국회도서관 입법정보서비스 개선방안에 관한 연구 (A Study on Improving Legislative Information Service in the National Assembly Library of the Republic of Korea)

  • 본 연구는 의원입법과정에서 발생하는 입법지원조직의 정보요구를 바탕으로 국회도서관 입법정보서비스 개선방안을 제시하기 위한 목적으로 수행되었다. 이를 위하여 입법지원조직 소속 이용자 20명을 심층 인터뷰하였다. 분석결과를 바탕으로 서비스와 시스템 개선방안을 제안하였다. 서비스 개선분야에서는 해외입법사례 정보요구 및 정책정보의 보완에 대한 요구 그리고 홍보가 필요한 부분을 반영하였다. 시스템 개선분야에서는 외국법률정보를 중심으로 법률정보시스템의 서비스인지도를 높이는 방안과 입법지원조직마다 차별화된 정보서비스를 제공할 수 있는 개인화서비스 운영방안을 제안하였다.

  • 최근 국토의 체계적인 모니터링 중요성이 부각되고 있다. 현행 법제도에는 국토의 현황을 조사/측정하는 법 항목은 있지만, 국토모니터링의 명확한 규정은 없으며, 그 외의 국토모니터링 데이터의 활용, 유통 및 공유, 보안 및 관리 등에 관한 내용은 미흡한 실정이다. 이를 개선하기 위해서는 국토모니터링 관련 용어정의, 제반작업, 구축 주기, 형태, 범위, 관리부서 등이 체계적으로 구성되어야 한다. 따라서 본 연구는 국토계획체계 내의 관련 법제도와 운영되는 시스템 현황을 파악하여 현재 국토모니터링의 문제점을 파악하고, 이를 바탕으로 국토기본법 내에 국토모니터링 체계 확립, 관련 분야의 개별법 개선안 도출, 새로운 국토모니터링 법제도 등을 제시하여 국토모니터링 자료취득 및 공동활용 개선을 위한 법제도 개선 방안을 제시하였다.

  • 4차 산업혁명이 화두로 등장하면서 블록체인에 대한 관심과 함께 블록체인을 활용한 다양한 플랫폼이 등장하고 있다. 블록체인 기술의 발전을 위해 관련 법률과 제도의 정비가 요구되고 있다. 이러한 측면에서 국내 블록체인 관련 법률 및 제도를 분석하여, 한계점을 도출하고 개선방향을 제시하였다. 연구방법은 문헌연구를 통하여 연구문헌과 관련 법령들을 분석하였다. 전체적인 법률과 제도를 한 번에 분석하기는 어려운 일이어서 블록체인 산업 활성화와 정보보호를 중심으로 우선적으로 필요한 법률과 제도를 살펴보았다. 분석 결과 전자거래 및 전자금융거래의 범위, 전자상거래, 전자서명, 수출입, 정보보호, 블록체인 산업진흥 및 연구 등에 관한 법률적 개선이 필요하다는 것을 확인하였다. 이를 통해 효과적인 블록체인 산업 활성화와 정보보호의 균형 있는 발전을 기대한다. 향후 각 항목에 대한 법조항과 제도에 대한 개별적인 연구가 진행될 수 있다.

농어촌도로 정비사업의 정책적 전개방향 (An Alternative Strategy on Minor Rural Road Improvement Project)

  • Since legislation of Rural Minor Road Improvement Act 1990, a quarter of its total length had been paved now. However, over 80% of arterial road length(national+provincial roads) had been paved, so, road improvement policy should be focussed on the local road(county+rural minor roads) from now. Generally, in the greater part of coastal plain and island areas, arterial road intensity(total road length/total catchment area) is relatively low, but local road intensity is relatively high. So, in terms of balanced development, much more efforts for rural minor road improvement should be concentrated in coastal plain and islands areas. In Chonnam Province, the maximum differentials of minor rural road improvement ratio was over 20%(the lowest; 14.1% in Goheung, the highest; 35.6% in Goksung) in 1999, but the improvement budget have been allocated in proportion to unpaved road length of each county by the provincial government. However, the differentials should not be fairly narrowed in the near future if the present budget allocation policy be maintained. To solve this problem, target differentials of rural minor road improvement between regions should be set up for each planning year and road improvement budget be allocated according to this policy change.

중국(中國) 상사중재제도(商事仲裁制度)의 문제점(問題點) 및 개선방향(改善方向) (The Problem and Improvement Direction of China Arbitration System)

  • This writing is for the purpose of investigating the specific character and problem point of China arbitration system which has near 90 years history and overviewing the drift of system improvement which happens recently. The arbitration system of China which traditionally does not acknowledge ad hoc arbitration, unlike most of the other nations that employ The UNCITRAL model law and make it their own legislation, is restrictive to the parties concerned principle of private autonomy considerably. Also the independence of arbitration is delicate, because of a civil characteristic weakness of the arbitral institutions and the intervention of the courts on the arbitration procedure and award. The dual system of domestic and international arbitration which maintains after enforcement of 1994 arbitration law is often to be a primary factor interrupting the development of Chinese arbitration system and making it vulnerable to challenges. The system improvement demand of the recent time reflects this point and makes the arbitration system of China to a international standard rather than now, so it is a desirable direction for China to be as the member of the world economy to be globalization.

지방자치단체 미술장식품 설치의 개선방안 (A Study on Reforming the Adornment of Buildings in the Provinces)

  • The purpose of this study is to examine the present problems relating to the legislation and execution of adornment of buildings in the provinces, and to explore ways to improve the role and function of adornment of buildings in terms of public art. In order to do that, the related national law and enforcement decree and the local regulations and rules were analysed. In addition the catalogues on the adornments of buildings that are managed by 31 cities and counties of Gyeonggi-Province were also compared and analysed. As a result of our survey, it has been determined that the reform of the adornments of buildings must be executed on the national and local levels. On the local level, the revision of regulations must occur simultaneously with the changes of national law and enforcement decrees. In many local self-governing bodies, there are quite a lot of discrepancies between their regulations and the upper law. Therefore, people can be confused regarding the sensitive problems such as the types of buildings that are required to display adornments and the proportion of the cost to the construction cost. In addition the effects of the improvements to national laws are often delayed. For example, the updated national law requires committee members to be appointed on the basis of merit, the announcement of the deliberation results, and the establishment of provisions regarding the management of existing structures. Unfortunately, improvements to the national law are not followed through on a local level. Concerning national legislation, the following improvements are necessary to minimize these problems. First, the western concept of‘public art’must be imported to Korea and applied to future legislation regarding adornment of buildings. Second, the perception of the purpose of adornment of buildings must be changed from‘art promotion’to‘improvement of the urban environment’Third, it is impractical to require private citizens to fund public worts of In. Korea requires an organized federal funding system for the commission of public art, which is to be controlled by committee. Finally, the definition of public artwork must be enlarged to include a more broad range of art, such as landscape architecture. In addition, continuing care of existing public worts of art must be managed systematically and strengthened.

  • SW사업의 고유특성에 따른 하도급 만연과 대 중소 SW기업간 하도급계약의 협상력 불균형 등으로 인한 불공정 하도급 거래관행이 지속되어 국내 SW사업의 다단계 위계화 하도급구조가 지속되고 있는 실정이다. 이로 인해 SW사업 결과에 악영향을 미치고 역량있는 중소 SW기업의 사업의지를 약화시켜 SW산업 발전을 저해할 수 있어, SW사업의 하도급관련 국내외 법제를 조사 분석하고 그 시사점을 도출하여 SW사업 주체간의 공정거래를 담보할 수 있는 SW사업 하도급관련 법제 인프라 개선방향을 제시한다.

Review on improving measurement of cyber terror management system

  • Damage and attack size of cyber terror is growing to the national size. Not only targeting at a certain companies or individuals but number of cyber terror targeting government bodies or unspecific people is increasing. This is because compared to traditional weapon, input cost is very cheap but ripple effect and shock are much stronger, affecting not only certain groups but also each individuals. 'Anti-terror measurement for protection of nation and public safety' passed last month is one of the renowned measurement passed regardless of objection from opposition party. The opposition party went against this through filibuster for 192 hours but this finally passed National Congress due to lack of oppositions. Korean government is taking post actions after passage of anti-terror measurement. Legislation of enforcement ordinance and regulations is due by 6th of next month. This regulation will be executed from June 4th after legislation. Whenever there is any security issues such as hacking of Korea Hydro and Nuclear Power and National Intelligence Service happens, lot of attention is made to those hackers. However, social recognition or management of those hackers need lot more improvement. Especially, as market of internet of things is increasing, there is an increased anxiety on information security. But as we only rely on security solutions, this problems are keep happening. Therefore, active investment on nurturing hackers who play the role of 'spear and shield' shall be made. Government should put more efforts to allow white hackers to show their abilities. We should have a policy for supporting high-quality programs such as BoB. To make information protection industry into future growth engine, it is necessary to nurture professionals for information protection and white hackers through special programs. Politicians should make related regulations as soon as possible to remove factors that prevent swift management of cyber attack due to lack of legislation. Government should pay lot more financial investment to nurturing professional manpower than now. Protecting life and asset of nation is responsibility and duty of our government. We all should recognize that controlling cyber attack is a part of national defense.

Fast, ethical and sustainable - The challenge for twenty-first century fashion producers -

  • It is recognized that the global apparel market of the twenty-first century is largely profit driven, and that the majority of producers and retailers have sourced products from the lowest cost locations. Purchase tickets of fashion goods available from 'fast' fashion retailers (at least within the UK) refrain from providing the consumer with details of the full circumstances of production. It seems that the majority of major retailers and producers are not willing to engage in levels of self-regulation which could ensure that the products offered to consumers are ethically produced and offer acceptable levels of sustainability. Meanwhile many fashion consumers have the desire to purchase sustainable products, produced ethically by workers paid fair wages in safe working environments. Consumer demand could be a powerful tool to adjust the behaviour of manufacturers and buyers. This paper proposes the introduction of international legislation demanding greater degrees of transparency than exist currently and that the full sourcing and production details of fashion products are stated clearly on the product's purchase ticket within its retail setting. With the introduction of such legislation, consumers could thus be given the opportunity of purchasing goods which they feel accommodate their own views on ethical manufacture and sustainable products. In turn, consumer pressure could ensure indirectly that retail buyers consider all ethical and sustainable aspects of production when negotiating with garment producers/suppliers. Further to this, such a negotiating stance could ensure the improvement of the terms and conditions of employment of the numerous garment workers worldwide.

해상노동법의 발전에 관한 사적연구 (A Historical Study on the Development of the Maritime Labour Law)

  • 해상노동법이란 선원의 노동에 관한 일체의 관계를 규율하는 법제도의 전체를 말한다. 해상노동이 육상노동과 구별되는 특수성으로는 위험성, 고립성, 책임의 중대성, 이사회성 등을 들 수 있다. 이러한 해상노동만이 가지는 특수성을 충분히 고려한 해사노동기준이 마련되어야, 선원의 지위 향상과 권익 보호를 실질적으로 달성할 수 있다. 선박 자체가 국제성이 강하므로, 그곳에서 이루어지는 해상노동 역시 매우 국제성이 강하다 그러므로 어느 나라에서 해상노동에 관한 입법을 할 때에는 국제적 관계를 충분히 고려하여야 한다. 따라서 이 논문은 해상노동법의 판단에 관한 사적 연구를 통하여 그 입법 정신을 밝히고, 이에 관한 국내법 제정지침을 제시하고자 한다.
