A Study on Unseaworthiness and Exclusive Right of Insurer on It (감항 능력 부족과 보험자의 면책 특권에 관한 해석론적 고찰)

  • One of the fundamental duty of the assured in a marine insurance contract is maintaining seaworthiness of the ship insured. Since duty of the seaworthiness of ship is a shipowners implied warranty in the marine insurance, the breach of the duty of seaworthiness by assured is recognized as immunity for the underwriter. This is a measure to protect the underwriter through prevention of unexpected casualties which may be occurred from the unseaworthiness. In the Korean Marine Insurance Act the legal character of the assured's duty of seaworthiness is not clear whether it is a legal duty or contracted one. Accordingly, in this paper the author pointed out that the duty of seaworthiness of the ship should be interpreted according to the English Law. As a conclusion, the hull insurance does not require even implied warranty concerning seaworthiness, since it is recognized as one of implied fundamental warranty of the English Marine Insurance Act. Especially, this issue pointed out is very meaningful and advisable under the consideration of the existing conditions of the marine insurance regime for the distant-water fishing vessels and the catch carriers in Korea.

Acoustic effects of the sound tube and resonance cavity in Korean Brahman Bells (한국범종의 음관과 명동)

  • The presence of the sound tube and resonance cavity is unique in Korea Brahman Bells which is no examples in other country bells in the world. The sound tube erected in the crown is effective to emit the fundamental tone of the bell when the condition of resonant transmissibility is satisfied. The results of our analysis shows that the optimum length of the sound tube in the Bell Emile is 96cm but is not the present length, 77cm. The resonance cavity erected underneath the lip of the Bell Emile is found to be for the resonance of standing waves in the space including both bell cavity and resonance cavity and resonance cavity to the fundamental tone of the bell itself, in order that the strongest vibration can last long by least energy and lengthen the reverberation of the bell. Some historical remarks are also made on the magic flute, MANPASIKJUK, which was in existence in Shilla that can lull all evil waves, such as plagues, storms, droughts, famines and even enemies. The sound tube erected in the crown of the bell was originated in this magic flute. Finally, a strong proposal is advanced on the new national symbol of Korean traditional cultural assets. Indeed, it should be highly recommended that the Great King's Bell Emile would be the only real symbol of our national cultural assets by its own right of excellency and richness in every aspect of arts and sciences.

  • This study is to consider the fundamental perceptions of pre-service elementary school teachers to natural environments. The recognition items of questionnaire for those environments include ones of water, atmospheric, soil, biologic and oceanic environments constituting of the earth system. From the results of the study, they affirmatively recognized biologic environment, but they showed highly negative recognitions to others. In other side, it is considered that their recognitions to natural environments were probably transferred by the things which involve press media, curricula and real lives. On the basis of the study results, systematic teaching-learning for natural environments is essential because the encouragement of eco-friendly attitude, one of main goal for environmental education, is budded from basic understandings to natural environments. Affirmatively environmental worldviews for elementary school students are important for reasons why teacher's quality and practice will is fundamental, and then teacher could change the views of the students for environmental education. So, preparing balanced attitudes, right concepts and connection to applicable knowledges for natural environments, pre-service elementary school teachers in environmental education must be pointed to organized education between human and natural environment.

Morphological classification of the moderator band and its relationship with the anterior papillary muscle

  • This study investigated and classified the various types of moderator band (MB) in relation to the anterior papillary muscle, with the aim of providing anatomical reference information and fundamental knowledge for use when repairing the congenital defects and understanding the conduction system. The study investigated 38 formalin-fixed human hearts of both sexes obtained from donors aged 38-90 years. The MB was evident in 36 of the 38 specimens (94.7%). The morphology of the MB and its connection with the APM took various forms. The MBs that had a distinct shape were classified into three types according to their shape: cylindrical column, long and thin column, and wide and flat column. Types 2 and 3 were the most common, appearing in 15 (41.7%) and 14 (38.9%) of the 36 specimens, respectively, while type 1 was observed in seven specimens (19.4%). Type 3 was divided into subtypes based on their length. The MB usually originated from a single root (91.7%), with the remainder exhibiting double roots. The pairs of roots in the latter cases had different shapes. The originating point of the MB ranged from the supraventricular crest to the apex of the ventricle. The most-common originating point was in the middle (25 of 36 specimens, 69.4%), followed by the upper third (13.9%), the lower third (11.1%), and the top fifth (5.6%) of the interventricular septum. This study has produced fundamental anatomical and clinical information that will be useful when designing cardiac surgical procedures.

  • This study is aiming to suggest baseline date for the establishment of policy alternative to make healthy consumption life of the elderly through investigating and analyzing actual condition of consumption related with the awareness of health functional food such as purchase behavior and consumer's problems about health functional food. Under the assumption that the vitalization of health functional food market will become an important market in the present and in the future, the fundamental marketing information about elder consumers is more important than any other information that is essential for successful marketing to domestic corporations and senior policy experts. In addition, there was a fundamental significance to provide necessary basic data for health promotion of the elderly by offering information about rights and interests of elder consumers who are members of vulnerable social group or right choice of purchasing or intake. The limitations of this study are as follows. First, the subjects were selected who live in Gangwon-do with the age of 60 and over due to the limitation of sampling, and that might be shown local characteristics. Therefore, the study result could not be generalized on behalf of all elderly in Korea and it is difficult to apply the result to more segmented market. To solve this problem, studies containing sampling by regional groups might be needed.

The fundamental frequency (f0) distribution of American speakers in a spontaneous speech corpus

  • The fundamental frequency (f0), representing an acoustic measure of vocal fold vibration, serves as an indicator of the speaker's emotional state and language-specific pattern in daily conversations. This study aimed to examine the f0 distribution in an English corpus of spontaneous speech, establishing normative data for American speakers. The corpus involved 40 participants engaging in free discussions on daily activities and personal viewpoints. Using Praat, f0 values were collected filtering outliers after removing nonspeech sounds and interviewer voices. Statistical analyses were performed with R. Results indicated a median f0 value of 145 Hz for all the speakers. The f0 values for all speakers exhibited a right-skewed, pointy distribution within a frequency range of 216 Hz from 75 Hz to 339 Hz. The female f0 range was wider than that of males, with a median of 113 Hz for males and 181 Hz for females. This spontaneous speech corpus provides valuable insights for linguists into f0 variation among individuals or groups in a language. Further research is encouraged to develop analytical and statistical measures for establishing reliable f0 standards for the general population.

  • In recent years, advanced in digital technologies have created significant changes in the way we reproduce, distribute and market Intellectual Property (IP). DRM for multicast contents is complicated risk, the further technology development and human demand, this approaching is still being researched by the scientist and all by the company which is conducting in piracy management reduced, and every country has national policy to make this consortium to limit piracy properties, based on this paper research development, just only two approaching to reduce piracy in DRM they are Industrial Property (IP) and Copyright. In this paper, we are not only figuring and analyzing about the processes to reduce and limit the piracy and unprotected copy law but also describing about the encryption process, watermarking and digital signature process algorithms. The basic concepts of this encryption process for web-based multicast content in DRM are implemented in Java. We conduct this method is a computerized through web based application system approaching to reduce unprotected copy and piracy. Which is used in DRM for multicast content in every section, by providing a fundamental in information technology development, we believe this research is reliable to prove that is unprotected copy, and piracy can be reduced by protecting with this paradigm.

  • Information and Communication Technologies(ICTs) have substantially enlarged both the opportunities to realize one's human rights but have also resulted in the emergence of new challenges. ICTs are so deeply embedded and cental to almost all aspects of human activity. And ICTs are assuming an increasingly central role in all aspects of human and societal development across the world. But this is especially true of the right to privacy, which faces challenges such as profiling and data mining for public(including national security) and private purposes. ICTs access is a fundamental right for all humans in the information age. So we have need for regulation based on human rights in the digital age. And governments have a responsibility to protect individuals against violations of human rights and data protection by public authorities, but also by private entities. In addition, internet governance and multi-stakeholder principle have to be stressed on all of the internet issues because internet governance is included in the principle of democracy which have bottom-up communication and equality. So it is very importance that Internet Governance Forum is the space for a meaningful discussion on public policy issues relating to the internet.

SOME ABELIAN MCCOY RINGS

  • We introduce two subclasses of abelian McCoy rings, so-called π-CN-rings and π-duo rings, and systematically study their fundamental characteristic properties accomplished with relationships among certain classical sorts of rings such as 2-primal rings, bounded rings etc. It is shown that a ring R is π-CN whenever every nilpotent element of index 2 in R is central. These rings naturally generalize the long-known class of CN-rings, introduced by Drazin [9]. It is proved that π-CN-rings are abelian, McCoy and 2-primal. We also show that, π-duo rings are strongly McCoy and abelian and also they are strongly right AB. If R is π-duo, then R[x] has property (A). If R is π-duo and it is either right weakly continuous or every prime ideal of R is maximal, then R has property (A). A π-duo ring R is left perfect if and only if R contains no infinite set of orthogonal idempotents and every left R-module has a maximal submodule. Our achieved results substantially improve many existing results.

  • With Seopa Ryu-Hee's Chunqiugwalyebulyu as the main research subject. this paper is to clarify characteristics in classification of the book's introductory remarks and its academic values. This book is a sort of synthetic collection of introductory remarks classification that defines standardized introductory remarks based on fundamental principles of Chunqiu introductory remarks. Seopa presented two fundamental principles for classifying Chunqiu introductory remarks. First, he clearly defined the nature and the system of the book Chunqiu, which was to present the background of classifying Chunqiu introductory remarks. Second, he declared that writing style and righteousness in Chunqiu serves as standard for classifying the introductory remarks. Seopa classified introductory remarks by type in accordance with these fundamental principles of introductory remarks in order to lay the groundwork for right interpretation of Chunqiu. Further, he was convinced that this classification of introductory remarks would block any chance of the book's wrong interpretation and at the same time, be able to remove the rationale behind distorted theories. This book can be appraised to have significant academic values in that it attempted standardization in classifying Chunqiu introductory remarks through systematic and synthetic analysis on various introductory remarks.
