The International Ship and Port Facility Security (ISPS) Code has come into force on July 7$^{th}$ 2004. It would therefore be prudent that all parties' concerned put in place, methodically, systematically and as soon as possible, all the necessary infrastructure needed to give effect to all the decisions of the Conference. But the ISPS Code doesn't have the details during implementation. For example, how to legislate, administrate\ulcorner How are the data relating to security incident saved\ulcorner So, the author will lay emphasis to expatiate on three aspects in this thesis on the basis of the fact of anti-terrorism at sea.

Maritime terrorism at sea is the form of violent interference with shipping. Its global reach and negative impact on sea transportation, safety of navigation and marine environment, as well as the threat it poses to human lives and property, call for effective countermeasures at the international and national level at the same time. First, this paper gives a factual assessment of the phenomenon of maritime terrorism as well as a legal analysis of the international provisions to suppress such forms of violence at sea which is different from piracy. And also this paper attempts to address and identify issues relevant to the existing international regulations such as SUA Convention as the main source of international regulations applicable to acts of terrorism at sea, ISPS Code, PSI, etc. Finally this paper suggests the national countermeasures against maritime terrorism in light of above mentioned the definition, causes, types of maritime terrorism and concerning international regulations.

선박의 안전과 보안의 유지는 공급망의 각 단계에서 화물운송 및 여객의 인명 안전을 보장하는데 중추적인 역할을 한다. ISPS Code는 선원과 선박을 보안 위협으로부터 보호하기 위해 SOLAS 협약에 채택되었고, STCW 2010 마닐라 개정에 따라 선원은 반드시 보안 교육을 이수해야 한다. 효과적인 선원의 교육과 훈련은 선박의 보안 관련한 위험을 최소화하기 위한 적절한 이행활동의 수준을 보장하는데 중요하다. 이 연구의 목적은 선원들이 이수한 보안교육과 선원의 보안인식 및 선박의 보안성과 사이의 관계를 실증 분석하는데 있다. 연구 결과에 따르면 (1) 선박 보안 교육을 이수한 선원들은 선박 보안에 대한 인식이 높고 (2) 이러한 보안 교육 및 보안 인식은 선박의 보안성과에 긍정적 영향을 미치며, (3) 보안 인식은 보안 교육과 보안성과 관계에서 매개 효과가 있는 것으로 분석되었다. 따라서 보안 교육과 훈련은 선원의 보안인식과 보안성과에 중요한 영향을 미치며, 이는 결과적으로 해운산업에서 보다 경제적 운영적 및 이미지 측면에서 주요 이점으로 해석될 수 있을 것이다.

국내 연안 여객선 관련 종사자들에 대한 보안의식에 대한 설문조사를 통하여 보안환경과 여객선의 보안취약성 을 분석하였다. 이러한 연안 여객선의 보안위협에 능동적인 예방과 체계적인 대응시스템 구축을 목적으로 연안 여객 선 보안강화 프로그램을 제안하였다.

2001년 미국 뉴욕에서 항공기를 테러수단으로 사용한 테러사건발생이후 국제항해선박과 항만시설에 대한 보안의 중요성이 강조되며 국제해사기구(IMO)에서 ISPS Code제정 국제적 테러대응을 한지 10년에 이르렀다. 그러나 여전히 항만보안에 대한 항만시설운영자의 관심을 받지 못하고 있으며 항만보안의 최일선을 담당하는 항만보안책임자 및 보안관리자의 교육 및 관리가 열악하다. 본 연구에서는 항만보안교육의 실태분석을 통하여 향후 우리나라가 항만보안교육을 임해야 할 방향성에 대해 제시하고자 한다.

2001년 9.11 테러사건 이후 선박과 승무원의 안전과 보안문제가 해양산업에서 새로운 화제로 대두되고 있다. 고 위험 테러시대에 선주와 항만당국 뿐만 아니라, 선박 종사자들도 그들의 업무와 행동에 있어서 테러위협에 대한 경각심과 대응책이 요구되고 있다. 본 논문에서는 먼저 해양보안관리의 개념과 원칙에 입각하여 상선의 보안 취약성과 주요 요소를 분석하여 상선보안관리원칙을 도출하였다. 그리고 ISPS 규정에 입각하여 선내의 보안조직과 보안업무를 설정하고 승무원의 보안문화 정착을 위한 PTC 프로그램과 선박보안 시스템을 구성하였다.

In modern industrial society carriage of dangerous goods by sea becomes more increasing than ever before. Dangerous goods are required for special care and handling in that shipment of dangerous goods could affect safety of the vessel and other cargoes. It is also true that dangerous goods could be used as a means of terrorism. his article investigates allocation of risk and liabilities between parties involved in the carriage of dangerous goods by sea. More specifically, this study examines principles of strict liability of the shipper in shipment of dangerous goods with some limitations based upon recent cases. Furthermore this article investigates the issues on identity of shipper who bears strict liability to the carrier where there exist actual or documentary shipper other than the contractual shipper. Lastly, whether it is reasonable that the transfer of strict liability to the transferee, who does not have opportunity to verify dangerous nature of the goods before shipment, by endorsing bills of lading will be discussed critically.

This study identified application range of SPS Code(Special Purpose Ship Code) applied to fishery training ship in Korea, and proposed counterplan for port state control. The latest contents of relevant convention was verified, used APCIS of Tokyo MOU and EQASIS provided by EU to analyze the current condition and deficiencies of port state control of fishery training ship. As the result, the SPS code equal to passenger ship and cargo ship of SOLAS convention should be satisfied with fishery training ship, and must follow ISPS Code. As for the result of record of port state control, it was confirmed that 8 fishery training ships were inspected 76 times and pointed out with 411 deficiencies in Tokyo MOU nation. 75% of deficiencies were related to SOLAS convention, and 71 times of inspections were conducted in Japan. Because it is not free from the fishery training ship, there is a need for active corresponding and preparation by enhancing local cooperative system and sharing the Internet inspection background, and need to develop and implement in-depth internship program to improve port state control counter plan for the trainees.

The supply chain security programs are designed to prevent terrorist attacks on world transit system, and to help protect the passengers and workers who use these systems on a daily basis. as evidenced by the train bombings in London and Madrid in recent years, the threats to America's transit systems are real. After 9 11 terrors in 2001, security problem is appearing to every nations and international organizations main pending issue than any problem and various countermeasure is prepared. Security is the major issue in international trade, with significant potential costs and economic impact. So, We need to ensure that supply chain security does not become a new non-tariffs barrier. The aim of this study is to examine the international maritime and aviation law on the supply chain security. Also I review the supply chain security in U.S. and other countries.
