E-Commerce in China is being expanded by way of policy for improving e-Commerce such as e-Government though China introduced e-Commerce later than other countries. There is going to be an e-Commerce boom in China owing to IT development and increasing use of Internet. It is estimated that China will be among the world's largest e-Commerce market in the future. E-Commerce Cooperation between Korea and China has been undergone as a part of Korea-Japan-China e-Commerce. The outcome of e-Commerce Cooperation between Korea and China is less than that of e-Commerce Cooperation between Korea and Japan. Therefore, there must be the development of Vision and roadmap and organizational reform in Government, sufficient budget, consideration of digital divide and improvement of Korea-Japan-China e-Commerce Cooperation for e-Commerce Cooperation between Korea and China, The purpose of this paper contributes to improve the e-Commerce cooperation between Korean and China and to improve e-Commerce infrastructures in China by estimating current e-Commerce Cooperation between Korea and China and suggesting development strategies of Korea and China e-Commerce cooperation.

국제주의 질서나 지역주의 및 쌍무주의 질서가 일응 무역자유화를 지향하는 점에서 양자는 일치하면서도 후자가 역내 자유주의와 역외 보호주의라는 양면성을 가지므로 갈등과 모순이 있을 수 밖에 없다. 그러나 차선 이론이나 GATT나 WTO의 현실인정의 예외 규정으로 보완내지 공존관계에 있음이 현실이고 나아가 지역주의와 쌍무주의가 국제주의의 실험장이 될 수도 있다. 우리나라의 통상현안과 관련하여 볼 때 WTO출범에도 불구하고 이처럼 국제주의질서와는 별개로 지역주의 및 쌍무주의 질서가 현실적으로 공존함으로써 우리의 어려운 통상환경의요인으로 작용하고 있으므로 대국적인 통상정책으로 이에의 적절한 대응이 요구된다. 요컨데 우리경제가 OECD에 가입했고 선진경제대열에 진입하고 있음을 감안할 때 범세계적 시각에서 통상관련제도를 국제주의 질서의 측면에서 최대한 개편 보강하여 통상협력 하는 한편, 지역주의나 쌍무주의 측면에서도 권역별로 충화된 수단의 최적 Mix를 도출함으로서 조화로운 통상관계를 정립시켜 나가야 할 것이다.

There are situations in e-commerce that are altogether new and to which the existing rules cannot apply. The uncertainty and business risk is too high for trading partners to deal with certainty. Therefore existing law must be changed to e-commerce law so that it provides certainty and enforceability in the e-commerce. Legal rules applying to the commerce and international commerce, in particular, contracts, proper law, jurisdiction and so on, have improved with time and experience. It has been found that the problems arising in the context of e-contracting were due to the absence of experience in electronic contracting and an absence of knowledge on how best to solve the problems. Thus, UNCITRAL Working Group on Electronic Commerce held an extensive discussion on issues related to electronic contracting and prepared and revised the Preliminary Draft Convention on International Contracts Concluded or Evidenced by Data Message from the thirty-ninth session in 2002 and prepared the Draft Convention from forty-first session which applies to international contracts concluded or evidenced by means of data messages. An electronic contract is concluded when the acceptance of an offer becomes effective, and an offer becomes effective when it is received by the offeree, and an acceptance of an offer becomes effective when the indication of assent is received by the offeror according to this Convention. Electronic contract may be concluded by the interaction of an automated computer system and natural person or by the interaction of automated computer systems, and a contract formed by a natural person that accesses an automated computer system of another person has no legal effect in case the neutral person made a material error in a data message. The purpose of this paper is to raise the understanding of the Convention on the Electronic Contracting by studying the contents of Draft Convention on Electronic Contracting and comparing Draft Convention with preliminary Draft Convention and finding the difference, characteristics and problem.

Social surveys, using various factors influencing the e-commerce's development of SMEs, are the means of explaining the rapid development of e-commerce. This makes it possible to make more efficient decisions in e-commerce. This article was written from surveys conducted in the manufacturing industry and Trade Company at Jilin Province via e-mail, fax and analyzed data by Statistical Package for the Social Sciences (SPSS). The result shows that in development of e-commerce, the business partners have significant impacts on the achievement of e-business both directly and indirectly. Second, consciousness of leaders, external support, transaction partner relationship and influence of competitors cause a direct result on the development of e-commerce On the other hand, the innovative capacity of enterprises and communication indirectly influence. Based on these, it is valid for us to for us to make correct decisions for the e-commerce development of SMEs.
