오늘날 주요 선진국들은 신안보 현실에 부응하여 형사특례 도입 등 관련 법제를 강화하고 있는 추세이다. 이러한 형사특례 절차를 마련하고 있는 것은 안보와 관련된 수사에서는 피의자의 인권이라도 어느 정도 제한할 수밖에 없다는 판단에서 출발한 것이다. 즉, 간첩, 테러 등 안보사범에 대해서 수사 절차를 다르게 적용하는 것은 개인적 보호법익보다는 국가의 법익과 사회적 법익을 우선으로 고려하여 어느 정도 한도에서는 감청을 허용하고 영장주의 예외를 허용하고 증거인멸과 더 큰 테러와 간첩행위에 의한 국가적 손실을 예방하기 위해 변호인 접견권을 제한하거나 테러 혐의자의 가택이나 사무실을 폭넓게 수색하도록 허용하고 있다. 이와 같이 안보사범의 처리에 있어 형사절차의 개선과 강화는 매우 중요하다. 하지만 우리나라는 선진국과 같이 예비와 음모죄를 강화하거나, 내수사 단계에서의 수사여건을 개선하는 등 적극적 노력보다는 일반 형사범의 처벌과정과 거의 차이가 없음을 알 수 있다. 이러한 분위기가 지속된다면 최근의 신안보 현실에서 국가적 위협요인에 대하여 효과적으로 대응하기 어렵다. 이를 개선하기 위해서는 선진국의 안보법제도를 고려하여 우리의 상황에 적절한 형사절차 등의 특례조항을 도입해야 한다. 이 논문에서는 국내 안보사례 분석을 통해 안보형사법제의 개선방안을 논의해 보았다.

The purpose of this study is to develop a application procedure and survey method for the empirical diagnostic indices system. In order to know the survey method, which has 65 investigation items for 52 indicators, this study not only presented so that the each survey items could be surveyed in at least 1 to 3 steps, but also presented the 4 survey method for each investigation items: preliminary survey, administrative survey, field survey, and interview survey. As a result of applying to 15 sample villages, the period of surveying a village of 100 households was 1.4 days, and it was confirmed that the survey was generally efficient in a short time. As a result of applying the survey system to the sample village, the developed survey system showed the possibility of investigating even the details of rural villages. Therefore, it was judged that it could be used as a basic procedure for a rural village unit survey.

우리나라 해양사고 조사매뉴얼은 국제적인 해양사고 조사지침과 코드 등을 수용하지 못하여 국제 기준과 절차 및 흐름에 뒤떨어져 있고, 새로운 시대와 여건에 맞는 독자적인 조사매뉴얼이 없는 실정이다. 이 연구에서는 한국과 일본 및 미국 해양사고 조사기관의 조사 매뉴얼을 비교ㆍ분석하여 우리나라 조사매뉴얼의 문제점을 도출하고, 우리 실정에 맞는 새로운 조사매뉴얼의 제정 방안을 제시하고자 한다.

The KNR(Korean National Railroad) is trying to set a new rail standard to back up the speed-up policy of the conventional railways. This work has passably significance since the rail standards used were introduced from Japan without the consideration on our situation. The contact analysis between wheel treads and rail heads, attended with complex calculation and the wear experiments taken long time should be accomplished for the exact investigation to establish a new rail standard. However, this paper just concentrates the structural investigation of the proposed rail standard and the dynamic analysis between trains and rail models with intent to shift the above procedure on the next step.

Diazepam (DZ) is one of the most frequently prescribed drugs as an antianxiety agent, muscle relaxant, and anticovulsant and sometimes causes intoxication due to accidental overdose, misuse or abuse. Screening or confirmation methods for DZ and NDZ in plasma are very important for clinical and toxicological studies and in forensic cases. GC/MS assay with SPE was developed for the determination of diazepam and its metabolite, nordiazepam in human plasma. Diazepam in plasma was extracted by a rapid and sensitive procedure based on C18 bonded-phase extraction. (omitted)

지난 3년('13~'15)간 화학물질사고는 301건이 발생하였으며, 연평균 약 100건이 집계됐다. 이와 같은 화학사고는 인명과 환경에 많은 피해를 가져왔다. '13년~'15년에 발생한 운반차량 화학사고는 연평균 21건으로 전체 화학사고의 약 21%를 차지한다. 화학물질 운반차량의 사고는 지역에 관계없이 도로상에서 발생하고 있기 때문에, 관계기관의 대응 및 사후처리 등 체계적인 현장조사가 필요하다. 또한 화학물질 운반업자 및 화물주 등의 협조가 절대적으로 필요한 상황이다. 따라서, 본 논문에서는 화학물질 운반차량의 사고발생에 대한 현장조사 및 처리 절차를 조사 분석하였다. 이를 통해 운반차량의 화학사고에 대한 원인을 분석하고 현장조사와 처리절차를 체계적으로 마련하는 기초자료가 될 것으로 판단된다.

The objective of this study is to examine the influence of fraud investigation on organizational performance of Thai listed companies through mediating effects of internal audit quality, accounting information transparency and financial effectiveness, and moderating effect of corporate governance. In this study, 333 Thai listed companies are the samples of the study. Both the structural equation model and multiple regression analysis are used to examine the research relationships. The results of this study show that fraud investigation has a significant influence on internal audit quality, accounting information transparency, and financial effectiveness. Internal audit quality significantly influences accounting information transparency, financial effectiveness, and organizational performance while financial effectiveness significantly influences organizational performance. Next, both internal audit quality and financial effectiveness potentially mediate the fraud investigation-organizational performance relationships. In addition, corporate governance critically moderates the fraud investigation-internal audit quality relationships and the fraud investigation-financial effectiveness relationships. In summary, fraud investigation functions as an important valuable technique of internal audit practices. As a result, businesses must build and implement a systematic fraud investigation procedure to generate and improve beneficial outcomes in the short, medium, and long term.

가상화는 논리적인 가상환경으로 하드웨어의 물리적인 한계를 극복하기 위한 기술이다. 최근 비용 절감 및 그린 IT정책의 일환으로 가상화 환경을 도입하는 기업들이 증가하는 추세이다. 특히 데스크톱 가상화는 한 대의 물리적 컴퓨터에서 다양한 운영체제를 효율적으로 사용할 수 있기 때문에 가장 활발하게 사용되는 기술유형 중 하나이다. 가상화 기술의 핵심 요소인 가상 머신 이미지는 하드디스크 이미지와 구조적으로 다르기 때문에 조사에 어려움이 있다. 따라서 가상 머신에 대한 기술적 이해를 바탕으로 가상 머신 이미지에 적합한 조사 절차 및 방안에 대한 연구가 필요하다. 본 연구는 가장 많은 사용자를 가지고 있는 VMware Workstation 가상 머신 이미지에 대한 디지털 증거 조사 절차와 손상된 이미지에 대한 조사 방안을 제안한다.
