A Comparative Analysis of Legal Deposit System for Electronic Publications (국내외 전자출판물 납본제도의 분석)

  • Legal deposit system is an important legal instrument for national libraries. But the law or act based on print materials in many countries predates the current information age and requires a new legal framework in order to encompass electronic publications. Many national libraries, therefore, are seeking to encourage their governments to establish legal deposit for publications in the whole range of formats. The purpose of this paper is to analyse a world-wide trends of the legal deposit system for on-line publications as well as off-line materials. The result of this analysis will be used to develop a new model of legal deposit system in Korea.

  • National libraries have an obligation to meet the information needs of users by collecting as many various materials as possible. As legal deposit accounts for the highest percentage of the collection building methods of national libraries, they are trying to encourage the legal deposit of the publishers. However, the rate of legal deposit for the most publishers are pretty low. Therefore, in this study, the improvement plans of legal deposit system for the purpose of helping legal deposit of national libraries improve smoothly has been investigated by identifying the problems with the legal deposit system that publishers had and by suggesting the matters that should be improved based on the recognition of legal deposit by publishers. The plans for the revitalization of legal deposit for the publishers are as follows: promoting factors of legal deposit systems such as scope, deadline, compensation, fine and legal deposit libraries, simplification of legal deposit procedures, set-up of automated online system for legal deposit and strengthening of the method for promoting and educating the legal deposit.

  • This study was conducted to confirm the research trend related to law librarians abroad. To this end, we collected articles about law librarians from abroad and analyzed the author's keywords and abstracts. As a result, it was confirmed that the primary roles of law librarians are legal research service, legal information service, and education service, and discussed topics on the changed roles of law librarians according to changes in the legal research environment and strengthening their expertise. Based on the results, the issues and directions for research about law librarians in Korea were proposed.

  • In this paper we describe an application of the lexical resource JurWordNet and of the Core Legal Ontology as a descriptive vocabulary for modeling legal domains. It can be viewed as the semantic component of a global standardisation framework for digital governments. A content description model provides a repository of structured knowledge aimed at supporting the semantic interoperability between sectors of Public Administration and the communication processes towards citizen. Specific conceptual models built from this base will act as a cognitive interface able to cope with specific digital government issues and to improve the interaction between citizen and Public Bodies. As a Case study, the representation of the click-on licences for re-using Public Sector Information is presented.

  • Building Information Modeling (BIM) has the great possibility of transforming the AEC industry. BIM will require increased information exchange and mutual collaboration between all stakeholders. BIM implementation and such increased collaboration can affect legal issues and contract provisions. And some legal issues accompanying BIM Implementation will be raised while a large change also comes in responsibility and role between all stakeholders. However, current standard agreement system is based on fragmented agreement between the architect and the owner, and between the owner and the contractor. Another legal obstacles and considerations associated with BIM implementation will be arose from BlM technology and use of BIM. AEC professionals in Korea have long utilized the standard agreement forms as well and look forward complementation of current standard agreement for BlM implementation. Such complement direction for the standard agreement will be examined by investigating the legal issues and overview comparison between AlA E202 and ConsensusDOCS 301.

Legal Deposit and Preservation of Digital Materials in Various Countries (디지털자료의 납본과 보존을 위한 각 국가의 노력)

  • Legal deposit system is an essential tool for a national library to ensure the preservation and access to a nation's intellectual heritage over time. Substantial amounts of digital materials of national cultural value are already being published. There is a global trend towards extending legal deposit to cover digital materials in order to maintain comprehensive national archives. This paper gives a progress report of some countries around the world whose legal deposit laws have already updated or are under revision. Some strategies are suggested for the digital collection building of the Korean National Digital Library which will open in 2008.

  • It is no doubt that information technology is the key factor of national safety. Information technology is positively useful for national security such as crime prevention and detection, criminal investigation, disaster management, and national defense. However, it might be a threat to the security as we saw in the examples such as '3.4 DDoS attacks' and 'Nong-hyup Computer Network Failure.' Although the effect that information technology makes upon the national security is immense, the current legal system does not reflect these changes well. National security should be kept during 'prevention-response-recovery' process regardless it is in the online on offline. In addition, public administration for national security should be based on laws. However, the current legal system is lack of legislative basis on cyber and physical disaster, and the laws on the response to disaster might cause confusing. Therefore, this study examines the limitation of the current legal system on national security, and suggests directions for the development of the system based on the new establishment of the legal concept for 'national security'.

A Study on the Reform Model of Legal Deposit System in Korea (한국의 납본제도 개선모형에 관한 연구)

  • In digital environment the hallmark of the national libraries is its responsibility or function of acquiring and preserving the county´s off-line and on-line publications in term of legal deposit. But the legal deposit system based on print materials in Korea predates the digital age and requires a new legal framework. It would be a tragedy if national library was not to archive the nation´s intellectual and cultural heritage because of limitation of legal deposit system. The purpose of this paper is to analyze form of the current deposit system and to suggest a reform model for legal deposit legislation with priority given to legal scheme and elements(terms, the depositor, the depository, object of deposit, number of copies, time of deposit, compensation and fine, right of migration and free access, etc.).

  • This study focuses on the legal concept of virtual money, focusing on the case of how we can change the framework of fixed thinking about our trade concept and money with the fourth industrial revolution. The legal character of the virtual money, which played a role as a means of trading in crime, could be discussed, and the court could put it in the category of " property " as a subject of confiscation. Many people are expressing empathy for the fact that there will be many traits in the future world that are difficult to predict. At this side, when the legal validity of the advantage is not recognized as the legal money yet to be recognized as the legal currency, it begins to be discussed as a necessary means of trading between individuals, businesses and individuals. Defining a legal character can be very significant in determining policy direction related to future operations of virtual money. But to date, it is very difficult to establish the legal character of virtual money through existing legislation. Therefore, as we looked at in this case, we examined whether the property was subject to the seizure of the profits from the crime. Attention was also given to the possibility of such abuse of virtual money and whether effective legal interpretation was possible for the categories of assets subject to seizure.
