Establishing of Fishing Bank GIS System (어장도 지리정보시스템 구축)

  • Today, administration management of fishing industry is formed by paper documents. So, it is suffered damage and loss concern by the long-term storage. when the new informations is renewed, much of manpower and time are wasted also. In addition, it has caused confusion to by used coordinate system which is not been consistent. To build a national standardized information system of fishing banks, in this study, fishing map DB and system based on GIS is constructed for fishery right area of JeollaNamdo (Mokpo city and other 14 counties) which has 55% of fishing permissions of Korea. Then administration management of fishing industry is constructed computerization for the user that business processing and for fishermen to improve their convenience. Also, It will be possible to link another system.

A Study on the Fishing Method of the Midwater Trawl -On the meneuveravilities of the fishing boat under operation- (중층 트롤의 어법에 관한 연구)

  • Due to depletion of fish resources as time goes on, the trawl fishing industries which have caught the demersal fish is confronting with financial difficulties. For the purpose of breaking these difficulties, trawlers are expanding the fishing targets to the midwater from bottom stock. The trawlers become to be able to detect the fish schools not only vertical but also horizontal direction by equipping the sonar system on board. Even though the operator locates the fish school by sonar, it is not easy to make a desirable catch of the fish school which is detected, for the reason of the maneuverring characteristics of trawler. For the purpose of enhancing the efficiency of a fish catch, the auther performed a series of on board experiments to investigate the maneuverablilites of midwater trawaler. The obtained results are summerized as follows: 1. The higher the RPM of main engine, the smaller the magnitude of turning circle. And it is smaller in the right than in the left turning 2. Towing speed varies irregularly under turning novenment. When the RPM of main engine being 560, 680 the angular velocities are 11.3deg/min, 22.5deg/min respectively. 3. The difference of new course distance between calculated by maneuverring indices and measured by experimental ship is high when altering course being large and towing speed low. 4. The faster the towing speed is, the shorter the new course distance becomes. When towing speed is same in right and left turning movement, the now course distance is shorter in case of right turning movement than in left. 5. It is considered to be convenient for a navigator to utilize the curves for altering course in order to steer the ship rapidly and accurately.

A Study on the Legal Status of Fishing Vessels (실정법상(實定法上) 어선(漁船)의 지위(地位)에 관한 고찰(考察))

  • The fishing vessels operation is a kind of maritime profit-making activities, which are complicatedly integrated by the basic and supplemental fishing activities with navigation. The Fishing Vessels Act of Korea defines the character of fishing vessels and gives a legal status to them, and this Act itself is linked with the allied public laws including the Ships Act of Korea. For this reason, the legal status of fishing vessels as Korean flagged ships by the public law is analogous to the general commercial vessels. And the specific character of ownership of the fishing vessels by the Korean Maritime-Commercial Act as a privated law is analogous to the general commercial vessels, nevertheless the Chapter 4(Carriage of goods) and the Chapter 5(General average) of this Act do not apply to the fishing vessels except the fish carriers. A fishing vessel possesses the legal status as a Korean flagged ship by having it registered and putting it on record under the provision of national law, however the principle of genuine link is an important factor for acquisition of nationality. Especially, the basic rules by the Law of the Sea those are attended with the distant-water fishing vessels operation at the overseas fishing ground are summarized as follows ; Firstly, the rights of navigation and fishing activities on the high seas are fundamentally recognized to all states, but the freedom is restricted according to the international legal order aiming at protection of reasonable interests of other states and conservation of the living resources and marine environment. Secondly, in the EEZ or EFZ the freedom of navigation is recognized, but fishing activities are exclusively ruled by the national law of the coastal state. Thirdly, foreign fishing activities are prohibited but the right of innocent passage is recognized in the territorial sea, while both activities are prohibited in the internal waters of the coastal state.

A Study on the Evolution of the Holding and Utilizing System of Fisheries Resources in Korea (수산자원 소유.이용제도의 변천에 관한 연구)

  • This study deals with the evolutional history of the holding and utilization of fisheries resources in Korea. Fisheries resources have the basic characteristics of the density dependent self-regulating renewable and common property resources, Irrational utilization of fisheries resources is mainly due to the unlimited access to the resources. The holding and utilization of fisheries resources in Koryo era was opened to everyone. But it was nationalized in the early Yi Dynasty. The purpose of its nationalization was to provent the paticular powered-man with their monoplized holding and to levy fisheries tax. Eoeop-peop, the first modern fisheries law in Korea, was enacted as a part of the invasion policy of Japan in 1908. With the japanese annexation of Korea in 1910, the Japanese Government established a new institutional system of fisheries as a part of an overall reformation of the institutional for an implementation of the colonial policy. It was very the new enacted Fisheries Law (Gyogyorei). Also the Government enacted compulsorily another new Fisheries Law (Chosen Gyogyorei) with its adjunct laws and regulations revise the institutional system of fisheries on May 1, 1930. After Eoeop-peop enactment, the fisheries resources in Korea could be used only under the license, permission, and statement. After Korea was from Japan in 1945, Korea Government at last enacted the new fisheries law (Susaneop-peop) in 1953. The goal of Susaneop-peop was to achive the general usage and protection of the fisheries resources, and to attain the development and democratization of the fishery in Korea. This law was amended 13 times until 1990. The license fishery have a legal right on the fishery, called a fishery rigt. This right means a right of exclusive occupation and utilization of a unit of the inshore fishing grounds. The main evolutional issues of license fishery are as the following : 1) the foundation of the exclusive usable fishery right(1911, Gyogyorei), 2) the deletion of the settled U9space lift net and settled space sein net fishery, and the expansion of the cooperative fishery-No.1, 2, and 3 type cooperative fishery-(3rd amendment, 1963), 3) the deletion of the No.2 and 3 type cooperative fishery, and the separation of the culturing fishery in No.1 and 2 type culturing fishery (13th amendment, 1990). The effective period of the license fishery was amended as the following : 1) 1908(Eoeop-peop) : within 10 years, renovation system, 2) 1929(Chosen Gyogyorei) : within 10 years, unlimited extension system, 3) 1971. 7th amendment : 10 years, renovation system, 4) 1972. 8th amendment : 10 years, only 1 extension system, 5) 1975. 9th amendment : 5-10 years, only 1 extension system, 6) 1990.13th amendment : 10 years, within 10 years of total extensional years. The priority order of the fishery license was established in 1953 (Susaneop-peop). First, it was within 5 years, and then was amended within 3 years(Chonsen Gyogyorei). Now it is 5 years.

A Study on the Distribution of Compensation for Damages of Common Property Fisheries by Alternative Cost Approach of Utilizing Fishing Ground (어장이용의 기회비용접근법에 의한 공동소유 어업권의 손실보상금 분배연구 - A어촌계의 미역양식어업권의 취소보상액 분배사례를 중심으로 -)

  • This paper tries to suggest a rational proposal for the distribution of compensation of common property fisheries damages caused by a large scale coastal reclamation. For the purpose the paper introduces the approach of alternative cost of the use of fishing ground. The background of the paper is the legal conflict between tenants and non-tenants, both of whom are common owners of seaweed cultivation ground, in the distribution of compensation for damages. In principal, so far as the seaweed cultivation right is a common property of the fishing association, the compensation is also a common property of it. Therefore the distribution method of the compensation entirely depends on the decision of the association. But in case that the numbers of non-tenants is larger than those of tenants, the distribution of the compensation is usually unfavorable to the tenants even though the latter is the key contributor to the realization of present value of the common property. The paper aims to show an appropriate distribution method based on the economic principle of optimal distribution. In others words, the value added to the economic value of alternative use of the fishing ground should be distributed to the tenants. the value amount of alternative use of the fishing ground should be equally distributed to the members of the association.

  • In line with post-1970s industrialization, the manpower shortage in fishing villages has been fueled by rapid desertion; young adults and middle-aged people have tended to avoid fishing by migrating to cities, driving the emergence of a national issue in terms of securing fisheries management succession. For the fisheries industry to maintain competitiveness, we need to cultivate young adults and middle-aged people to be leaders of the domestic fishing industry through promoting inspiration for the fishing industry, teaching fisheries expert knowledge, and fostering the ability to promote business. In addition to safe supply of marine products through continued fisheries operation, securing young and skilful workers is essential in order to promote balance development of domestic industries, including job creation. The study therefore seeks to provide measures to foster specialists in order to enable the transfer of management through an opinion survey of fishermen. To cultivate specialists for enabling the transfer of management, the following solution should be promoted at the state level. First, to support the introduction of young and talented workers to the fisheries industry through transfer of management, Second, in order to enable the transfer of management, change is required first in the fisheries industry for it to become a value-added industry. Third, despite fisheries being a composite industry that is syncretized to tertiary industries from primary industries, the fisheries industry is still recognized as a labor intensive industry, which reflects the current status of fisheries education.

Residential Quarter Organization and Housing Spatial Form of Fishing Village in Eocheong-do Island (어청도 어촌취락의 공간구조와 주거형태에 관한 연구)

  • This paper aims to clarify the residential quarter organization and housing spatial form of fishing village in Eocheong-do Island. The results are as follows. First, island residential quarter is formed along the coastline, the detached house and the shop house are mainly located in the front of the coastline. Second, the inclination road which connects the northernmost end part and the seashore road is maintained as a road system of a residential quarter from the Japanese colony term until now. Third, It is the feature that Eocheong-do island has the wide width of the front of a site compared with other island residential quarters. Therefore, the frontage wide of a building is also large. Fourth, the entrance of the building where the frontage is mainly located right in the middle, and each rooms are located in the surroundings of it. Finally, the typical community space of Eocheong-do island is Pyeongsang(平床). Pyeongsang is space which receives various functions in inhabitants' life cycle.
