The American Law Institute(ALI) has presented drafts of "Principles of the law of software contracts" to clarify and unify the law of software transactions. These principles apply to agreements for the transfer of or access to software. Providing these principles means something in software contracts. First of all, these principles seek to limit the scope to cover only contracts involving software exchanged or accessed for consideration, while UCITA includes a wide variety of "computer information". Secondly, this project is "Principles" instead of "Restatement" which means that these principles are not the law unless a court adopts it. This is for flexibility not to hinder law's adoptability of new legal issues that might be created in the future since the software industry has developed. Third, the project seek to balance between software transferor's interest and transferees to permit the use of remote disablement in limited circumstances. These principles, however, should be considered some concerns in the future work. For example, not to be a unconscionable agreement, it is better to suggest the specific click-wrap procedure and be more illustrative about what types of browser-wrap language are acceptable and what types are not.

This paper focuses generally on the ‘fourteen principles of management’ by Henri Fayol. However, it specifically analyses their application to and implications for libraries and information centres. An extensive review of published works on management generally, and library management in particular, was conducted. This yielded vital insights on the original meaning and later modifications of these principles, as well as their application in the management of various organisations. Consequently, the strengths and weaknesses of these principles were examined to determine their suitability in libraries and information centres. Inferences, illustrations, and examples were drawn from both developed and developing countries which gives the paper a global perspective. Based on available literature, it was concluded that Fayol’s principles of management are as relevant to libraries as they are in other organisations. The paper, therefore, recommends that in addition to modifying some aspects to make these principles more responsive to the peculiar needs of libraries, further research should be undertaken to expand the breadth of these principles and ascertain their impacts on the management of information organisations.

Nowadays even if environment of international commercial transaction is changing quickly municipal law could not meet with such change accordingly. So far, however, efforts towards unification have prevailingly taken the form of binding instruments, such as non-national or supranational legislation, international conventions or international model laws. Among them, the UNIDROIT Principles with parties' autonomous and yet non-binding character do not only meet the substantive requirements of a true law merchant. In addition they also counter some of the main points of criticism against the modern lex mercatoria. As such the Principles constitute a cornerstone in the lex mercatoria debate and may become the heart of the new lex mercatoria. The purpose of this article is to ask whether there could be applied the Principles in international commerce. For the purpose it is to investigate when the Principles are applied in international commerce and how effectively the Principles are applied for the decision in international commercial disputes. Even though the Principles are used for reference by parties involved for the voluntary regulation of their contract, it is sufficiently expected that the Principles are to be a stepstone of uniform contract law in international commerce. Until now cases of appling the Principles are not satisfied with its expectation as a source of non-legislative means of unification or harmonization of law. Given the party's autonomy in the contract, this is among other things because business parties are strongly tend to observe their national laws in their international commerce. And also, even though there are a number of neutral and uniform regulations for international commercial contracts, parties do not often recognize their usefulness with being up to expectation. In order to explore the applicability of the Principles a number of cases of ICC International Court of Arbitration and others are quoted.

The founder of TRIZ, Genrich Altshuller, discovered forty patterns of inventive solutions, known as 40 Inventive Principles, extracting them from tens of thousands of technical patents. It was found further that 40 Inventive Principles are applicable not only for every technical field, but also for non-technical spheres - finance, business, management, marketing, social relations, education and etc. This paper extends the area of reliability through TRIZ. Enclosed are several examples how 40 Inventive Principles have been used in the reliability enhancement in the literature.

It has been general view to Josun palace space that the Kyongbok palace, a main palace, is arranged with symmetric geometrical composition principles and, unlikely main palace, sub-palaces such as Changduk, Changkyong and Kyonghee palace are placed in organic structure adapted to natural land form. With that view, there are no common factors to be considered between these palace, main and sub palace, in composting principles of the space. In this study, because of same ideological period, although there is external difference of that palaces, that common ideological principles are projected to these two palaces types through compositing space is assumed. On this hypostasis, this study has been focused on finding the ideological principles projected to these palace space commonly. As result of study, some of them are considered as common principles; Firstly, they are arranged in the text of contents through the way of naming to building, enterence and so on. The second point is ; it is viewed that the Oheung and symmetric arrangement method based on Oheung are used in compositing of palace space. The third is ; through analizing central space of Kyongbok palace, it is analized that oneness composition principles, which are based on the theory of Umyangheong, are projected to different palace space commonly.

Dr. Ranganathan's "Principles for Helpful Sequence" among the set of normative principles play an exclusive role in the arrangement of subject isolates. Each subject in the universe of subjects is regulated by a guiding principle of its own which analogously determines the sequence of Arrays in ordering the subject surrogates or isolates. For example, the "Principle of Later-in-Evolution" is applied for sequencing isolates of Animal and Plant Species; this concept can be applied to one of the tools of KOS viz. Taxonomies. The application of Principles for Helpful Sequence is summarily presented and in the process the paper highlights the inherent elements of knowledge organization in each one of these principles in a manner that might map the future course of research in this area with the potentiality to bring about a relation between principles for helpful sequence and KOS.

To assure the safety of urban railway train, it is necessary to observe the specified driving principles under an essential condition during running on tracks. These principles arises from a great deal of experience for a long time and include safe distance between trains, the railway signaling, block system, regular block of the highest priority and driving prohibition of simple railway vehicle in the main track, etc. Therefore, it is important to apply these principles to domestic urban railway driving regulations and railway vehicle driving regulations. However, domestic urban railway administrator established his own operation rules within the regulation. In this study, domestic urban railway administration's own rules are examined and the appropriate driving regulation on the safe driving principles is proposed.

Some simple devices to demonstrate important hydraulic principles to students are necessitated in fluid mechanics or hydraulics classes. These devices should\ulcorner be easy to make and operate with inexpensive cost. The writer has studied some simple demonstrhation apparatus of hydraulic principles which were made with cheap materials. The purpose of this paper is to present the results of the study. In this paper, hydraulic principles that can be demonstrated by using these apparatus are described, the plans of them are presented, and how to make them and what materiaIs to be used are briefly explained. An axial-flow fan is a device with which the flow of air is supplied for several purposes. It consists of a duct, a fan and a guide vane. It may be possible to demonstrate the principles of propeIler,drag force, lift, etc.

Objectives: The purpose of the Act is to comprehensively consider the legislative notice of the Enforcement Decree of the Serious Accidents Punishment Act for each important issue in terms of system, content, and execution. Methods: We examine the legislative notice of the Enforcement Decree of the Serious Accidents Punishment Act in-depth from the perspective of the effectiveness of disaster prevention, consistency of the legal system, and harmony with legal principles. Results: The proposed Enforcement Decree of the Act on the Punishment of Serious Accidents hardly resolves the uncertainties of the law, and there are many aspects that are unclear in the enforcement ordinance itself and that do not comply with constitutional principles. As a result, it is judged that it is difficult to for it to serve as an accident prevention standard due to its low predictability and that it will be difficult to achieve effectiveness in accident prevention. Conclusions: Ultimately, the law itself should be extensively reorganized in order to ensure universal and sufficient effectiveness, including the abolition of the Serious Accidents Punishment Act. In the short term, even the Enforcement Decree of the Act should be reorganized and supplemented in accordance with the law and safety principles.
