UCP 600 해상운송서류(海上運送書類) 규정(規定)의 주요(主要) 개정사항(改正事項)에 관한 연구(硏究) (A Study on The Revision of UCP600 concerning the Sea Transport Documents)

  • UCP 600 approved at the Banking Commission Meeting of ICC at the end of October, 2006 comes into effect from July 1, 2007. The main revision of the UCP 600 concerning the sea transport document are as follows. First, if the bill of lading contains an on-board-notation, with the date of shipment, the date stated in the on-board-notation will be deemed the date of shipment. Secondly, phrases "on its face" and "otherwise authenticated" should be eliminated. Thirdly, when an agent signs for or signs on behalf of the master, there is no longer a need for the name of master to be quoted. Fourthly, the terminology "loading on-board or shipped on a named vessel" is changed to "shipped on-board a named vessel." Fifthly, phrases "the rejection of the documents transported only by sail" is removed. Finally, new rule in UCP is the signing of a charter party bill of lading by the charterer or a named agent on behalf of the charterer. My assessment of the revision in UCP 600 is as follows: Because a freight forwarder transport document is a weaker form than a liner bill of lading as collateral, banks may need a secure measure as to protect themselves from such a weak collateral effect. we recognize that Such a weak collateral effect stemmed from the elimination of rules in UCP 500 article 30, and the admission of transport documents issued by the freight forwarder as long as any one besides carrier, shipper, and charterer satisfies the requirements of transport document clauses in UCP 600. Finally, I hope the Commentary on UCP 600 will serve to explain the ambiguities remaining in the new rules.

국제물류주선업체의 부서 간 역학관계가 관계몰입과 성과에 미치는 영향 (A Study on the Effect of Inter-departmental Dynamics on Relationship Commitment and Performance in International Freight Forwarder)

  • 본 연구는 국제물류주선업체의 부서 간 역학관계가 시장지향성에 어떠한 영향을 미치는지, 그리고 시장지향성이 관계몰입을 통해 고객성과에 미치는 영향에 대해 규명하여 국제물류주선업체의 경쟁력을 향상시키고자 실시하였다. 연구결과 부서 간 연계를 통해 부서 간 갈등수준이 낮아져야 시장지향성이 높아진다는 것을 알 수 있었다. 하지만 시장지향성이 고객성과에 미치는 영향에 대해서는 유의한 영향력을 확인할 수 없었으며, 시장지향성은 관계몰입이라는 매개변수를 통해 고객성과에 유의한 영향을 미친다는 점이 밝혀졌다. 현재 우리나라의 국제물류주선업의 시장은 매우 경쟁적이며, 경쟁전략의 대부분이 비용전략이며, 비용전략은 다른 경쟁기업이 고객에게 제공하는 비용에 따라 수시로 바뀌는 실정임을 비추어 볼 때, 국제물류주선업체들은 출혈경쟁을 지양하고, 고객기업과의 신뢰형성과 장기적인 관계유지를 위해 노력을 기울여야 경쟁력이 강화될 것으로 보인다.

컨테이너 터미널 경쟁력향상을 위한 항만마케팅 전략에 관한 연구 (A Study on the Port Marketing Strategy for Strengthening the Competitive Power of the Container Terminal)

  • The intensification of the competition among container terminals has led to important affect such as, decision making or aggressive intervention of customers for terminal operation. Therefore, in case of developed ports, the large transition of port operation is composed of the press of terminal customer than decision making of terminal manager. Overall port tariffs for using terminal is made out by the conference of terminal customers than the supreme headquarters of terminal operation, and the related investment of terminal has been made according to requisition or proposal of customers. Therefore, among decision making problems that shippers, shipping companies, and freight forwarder among decision making problems that shippers, shipping companies, and freight forwarder face, the choice of the container terminal is one of the most important problems. So, the decision making of the users seems to have a significant impact on the competitive power of container terminals. The main objective of this study is to design port marketing strategy for strengthening the competitive power of container terminals. The results of this study were found as follows: Firstly, port authority should establish user-oriented operation policy of terminal as the means of activating the opinion window, using terminal monitoring system(TMS). Secondly, terminal planning and development of government should be made to minimize the lead time, to induce the civil capital and to utilize the economies of scale. Thirdly, port authority needs to endeavor to analyze the information of competing foreign terminals as well to promote the concentrated marketing for the terminal on the users, to train the expert and to develop the new port charge system. Fourthly, to improve the competitive power of the container terminal, Port Authority should optimize the subsystems related to port marketing, far more these systems should be joined organically to work effectively. Finally, port authority system should be introduced, Namely, port should have the enterprise inclination as well s the public inclination.

수출 화주기업 물류위탁 특성이 포워더와의 거래형성과 지속에 미치는 영향 연구 (A Study on the Effect of Logistics Consignment Characteristics of Export Shippers on the Formation and Continuation of Transactions with Forwarders)

  • If import/export shippers entrust their international logistics activities to forwarders, they can receive good logistics services at a lower cost. Therefore, it is important to form a trading relationship between the export shipper company and the forwarder, and it helps to improve the competitiveness of the company. This study derives factors that an export shipper company forms a transaction relationship with a forwarder, and analyzes the effect of transaction formation factors on transaction continuity. Next, the relationship between export consignment characteristics of export shippers and their influence on transaction formation factors and transaction continuity is identified. As a result of the study, transaction formation factors consisted of price, quality, and companionship, and all factors were found to affect transaction continuity. The characteristics of consignment logistics for shippers are the proportion of consignment, the number of business partners, and the transaction period. The proportion of consignment and the number of business partners affected the price factor, and the number of business partners affected the quality factor. There was no mutual influence between the transaction continuity and the characteristics of the shipper's logistics consignment. Therefore, there is a need for recognition of a relationship that can grow between shippers and logistics companies through consignment transactions rather than subordinate recognition based on fair transactions.

인천항 물류애로요인 분석에 관한 연구;컨테이너 화물을 중심으로 (A Study on Analyzing Bottlenecks of Logistics in Incheon Port;Focused on Container Freight)

  • As the current trend to the main index of the port competitiveness evaluation, the competitiveness index of the port service comes to more important than the part of expense, location and facility. To reform the bottleneck of port has an effect on improving port service competitiveness. Therefore, this study shows the importance of analyzing bottlenecks on logistics to improve port competitiveness. It collected recent questionnaire data which are the subject as the Custom Service, the Chamber of Commerce and Industry, the Trade Association about bottlenecks of port logistics for working out bottlenecks of domestic port logistics and it produced the order of priorities of bottlenecks by multiplying each output priorities and weights of each process in user of Incheon inner-outer port which is focused on container freight by analysis of priority and Analytic Hierarchy Process(AHP). Unlike existing studies, this study has important values. It presents the priority evaluation only focused on the container freight was produced by port users who are categorized into shipping company, terminal operation company and forwarder, car-ferry in Incheon inner-outer port and making a application of logistics process. It means internal and external competitiveness improvement plan can be presented more concretely and detailed than past competitiveness attributes such as location, facility, service and expense. If the analysis of port logistics bottlenecks which was focused on container freight is extended to the part of general cargo and sundries such as haul grain, car, scrap iron, those studies will be able to provide Incheon port users with useful information and a model of analyzing overall bottleneck of logistics in Incheon port.

구조 방정식을 활용한 국내 화물자동차 회사의 경영모델 연구 (A Study on the Management Model of Domestic Freight Company Using Structural Equations)

  • 본 논문은 위수탁제의 주체인 화물자동차 운송회사와 위수탁차주 간의 지속적인 발전과 상생을 위한 경영모델을 제시하였다. 화물자동차 운송시장의 내외적 환경분석 및 운송회사와 위수탁차주 대상의 설문을 진행하여 사업 주체자들의 서로에 대한 인식과 개선 요구 사항 등 경영모델 수립에 필요한 변수를 측정할 수 있는 구조방정식 기반의 설문지를 개발·분석하였다. 분석 결과, 위수탁제도의 합리성은 재무성과나 운송서비스의 수준에 유의한 영향을 미치지 않는 것으로 확인된 반면, 운송 사업의 외부 환경과 보상시스템은 재무성과와 운송서비스 수준에 유의한 영향을 미치는 것으로 분석되었다. 또한 위수탁 제도의 합리성은 사업 주체간 관계 개선에는 영향을 미치지 않으나, 신뢰 수준 향상에는 영향을 미친다. 운송 사업의 외부 환경과 보상시스템은 관계 개선과 신뢰수준 향상 모두에 영향을 미치는 것으로 확인되었다. 신뢰수준은 재무성과에 영향을 미치고, 관계 개선은 재무성과와 운송서비스 수준 모두에 영향을 주지 않는 것으로 나타났다. 운송회사와 위수탁차주가 화물자동차 운송시장에서 지속적으로 발전하고 상생하기 위해 확인된 분석 결과를 토대로 위수탁제를 관리할 필요가 있다.

컨테이너 항만의 마케팅 전략에 관한 연구 (The Port Marketing Strategies of the Container Terminal)

  • The main purpose of this study is to design the port marketing strategies for strengthening the competitive power of container terminal. So far many attempts have been made to analyze the international competitiveness of the terminal. Six factors hypothesized by this study come from previous research analyses about customers preference for port selection. Those are Cost Centrality and Intermediacy Free trade port Inland transportation connections Political and Economic institution and Port facilities. this study analyzes the most important factors about hob port and transhipment port separately through questionnaire analysis about users(shipper shipping company and freight forwarder) influencing on port selection.   • 선박의 대형화 및 해상사업의 기업화 등에 따라 해상운송에 있어 화물의 하역, 보관 등의 전문적인 부분을 담당하고 있는 항만하역업자, 항만터미널운영자, 창고업자 동 독립계약자의 역할은 점점 증대되어 가고 있는 추세이다. 하지만 국제해상운송은 해상운송인과 화주를 중심으로 체결한 운송계약을 중심으로 이루어져 왔으므로, 영국 보통법상의 직접계약관계의 원칙에 의해 계약당사자가 아닌 자는 계약상의 이익을 원용할 수 없다는 입장을 유지하여 왔다 이에 대해 이를 완화하고자 하는 다양한 방안이 적용되고 있으며, '히말라야약관'도 그러한 방안중의 하나이다. 본 논문은 최근 대법원판결을 통해 우리나라 법원의 히말라야약관의 유효성 인정에 대한 내용을 재검토해 본다.

로테르담 규칙에 대한 평가와 전망 (An Appreciation and a Prospect on the Rotterdam Rules)

  • The Rotterdam Rules, which was adopted in December 2008 by UNCITRAL, has underlying intention that it will provide uniform law for the international carriage of goods by sea and modernize transport law reflecting modern transport custom. However, it is also true that there are various conflicting views on the Rotterdam Rules. This article tried to analyze main controversial issues such as scope of application, basis of liability of the shipper and the carrier, exception th the volume contract, legal position of the freight forwarder, delivery of the goods from the both sides of view. The Rotterdam Rules exposes some problems in applying and interpreting the Rules as many people indicated. These problems, I think, mainly due to the extended scope of application and broader range of issues. However, I do not think that the Rotterdam Rules will serious affect to the international transport industry. Furthermore, it is unreasonable to expect perfect Rules satisfying every interests.

  • The importance of service quality in any service industry cannot be disputed. Shippers have increased expectations concerning the quality of shipping service they receive and carriers are struggling to meet these expectations. This struggle between shipper and carriers would suggest that there is room to improve much more understandings of how shipper define shipping service quality in the carriers' perspectives. This is an empirical investigation and study on the measurement of customer response and service quality as perceived by customer in the international transportation logistics system. The purpose of this study is to clarify factors of shipping service quality on the basis of service marketing concept. In order to fulfill the objectives, this paper combined research tools that include both empirical study and documentary research. Data was gathered from 132 freight forwarder by the use of questionnaire. In this study, the established hypotheses were generated on the basis of the service quality evaluation model(SERVQUAL, SERVPERF, and EP) and Gap model.
