A Study on the Scope of Protection for Freedom of Expression on Internet: Focused on the Analysis of Judicial Precedents on Cyber Conflicts (인터넷에서 표현의 자유 보호 법리에 관한 연구: 사이버 분쟁에 대한 법원 판례 분석을 중심으로)

  • Various opinions are expressed about the Internet Regulation. Some people argue that it is impossible to control because of the technical characteristics of Internet, while other people argue that it is easy to control. Recently in Korea, a move to reinforce the Internet Regulation through the extension of cyber real-name system is emerging, whereas the concern for its excessive infringement of the Freedom of Expression is increasing. This paper was intended to draw a reasonable direction for Internet Regulation in our society. And accordingly this paper tried to suggest a desirable direction of Internet Control in the future and to draw a criterion for domestic court judgement by analyzing cases of cyber defamation so far. The result of this study proposed that the Freedom for Expression be widely secured in the case of cyber defamation of criticism and political comments upon public officials and that the legitimacy and effectiveness of Internet Regulation be ensured. This result of study is expected to help establish the direction and principle of Internet Regulation in the future around Korea Communications Commission and Korea Communications Standards Commission.

  • Parody is credited for one of the forms of artistic presentation, and the utilization has been increasing day by day. However, there is no clear regulation in legislation or case. Parody is usually made without authorization to exploit of original author, so there is a lot of controversy over its infringement of copyright. Constitutional Law guarantees the freedom of expression and that of art, but it protects the author's right as well. So it is important how settle the collision of fundamental rights. It is expected the development of a variety of discussion on parody from the views of the basic value the Constitution pursues and the improvement and development of the culture that is the purpose of Copyright Act.

  • This paper attempts to portray the issues of intellectual freedom that confront librarians in developing collections in libraries. It is observed that the issue has hardly been drawn attention in Korea while, from various cases, concerns about intellectual freedom have been increased in many countries. Situated in this observation, this paper surveys various aspects of endeavors to protect intellectual freedom in information service settings. It is also stressed how such issues as free access to information, freedom to know, information barriers in public sectors, and freedom of expression are addressed in library world. Emphasis was also put on the meaning of intellectual freedom as viewed through some policy documents and guidelines in other countries and its implications.

  • Recently, Game Rating Board has been established. It is to follow worldwide trend in building up publicity, autonomy and professionalism under the framework to assure freedom of expression. This article analyzed major nation's game rating system, and showed some points to need improvement which are to have more detailed classification in game rating, to modify contents descriptor, to appoint committee members with expertise on game, to revise articles to be capable of misuse, and to become a nongovernmental organization.

  • With the drastic development of technology for almost eternally saving digital information, cases for giving sufferings to a person who deserves to enjoy privacy have increased. So I study the right to be forgotten focusing on the collision between that right and freedom of expression. I also study the concept of the right to be forgotten and its legal basis for the protection of that right. That right can be protected mainly by the self-decision making right under the Article 10, and secondly the privacy right under the Article 17 of the Constitutional Law. The Press Arbitration Law can be applied to protect the right to be forgotten, but that Law needs the revision of time-limit clause for complain, protection clause for the right to ask to delete factual past article, and the clause of staleness doctrine for the consent of giving personal information.

  • Since the use of the Internet has proliferated, the availability of illegal and harmful content has been a great concern to both governments and Internet users. Among various solutions for issues related to such content, Internet content filtering technologies have been developed for enabling users to deal with harmful content. In recent years, commercial filtering has become massively popular. Many parents, teachers and even governments have chosen commercial filtering software as a feasible technical solution for protecting minors from harmful information on the Internet. The Internet content filtering software market has grown significantly. However, Internet content filtering software has led to intense debate among civil liberties groups, They deem this to be censorship and argue that Internet filtering technologies are simply unworkable because they have inherent weaknesses. They are critical of the fact that most filtering has violated free speech rights and will eventually wipe out honor and controversial, yet innocent incidences of free speech on the Internet. In this article Internet content filtering, in particular PICS/RDF-based label filtering, so-called Internet content rating system, will be explored and its advantages and drawbacks relating to end-users' autonomy and freedom of expression will be discussed.

  • This study focuses on "Intellectual Freedom" based on the fundamental principles of library services. Particularly, this paper pursues to the legal foundations of "the freedom of expression". The American Library Association celebrates "the Banned Books Week" to draw attentions to the danger of banned books and censorship. This study also studies how "the banned books" are made by pursuing the definitions of "pornography" and "obscenity" in terms of the court's opinions of The Supreme Court of the United States and Korea. Recently, the top three reasons for the "banned books" are considered to "be sexually explicit", "contain offensive language" and "be unsuitable to age groups".

  • Matters related to the right to be forgotten started the dispute Europe to introduce it first when Data Protection Directive established in 1995 proceeded revision. Relating to this, diverse disputes proceed on responding to personal information protection and internet laws in our nation. Especially as our National Assembly submitted the law regarding the promotion of information and communication network use and protection of information and amendment of copyright, it is necessary to look into the movement on introduction of law of right to be forgotten closely in detail. EU which attempted the institutionalization for the first time, relating to review of General Data Protection Regulation, proposed opinions such as the necessity to define subjects of personal information concretely and specifically and or protection target and balanced consideration on freedom of expression which is constitutional value. In the case of our nation, there was legislation attempt to introduce the regulation but it was limited in the form of fallen effectiveness without concrete and detailed review on internet law. To solve such problems, it is necessary to look into issues and matters to be considered required to accept right to be forgotten closely and discuss possibility of introducing right to be forgotten, conflicts between fundamental rights becoming issue, effect of goal achievement of personal information protection through the system introduction, and other rational acceptance method.

  • The purposes of this study is for consideration of the flapper image through the culture and novels in Jazz Age(1919∼1929) of America. The back ground of flapper fashion was Jazz. Jazz was one of the cultural languages which expressed liveness, noise, salacity, harmony of primitivity, modernity, innocence and freedom. In processing American had gotten economic power, the Jazz Age had new mood which was combined materialism and realitism. Environmental changes of life styles and development of mass culture of modern big cities could aid the birth of modern girls, flappers. They became the main group of new consumer and mass culture in new consciousness and freedom with independence. Their characteristics are confirmed from Fitzgerald's novels, This Side of Paradise and The Great Gatsby. As the results of above, the consciousness of flapper were rebellious attitude, liberalism and actualism. The designs of flapper fashion were expressed by simplicity, functionality, nudity and rhythm. The flapper images are as follows: First, they expressed modern image as a rebellious attitude. Second, flapper had a sensual image of freedom through rhythmical and speedy expression. Third, premature image for pursuing youth could be found. Therefore the changes of culture and women's life styles are very important points for fashion studies and the connecting fashion and other fields like novels is needed also for it.

  • The study is in depth an analysis of the consciousness structured in unisex, androgyny, punk and postmodernism fashion in order to explain the dominant bisexual trend in fashion since the 1960's. Bisexuality in fashion can be interpreted as an effort in recovering the attitude within commentarialism, as opposed to the dichotomous split of the sexes. It is a reflection of the fundamental desire to be as one and implies "freedom" as an expression of feminism and postmodernism furthermore. Bisexuality is a reactionary movement in fashion which encompasses adaptive ways to the world we now inhabit. It is also a clear picture of the necessity of destroying the dichotomous sexuality in order to achieve the freedom and the importance of realizing as a whole the oneness of human kind. Bisexuality in fashion primarily is the pursuit of a new perspective on the human entity required in the modern world. Namely a communitarian spirit devoid of sexual prejudices. And secondly, it is a phenomenon reflecting the transitional woes of the pluralistic society experiencing deconstructivism and reconstructivism.ructivism.
