의료분쟁조정법의 시행에 따르는 현행법상의 해결과제 (Challenges in Accordance with Current Law by the Enforcement of the Medical Dispute Adjustment Act)

  • 의료분쟁은 전 국민을 대상으로 하는 의료보험사업의 시행과 더불어 건강에 대한 국민들의 관심이 증가하고 의료수요가 급격히 증가되는 가운데 필수 불가결하게 발생하는 문제이다. 분쟁의 대상은 대부분 의료인의 의료과오로 인한 형사적 처벌과 민사적 피해구제와 관련되는 것으로, 종래에는 합의에 의한 해결이 우선시 되었고 나아가 소송과 실력행사를 통해 해결하려 하였으나 명확한 기준과 관련 법제의 미비로 인하여 합리적이고 원활한 해결에 어려움이 있음을 부인할 수 없다. 이를 위하여 의료사고 처리와 의료분쟁을 분쟁당사자들 간의 자율적인 문제로 해결할 수 있도록 우여곡절 끝에 "의료사고 피해구제 및 의료분쟁 조정 등에 관한 법률"(이하 '의료분쟁조정법')은 2011년 4월 7일 제정되어 2012년 4월 8일 시행되었다. 이는 조정이나 중재로써 당사자 간의 갈등을 해결하려는 입법적인 취지가 있겠으나 의료분쟁조정법의 내용상 형사적, 민사적 관련 현행법과의 선결 되어야하는 문제와 더불어 헌법적 관점에서 고찰해야 할 검토 사항이 있다. 따라서 본 논문에서는 의료분쟁 조정법과 헌법상의 쟁점 및 형법적, 민법적 쟁점사항을 알아보고 이에 대한 해결과제를 모색하여 보다 안정적이고 효율적인 의료분쟁의 해결이 될 수 있도록 하는 계기가 마련되기를 기대해 본다.

초등학생의 안전사고 실태 및 예방전략에 관한 조사 연구 (A Study on the Occurrences and Preventive Strategies of Accident in Children)

  • Accidents are important causes of death and disability in children. They also have enormous financial implications. Young children become an victim of accidents easily because of their physical fragileness and their coping behavior being vulnerable to any actions taken by accidents. Once they have a accident, the children whose not fully developed, suffer from devastating long-term after-effects. Lee, Lee, Kang and Han(1995) reported that ninety percent of accidents can be prevented. But there is no national system to manage, evaluate and analyse the information about child accidents, even though it is necessary for accident prevention policies and health promotion of the general public. The purpose of the study was to determine how often children have accidents and define the accident prevention strategies in children. The investigator conducted a descriptive study by performing the surveys, interviews, and workshops for the 2,458 young children, 10 teachers, and 1,494 parents. The data collection for the study began on September 2000 and completed on April 20, 2001. The analysis of the data was done with Window SPSS 10.0 for descriptive statistics. Among those children, 1,298 children(52.8%) injured from accidents. The children who had accident answered that they injured from traffic accident(27.3%), inside the home(26.3%), on the playground(17.0%), during playtime(13.6%), in the school(5.9%) and food poisoning(7.1%). To define accident prevention strategies for the school children, the parents and the teachers who had a special interest in this topic formed a special task force under the guidance of the investigator. The team was charged to prepare the basis of content materials by identifying the problems, setting standards for the program, prioritizing the process, and selecting the methods of implementation and evaluation. Eight issues and concerns identified by the team were: 1)allowing young children to learn undesirable habits and behaviors that would bother others without knowing; 2) not guarding young children from car accident; 3)unattended accident at playground; 4) considering home places safe; 5)unattended accident at school. These issues were found to be coinciding with the actual child accident cases occurred recent years in Korea. Greater efforts are required to reduce unnecessary deaths and disability from childhood accidents. This study gave a very useful and important data to prepare accident prevention educational program and to prepare accident prevention strategies.

상박위(上膊圍)에 의(依)한 성장기(成長期) 아동(兒童)에 영양상태(營養狀態)의 판정(判定)에 관(關)한 연구(硏究) (A Study on the Nutritional Assessment of Early Childhood Using Mid-Upper-Arm Circumference)

  • Growth retardation and a variable degree of body disproportion are recognized features of malnutrition, and mild and moderate protein-calorie malnutrition(PCM). Among the various body measurements suggested to assess the prevalence of all grades of PCM as judged by growth retardation and by body disproportion, the 'mid-upper-arm circumference'-abbreviated to 'arm-circumference' has been suggested as a potential useful simple field index for the assessment of PCM showing that the measurement would give composite information simultaneously on three important effects on PCM-deficit in the muscle protein reservoirs, availability of calorie stores in the form of subcutaneous fat, and growth failure. And this is selected because of its easy accessibility, and less involvement with clinical edema. This study is conducted to make a comparison between the percentage of Korean weight for age standards and the percentage of mid-upper-arm circumference for age standards of 175 preschool children aged $3{\sim}72$ months who are selected among the low-income residents in Seoul. In this study, a comparison is made between the results obtained by expressing the observed weight of the child as a percentage of Korean standard, referred to as 'weight-for-age' and the observed arm-circumference expressed as a percentage of the age-specific arm standard of Jelliffe, referred to as 'arm-for-age'. All the measurements were taken following the techniques described by Jelliffe. The left mid upper arm was measured using a glass-fibre tape and the Fairbanks Morse beam balance was used for weighing. 80% level of weight for age Korean standard and 85% level of arm for are Jelliffe standard were used as an upper borderline limit for PCM. Comparing the 80% weight-for-age and the 85% arm-for-age standard as an upper limit for PCM, for children aged $3{\sim}72$ months, results in 84.6% agreement with the sensitivity of 86.4% and its specificity of 83.5%. If arm circumference alone had been measured and judgement made on this basis, then only 5.1% of the children would have been 'wrongly' classified. And there is a moderately close correlation between arm circumference and weight for age as the data in Table 4 shows. The problem therefore lies in the standard for arm circumference in normal children and in determining what is the lower limit of normal. Once this is clearly difined, one can rely more confidently on arm circumference measurements alone for the nutritional assessment of early childhood.

기술위험 관리와 위험갈등 : 휴대전화 전자파의 인체유해성 논란 (Managing Technological Risk and Risk Conflict : Public Debates on Health Risks of Mobile Phones EMF)

  • 새로운 기술의 개발과 확산으로 인해 기술 위험의 가능성과 영향이 크게 증가하고 있다. 불확실성을 기본적 속성으로 하는 위험의 특성상 지식의 불확실성 해소는 기술 위험관리의 핵심적 요소라고 할 수 있다. 지식의 불확실성이 기술위험 갈등의 중요한 원인이 되기 때문이다. 그러나 지식 축적만으로 기술위험 갈등이 해소되는 것은 아니다. 기술위험의 성격에 따라서는 기술위험에 대한 합의의 부족이 갈등의 주원인이 될 수 있기 때문이다. 휴대전화 전자파의 인체 유해성 논란은 대표적인 예라고 할 수 있다. 휴대전화 전자파의 인체 유해성 여부에 대해서는 명확한 결론을 내릴 수는 없지만 관련 지식이 꾸준히 축적되어 왔기 때문에 지식의 불확실성은 높지 않다. 산업계는 유해성을 입증할만한 뚜렷한 증거가 없기 때문에 법적 규제는 불필요하다는 입장인 반면 시민단체들은 유해 가능성이 입증되지 않았지만 가능성은 여전히 남아있기 때문에 사전 예방적 차원의 규제가 필요하다는 입장을 취하고 있다. 우리나라의 경우 시민단체의 지속적인 문제제기에 따라 정부는 인체흡수율(SAR) 기준을 설정하고 인체 흡수율 정보를 공개토록 하고 있다. 그러나 시민단체의 입장에서 보면 인체 흡수율 기준은 전신이 아닌 얼굴 부위에만 적용되는 제한적 기준이며, 인체 흡수율 정보도 자율적으로 공개토록 하고 있다는 점에서 완화된 형식적 규제라고 할 수 있다. 예방적 규제를 지지하는 시민단체와 산업계 보호의 관점에서 완화된 규제를 유지하려는 정부간에는 여전히 큰 인식 차이가 존재한다. 휴대전화 전자파의 기술 위험은 기술의 친숙성으로 인해 심각한 위험으로 받아들여지지 않고 있지만 심각한 갈등과 재난을 초래할 가능성도 있다. 따라서 이러한 문제를 예방하기 위해서는 안전의 목표를 경제적 목표와 통합하는 정책 통합과 위험 커뮤니케이션의 촉진을 통해 갈등 가능성과 재난의 발생의 소지를 차단하는 기술위험 관리가 필요하다.

보안 표준 지원 M2M 공통 서비스 플랫폼 (Common Services Platform for M2M Supporting Security Standards)

  • 사물통신(M2M)은 사람의 개입이나 간섭 없이도 2개 이상의 단말 간에 통신을 가능하게 하는 기술이다. M2M 통신은 환경 모니터링, 헬스 케어 등과 같은 다양한 유즈케이스에 적용될 수 있다. 대부분의 유즈케이스에서 M2M은 관심 있는 환경으로부터 데이터를 수집하기 위해서 센서 노드를 활용하며 데이터는 다른 기기(즉, 게이트웨이, 싱크 노드)를 거쳐 M2M 응용으로 전송된다. 어떤 유즈케이스에서는 M2M 단말들이 서비스의 신뢰성을 향상시키기 위해서 센서 데이터를 저장하고 처리할 수 있도록 설계되어진다. 게이트웨이와 싱크노드 또한 센서 노드들로부터 수집된 데이터를 저장 및 처리할 수 있다. 이러한 형태의 접근방법은 학계 및 산업계 모두에 매우 도전적으로 받아들여지고 있다. 이러한 접근방법의 성능을 개선하기 위해 본 논문에서는 M2M 단말과 게이트웨이를 위한 공통 서비스 보안 플랫폼(CSSP)를 제안한다. CSSP 플랫폼은 단말과 게이트웨이를 보다 정확하고 효율적으로 만들기 위한 솔루션을 제공한다. 게다가, 통신 프로토콜간의 비교 및 선정된 메트릭스에 따른 프로토콜들의 성능 분석을 제시한다.

해외 사례 분석과 국내 공간정보 분석을 통한 화산재 피해 분야 선정 (A Study on the Volcanic Ash Damage Sector Selection based on the Analysis of Overseas Cases and Domestic Spatial Information)

  • 한반도 주변에는 백두산, 아소산, 사쿠라지마산, 키카이산 등이 분포하고 있으며 최근 백두산의 분화 징후가 급증하고 있어 겨울철 분화 시 계절풍에 따라 화산재가 유입될 수 있는 피해가 우려되고 있다. 따라서 화산재 확산 및 피해에 대한 조사 및 대책에 대한 구체적인 절차가 필요하지만 우리나라 국가법령정보센터에서 제시하는 화산재 주의보 및 경보는 '피해가 예상될 때'와 '심각한 피해가 예상될 때'로 기준이 모호하다. 이에 본 연구에서는 피해발생 임계치를 분석하고 국외 피해사례를 국내에 적용하기 위하여, 공신력있는 공공기관의 국내 공간정보 구축 현황 조사를 수행하였다. 국외 화산재 피해 조사 결과 각 국가의 생활 형태나 수입원에 따라 피해사례가 자세히 작성된 부분이 상이하였다. 따라서 국외 화산재 피해 사례를 국내에 집적으로 적용하는 것이 아니라, 국내의 사회환경 및 자연환경의 특징을 반영한 공간정보 분석을 수행하였고 우리나라 화산재 피해발생시 고려해야 할 매체를 선정하였다. 최종적으로 국내 화산재 피해내역은 보건, 주거, 도로, 철도, 항공, 전력, 수도, 농업, 축산, 산림 그리고 토양으로 분류하는 것이 적합할 것으로 사료된다. 본 연구는 국내외 화산재 피해가 발생했을 경우 공신력 있는 공간정보를 활용해 피해 항목을 정리 했다는 것에 의미가 있으며, 향후 우리나라에 최적화된 화산재 경보 수립할 때 본 연구에서 조사한 국외 화산재 피해사례 및 국내 공간정보구축 현황은 정책수립에 도움이 될 것이다.

An outlook on livestock welfare conditions in African communities - A review

  • A significant proportion of the African continent is conducive for animal agricultural production, due to its historical experience and available resources to accommodate and nurture various indigenous and exotic animal species and breeds. With food security being a global challenge, animal products can play an important role as nutrient dense food sources in human diets, particularly in Africa. However, this does not seem to reach its full potential in practice, due to numerous reasons that have not been adequately addressed. Animal welfare reservations can be highlighted as one of the major contributing factors to the curbed progress. The consequences have been scientifically proven to affect product quality and market access. However, in the African community, the concept of animal welfare has not been fully embraced. While there are international animal welfare standards in the developed world, there are inherent factors that hinder adoption of such initiatives in most developing regions, particularly among communal farmers. These include cultural norms and practices, social ranking, socio-economic status, available resources, information dissemination and monitoring tools. Therefore, there is need to harmonize what is internationally required and what is feasible to accommodate global variability. The protocols followed to ensure and evaluate farm animal welfare require regular investigation, innovation and a sustainable approach to enhance animal productivity, efficiency and product quality. Additionally, investing in animal wellbeing and health, as well as empowering communities with significant knowledge, has a potential to improve African livelihoods and contribute to food security. This review seeks to highlight the concept of animal welfare in relation to livestock and food production in African conditions.

국내 구급차 내 수납공간의 문제점과 개선방안을 위한 디자인 연구 (Design Study for the Improvement of Storage Space in the Problem of Domestic Ambulances)

  • This research proposed a design direction for the ambulance interior storage space based on the placement and access to the equipment to facilitate an emergency medical practice taking into account the safety and efficiency by the emergency medical technician ergonomic factors. Therefore, through a field survey for the current derivation of the storage space problem 'placement', 'enable', 'management' like these three items resulting clarity, accessibility, simplicity and functionality of the four functional elements by targeting ambulances in operation in this country. First, there is a need to improve standardized of cabinet sizes fit to loaded meet emergency equipment standards. Currently, the equipment designed to use a simple storage cabinet has had problems in the usability. Second, it must be located in the continuous exposure in progress to the user's traffic line. Third, the problem was the insufficient function of the cabinet to ensure the safety of patients by paramedics from the emergency rescue equipment and due to the leaning of the ambulance driving. Besides, it was pointed out that in addition to the proposed alternatives, including the agenda, states that safety belt replacement equipment, emergency personnel and patients with the handle of a guardian for the efficient use storage space within the 119 ambulance. However, in the present study suggest that there is a state proceeds mainly limited usability in the field, having been installed.

산림보호지역의 관리효과성 평가지표 개발 연구 (Management Effectiveness Evaluation (MEE) Indicators Development in Protected Forest Areas)

  • In order to develop the indicators which evaluate the management effectiveness for the protected forest areas in Korea, candidate indicators were listed based on literature and experts interviews, then questionnaire survey on the experts were conducted. 5 elements of context, planning, input, process, output and outcome and 32 indicators were selected. Context element includes 6 indicators of 1) documentation and assessment of values; 2) documentation and assessment of threats, 3) influence of government policy, 4) related regulations, 5) community cooperation and 6) the structure of management organization. 6 indicators of Planning element were 1) the management objective, 2) protected area design, 3) protected area size and number, 4) representation, 5) standards and categories and 6) management planning. Input element of 3 indicators were 1) management staff, 2) funding, 3) establishment and application of information. Process element were consisted of 1) governance, 2) management guidelines, 3) human resource management, 4) law enforcement, 5) eco-management, 6) disaster management, 7) education program and 8) research and monitoring. The element of outputs and outcomes were 1) accomplishment of plan, 2) accomplishment of program, 3) private land management, 4) threats change, 5) biodiversity change, 6) ecosystem health and vitality, 7) impact on community, 8) international management level and 9) visitors' satisfaction and variation in civil compliant. It is recommended to have further research on evaluation methods development by applying those above developed indicators for the protected forest areas to ensure the practicality of the indicators.

Relationship between Soil Management Methods and Soil Chemical Properties in Protected Cultivation

  • Various cultural practices have been promoted as management options for enhancing soil quality and health. The use of soil management methods can cause changes in fertility by affecting soil chemical properties. This study aimed to evaluate interactions between soil chemical properties and soil management methods in protected cultivation, and to classify soil management methods that similarly affect soil chemical properties. Water-logging and irrigation reduced soil pH and available $P_2O_5$ content. Application of animal manures has a positive effect on levels of organic matter, Av.$P_2O_5$, K, Zn, and Cu. The electrical conductivites tened to be low in the application of organic amendments, including rice and wood residues. Deeper plowing caused a reduction in Ca content. Practicing soil nutrient-considering fertilization and fertigation did not exert an influence on nutrient element contents. In a cluster analysis of the soil management methods according to major nutrients, low similarities were found with deeper plowing and crop rotation with rice in comparison with other practices. In a cluster analysis by minor nutrient characteristics, crop rotation and application of animal manures and rice residues were linked at a high Ward's distance, while other practices were found to be relatively low distinct. Each soil management method has a similar or different effect on soil chemical properties. These results suggest the necessity of establishing limits and standards according to the effects of soil management methods on soil chemical properties for economic soil practices.
