Purpose - This paper investigates the theories and practices of Most-Favored-Nation (MFN) clauses. The MFN clause became a controversial issue during the past two decades, especially in the context of investment arbitration. This paper aims to clarify a reasonable way to apply MFN clauses. It in particular focuses on the territoriality requirements and the scope of investment activity which are common features included in most of investment treaties. Design/methodology - This paper analyses two investment arbitration cases, Ansung Housing and Beijing Urban Construction. Through the case study, this paper reveals limitations of the currently dominant views on the operation of MFN clauses. It then tries to reconstruct the system of MFN application within the relevant arbitration principles. Findings - Tribunals of recent investment arbitration as represented in the two cases above employed strict literal interpretation of the treaty provisions, especially of the phrase "in its territory". This paper finds a more functional interpretation is appropriate and consistent with theories of public international law and developments of global economy. Originality/value - Existing studies either stuck to literal interpretation or suggested more flexible interpretation of the phrase "in its territory" without full explanation. This paper tries to fill the gap in the existing discussion by analyzing legal foundations and theoretical structure for an effective interpretation of MFN clauses.
Purpose - First, this study contextually examines the governance codes of South Africa and South Korea. Second, it analyzes board features of South African (JSE) Mainboard and South Korean (KRX) KOSPI-listed companies. Design/methodology - This review is qualitative and uses data from the annual reports of the selected markets' companies, respective exchanges' official web sites and corporate governance-related web sites in order to examine the corporate governance practices in the two markets. In addition, Nvivo is employed in analyzing the content of the corporate governance codes of the selected countries. Findings - Our analysis indicates that the corporate governance codes of the two countries are evolving to keep up with the international trend of principles-based approach. The composition of the board of directors (BODs) of non-financial companies of both South Africa and South Korea shows no significant variation between the companies with regards to the executive (inside) and nonexecutive (outside) directors. On the contrary, there is a significant variation between South African and South Korean listed companies with respect to diversity. Originality/value - While previous studies are centered on the impact of governance codes on performance, this study intends to contextually evaluate the codes and features of South Africa and South Korea listed companies. This is essential and timely for regulators and policy makers given the importance of corporate governance features such as board independence and diversity in recent times.
In this study, consumption-based greenhouse gas emissions from 1990 to 2021 are calculated by the industry sector, and greenhouse gas emissions transferred due to trade between countries are compared to analyze what implications Korea has. As a result, production-based and consumption-based emissions in the United States, Germany, the EU, and the OECD are gradually decreasing. Production-based emission in Korea is larger than consumption-based emissions because Korean economic structure is import-oriented. However, unlike other developed countries, Korea cannot trade energy by land, so it can be said that it is reasonable to establish a greenhouse gas reduction plan considering Korea's unique characteristics.
Purpose - Population is the foundation for maintaining and growing the strength of a nation, and a certain number must be maintained for the growth of the national economy. and Amidst the changing population structure where the elderly population is steadily increasing while the productive population is gradually decreasing, there is a practical need for devising solutions to overcome the low birth rate. Design/methodology/approach - For conducting this study, data was collected from a total of 1,000 residents of Goyang city, aged 19 and above. Out of these, empirical analysis was conducted using the SPSS 29.0 statistical program on the response data of a total of 247 individuals, including 156 individuals in their 20s and 191 individuals in their 30s, who belong to the MZ generation. Findings - The results showed that first, the awareness of the childbirth encouragement policy did not significantly affect the child-rearing environment. The perception of the importance of the childbirth encouragement policy had a positive and significant effect on the child-rearing environment. Moreover, the child-rearing environment had a positive effect on marital attitudes. Research implications or Originality - Thus, rather than the effects of awareness through the promotion and education of national childbirth policies, it is preemptively necessary to realize substantial childbirth encouragement policies for improving the child-rearing environment.
The rapid development of the internet may not have occurred without techniques of linking and framing, which provide users flexible and easy access to other website. These techniques have enabled internet users to navigate the internet efficiently and sort through the products, services and information available on the internet. The Advent of the global information structure and the do-called EC revolution raise countless new issues and questions. There are no limitations regulating the expressions on the cyberspace due to internet's of quality anonymity? diversity? spontaneity. Therefore, the freedom of speech is expanded in both areas of time and space, which was impossible with the old communicating system. Although online technology raises many new legal issues, the law available to help us resolve them, at least today, is largely based on the world as it existed before online commerce became a reality. Thus the challenge is to predict how these new legal issues may be resolved using the current law. As a result of the drastic change of the environment for international trade of which that has taken took place in parallel with the global information technology revolution on a global basis, the scope of issues to be addressed which should be resolved by the conflict of laws principles has been remarkably expanded, and various new issues of an entirely which are quite new in its type and nature have arisen been raised. Further more in addition, the old act prior act was regarded as insufficient in that it lacked rules on international governing law to adjudicate, or international adjudicatory governing law, where as the expectation of the public was that the private international law should function as the basic law of the legal relational encompassing rules on governing law given the increase of It international disputes. for the move the private international law has also attracted more attention from the korean.
According to the previous study, after 2000s, factors of the Chinese government's trade policy changes would be a significant burden on the company. However, many previous studies were limited to the response strategy by judicial analysis. Therefore, this study aims to analyze the factors that affect the export performance of Korean manufacturing companies in China. Also, by using that result, I would like to provide advises for entered the korean companies in Chinese market As the results, I knew that export performance are most heavily influenced by labor policy factor and the fallowing is exchange rate policy factor. Eventually, Most of our country companies entering in china were affected changes in the exchange rate policy factor, but many company were manufacturing-type businesses to economize labor costs. Therefore, corporate and governmental response strategies are needed for that's companies.
Opening domestic market to international trade may enhance not only actual competition but also potential competition from foreign competitors. It seems that the competition authority has focused mainly on the actual competition (measured by the current market share) and has paid less attention to the potential competition. In this regards, this paper investigated the relation between potential foreign competition and domestic market structure. Using dynamic panel regression model, we analyzed the dynamic response of import penetration to the changes of domestic market condition in Korea as a proxy for the degree of potential foreign competition. The empirical results suggests that potential foreign competition does exist in the Korean manufacturing sector and this tendency is more stronger when the market is more concentrated. Thus, in order to effectively implement competition policy, it is necessary to consider both actual and potential competition.
Purpose - This study analyzed the correlation between economic liberalization and foreign direct investment. The purpose of this study is to seek ways to attract foreign direct investment from developing countries. Design/methodology/approach - This study analysed with observations of 19 from 2000 to 2018 using a fixed effect model, a random effect model, and a two-way fixed effect model. Findings - First, it was found that economic liberalization had a positive effect on attracting foreign direct investment in the early stages of economic liberalization. Second, it was found that economic liberalization in the deepening stage of economic liberalization had a negative effect on attracting foreign direct investment. In general, it was found that the higher the level of economic liberalization in developing countries is not accompanied by innovative changes in the industrial structure, the higher the level of economic liberalization is likely to decrease the inducement of foreign direct investment due to negative factors such as an increase in labor costs. Overall, this study approved that Economic liberalization have a non-linear (inverted U-shape) relationship with the inflow of foreign direct investment. Research implications or Originality - First, this study attempted to expand the variables for the determinants of FDI by analyzing economic factors which is a determinent of FDI. Second, economic liberalization generally has a positive effect on foreign direct investment, but it proved that it does not have only positive effects as a factor of attracting foreign direct investment in developing countries. The advantage of low wages in ASEAN countries acts as a factor for foreign direct investment, but as the degree of economic liberalization increases, the environment such as government size, guarantee of property rights, international trade freedom, fiscal soundness, and regulations change positively. On the other hand, it can be suggested that if the industrial level is less, it may lead to a loss of comparative advantage and a decrease in investment.
OECD MNE Guidelines ('OECD Guidelines') was set forth in 1976 as a form of annex to the OECD Declaration on International Investment and Multinational Enterprises. The objective of the OECD Guidelines is to fulfill the implementation and adoption of the Responsible Business Conduct ('RBC') among the adhering states. To further the effectiveness of the OECD Guidelines, OECD, specifically the Investment Committee of OECD, has utilized National Contact Point ('NCP') structure. According to the Procedural Guidance annexed to the OECD Guidelines, peer learning is prescribed as an important tool for promoting and facilitating the implementation procedures of the OECD Guidelines. This paper, inter alia, is mainly focusing on the peer review mechanism applicable to NCPs because negative assessments by peers are likely to harm Korea's state image and entail international criticisms even though such reviews are conducted voluntarily. In addition, the Working Party on Responsible Business Conduct ('WPRBC') decided to have a peer review of Korean NCP in 2019. This paper first outlines the meaning and current applications of the peer review mechanism, and then analyzes specific peer review cases conducted in Denmark and Belgium in 2015, and in 2016, respectively. Lastly, based on the issues handled in the peer review reports on the above states, this paper makes a few recommendations for Korean government to prepare the peer review scheduled in 2019.
