개정 국제사법(國際私法)의 소개 : 국제거래(國際去來)에 미치는 영향을 중심으로 (The New Conflict of Laws Act of the Republic of Korea)

  • The Law amending the Conflict of Laws Act of the Republic of Korea ("Korea"), which had taken two years to prepare, was promulgated on April 7, 2001 and finally took effect as of July 1, 2001. Accordingly, the old earlier Conflict of Laws Act which was called "Seoboesabeop" in Korean ("Prior Act"Old Act) was replaced by the new Conflict of Laws Act called "Gukjesabeop" in Korean ("New Act"). In fact the Old Act Prior Act was promulgated in 1962, but it was regarded as outdated from the moment of its promulgation. However, since the Old Act because it was modeled after the chapter of the Private International Law of the Einfuehrungsgesetz zum Buergerlichen Gesetzbuch (EGBGB) of the Federal Republic of Germany ("German PIL") and the Japanese Private International Law ("Japanese PIL") which had been promulgated toward the end of the 19th century., the Old Act was viewed as outdated from the moment of its promulgation. As a result of the drastic change of the environment for international trade of which that has taken took place in parallel with the global information technology revolution on a global basis, the scope of issues to be addressed which should be resolved by the conflict of laws principles has been remarkably expanded, and various new issues of an entirely which are quite new in its type and nature have arisen been raised. In the field of conflict of laws in its narrow sense, a revolution or crisis of the traditional conflict of laws has been brought about by the advent in the United States rise of a the new methodology for of the conflict of laws, of the United States of America and in the process of overcoming the such crisis the conflict of laws of the European continent has undergone substantial changes such as the diversification of the connecting principles, the expansion of the principle of party autonomy and the consideration of the value of the substantive law to protect socio-economically weaker parties of. The Prior Act, which was based on However, with the mechanical connecting principles and contained various outdated the inappropriate provisions, the Old Act could not cope with the issues raised by the internationalization and globalization of the Korean society. Furthermore In addition, the Old Act Prior Act was regarded as insufficient in that it lacked rules on international jurisdiction to adjudicate, or international adjudicatory jurisdiction, whereas the expectation of the public was that the Conflict of Laws a Act should function as the "Basic Law of the International Legal Relationships"encompassing rules on international jurisdiction given the increase of international disputes. Furthermore the private international law has also attracted more attention from the Korean At the beginning of the new Millennium, thanks to the promulgation of the New Act, I believe that Korea has succeeded in achieving the modest goal of reflecting in the its codification substantial parts of the major developments of the private international law which the leading advanced continental European countries had achieved during the last century. The New Act has followed the approach of the traditional conflict of laws of the European continent. It is a product of the efforts to eliminate the then existing problems of the Prior Old Act and to adapt the Korean private international law regime to the standard of international conventions and national laws of advanced countries. Unlike the Prior Old Act which was heavily dependent upon the prior Japanese PIL and the prior German PIL, the New Act has been prepared by taking into full account the Rome Convention, the Swiss PIL, the new German PIL which took effect in 1986 and various conventions adopted by the Hague Conference. Therefore, the New Act has substantially reduced dependence upon the Japanese PIL and the German PIL, and has gained relatively greater universal validity. The fact that the New Act expressly declares that the determination of international jurisdiction is a matter of conflict of laws is a clear sign that it has departed from the German tradition which confines the conflict of laws principles to choice of laws rules, and moved toward a broader and more practical approach widely accepted in the area of conflict of laws. It is hoped, and I am personally confident, that the New Act will be able to achieve its intended objectives in the 21st century as the basic law for the ever-increasing legal relationships with a foreign element.

As the development of electronic transaction is difficult without smooth settlement of dispute the pursue of smooth settlement of dispute is very important menu. while the most common method relating to the settlement of dispute is litigation. them relating to the litigation, the subject of governing law so jurisdiction and the subject of governing laws should be resolved above all. Therefore, governing law to application concerned about electronic transaction should be prepared and the environment to keep electronic transaction secure and stable be guaranteed. Reconsideration of the Public Diplomacy Act in Korea and a Few Suggestions

  • The Korean government has recently invigorated the activities of public diplomacy. It is based on the Public Diplomacy Act enacted in 2016. However, there is a widespread concern that it was belatedly enacted and showed necessity to a revision. We believe that this paper contains three contributions which were not sufficiently addressed before. First, we identify the current state of public diplomacy-related legislation in Korea. Second, we argue the necessity to critically review the legal adequacy of Public Diplomacy Act with a consideration of rapidly changing external environment. Lastly, we propose several ways of revision for the future development of public diplomacy in Korea. When revising the Act, it is necessary to make clear a legal connection between the general law and the special law as in the case of the Korea Foundation Act and the Public Diplomacy Act. In this regard, it is worth examining the relationship between the Framework Act on International Development Cooperation and related norms. In addition, the role of the private sector and subnational governments should be expanded. For this purpose, a method and level of cooperation with the private sector should be clearly defined.

  • The rapid development of the internet may not have occurred without techniques of linking and framing, which provide users flexible and easy access to other website. These techniques have enabled internet users to navigate the internet efficiently and sort through the products, services and information available on the internet. The Advent of the global information structure and the do-called EC revolution raise countless new issues and questions. There are no limitations regulating the expressions on the cyberspace due to internet's of quality anonymity? diversity? spontaneity. Therefore, the freedom of speech is expanded in both areas of time and space, which was impossible with the old communicating system. Although online technology raises many new legal issues, the law available to help us resolve them, at least today, is largely based on the world as it existed before online commerce became a reality. Thus the challenge is to predict how these new legal issues may be resolved using the current law. 점유이탈 예술품의 국제거래에 관한 법적 연구 - 문화재를 중심으로 - (A Legal Study on the International Trade of stolen/lost artworks: Focused on Illegal trafficking of cultural property)

  • 예술품의 국제거래상 준거법 채택의 문제는 실제로 소송의 결과와 밀접한 관계가 있는데, 최근 들어 국제예술품시장의 허브인 뉴욕을 중심으로 점차 현대적 혼합법을 채택하고 있다. 예술품 국제거래의 준거법 지정은 해당 국가의 사법규정만으로는 결정되기 곤란하며, 해당 국가의 이익 및 공익과 관련된 경우 공법규정도 함께 고려되어야 한다. 섭외적 사안에 대해서 우리 국제사법은 공공질서이론을 수용하고 있으며, 국제사법 제7조에 따라 입법목적상 해당 사안에 적용 되어야 하는 우리 강행규정은 준거법 지정여부와는 무관하게 적용된다. 여기서 말하는 강행규정이란 당사자 합의로 그 적용배제가 불가능 하고 외국법이 준거법인 경우에도 적용이 배제되지 않는 '국제적 강행법규'를 의미하며, 특정 법률이 국제적 강행법규에 해당하는 지는 법규의 의미와 목적상 적용의지를 가지는가를 면밀히 분석 후 판단해야 한다. 거래목적물이 문화재라면 관련 공법규범 역시 검토가 필요한데, 예술품의 국제거래 대상이 문화재의 범주에 속하는 경우, 당해 법원은 법정지의 강행법규까지 고려해야 한다. 우리 민법은 문화재 보호법이 적용되지 않는 경우에는 원칙적으로 문화재에 대한 선의취득을 인정하는데, 점유이탈 예술품 역시 선의취득의 대상이지만 도난 혹은 분실물인 경우 원소유자는 민법 제250조에 의해 도난, 분실 후 2년 내에 그 작품의 반환을 요구할 권리가 있고 매수인은 원소유자에게 반환하여야 한다. 나아가, 매수인이 전문 경매회사나 화랑, 갤러리 등 전문 업자에게 구입한 경우 원소유자에게 구입대금의 배상을 요구할 수 있고, 사적 거래로 구입한 경우에는 원소유자에게 구입가를 배상받지 못하고 작품을 반환해야 하는데, 이 경우 매수인은 매도인에 대하여 민법 제570조에 기한 책임을 물을 수 있다. 유니드로와(Unidroit) 협약 발효 이전에 도난 및 반출된 문화재에 대한 소급효의 부정과 미국의 조항 유보행사와 관련해서는 외교적 논의가 필요하며, 현재로서는 미국 연방도품법 활용 등 우회적 노력이 차선책이다.

국제상사계약에서 신의칙의 법적 기능과 판정례에 관한 고찰 (A Study on the Legal Function and Cases of Good Faith under International Commercial Contracts)

  • The meaning of Good faith is honest intent to act without taking an unfair advantage over another person or to fulfill a promise to act, even when some legal technicality is not fulfilled. The term is applied to all kinds of transactions. According to the CISG only regulated Art. 7. that is in the interpretation of this Convention, regard is to be had to its international character and to the need to promote uniformity in its application and the observance of good faith in international trade (1) and questions concerning matters governed by this Convention which are not expressly settled in it are to be settled in conformity with the general principles on which it is based or, in the absence of such principles, in conformity with the law applicable by virtue of the rules of private international law (2). In the other hand PICC is related to the good faith and fair dealing, each party must act in accordance with good faith and fair dealing in international trade (1) and the parties may not exclude or limit this duty (2). Good faith of PECL is these principles should be interpreted and developed in accordance with their purposes. In particular, regard should be had to the need to promote good faith and fair dealing, certainty in contractual relationships and uniformity of application. Further more regarding to the good faith and fair dealing, same to the PICC regulations.

상업적 우주활동의 국제법적 규제 (International Legal Regulation on Commercial Space Activity)

  • 종래의 우주활동은 국가주도의 우주개발을 통해 과학적 혹은 군사적 목적의 활동이 커다란 비중을 차지해 왔으나 점차 우주의 실용적 이용 내지 실용화에 이르는 과정에서 민간기업이 참여하는 상업적 우주활동이 현격한 증가를 보게 되었고 다수의 국가들이 독자적으로 또는 민간기업과의 협력이나 지역적 기구와의 공동사업을 통해서 우주의 상업적인 활용에 가담하고 있다. 그 발전의 폭도 원격탐사, 우주통신, 우주발사 서비스 및 제조업, 에너지 생산분야, 우주운송 및 보험 등 다양한 영역으로 확대일로에 있다. 그런 가운데 특히 각국은 우주의 상업화가 불기피한 발전방향이라는 점을 인식하면서 요람기의 우주산업을 육성하는데 노력을 경주해 오는 한편 국제적인 측면에서는 주로 안전 보장을 위한 고려에서부터 자국의 활동에 관한 국제적 책임(우주조약 제6조)을 이행하기위한 목적으로 우주산업에 대해 엄격한 국가적 규제에 따르도록 해온 것이 사실이다. 이러한 우주에서의 상업적 활동 내지 민간차원의 이용이 우주조약 등 관련 우주국제법의 적용을 받는 우주활동인가 여부에 관해서는 국내외적으로 논란이 있었던 것은 사실이지만 앞서도 논한 바 있듯이 우주조약에서 규정하고 있는 바대로 모든 국가와 전 인류의 이익을 위해 수행되어야 하는 우주활동속에 포함되는 것으로 보아야 할 것이다. 여기서 주목해야 될 것은 상업적 활동 내지 민간차원의 우주이용에 관해 우주국제법의 태도이다. 물론 민간기업의 형태를 취한 상업우주발사활동을 규제하는 일반국제우주법의 규칙은 아직 명료하지 않다. 게다가 상업적 이용의 진전에 따라 대두되는 문제에 대해서 기존의 우주국제법이 한계점을 드러내고 있는 것이 주지의 사실이고 새로이 생성중에 있는 법규범과도 상호 모순되거나 입법적 불비가 있을 수 있는 만큼 이를 극복할 수 방안이 국제 공동체의 부단한 노력을 통해 마련되어야 할 것이다. 현재 우주조약이나 책임협약 등 우주관련 조약에 따르면 기본적으로 국가는 비정부단체나 개인 등의 우주활동에서 야기되는 모든 손해에 대해 국제책임을 지는 것을 원칙으로 하고 있는 바 이를 위해 각 국가는 국내적으로 그들의 활동에 대한 감독책임을 부담하고 있으며 이는 구체적으로는 장차 우주의 상업적 이용을 허가 및 규제하는 당해국가들의 국내법에 반영되어야 할 것이다. 그밖에도 앞서 본 각국의 국내법적 차원에서의 정비도 법리적인 측면에서나 국제협력의 관점에서 기존의 우주국제법과 조화를 이루도록 해야 하겠지만 일반국제법 내지 특별우주법규칙에 있어서도 상업적 우주활동의 발전 추세에 부합하고 또한 양 법체계가 조화를 이룰 수 있도록 재검토하고 경우에 따라 새로운 법제를 마련해야할 필요성도 제기되고 있다.

  • Purpose - This paper analyzes how to interpret the legal view of the precedents to the UK Insurance Act 2015, comparing it to the UK Marine Insurance Act (MIA) 1906 with a focus on the relationship between the duty of uberrimae fidei and the duty of disclosure. Furthermore, this study focuses on the judgment of the Korean Supreme Court in a case, that examined whether the legal nature of the duty of disclosure or duty of uberrimae fidei in insurance law can be considered as a matter related to the insurer's liability when the applicable terms of English law are incorporated under the insurance contract. Design/methodology - This paper belongs to the field of explanatory legal study, which aims to explain and test whether the choice of law is linked to the conditions that occur in the reality of judicial practice. The approach that is used toward this problem is the legal analytical normative approach. The juridical approach involves studying and examining theories, concepts, legal doctrines and legislation that are related to the problem. Findings - Regarding the requirements and effects of breach of the duty of disclosure, if English law and the Korean Commercial Act are handled differently from each other and Korean law is recognized as the applicable law outside of the insurer's liability, it may be whether the insurer's immunity under English law is contrary to s.633 of the Korean Commercial Act. In considering the breach of the duty of disclosure as a matter of the insurer's liability, even if English law is applied as a governing law, the question of how to interpret the agreement of the governing law in this case may also be raised in the interpretation of Korean International Private Law in relation to the applicable law that applies to the rest of the matter, excluding the matters of liability. Originality/value - According to the Korean Supreme Court judgement under the governing law of the MIA 1906, the basis for recognizing the assured's pre-and post-contractual duty of disclosure is separate, and the only important matters to be notified by the assured after the conclusion of the insurance contract are those that are "relevant" and "material circumstances" that are "relevant" to the matter in question after the conclusion of the insurance contract.

  • Currently, it is the general trend that the party's autonomy principle is applicable in determining the applicable law for the international private law and the international commercial arbitration. The purpose of this article is to make research on the party's autonomy principle for the international commercial arbitral awards. For this purpose ist to analyse regal issue the applicability of the lex mercatoria and the possibility of $d\acute{e}pe\c{c}age$ relating to the party autonomy. In this Article ist dealt with Art. 29 para. 1 of the Korean Arbitration Act in comparison with Art. 28 para. 1 UNCITRAL Model Law and Art. 1051 para. 1 of the German Code of Civil Procedure. The Art. 28 para. 1 UNCITRAL Model Law and Art. 1051 para. 1 of the German Code of Civil Procedure provides equally. "The arbitral tribunal shall decide the dispute in accordence with such 'rules of law' as chosen by the parties as applicable to the substance of the dispute. Any designation of the law or legal system of a given State shall be construed, unless otherwise expressed, as directly referring to the substantive law of that State and not to its conflict of laws rules." The term 'rule of law' used to describe the applicability of the lex mercatoria and the possibility $d\acute{e}pe\c{c}age$. Unlike Art. 28 para. 1 UNCITRAL Model Law and Art. 1051 para.1 of the German Code of Civil Procedure. Act, Art. 29(1) of the Korean Arbitration Act provides that the arbitral tribunal shall decide the dispute in accordence with the 'law' chosen by the parties as applicable to the substance of the dispute. However the majority view in Korea takes the position that the term 'law' should be interpreted broadly so as to encompass 'rules of law' at UNCITRAL Model Law and the German Code of Civil Procedure.
