A Study on the Scope of Protection for Freedom of Expression on Internet: Focused on the Analysis of Judicial Precedents on Cyber Conflicts (인터넷에서 표현의 자유 보호 법리에 관한 연구: 사이버 분쟁에 대한 법원 판례 분석을 중심으로)

  • Various opinions are expressed about the Internet Regulation. Some people argue that it is impossible to control because of the technical characteristics of Internet, while other people argue that it is easy to control. Recently in Korea, a move to reinforce the Internet Regulation through the extension of cyber real-name system is emerging, whereas the concern for its excessive infringement of the Freedom of Expression is increasing. This paper was intended to draw a reasonable direction for Internet Regulation in our society. And accordingly this paper tried to suggest a desirable direction of Internet Control in the future and to draw a criterion for domestic court judgement by analyzing cases of cyber defamation so far. The result of this study proposed that the Freedom for Expression be widely secured in the case of cyber defamation of criticism and political comments upon public officials and that the legitimacy and effectiveness of Internet Regulation be ensured. This result of study is expected to help establish the direction and principle of Internet Regulation in the future around Korea Communications Commission and Korea Communications Standards Commission.

Implications of Incentive Auction : Focusing on key issues in U.S.

  • The Federal Communications Commission (FCC), which regulates interstate and international communications in the United States, has established a plan to allocate high demand spectrum to the usage of mobile communication by inducing voluntary relinquishment from broadcasters. This plan was introduced by the National Broadband Plan as an incentive auction in 2010. The FCC suggested the Notice of Proposed Rulemaking (NPRM) in 2012 and issued Report and Order (R&O) on May 2014 regarding the overall rules of incentive auctions expected to be implemented in mid-2015. The incentive auction attracts the attention of many countries because this policy suggests a novel approach regarding the alteration of use from an inefficient usage to an efficient usage in limited spectrum resources. In this paper, we define the key issues in order for implementation of incentive auction. Since the incentive auction is a highly complicated process compared to previous allocation procedures, a careful review of the incentive auction regarding whether this spectrum policy can be introduced is required. In this paper, we describe the detailed procedure of the incentive auction and present policy considerations for the introduction of the incentive auction.

A Case Study on Closed Captions: Focusing on on Netflix (넷플릭스 <오징어 게임> 폐쇄자막 연구)

  • This study aims to evaluate the accuracy and completeness of Korean and English closed captions for Netflix's "Squid Game" and to present implications based on the findings. To achieve this, the closed captioning guidelines of the U.S. Federal Communications Commission, DCMP, and the Korea Communications Commission were identified and analyzed. The analysis of the subtitle of the entire "Squid Game" series reveals that, while Korean closed captions accurately present slangs and titles, they present non-existent information in speaker identification. In English closed captions, speaker identification guidelines are well followed, but omissions of slangs and title mistranslations are observed. In terms of completeness, both Korean and English closed captions are found to omit certain audio parts. To address these issues, the study suggests strengthening the QA process, establishing a system to communicate original text problems during translation, and utilizing general English subtitles.

  • In South Korea, to effective and systematic response to disasters, the government will build wireless communication network for PPDR(Public Protection and Disaster Relief) on a national level by 2015. To do it, as MOPAS(Ministry of Public Administration and Security) requested the new frequency assignment for PPDR, KCC(Korea Communications Commission) has been examined new frequency allocations about TETRA and WiBro technologies. In this paper, we were defined the technical parameters, were estimated the spectrum of TETRA-TRS requirements for Korean wireless communication of PPDR based on M.2033 methodology recommended by ITU-R.

  • COMS (Communication, Ocean and Meteorological Satellite) is the multi-purposed Korean geostationary satellite funded by four Korean government ministries, and is to supply communication services, ocean and weather observation for 7 years. As part of COMS, development of Ka band communication payload composed of microwave switching transponder and multi-horn antenna is sponsored by KCC (Korea Communications Commission) and developed by ETRI (Electronics and Telecommunications Research Institute). The purpose of Ka Payload development is to acquire space proven technology of Ka payload and to exploit advanced multimedia communication services. This paper aims to study development technology of Ka payload system through whole process of ETRI project. Also application of Ka payload will be dealt in this paper.

IPv4 Address Trading Using Resource Certificate

  • The Internet has been growing at unprecedented rates. The problem of an address shortage could act as a barrier on this growth. In principle, a new Internet standard, IPv6 solves the problem of the address shortage because it has a very large address space. But IPv6 is not yet compatible with the IPv4 and during the IPv4-to-IPv6 transition period IPv4 address will continue to be in demand. Thus for quite some time, the problem of IP address shortage will persist. To solve the problem, we propose the mechanism of secure IP address trading. This mechanism is based on the Resource PKI (RPKI). The RPKI is the working item of IETF. This proposed mechanism maximizes the trust of IP address trading using RPKI.

  • 최근 들어 일본의 대지진과 같이 "위험사회"에서 발생할 수 있는 여러 현상들이 나타나고 있다. 국가는 위험한 상황을 신속하게 국민에게 전달하여 국민의 생명과 재산을 보호해야하는 중요한 의무를 가진다. 이러한 국가의 의무를 효과적으로 수행하기 위해 국가는 법령에 재난정보전달에 필요한 사항을 규정한다. 본 고에서는 우리나라의 법령 중 재난정보전달과 관련된 법령을 수집하여 분석한다. 이를 위해 헌법, 자연재해대책법, 재난 및 안전관리 기본법, 방송통신발전기본법, 기상법, 마지막으로 민방위기본법과 관련 시행령을 조사하였다. 결론으로 이러한 법령과 관련 조직이 현재 가지고 있는 문제점을 파악하였다.

  • This paper gives an overview of the CBUF project. The work described is the collective effort of 11 CBUF partners, laboratories, universities, industries, in 8 countries. It became possible to do this research thanks to the European Commission interest in the burning behaviour of upholstered furniture and their willingness to sponsor this large effort. The opportunity to work with the many of the most prominent fire researchers and furniture experts have been extremely rewarding. All the expertise of these scientists have resulted in a lot of research results that are presented. The article only gives the main findings and conclusions of the project, namely the presentation of the fire safety design procedure of the CBUF project. Other articles will deal with specific modelling topics and an extensive description of the project can be found in the final CBUF report EUR 16477 EN.

A Crisis in Public Broadcasting of South Korea A Perspective from the Case of the So-called "Paik Jong-moon's Taped Conversation" at MBC with a Focus on the Press Control by Political Power (MBC '백종문 녹취록' 사건으로 본 공영방송의 위기 정치권력의 언론 통제 기제를 중심으로)

  • The case of 'Paik Jong-moon's Taped Conversation,' has presented "an important and serious challenge to the freedom of the press and democracy" in South Korea. Nevertheless, this case has not been reported by the mainstream news media. It has also been forgotten without a proper fact-finding or investigation by regulatory agencies, like The Foundation for Broadcast Culture, The Korea Communications Commission, or The National Assembly. This study aims to examine why the above has happened through in-depth interviews of reporters and TV producers, senior journalists, former and incumbent commissioners of the broadcasting regulatory agencies, and experts of the industry, as well as literature research. Here, I present three answers. First, I found two reasons the mainstream press has ignored this incident. 1) It serves for political interests instead of reporting truth. 2) Public broadcasters' watchdog role has been neutralized. Second, regulatory agencies like The Foundation for Broadcast Culture, The Korea Communications Commission and The National Assembly are ruled by political tribalism. The ruling party's members of the National Assembly and these agencies were reluctant to investigate allegations surrounding Paik Jong-moon, such as illegal dismissals, illegal intervention in programming or production, illegal recruitment and illegal business deals. That's because they considered CEO Paik an ally. Using their majority power, they have rejected the request from opposition-affiliated commissioners or from opposition lawmakers to investigate the allegations. Third, there were no alternative forces within the public broadcasters to unveil the truth. In conclusion, the legal and institutional shake-up of corporate governance is urgently needed for public broadcasters and broadcasting regulatory agencies.

A study on the effective regulation of user discrimination : focusing on the offering of promotional gifts and exemption of charges (방송통신사업자의 부당한 이용자 차별 행위의 위법성 판단 기준의 타당성 및 효과적 규제 방안 : 경품 제공 및 요금 감면 관련 행위를 중심으로)

  • This study aims to find out the effectiveness of regulation of promotional gifts and exemption of charges by analyzing the judgement criterion of illegality and the corrective action taken by regulatory agencies and suggests effective way of regulation. The results show that recently the differences of price-cut is getting bigger. In addition, Fair Trade Commission has considered discounts as unfair predatory price only if price is below the cost. But in the telecommunication business law enacted by Korea Communications Commission, 'expected profits per subscriber' has been applied as a key criterion. KCC's criterion is based not on the expected profit of individual service provider but on the averaged profit of services providers. It doesn't consider differences of service quality and the cost structure between dominant firm and late comers. Prohibition act of user discrimination result in the increase of subscriber and operating profits of late comers but this is not direct purpose of regulation. It can be desirable in the aspect of fair competition but since it may reduce consumer welfare, the criterion needs to be reconsidered.
