군(軍) 정보수사기관의 대통령 경호활동 고찰: 1950년 한국전쟁 이후부터 현재까지 (A Study on Presidential Security Activities of Military Intelligence Investigation Agency - Since the Korean War, from 1950 to the present -)

  • 군(軍) 정보수사기관은 군내 정보업무와 내란 반란죄 등 특정범죄수사를 맡고 있는 국군 기무사령부가 유일하다. 기무사의 대통령 경호활동은 경호처 경찰과 함께 대통령 경호의 3대 축을 형성할 만큼 그 역할이 중요함에도 그동안 군(軍)의 특성상 일반에 알려진 내용은 매우 미미한 실정이다. 이에, 핵심인물 일대기 언론보도 공개자료 등을 토대로 기무사의 모체인 특무부대에서부터 오늘에 이르기까지 기무사의 경호와 관련된 부분을 살펴보았으며, 기존 연구에서 다루지 않았던 새로운 내용들을 발굴할 수 있었다. 첫째, 한국전쟁이 발발한 1950년대 남한 도처에 북한 무장병력과 좌익세력들이 위협하는 상황 하에서 특무부대는 공식적인 경호책임기관인 경찰보다 더 측근에서 1선 경호를 담당했다. 둘째, 1963년 경호실 출범 후에도 방첩부대, 보안부대, 보안사령부는 과거 특무부대 당시 이승만 대통령과 국가주요직위자들에 대한 경호책임활동의 축적된 노하우를 바탕으로 그 역할이 확대되어 왔다. 셋째, 1990년 기무사로 개칭이후 더욱 경호임무가 추가되고 법적 근거가 강화되었으며, 뛰어난 전문성을 바탕으로 G20 등 국가급 행사에서 중추적 역할을 수행하였다. 문재인 정부 출범 후, 국방개혁 조치로 기무사의 기능이 축소 폐지되는 가운데서도 경호분야는 오히려 조직을 보강하여 경호역량을 강화하고 있다. 이러한 경호역량 강화는 아직도 주적 북한과 정전체제로 대결하고 있는 상황에 효과적으로 대처함은 물론, 경호행사시 상시적으로 수상한 병력 움직임과 군부내 경호위해요인에 대한 감시가 필수적이라는 점에서 그 중요성이 증대되고 있다.

'평화통일국민협약' 추진의 법제도적 과제 (Legal Issues and Tasks for the Establishment of National Contract for Peace and Unification)

  • 한국 사회의 내적 신뢰위기, 특히 한반도정책에 있어 남한의 정치권과 시민사회단체 그리고 국민 사이에 존재하는 남남갈등은 지속적이고 일관성 있는 한반도 평화통일정책의 추진력을 크게 약화시켜 왔다. 한반도의 새롭고 대담한 평화를 위한 남북관계의 대전환기에 지속가능한 평화통일정책의 추진기반으로서 국민적 합의는 매우 중요한 의미를 갖는다. 이러한 배경에서 우리 국민 모두의 안위와 미래에 직결되는 한반도의 평화와 통일문제에 대한 일종의 사회적 협의체제로서 통일국민협약이 요구되어 왔다. 평화통일국민협약은 모호하고 추상적인 평화와 통일을 위한 사회적 공감대의 형성을 넘어 구체화된 한반도정책의 원칙과 방향 그리고 실천적 과제에 대하여 각 참여주체가 합의하고 합의된 협약에 대하여 준(準) 입법적 구속력을 부여한다는 점에서 세계적으로 유래가 없는 비공식적 법규범을 만들어가는 과정이다. 평화통일국민협약은 개념적 측면에서 과정과 결과 모두를 포함하는 '국민의 합의'로서 한반도평화번영과 통일의 '합의된 방향과 원칙'을 담고 있는 협약이며, '목표달성의 장기성과 참여주체의 개방성'을 특징으로 한다. 법적인 측면에서는 비공식적 법규범으로서 종전선언 전후에 추진되어야 할 관련 국내법제의 종합적 정비와 국제법적 합의의 정당성 근거를 제공하여야 한다. 또한 '국민의 법'으로서 평화통일국민협약의 법적 성격은 '정치적 강령'이나 사회적 합의의 차원을 넘어 합의의 내용이 관련 법제의 제정이나 개정의 법원(source of law)으로서 의미를 갖으며 조직화된 시민사회의 평가를 통해 협약으로부터의 이탈이 억제되고 구속력이 담보되어야 한다. 동시에 국민협약은 그 자체는 법규범이 아니지만 국민협약의 이행을 구체적으로 실행하기 위한 독립적 행정조직에 의하여 이행되는 연성법(soft law) 규범으로서 역할을 하여야 한다. 평화통일국민협약의 성립과 이행의 실효성을 담보하기 위해서 협약에 참여하는 국민적 대표의 범위결정과 협약추진 절차 그리고 협약의 추진과 협약체결 이후 이행을 위한 기구의 설립과 조직구성이 요구된다. 이를 위해서 정부의 독립행정위원회 조직으로 '(가칭)평화통일협약국민회의'의 설치와 '(가칭)평화통일협약국민회의법'을 통한 평화통일국민협약 추진법제의 입법이 요구된다.

『도헌』의 법률적 구성과 제도적 장치 연구 - 대한민국헌법을 중심으로 - (Research on the Legal Composition and Institutional Systems of The Dao Constitution: Focusing on The Constitution of the Republic of Korea)

  • 이 연구의 목적은 대한민국헌법에 구현된 법체계의 기본원리를 기준으로 『도헌』의 사상적 배경과 법률적 구성, 그리고 제도적 장치의 권력분립에 대해 분석하는 것이다. 『도헌』의 사상적 배경은 대순진리이다. 대순진리에는 선천의 상극적인 신의 의지로 인해 상극적인 자연법, 상극적인 자연 상태, 상극적인 인간으로 이루어진 진멸할 위기의 세상을 상제가 상생의 자연법, 상생의 자연 상태, 상생의 인간으로 개벽하는 우주 자연의 질서에 대한 패러다임의 전환이 설명되어 있다. 패러다임의 전환 시기 상제는 인간에게 상생적 인간이 되도록 신의 의지를 밝혔다. 따라서 『도헌』은 인간에게 부여된 상제의 의지를 도인의 사명으로 받아들여 실행하기 위한 '도인의 권리와 의무'에 기초한 근본규범이다. 『도헌』의 법률적 구성은 본문, 부록으로 되어 있고, 본문은 총칙, 도인의 권리와 의무, 연원, 제도적 장치로 구성되어 있다. 제도적 장치에는 중앙본부의 체계, 중앙종의회, 포정원, 정원, 종무원, 사업, 재정, 감사원, 도헌 개정 등으로 구성되어 있다. 『도헌』의 법률적 구성은 헌법의 법률 구성과 유사하다. 차이점은 헌법이 '최대권리 최소의 무의 원칙'이 적용된 데 반해 『도헌』에는 도인의 사명 완수를 위해 권리보다 의무가 더 많이 규정되어 있다. 『도헌』의 제도적 장치에는 권력분립의 원리가 적용되어 있다. 『도헌』상 중앙본부의 조직 형태는 도전의 별세 이전과 이후로 나누어서 살펴보았다. 도전의 별세 이전 중앙본부의 조직 형태는 입헌군주제와 유사하다. 『도헌』 상 도전의 별세 이후 중앙본부의 조직 형태는 의원내각제와 유사하다. 그리고 중앙본부의 기능 간 권력분립은 입법권(중앙종의회), 행정권(종무원), 사법권(감사원) 등 삼권분립의 원리이다. 중앙정부의 기능 내 권력분립은 첫째, 중앙종의회와 종무원 간에는 입법부 우위형(의회정부제), 둘째, 중앙종의회와 감사원 간에는 입법부 우위형(의회정부제), 셋째, 종무원과 감사원 간에는 사법부 우위형이다. 그리고 중앙본부와 방면 조직 간에는 수직적 권력분립의 원리가 작용하고 있다.

항공기(航空機) 사고조사제도(事故調査制度)에 관한 연구(硏究) (A Study on the System of Aircraft Investigation)

  • The main purpose of the investigation of an accident caused by aircraft is to be prevented the sudden and casual accidents caused by wilful misconduct and fault from pilots, air traffic controllers, hijack, trouble of engine and machinery of aircraft, turbulence during the bad weather, collision between birds and aircraft, near miss flight by aircrafts etc. It is not the purpose of this activity to apportion blame or liability for offender of aircraft accidents. Accidents to aircraft, especially those involving the general public and their property, are a matter of great concern to the aviation community. The system of international regulation exists to improve safety and minimize, as far as possible, the risk of accidents but when they do occur there is a web of systems and procedures to investigate and respond to them. I would like to trace the general line of regulation from an international source in the Chicago Convention of 1944. Article 26 of the Convention lays down the basic principle for the investigation of the aircraft accident. Where there has been an accident to an aircraft of a contracting state which occurs in the territory of another contracting state and which involves death or serious injury or indicates serious technical defect in the aircraft or air navigation facilities, the state in which the accident occurs must institute an inquiry into the circumstances of the accident. That inquiry will be in accordance, in so far as its law permits, with the procedure which may be recommended from time to time by the International Civil Aviation Organization ICAO). There are very general provisions but they state two essential principles: first, in certain circumstances there must be an investigation, and second, who is to be responsible for undertaking that investigation. The latter is an important point to establish otherwise there could be at least two states claiming jurisdiction on the inquiry. The Chicago Convention also provides that the state where the aircraft is registered is to be given the opportunity to appoint observers to be present at the inquiry and the state holding the inquiry must communicate the report and findings in the matter to that other state. It is worth noting that the Chicago Convention (Article 25) also makes provision for assisting aircraft in distress. Each contracting state undertakes to provide such measures of assistance to aircraft in distress in its territory as it may find practicable and to permit (subject to control by its own authorities) the owner of the aircraft or authorities of the state in which the aircraft is registered, to provide such measures of assistance as may be necessitated by circumstances. Significantly, the undertaking can only be given by contracting state but the duty to provide assistance is not limited to aircraft registered in another contracting state, but presumably any aircraft in distress in the territory of the contracting state. Finally, the Convention envisages further regulations (normally to be produced under the auspices of ICAO). In this case the Convention provides that each contracting state, when undertaking a search for missing aircraft, will collaborate in co-ordinated measures which may be recommended from time to time pursuant to the Convention. Since 1944 further international regulations relating to safety and investigation of accidents have been made, both pursuant to Chicago Convention and, in particular, through the vehicle of the ICAO which has, for example, set up an accident and reporting system. By requiring the reporting of certain accidents and incidents it is building up an information service for the benefit of member states. However, Chicago Convention provides that each contracting state undertakes collaborate in securing the highest practicable degree of uniformity in regulations, standards, procedures and organization in relation to aircraft, personnel, airways and auxiliary services in all matters in which such uniformity will facilitate and improve air navigation. To this end, ICAO is to adopt and amend from time to time, as may be necessary, international standards and recommended practices and procedures dealing with, among other things, aircraft in distress and investigation of accidents. Standards and Recommended Practices for Aircraft Accident Injuries were first adopted by the ICAO Council on 11 April 1951 pursuant to Article 37 of the Chicago Convention on International Civil Aviation and were designated as Annex 13 to the Convention. The Standards Recommended Practices were based on Recommendations of the Accident Investigation Division at its first Session in February 1946 which were further developed at the Second Session of the Division in February 1947. The 2nd Edition (1966), 3rd Edition, (1973), 4th Edition (1976), 5th Edition (1979), 6th Edition (1981), 7th Edition (1988), 8th Edition (1992) of the Annex 13 (Aircraft Accident and Incident Investigation) of the Chicago Convention was amended eight times by the ICAO Council since 1966. Annex 13 sets out in detail the international standards and recommended practices to be adopted by contracting states in dealing with a serious accident to an aircraft of a contracting state occurring in the territory of another contracting state, known as the state of occurrence. It provides, principally, that the state in which the aircraft is registered is to be given the opportunity to appoint an accredited representative to be present at the inquiry conducted by the state in which the serious aircraft accident occurs. Article 26 of the Chicago Convention does not indicate what the accredited representative is to do but Annex 13 amplifies his rights and duties. In particular, the accredited representative participates in the inquiry by visiting the scene of the accident, examining the wreckage, questioning witnesses, having full access to all relevant evidence, receiving copies of all pertinent documents and making submissions in respect of the various elements of the inquiry. The main shortcomings of the present system for aircraft accident investigation are that some contracting sates are not applying Annex 13 within its express terms, although they are contracting states. Further, and much more important in practice, there are many countries which apply the letter of Annex 13 in such a way as to sterilise its spirit. This appears to be due to a number of causes often found in combination. Firstly, the requirements of the local law and of the local procedures are interpreted and applied so as preclude a more efficient investigation under Annex 13 in favour of a legalistic and sterile interpretation of its terms. Sometimes this results from a distrust of the motives of persons and bodies wishing to participate or from commercial or related to matters of liability and bodies. These may be political, commercial or related to matters of liability and insurance. Secondly, there is said to be a conscious desire to conduct the investigation in some contracting states in such a way as to absolve from any possibility of blame the authorities or nationals, whether manufacturers, operators or air traffic controllers, of the country in which the inquiry is held. The EEC has also had an input into accidents and investigations. In particular, a directive was issued in December 1980 encouraging the uniformity of standards within the EEC by means of joint co-operation of accident investigation. The sharing of and assisting with technical facilities and information was considered an important means of achieving these goals. It has since been proposed that a European accident investigation committee should be set up by the EEC (Council Directive 80/1266 of 1 December 1980). After I would like to introduce the summary of the legislation examples and system for aircraft accidents investigation of the United States, the United Kingdom, Canada, Germany, The Netherlands, Sweden, Swiss, New Zealand and Japan, and I am going to mention the present system, regulations and aviation act for the aircraft accident investigation in Korea. Furthermore I would like to point out the shortcomings of the present system and regulations and aviation act for the aircraft accident investigation and then I will suggest my personal opinion on the new and dramatic innovation on the system for aircraft accident investigation in Korea. I propose that it is necessary and desirable for us to make a new legislation or to revise the existing aviation act in order to establish the standing and independent Committee of Aircraft Accident Investigation under the Korean Government.

청년창업보육센터 입주기업 성과에 미치는 지원 요인에 관한 연구 (Impact of Youth Start-Up Business Incubating System On the Start-Up Business Performance)

  • 본 연구는 정부 또는 지방자치단체의 청년 창업지원 사업 및 지원시스템이 창업성과에 미치는 영향을 분석하는데 그 목적이 있다. 이를 위해서 서울시 청년창업지원시스템(청년창업1000프로젝트)이 청년창업가의 창업성과에 미치는 영향을 설문조사를 통하여 실증적으로 분석하였다. 본 연구에서는 청년창업1000프로젝트에 수혜를 받은 20세이상 40세 미만의 청년창업가를 표본으로, 청년창업가 특성(수혜시기, 창업 시 자본금 규모, 입주 전 지적재산권 보유개수) 및 창업지원 서비스 요인에 대한 만족도(창업활동지원금, 홍보 및 판로개척지원, 입주자간 협업지원 등)가 창업성과(창업성공만족도)에 어떠한 영향을 미치는 지를 분석하였다. 실증분석 결과, 청년 창업가의 창업시 자본금 규모, 입주전 지적재산권 보유개수, 창업활동 지원금 지원, 홍보 및 판로개척지원, 입주사간 협업 지원들이 창업성과와 정(+)의 상관관계가 있는 것으로 나타났다. 또한 창업가의 특성 및 지원서비스와 창업성과와의 회귀분석 결과는 청년 창업가의 졸업기수, 사무실 규무, 지적재산권 기존 보유 개수, 창업활동 지원금 지원, 입주사간 협업 지원들이 청년 창업기업의 창업성과에 정(+)의 영향을 미치는 것으로 나타났다. 본 연구결과는 청년창업가의 창업성과에 영향을 미치는 요인에 대한 분석으로 정부 및 지방자치단체의 정책적 지원 방안의 기초자료가 된다는 점에서 시사점이 있다.

청소년대상 인쇄매체 성교육자료분석 (A Study on the Analysis of Sexual Health Education for Korean Adolescents)

  • The Purpose of this study is to offer basic data when the new printed media for sex education are developed, by grasping the problem through analyzing the data of the printed media for sex education that are produced by the government and composed of relatively inclusive contents. The subjects of analyzed data were 10 printed media books connected with sex education. This study focused on analysis for the printed media. therefore the method of analysis used effectively for the study of the mass media was used. The SAS program was used for analyzing the frequency of data and processing with percentage. The result of this study is as follows. 1. The subject of sex education that the printed media intend for was classfied the data for students and for teachers and the general. 2. According to the result of analyzing the writers of the printed media for sex education, classified by occupation, research workers accounted for $30.2\%$ as 23 persons, and the rest were distributed as 19 professors $(25\%)$, 13 teachers $(17.2\%)$, 10 workers in related institutions of various kinds $(13.1\%)$, 6 doctors $(10.6\%)$ and 3 writers $(3.9\%)$. Examing the organization of writers of the printed media for sex education for students, it was composed of sequence as research workers $30.5\%$. workers in related institutions of various kinds $19.6\%$, teachers $19.5\%$, professors $13\%$, doctors $10.8\%$ and writers $6.5\%$. And that of writers of the printed media for sex education for teachers and the general was shown as professors $43.2\%$ (13 persons), research workers $30.1\%$ (9 persons), teachers $13.2\%$ (4 persons) and doctors $10.2\%$ (3 persons). 3. Seeing the result of analyzing for the printed media, classified by themes, it was shown as 314.1 pages $(28.5\%)$ in a field of development of men, 195.9 pages $(17.6\%)$ in a field of sex-health, 141.7 pages $(12.9\%)$ in a field of relationship. 74.1 pages $(6.7\%)$ in a field of a sex act. 51.7 pages $(4.6\%)$ in a field of a personnal technology and 313.4 pages $(28.4\%)$ in the others. As are suit of the analysis classified by themes about the printed media for sex education for students, it was distributed as the content about sexual abuse $12.3\%$ (60.2 pages), the anatomical physiology of reproduction $12.1\%$ (59.3 pages). a friendship $8.5\%$ (41.6 pages). the reproduction $7.2\%$ (35.5 pages). a sexual disease $6.8\%$ (33.2 pages) and the puberty $4.3\%$ (20.9 pages). Examing the result of the analysis about contents classified by themes of the printed media for sex education for teachers and the general. it was indicated as 67.1 pages $(10.9\%)$ on the 'puberty', 37.9 pages $(6.2\%)$ on the anatomical physiology of reproduction, 36.6 pages ($6.0\%$ on a sexual disease, 23.2 pages $(3.8\%)$ on dating, 21.7 pages $(3.5\%)$ on a human sexual reaction. 21.0 pages $(3.4\%)$ on a sexual role. 20.1 pages $(3.3\%)$ of the reproduction. The suggestion according to the upper result is as follows. 1. It is needed to expand the range of analysis into the data. besides the printed media. into the data for sex education using such media as a video. a slide, a CD-ROM, on internet, etc. 2. It is necessary to develop the ideal program for sex education of teenagers and analyze the effect. on the basis of analyzing data about data sex education. 3. It is needed that practice workers for nursing or teachers for nursing as well as workers in educational field or medical experts participate in producing data for sex education.

방화범죄의 실태와 그 대책 - 관심도와 동기의 다양화에 대한 대응 - (The Reserch on Actual Condition of Crime of Arson Which Occurs in Korea and Its Countermeasures)

  • This article is the reserch on actual condition of crime of arson which occurs in Korea and its countermeasures. The the presented problem in this article are that (1) we have generally very low rate concern about the crime of arson contrary to realistic problems of rapid increase of crime of arson (2) as such criminal motives became so diverse as to the economic or criminal purpose unlike characteristic and mental deficiency of old days, and to countermeasure these problems effectively it presentation the necessity of systemantic research. Based on analysis of reality of arson, the tendency of this arson in Korea in the ratio of increase is said to be higher than those in violence crime or general fire rate. and further its rate is far more greater than those of the U.S.A. and Japan. Arson is considered to be a method of using fire as crime and in case of presently residence to be the abject, it is a public offense crime which aqccompany fatality in human life. This is the well It now fact to all of us. And further in order to presentation to the crime of arson, strictness of criminal law (criminal law No, 164 and 169, and fire protection law No. 110 and 111) and classification of arsonist as felony are institutionary reinforced to punish with certainty of possibility, Therefore, as tendency of arson has been increased compared to other nations, it is necessary to supplement strategical policy to bring out overall concerns of the seriousness of risk and damage of arson, which have been resulted from the lack of understanding. In characteristics analysis of crime of arson, (1) It is now reveald that, in the past such crime rate appeared far more within the boundary of town or city areas in the past, presently increased rate of arsons in rural areas are far more than in the town or small city areas, thereby showing characteristics of crime of arson extending nation wide. (2) general timetable of arson shows that night more than day time rate, and reveald that is trait behavior in secrecy.(3) arsonists are usually arrested at site or by victim or report of third person(82,9%).Investigation activities or self surrenders rate only 11.2%. The time span of arrest is normally the same day of arson and at times it takes more than one year to arrest. This reveals its necessity to prepare for long period of time for arrest, (4) age rate of arson is in their thirties mostly as compared to homicide, robbery and adultery, and considerable numbers of arsons are in old age of over fifties. It reveals age rate is increased (5) Over half of the arsonists are below the junior high school (6) the rate of convicts by thier records is based on first offenders primarily and secondly more than 4 time convicts. This apparently shows necessity of effective correctional education policy for their social assimilation together with re-investigation of human education at the primary and secondary education system in thier life. The examples of motivation for arosnits, such as personal animosity, fury, monetary swindle, luscious purpose and other aims of destroying of proof, and other social resistance, violence including ways of threatening, beside the motives of individual defects, are diverse and arsonic suicide and specifically suicidal accompany together keenly manifested. When we take this fact with the criminal theory, it really reveals arsons of crime are increasing and its casualities are serious and a point as a way of suicide is the anomie theory of Durkheim and comensurate with the theory of that of Merton, Specifically in the arson of industrial complex, it is revealed that one with revolutionary motive or revolting motive would do the arsonic act. For the policy of prevention of arsons, professional research work in organizational cooperation for preventive activities is conducted in municipal or city wise functions in the name of Parson Taskforces and beside a variety of research institutes in federal government have been operating effectively to countermeasure in many fields of research. Franch and Sweden beside the U.S. set up a overall operation of fire prevention research funtions and have obtained very successful result. Japan also put their research likewise for countermeasure. In this research as a way of preventive fire policy, first, it is necessary to accomodate the legal preventitive activities for fire prevention in judicial side and as an administrative side, (1) precise statistic management of crime of arson (2) establishment of professional research functions or a corporate (3) improvement of system for cooperative structural team for investigation of fires and menpower organization of professional members. Secondly, social mentality in individual prospect, recognition of fires by arson and youth education of such effect, educational program for development and practical promotion. Thirdly, in view of environmental side, the ways of actual performance by programming with the establishment of cooperative advancement in local social function elements with administrative office, habitants, school facilities and newspapers measures (2) establishment of personal protection where weak menpowers are displayed in special fire prevention measures. These measures are presented for prevention of crime of arson. The control of crime and prevention shall be prepared as a means of self defence by the principle of self responsibility Specifically arsonists usually aims at the comparatively weak control of fire prevention is prevalent and it is therefore necessary to prepare individual facilities with their spontaneous management of fire prevention instead of public municipal funtures of local geverment. As Clifford L. Karchmer asserted instead of concerns about who would commit arson, what portion of area would be the target of the arson. It is effective to minister spontaveously the fire prevention measure in his facility with the consideration of characteristics of arson.
