Ritualism versus Universalism: The Challenge of Establishing an Effective Rights-Based Labor Migration Regime in ASEAN

  • Southeast Asia accounts for nearly a tenth of total worldwide cross-border movements of migrant workers. Cambodia, Indonesia, Laos, Myanmar, and Philippines make up the sending countries while Malaysia, Singapore, and Thailand are the major destinations. Migrant worker movements are predominantly in production process and low- to medium-skilled sectors. It is not unusual for irregular or undocumented movements to take place. In not a few instances, migrants work under harsh and exploitative conditions. In recent years, however, ASEAN has taken steps to manage labor migration at the regional level. The paper argues that ASEAN has not managed these cross-border labor flows as well as it should particularly in terms of protecting and promoting the human rights of migrants. It will be difficult to establish the genuine building blocks for a regional human rights mechanism unless there is a diffusion of alternative universal norms and standards to what ASEAN already embodies. As long as states resist any attempt to weaken or question or deligitimize their capacity to determine who gets to enter, stay, and leave their jurisdictions, it will be difficult to establish an effective migrant rights framework for the region.

중국의 노동쟁의 현황 및 처리제도에 관한 연구 (A Study on the Current Situation and Resolution System of Labor Dispute in China)

  • In 1978, Chinese reform and opening caused a big changes in Chinese labor relationship. Through reforming and opening, China gave up part of state ownership system and group ownership system, permitted private ownership system, and also opened the way for capitalists to ride again. Since China was established, the labor relationship ceased for 30 years has been appeared. However because the top priority aim of China's reform was economic growth, the protection of the rights and interests of labor was pushed back on the policy priority list. China takes foreign capitals based on cheap labor force quickly and China come up the worldwide plants. Since reformed, China keeps an economic growth rate of 9.7% annually for 30years. This economic growth is based on labor's sacrifice. However, Chinese fast economic growth causes side effects such as increasement of the gap between the wealthy and the poor, increasement of unbalanced development between regions, and the increasement of conflict between labor and management. Especially, according to changes in labors' level of consciousness, the labors recognized that their rights and interests are exploited by employers. Therefore, the labor dispute is continuously increasing. Chinese government changes their policy from the policy focusing on enterprise development to the policy protecting labor's rights and interests. In order to protect labor's rights and interests, China conducts labor contract law and labor dispute conciliation arbitration law in 2008. This kind of changes in Chinese labor environment affect a lot to Korean companies which already entered into China or are willing to enter. According to studying on present situation and resolution system in Chinese labor dispute, this paper suggests the proper countermeasure related to labor dispute of Korean companies which entered in China. First, the success rate of labor dispute conciliation by enterprise labor dispute conciliation committee is around 20% during recent several years and the success rate by year is in decline. Therefore, when labor dispute is occurred, our companies which entered into China better use other labor dispute methods such as negotiation and arbitration than conciliation in order to settle a conflict. Second, from the Korean enterprises entered in China point of view, there exists a problem not to sue except special cases which provided in the law even though they are dissatisfied with arbitrate judgment. Thus, when labor dispute occurred, Korean enterprises try to do best to settle the dispute through negotiation. However, in case of that the dispute cannot be settled by negotiation, they have to attend in the arbitration as if it is a last chance. Third, Korean enterprises keep in mind that dispute handling procedures between labor union and users or between labor group and users are different, and then deal with separately. Thus, dispute between labor and users have to follow arbitrate procedures as a necessary procedure, but in case of dispute related to group contract, namely dispute against labor union, labor dispute can be settled by arbitrate or suit, so after figuring out the situation exactly, it is necessary to select more advantageous way in order to settle the dispute. Moreover, in case of the dispute between labor union, they have to keep in mind that conciliation procedures cannot be used.

한국노동쟁의에 있어서 직권중재제도의 개선에 관한 연구 (A Study on the Improvement of Compulsory Arbitration System in Labor Dispute of Korea)

  • This article deals with the Improvement of Compulsory Arbitration System on Trade Union and Labor Relations Adjustment Act in Korea. If a labor dispute occcur, the settlement of labor dispute must be reached for the parties' own accord. The autonomy of the parties concerned is the fundamental principle in the settlement of labor dispute. If the Rights Which are guaranteed by art. 33 Constitutional Law belong to civil liberties, we should consider Trade Union Act as the restriction of basic rights. Arbitration is a procedure which permits the most positive intervention by the arbitrator. It is carried out by an arbitration committe which is composed of three arbitrators appointed by the chairman of the Labor Relations Commission. Compulsory arbitration system of the labor for parties should be improved. In case of necessary public enterprises, more strict requirements on assembly for labor disputes should be prepared and the government should support institutions to prevent labor-management disputes by educating experts on labor-management relations and improving the quality of arbitration.

바우처 제도의 이용자 선택권 강화가 돌봄노동자에게 미친 영향과 그 의미 (Enhanced User Choice of Voucher Program and its Impact and Implications on Care Worker)

  • 본 연구는 이용자 선택권 강화 맥락에 초점을 두고 바우처 도입 이후 돌봄노동자에게 나타난 변화를 분석하였다. 분석 결과, 바우처 도입 이후 돌봄노동자들의 고용, 해고, 노동강도 등에 서비스 이용자들이 미치는 영향력이 강화됨에 따라 돌봄노동자들은 노동지위의 취약화와 노동 의미와 상실, 돌봄노동자로서의 정체성 혼란 등 '노동소외'를 경험하는 것으로 나타났다. 돌봄노동자의 노동소외는 사회서비스 질 향상에 부정적인 영향을 미칠 수 있는 요인으로 양질의 사회서비스 공급을 위해서는 서비스 이용자의 권리 향상과 더불어 돌봄노동자의 인권 및 노동권 보호 논의가 함께 이루어져야 함을 제안하였다.

춘천시 청소년 노동인권 조례 현황 및 개선 연구 (A Study on the Current Status and Improvement of the Youth Labor Rights Ordinance in Chuncheon City)

  • Purpose - The purpose of this study is to compare and analyze the ordinances of other local governments to propose implications and improvement plans for the ordinances of Chuncheon City. To this end, cases of overseas legislation related to youth labor rights, domestic laws and major policies of the central government were reviewed. Design/methodology/approach - This study mainly utilized literature research methods. In addition, it was based on foreign laws and case analysis, domestic laws and ordinances, and preceding research and data related to government policies. Findings - Chuncheon city ordinances are superior to those of other local governments. However, the details of the establishment of the implementation plan, the actual condition survey, and the establishment of the consultation system are included in the project contents of Article 6, so it is not concrete and clear. And there were no articles related to the labor environment check. Research implications or Originality - It is proposed to make the contents of the establishment of an implementation plan, survey, and consultation system as independent provisions. It is also proposed to establish a new article related to the youth labor environment check. In addition, it is desirable to establish detailed regulations by establishing the ordinance enforcement regulations.

복지권의 구성과 성격 (The Construction and Characters of the Welfare Rights)

  • 본 연구는 권리의 개념과 유형을 살펴보고, 인권 및 시민권 논의를 통해 복지권의 구성내용과 성격을 분석하였다. 분석 결과, 복지권의 구성 내용으로는 (1) 사회적 권리로서 사회보장권, 사회복지서비스권, 건강권, 교육권, 주거권을 (2) 경제적 권리로서 노동권, 노동시장 개입권 및 직업안정권, 자본통제권을 (3) 문화적 환경적 권리로서 문화권, 환경권을 포함한다. 그리고 복지권은 현대 시민사회에서 시민, 그리고 더 나아가서는 인간에게 부여되는 당연한 권리로서 자유권, 정치권 등 다른 권리와 동등한 가치를 지니며, 객관적으로 존재한다기보다는 구축되는 것으로 보아야 한다. 또한 복지권에는 동시에 의무도 수반되지만 그 의무는 비조건적인 성격이 강하며, 복지권에 따른 복지의 수준은 사회성원으로서 완전한 참여와 통합을 지향하는 목표로서 불평등의 지속성을 방지할 수 있는 적정수준이어야 한다.

韓-歐FTA中与ILO相關條款紛爭及對中國的啓示

  • Over the past 20 years, labor standards have been widely used in free trade agreements. The U.S., the European Union and China have all aggressively signed free trade agreements with their trading partners, developing different styles on labor standards. According to the study, the implementation of the KOREa-EU FREE trade agreement has been hampered by ongoing disputes over the terms of the FREE trade agreement and the ILO since the korea-EU free trade agreement was signed. Because in order to break this deadlock, relevant scholars have done a lot of research, but mainly focused on the economic and trade field. Therefore, this paper for the first time systematically studies the substantive focus of disputes over FTA and ILO clauses, and carefully analyzes the domestic law amended by South Korea, and provides suggestions and inspirations for China by drawing lessons from the revision model of South Korea's domestic law. This is from a newperspective: the essence of the korea-EU FTA and ILO disputes is the conflict between international law and domestic law, and the conflict between free trade agreements and human rights protection. It holds that the essence of disputes should be sorted out from the perspective of legal principles and human rights protection, and the free trade and human rights protection should be actively coordinated. In order to make China more actively integrate into the international economy, China should adopt a positive attitude to revise and perfect its own laws, so as to realize the purpose of common development of international trade and human rights protection.

노동정보처리와 정보인권보호 (The information process on labor and the protection of information human rights)

  • 기업의 정보화 추진은 첨단의 정보처리기술이 기업영역으로 흡수되면서 기업사회에 기업의 효율성 제고라는 효과와 함께 노동자의 정보인권보호라는 문제가 서로 충돌하는 위험성도 확대되고 있어 대책마련이 요구되고 있다. 그럼에도 불구하고 정보보호에 대한 무감각은 경영의 효율성을 요구하는 왜곡된 사회구조에 의해 뒷받침된다. 자본과 언론이 경제위기의 심각성을 경고하게 되면 이 불안감에 정치권은 정보보호의 측면을 외면하고 경영의 효율성에 지향된 법정책을 채택하게 된다. 이러한 일련의 과정을 통하여 정보보호의 중요성은 경영의 효율성보다 작은 이익으로 평가되기 마련이며, 결과적으로 노동자의 인권침해가 발생하게 되는 것이다. 정보처리기술의 발전과 함께 기업의 정보화는 노동자의 행동을 보다 더 철저히 감시 $.$통제하는 것이 가능해졌다. 산업현장에 새로이 파생된 정보인권 침해문제는 한편으로 정보보안의 확립과 함께 정보처리기술을 이용한 노동통제를 규제하기 위한 법적 $.$제도적 장치의 마련을 촉구하고 있다. 정보의 활용이 많은 효율성을 가진다 해도 인권의 침해가 없는 기업생활의 보장은 국민의 기본권을 보장하고 있는 헌법정신의 구현이며 시대적 요청이기도 하다. 무엇보다도 정보인권 시대에 걸맞은 관련 법률의 제정과 개정 등의 정비가 이루어져야 한다. 산재된 정보보호 관련규정을 통합하고 온-오프라인의 접목 등 다양한 영역을 포괄할 수 있는 공통원리를 적용하여 '개인정보보호기본법'(가칭)을 제정할 것을 제안한다. 그 기반 위에 노동법상으로 산업현장이라는 특수영역에서의 정보인권을 보호하기 위하여 노동조합의 주도적 참여를 보장하는 등의 직접적이고 구체적인 정보인권보호 방안을 구축해 나가야 할 것이다.

아역 연기자에 대한 법적, 제도적 고려사항 (Legal and Institutional Considerations for Child Actor)

  • Child labor is being recognized as the key issue of human rights, and the International Labor Organization and the Convention on the Rights of the Child emphasize that children are individuals with dignity and rights. Male and female child actors belong to a profession with wide public exposure and there is a potential danger of invading classes and roles not matching the developmental stage of the child. In this study, we would like to discuss international and domestic laws and future complementary measures surrounding legal and institutional issues that need to be considered for child actors. Although the basic rights for child workers are stated in the Constitution Article 32 Paragraph 5 and Labor Standards Act Articles 64 through 70, they are insufficient. Following the revised broadcasting deliberation regulations by the Korea Communication Commission and amendment of the Juvenile Protection Law, several changes are taking place in the working environment. In certain foreign places such as California, United States, the economic and educational rights of male and female child actors are being protected. Although legal and institutional frameworks for the male and female child actors are being reinforced, more consistent devices are needed. Consideration for working hours, regulations to keep up with learning while working, and preparation for physical and emotional influences are required to keep up with international changes.

청소년 노동의 실태와 노동인권 의식에 관한 연구 (A Research on Actual Conditions of Juvenile Labor and Labor Rights Consciousness)

  • 본 연구는 지역사회에서 이루어지고 있는 청소년 노동의 실태와 노동인권 의식에 관한 실태조사를 통해서 S시에 거주하는 청소년들이 경험하고 있는 노동 상황을 파악하고, 청소년들이 노동 현장에서 부딪치는 여러 가지 내용들을 통해서 청소년들이 어떤 처우를 받고, 어떻게 대응하는가에 대한 실태를 파악하고자 한다. 또한 이들 청소년들이 노동현장에서 부당한 대우를 받았을 때 어떻게 대응하는 것이 바람직한가에 대한 올바른 교육을 위한 기초 자료를 확보하는 데 있다. 연구결과는 다음과 같다. 첫째, 전체 대상자 중 청소년 노동인 아르바이트 경험이 있는 학생이 262명 50.5%로 나타났다. 둘째, 노동인권에 대한 교육 경험이 있는 경우가 133명 24.9% 나타나서, 상대적으로 적은 학생들만이 노동인권에 대한 교육을 받은 것으로 나타났다. 셋째, 학생들의 아르바이트 경험에 대한 조사에서는 아르바이트를 할 때 가장 중요하게 고려하는 것은 '급여'로 응답자 중 54.2%이며, 아르바이트 구직방법은 '부모, 친구, 지인소개'가 응답자 중 67.7%이고, 최근에 경험한 아르바이트 종류는 '음식점'으로 응답자의 60.2%로 나타났다. 평균노동시간은 1일 7시간 정도이며, 주간은 20시간으로 나타나서 상대적으로 장시간을 노동에 참여하는 것으로 나타났다. 넷째, 청소년들의 노동 참여과정에서 근로계약서를 작성하는 경우는 응답자의 28.9%로 나타났으며, 아르바이트의 주된 목적은 '돈을 벌려고'가 응답자의 82.1%이었다. 다섯째, 아르바이트를 하면서 부당한 대우를 경험했는가에 대해서는 응답자의 24.7%가 '그렇다'라고 하였으며, 부당한 대우의 해당 사례에 대해 복수 응답하게 한 결과 '약속이외의 업무'가 17.9%로 가장 높았다. 부당한 대우에 대한 대처방법에 대해서는 '일을 그만두었다' 30.3%로 가장 높았으며, 마지막으로 청소년의 아르바이를 위해 개선되어야 할 사항에 대해 복수 응답으로 조사한 결과 '최저임금, 주휴수당 등의 임금수준'이 25.1%, '사회적 인식개선' 14.3%, '좋은 일자리 확대' 12.8%, 등으로 나타났다.
