Review on Need for Introduction of New Legal Framework of Investigation and Criminal Sanctions for OSH Fatal Accidents

  • Current OSH system was analyzed in this paper to explain why high fatal incidents and disasters are continuously repeated for recent years in Korea. It was found that we have Dichotomous Perceptional Misconception of prevention before accident and compensation after accident and there is a significant lack of proper feed­back reward system for OSH performance. It was assumed that no reduction of accident rate and fatality rate have not been achieved recently despite of a great effort and increased resource allocations. Some statistics for proving weak punishment were analyzed. In the current system, the will of administrative agency would have been very limited particularly in the legal aspects. The Industrial Safety and Health Act is not suitable to after-injury punishment for employer and/or corporate since it is based on a framework for enforcement of prevention. Based on these analyses, it was concluded that there was a need to consider a special law for Corporate Accountability for Fatal Accidents. Because it is necessary to consider seriously for introduction of a new legal system for after injury punishment to repair the current system where it was found lack of proper feedback system. Also, there was no proper sanction measures for corporate with the current OSH legal system, and the most urgent problem in OSH area is the high fatality rate. it is necessary to consider seriously for introduction of a new legal system for after injury punishment. GHS 체계에 대응한 MSDS DB 구축 및 정보 제공 프로그램 개발 (Development of MSDS DB management system corresponding to the Globally Harmonized System of Classification and Labelling of Chemicals (GHS))

  • The United Nation agreed to adopt the Globally Harmonized System of Classification and Labelling of Chemicals (GHS) until 2008 to solve the significant differences enough to result in different labels or MSDS for the same chemical in different jurisdictions. Though the GHS is an ideal solution in the respect of pursuing only one format of a MSDS throughout the world, it may cause confusion at the beginning due to lack of information. So the Korean Ministry of Labor (MOL) revised the Industrial Safety and Health Act (ISHA) and related public notice on the classification & labelling of chemicals according to the GHS in 2006. The transition period for the implementation of the GHS for substances was set until Jun 30, 2010, and for mixtures until Jun 30, 2013. To promote the implementation of the GHS in Korea, we developed an application program for constructing MSDS database and a management program for providing MSDS contents on the web in accordance with the GHS. We analyzed the sixteen sections of MSDS by the GHS guideline, and the result showed the necessity to construct logically connected DB for chemical identifier, hazard classification, label, standard phrases and regulatory information. Each section of a MSDS was divided into sub-databases to update the database efficiently. According to Relational Database Management System (RDBMS), the sub-databases were automatically assembled and subsequently a full MSDS is produced. At present, MSDS database for 6,314 substances has been built and provided through internet as the MSDS Editing program. During the service period from January 1 to March 31, 13,666 users have searched MSDSs for 33,401 substances. During program review, some comments about the classification results and other MSDS element sources were reported but no technical bug reported. We expect that the MSDS DB management system in accordance with GHS will accelerate the implementation of the GHS in Korea.

  • 2013년 이후로 산업안전보건법상 건설업 위험성 평가가 시행되었으나 법적 강제성이 없어 건설회사들은 이를 형식적으로 운용해 왔다. 또한 최근 산업안전보건법 전면개정, 중대재해 처벌등에 관한 법률 등으로 안전보건 의무를 강화하였으나 사고성 사망만인율은 정체되고 있는 것이 현실이다. 산업재해를 예방하기 위한 위험성 평가 계획이 적절하게 수립된다고 하더라도 해당 사업장에 종사하는 근로자가 위험성 평가의 내용을 이해하고 실행할 수 있어야 하며 이를 위해서는 해당 근로자를 참여하도록 하는 것이 중요하다. 본 연구에서는 이를 위해 건설업 위험성 평가 시 취약계층 근로자의 참여를 활성화할 수 있도록 현장 실태조사를 통해 문제점을 파악하고 효율적인 근로자 참여방안을 모색하고자 하였다.

우리나라 산업안전보건법상 특별관리물질 규정에 대한 독일, 영국 및 일본과의 비교법적 고찰 (A Comparative Legal Study of Germany, the United Kingdom, Japan and Korea for the Regulations on Special Management Materials)

  • Objectives: This study was conducted in order to evaluate the limitations of the regulations on the safety and health standards for special management materials(SMM) under the Industrial Safety and Health Act in Korea. Methods: Hazardous chemicals management systems in Germany(Hazardous Substances Ordinance), the UK(Control of Substances Hazardous to Health Regulations), Japan(Ordinance on Prevention of Hazards due to Specified Chemical Substances) and Korea(Regulation of Occupational Safety and Health Standards, ROSHS) were investigated and compared in terms of 14 items. Results: Among the 14 items, we eventually found seven items which should be amended: 1) definition and scope, 2) general duties clause, 3) principles of management, 4) preventive measures, 5) control measures, 6) risk assessment, and 7) record keeping. The principal limitations of Korean regulations in comparison with those of other countries were that there were no preventive measures such as substitution, and no principles of good practices for the control of exposure to SMM. In terms of control measures, there were no regulations on suitable workplace design, reducing the number of exposed workers, reducing the level and duration of exposure, and reducing the quantity of hazardous substances in ROSHS. Conclusions: Based on the results of this study, ROSHS should be complemented with preventive measures and the principles of management related to SMM. According to the suggestions, an employer who deals with SMM should preferably consider the possibility of substitution and perform substitution so far as is reasonably practicable.

용접·용단 작업 중 사고 예방을 위한 제도 개선 연구 (A Study on the Improvement of System to Prevent Accidents during Welding and Melting Operations)

  • 최근 가연물이 있는 장소에서 용접·용단 작업 중 불꽃 비산 등으로 인한 화재·폭발사고가 빈발하고 있으며, 이러한 화재사고의 원인은 위험물 제거, 불꽃 비산방지 조치 등 기본적인 안전수칙 미준수가 대부분으로 산업안전보건법의 제도적인 보완이 필요하다. 본 연구에서는 국내 용접·용단 작업 등 화기작업에서의 화재·폭발 사고를 시스템적 관점에서 분석하고 그 결과를 반영하여 화재감시자 배치 확대, 화재위험작업의 사전승인, 화재예방 안전교육 강화 등 제도개선방안을 제안하였다.

산업체 규모와 업종에 따른 MSDS 영업비밀 적용 실태조사 연구 (Study on the Status of Application of Trade Secrets in MSDS Provided in Workplaces)

  • Objective: This study analyzed the status of the application of trade secrets in MSDSs according to size and type of industry. The contents of the MSDS non-public approval policy are summarized. We suggest proactive improvement requirements related to the operation of the MSDS non-public approval policy. Methods: To review this subject, we selected 153 manufacturers and six importers in such fields as organic chemical production. The trade secrets application status and ratio (%) of MSDSs by industry size and industry classification were investigated. Improvements toward a proactive system related to the operation of the MSDS non-public approval policy under the Occupational Safety and Health Act(OSHA) were summarized. Results and Conclusions: According to the results, the trade secret ratio in MSDSs by industry size was 33% in workplaces with less than 50 employees, 23.1% in workplaces with more than 50 but less than 100 workers, 73% in workplaces with more than 100 workers, and 83.4% in workplaces with 300 or more workers. For the trade secret writing rate for MSDSs by industry, the highest was MOCCP (Manufacture of ink, paint, coating and similar products) at 80.9%. MOC (Manufacture of other chemicals) was the lowest at 16.2%. We propose four proactive efforts to minimize the administrative burden of implementation of the MSDS non-public approval policy. The results of this study can be used as basic data for policy improvements to make more effective use of MSDS.

일부 대체세정제 제조업체의 물질안전보건자료의 실태와 그 화학물질의 유해성 평가에 관한 연구 (Survey of Actual Conditions of Material Safety Data Sheet and Quantitative Risk Assessment of Toxic Substances : Substitutes for Degreasing Agents)

  • Since the regulation of MSDS (Material Safety Data Sheets) had started from July 1996, employers were required to furnish MSDS for the chemicals in use in their workplace. However, many MSDS did not contain upright information for the chemicals, and they were not updated regularly, and were not written in the standard format required by the Industrial Safety and Health Act (ISHA). The purposes of this study were 1) to examine the reliability of MSDS for mixed solvents, 2) to provide reliable MSDS to employers or employees, 3) to find out any difficulties in implementing MSDS after the initiation, and 4) to promote regular MSDS updating and to ensure the reliability of MSDS for chemical manufacturers. To check the reliability of MSDS of mixed chemicals, 21 samples of mostly degreasing solvents were collected along with their MSDS from the work place. The samples were analyzed by gas chromatography-mass selective detector(GC-MSD). Their components were classified as saturated hydrocarbon, cyclic hydrocarbon, aromatics, and halogen containing hydrocarbon, and the amount of each class were measured. Manufacture's MSDS were compared with the actual composition of the collected samples, and further examined the reliability by checking whether the chemicals analyzed were included in the MSDS correctly. Finally, each item of MSDS was evaluated whether the MSDS correspond to the regulation required by ISHA. The results were following: 1) most of the degreasing solvents in MSDS were incorrect in their composition and contents, 2) the information in the MSDS including hazard classification, exposure level, toxicity, regulatory information were incorrectly provided, and 3) some MSDS did not disclose carcinogens in their MSDS. Continuous monitoring of MSDS was required to ensure reliability of MSDS. The Chemicals containing hydrocarbons from C10-C15 need to be tested to provide toxicity data. In addition, governmental support for providing correct MSDS was recommended to ensure reliability of MSDS. The MSDS regulation relating to the confidential business information may need to be revised to ensure reliability of MSDS.

식품가공기계에 대한 재해분석 및 예방대책 (Disaster Analysis and Prevention Measures due to Food Processing Machinery)

  • 신흥국들의 경제성장과 선진국들의 기능성, 편의성 식품에 대한 수요증가에 따라 다양한 식품에 대한 수요가 증가하고 있으며, 이에 따라 국내에서도 식품가공기계산업에 대한 관심 및 식품가공기계의 사용빈도가 지속적으로 증가하고 있다. 따라서 식품가공기계와 관련하여 발생하는 재해도 역시 증가하고 있으며, 전체 산업 재해율보다 높은 재해율을 보이고 있다. 이에 본 연구에서는 식품가공기계 관련 재해특성을 분석하고 그 예방대책을 제시하고자 한다.

벤진의 유해 위험성과 작업환경 노출기준 연구 (A Study on the Hazardousness and the TLV in Working Environments of Benzine)

  • Of many volatile organic detergents for metals, benzine(CAS No. 8030-30-6), of which the toxicity has not yet been proven, has been used as an alternative of the halide compounds in the consideration of toxic effects, global warming and the destruction of ozone layer. In order to evaluate the effects of the benzine on human body by investigating the subchronic inhalation toxicity, to obtain the basic data for establishing the criteria of exposure in working environments and to classify the hazardousness in compliance with the Industrial Safety and Health Act by evaluating the hazardousness, repeated inhalation exposure test was carried with SD rats. The rats were grouped by 10 females and males each. The repetitive inhalation exposures were carried out at 4 levels of concentration of 0 ppm, 60 ppm, 300 ppm, and 1,500 ppm, for 6 hours a day, 5 days a week, for 13 weeks. The results are described hereunder. 1. No death of the animals of the exposed and controlled groups in the test period. Not any specific clinical symptoms, change in feed intake quantity, abnormality in eye test, or change in activity were observed. 2. In the 300 ppm and 1,500 ppm groups, weight reduction in the female groups and weight increase of liver and kidney in the male groups compared with control group were observed with statistical significance(p<0.05). 3. In the blood test, the HCT increased in the male 300 ppm group and the number of hematocyte increased, MCV and MCH decreased in the male 1,500 ppm group. In the female 1,500 ppm group, the HB decreased and the distribution width of the hematocyte particle size increased. In the blood biochemistry test, the TP in the male 1,500 ppm group and the LDH in the female 1,500 ppm group were increased with statistical significance(p<0.05). 4. Under the test conditions of the present study with SD rats, the NOEL was evaluated to be from 60 ppm to 300 ppm for both male and female groups. By extrapolation, the NOEL for human who work 8 hours a day was evaluated to be from 128 ppm to 640 ppm 5. Since the NOEL evaluated in this study do not exceed 60ppm(0.184 mg/L) the test material does not belong to the classification of the hazardous substance "NOEL${\leq}$0.5mg/L/6hr/90day(rat), for continuous inhalation of 6hours a day for 90 days" nor to the basic hazardous chemical substance class 1(0.2 mg/L/6hr/90day(rat) defined by the GHS which is a criteria of classification and identification of chemical compounds. However, considering the boiling point($30-204^{\circ}C$), flashing point($-40^{\circ}C$), vapor pressure(40 mmHg), and the inflammable range(1.0 - 6.0 %), sufficient care should be taken for handling in the safety aspects including fire or explosion.

산업안전보건법 허용기준 대상물질의 허용기준 개정을 위한 유해성·위험성 평가 및 사회적 비용·편익 분석 (Hazard and Risk Assessment and Cost and Benefit Analysis for Revising Permissible Exposure Limits in the Occupational Safety and Health Act of Korea)

  • Objectives: An objective of this study was to perform a risk assessment and social cost-benefit analysis for revising permissible exposure limits for seven substances: Nickel(Insoluble inorganic compounds), benzene, carbon disulfide, formaldehyde, cadmium(as compounds), trichloroethylene, touluene-2,4-diisocyanate. Materials and Methods: The research methods were divided into risk and hazard assessment and cost-benefit analysis. The risk and hazard assessment for the seven substances consists of four steps: An overview of GHS MSDS(1st), review of document of ACGIH's TLVs (2nd), comparison between international occupational exposure limits and domestic permissible exposure limits(3rd), and analysis of excess workplace and excess rate for occupational exposure limits based on previous work environment measurement data(4th). Total cost was estimated using cost of local exhaust ventilation, number of excess workplace and penalties for exceeding a permissible exposure limit. On the other hand, total benefit was calculated using the reduction rate of occupational disease, number of workplaces treating each substance and industrial accident compensation. Finally, the net benefit was calculated by subtracting total cost from total benefit. Results: All the substances investigated in this study were classified by CMR(Carcinogens, Mutagens or Reproductive toxicants) and their international occupational exposure limits were stricter than the domestic permissible exposure limits. As a result of excess rate analysis, trichloroethylene was the highest at 11%, whereas nickel was the lowest at 0.5%. The excess rates of all substances except for trichloroethylene were observed at less than 10%. Among the seven substances, the total cost was highest for trichloroethylene and lowest for carbon disulfide. The benefits for the seven substances were higher than costs estimated based on strengthening current permissible exposure limits. Thus, revising the permissible exposure limits of the seven substances was determined to be acceptable from a social perspective. Conclusions: The final revised permissible exposure limits suggested for the seven substances are as follows: $0.2mg/m^3$ for nickel, 0.5 ppm(TWA) and 2.5 ppm(STEL) for benzene, 1 ppm(TWA) for carbon disulfide, $0.01mg/m^3$(TWA) for cadmium, 10 ppm(TWA) and 25 ppm(STEL) for trichloroethylene, 0.3 ppm(TWA) for formaldehyde, and 0.005 ppm(TWA) and 0.02 ppm(STEL) for toluene diisocynate(isomers).
