, 19%, 63%, and 94%, respectively, in 2013. While general hospitals had an increase in the proportion during the 1996-2013 period, small changes were found in hospitals and clinics. In 2013, nurses were estimated to care for 16 (interquartile range: 12~24) patients per shift in general hospitals. Three quarters of clinics had no RNs in 2013. Conclusion: Many medical institutions did not meet the legally mandated minimum staffing level. The government must implement policy actions for all medical institutions to meet the legal standards.

  • Legal sources of fraud rule in documentary letter of credit, which have their origin in Sztejn Case can be traced to various rules or laws of international or domestic level ; URCG, URDG and ISP98 as ICC Rules, and UNCITRAL Convention as an international uniform law, and UCC as a domestic law and U.K. cases. Among them the combination of "material fraud" in UCC ${\S}5-109$ and the detailed list of the types of misconduct in UNCITRAL Convention may provide the best solution or standard in real application of the fraud rule in letter of credit transaction.

  • Commercial transactions, one of the pillars of the capitalist economy, are occurring countless times every day, especially small and medium-sized businesses. However, small and medium-sized enterprises are bound to be the legal underdogs in contracts for commercial transactions and do not receive legal support for contracts for fair and legitimate commercial transactions. When subcontracting contracts are concluded among small and medium-sized enterprises, 58.2% of them do not apply standard contracts and sign contracts that have not undergone legal review. In order to support small and medium-sized enterprises' fair and legitimate contracts, small and medium-sized enterprises can be protected from legal threats if they can reduce the risk of signing contracts by analyzing various risks in the contract and analyzing and informing them of toxic clauses and omitted contracts in advance. We propose a risk prediction model for the machine reading-based legal contract to minimize legal damage to small and medium-sized business owners in the legal blind spots. We have established our own set of legal questions and answers based on the legal data disclosed for the purpose of building a model specialized in legal contracts. Quantitative verification was carried out through indicators such as EM and F1 Score by applying pine tuning and hostile learning to pre-learned machine reading models. The highest F1 score was 87.93, with an EM value of 72.41.

  • Product liability is an important regulation factor in automotive industry. ISO 26262 international standard was established as an exemption clause of product liability. In autonomous car, product liability becomes more important, and ISO/PAS international standard was additionally established, but it can be applied to only sensing stage, which can partly make the autonomous car companies exempt the product liability but not completely. Therefore, reform of current legal system is absolutely necessary to commercialize autonomous car until a new international standard is established as a complete exemptions clause.
