전자상거래에 관한 국제적 동향과 대응방안 (International Movement and Korea's Response of Electronic Commerce)

  • 최근 전자상거래의 규모는 점점 확대되어 나아가면서 가상공간에서의 상거래에 있어 여러 가지 문제점이 발생된다. 따라서 본 연구에서는 인터넷의 확산과 아울러 전자상거래에서 현행 제기되는 몇 가지 문제점들을 살펴보고. 주요 문제점들에 관한 국제적 동향과 우리나라의 대응방안을 고찰하고자 한다. 결국, 인터넷라운드의 대응 및 전자상거래 안정적인 성장을 위해서 정부가 주도적으로 규범화 작업등을 통하여 국제적인 수준으로 맞추어 나아가야 할 것이다.

Study on Virtual Reality and E-commerce

  • Electronic commerce (E-commerce) using virtual reality (VR) has the advantage of being able to purchase products without restrictions of time and location by overcoming the limitations of existing offline transactions. It is still a rudimentary but fast growing technology, and the use of E-commerce in VR is expanding. The barriers that consumers might face in utilizing E-commerce in VR is the relevance to Information and Communications Technologies (ICT) technology. Fundamentally, it requires Internet access and use through PCs or mobile devices such as smart phones. Because unlike off-line markets, it is difficult to determine the purchase patterns of customers, customer purchasing behavior analysis must be done using computer access records. In order to expand and develop E-commerce in VR in the future, learning ability should be improved through combining with artificial neural network by deep learning that is recently in the spotlight, and the ability to overcome errors need to be improved to enable use in various fields.

  • Since the internet is open to public in 1990, electronic commerce(EC) user has increase rapidly. Now EC is considered not only as communication method but also as new economical activities. EC is a kind of new commerce model which uses electronic means. And EC has global characteristics so that many country's legislation which regulates it differently makes an obstacle to vital of EC. The purpose of this study is to examine legal problems of internet electronic commerce. First, there are some legal problems whether electronic document has same legal function like traditional documents. Second, electronic signature must has authenticity, integrity, non-repudiation, writing and confidentiality in order to use looks like common signature. Finally, electronic contract is concluded on principle of mutual agreement. It is apparent that the concept of arrival is applied to the date and place in conclusion of electronic contract.

  • The paper at first gives an introduction to e-commerce, recalls the birth and the growth of an e-commerce giant Chinapages.com in the tough environment in the primary stage of the development of e-commerce in China, provides an overview of its e-business scope and its experience in its e-business development, then describes its present favorable and unfavorable e-business e-environment and its challenges in its future development. Finally it concludes that Chinapages' future is bright and promising with China's WTO entry just around the corner, if Chinapages takes advantages of the opportunities and faces the challenges with confidence and aggressiveness in the new era of e-commerce.

  • The article is devoted to current issues of the development of e-commerce, which is gaining more importance in the conditions of widespread quarantine restrictions. As a result, of the research the importance of digitalization as a driver of economic development is substantiated and the main business models of e-commerce and their modifications are examined. The peculiarities of e-commerce in the context of digital economy were analyzed and their current state was established. Identified the main trends in the development of e-commerce at the current stage, which allowed to identify problem areas that require further study and evaluation. Presented the results of the market research of decorative cosmetics, based on which the summarized set of problems that affect the online sales in this segment of the market.

  • This study is conducted to find out whether companies which use electronic commerce for their business are collecting the least personal information. of consumers that are necessary for providing electronic commerce services to consumers. Investigators visited website of 799 electronic commerce companies, and checked out the personal informations of consumers that were asked when they join the site as a member. The collected data were analyzed with frequency, percentage, and cross-tab analysis using SPSS program. Generally most electronic commerces required more personal information of consumers than necessary for providing their services to consumers. These phenomena are partly due to the fact that regulations regarding consumer privacy in electronic commerce are advisory rather than mandatory at present. Therefore, it is suggested that mandatory regulation which makes companies poot their identification within a certain area of their web page has to enforced for the protection of consumer privacy in electronic commerce. And it would be more efficient if consumers are consistently educated about self protection guideline regarding personal information in using electronic commerce in addition to a mandatory regulation.

국제상거래(國際商去來)의 사법통일(私法統一)노력과 우리의 대응(對應) (New Trends in Private International Law and Our Response)

  • During the past few decades, we have witnessed three approaches to overcome the legal disparities between trading countries: - determining the individual governing law in accordance with the conflict of laws principle; - unifying and harmonizing private international law into uniform rules and substantive laws under the auspices of ICC, UNCITRAL, UNIDROIT and various NGOs ; and - drafting model laws like the UNCITRAL Model Law on Electronic Commerce and promoting member countries to enact them. Against this backdrop, the United Nations Convention on Contracts for the International Sale of Goods (CISG) and the process by which it was adopted, established the benchmark for the unification of commercial law. The CISG, completed in 1980, merged civil and common law concepts and came into force in 1988 after a certain number of countries endorsed the treaty. Besides the CISG, the U.N. Limitations Convention and the UNIDROIT Principles of International Commercial Law, to name a few, have attempted to set cross-border legal norms and standards in the international business transactions. However, since the advent of computer-based commerce, there have emerged all-out efforts to establish uniform rules before national legal systems have been developed. As a consequence, the Model Law on Electronic Commerce has become a specimen legislation covering functional equivalents of paper-based writing and signature. For the credit enhancement exemplified by the Uniform Rules for Demand Guarantees (ICC Publication No.458), the UNCITRAL prepared the U.N. Convention on Independent Guarantees and Stand-by Letters of Credit, which was adopted by the U.N. General Assembly in 1995 but remains still not effective as only two countries have ratified this treaty so far. In this connection, two draft conventions underway at UNIDROIT and UNCITRAL deserve our attention as the probability of unification in the Korean Peninsula is mounting. They are to create security interests for commercial finance in moveable equipment and accounts receivable. The UCC-type security rights are regarded to be useful to enable the North Koreans with limited properties to borrow from the banks.

부산지역(釜山地域) 수출기업(輸出企業)의 전자상거래(電子商去來) 활용실태(活用實態)에 관한 고찰(考察) (A Study of the Conditions on applying Electronic Commerce to the Process of Export by the Firms in Pusan)

  • As we increase installing computers, traditional commerce by paper document is replaced by Electronic Commerce, paperless document commerce. Electronic Commerce proves to be an intermediary for increasing efficiency on work, which makes us use it more. This study aims to contribute to streamline local export by analyzing trade firms and manufacturers' using status of Electronic Commerce on work in Pusan. I sent questionnaires to 202 firms working on trade in Pusan to do survey. The sample of this study consists of 96 of them. I analyze using status of Electronic Commerce on work based on those data. The result shows that the more the firms install facility to be able for Electronic Commerce and the better they understand Electronic Commerce related laws, the more they select that on work. Generally The firms in Pusan rarely select Electronic Commerce on work and even acknowledges how much that is needed on work. Considering all of them, this study shows the method of streamlining local export by Electronic Commerce as follows; First, all kinds of Electronic Commerce such as trade related site in Internet should be systemized. Second, the laws on Electronic Commerce should be established in details. Third, workers on firms should be educated on Electronic Commerce. Forth, the firms should install the facility for Electronic Commerce, assist financially and make marketing strategy for selecting Electronic Commerce on each step in work. In conclusion, export in Pusan would be streamlined when the use of Electronic Commerce, effective intermediary, is motivated and we take that method to use on work properly.

The Influence of E-Commerce on the Foreign Trade of Shanghai Free Trade Zone

  • Purpose: As one of the most developed cities in China, the application of e-commerce is more mature, especially the promotion of ecommerce to foreign trade. After the establishment of Shanghai Free Trade Zone (FTZ) in 2013, the government issued a series of policies to promote the application of e-commerce in Shanghai's foreign trade. This paper takes Shanghai FTZ as an example to study how to develop the application of e-commerce in other free trade zones and how to innovate the international trade mode. Research design, data and methodology: This paper selects the latest data from 2010 to 2019, uses econometric correlation analysis and regression analysis to study the impact of e-commerce on the foreign trade of Shanghai FTZ. Results: At last, the conclusion is drawn that the establishment of free trade zone provides many advantages for the development of e-commerce in Shanghai, and the growth of e-commerce in Shanghai FTZ promotes the development of foreign trade of Shanghai FTZ. Conclusions: So as to promote the development of e-commerce in Shanghai Free Trade Zone, some suggestions are put forward, such as increasing network supervision, establishing e-commerce talent training system, logistics management and information management systematization.
