The Formation and Ratification of ISDS in International FTA and Its Characteristics -with a special emphasis on KORUS FTA, NAFTA & AUSFTA- (국제자유무역협약에서 ISDS의 생성과 비준에 관한 연구 -KORUS FTA, NAFTA 및 AUSFTA를 중심으로-)

  • This article deals with the nature of ISDS along with the admissibility thereof, for the settlement of investment disputes between states and nationals of other states. ICSID as an organization of World Bank Group, has been established in 1966 and as of May in 2011, 157 nations ratified its convention. As for the Republic of Korea(ROK) it has been involved in the problematic situation with regard to ISDS of the KORUS FTA in negotiation with the United States. The ruling Grand National Party is pushing the FTA for ratification including ISDS. However, the opposition party, the Unified Democratic Party rejected the ISDS with a view to a toxin infringing on its judiciary sovereignty. The ROK has invested in the US 3.5 times more than the US did in Korea up to now. As a result, it seems that the ROK is more concerned about ISDS than the US is, considering that exhausting local remedy through the US local courts, applying even a municipal ordinance in their decisions which will be unsatisfactory toward the ROK side. The ROK is now struggling with the ISDS as a political issue between the ruling party and the opposition party mostly based on sovereignty with a reference on AUSFTA which excluded the ISDS. Australian model about ISDS has been impacted by the experience from the NAFTA which allowes direct claims against each other(the US against Canada and Canada against the US). It seems not to be much sympathy for developed countries because it has long been held to standards for pressing on developing countries. Australia is also struggling with ISDS from the political point of view likewise the ROK. And the ISDS is destined to the political situations established within the domestic countries among the political parties in relation with the acceptance or rejection of thereof.

An Empirical Analysis on the Appeal Case of Origin Verification for Korean Import Goods Using Bootstrapping Technique (부트스트랩 기법을 활용한 한국 수입 상품의 원산지검증 불복사례 실증분석)

  • Under the FTA agreement, preferential tariffs between FTA members will result in tariff reductions. In order to ensure the stable use of the FTA tariff system, it is necessary for the customs authorities to determine whether the origin goods are clearly applicable. This study analyzed the procedure of appeal according to the origin verification system based on the decision made by Korea Customs Service and Tax Tribunal. From this, we examined whether the rate of re-claiming a case rejected in the 'Review System of the Legality Before Taxation' differs. In addition, we carried out a quantitative analysis using bootstrapping technique in order to overcome the scarcity cases of verification of origin among FTA members. The implications of this paper are summarized as follows: First, we tested the hypothesis that the re-claiming rate of Western countries is higher. Second, some issues represented higher re-claiming rate. Third, there was no significant difference between the verification group and the re-claiming rate. Finally, even if an applicant makes a claim again, there is a possibility of being rejected again.

  • Since Korea establish diplomatic ties with China in 1992, korea and China have had rapid progress in most of field as politic, economy, society and culture through basing on cultural commonality and geographical adjacency. Especially, China is the biggest trading partner to korea, and also Korea is third-biggest trading country to China. They become strategic cooperating relation in 2008. Currently, in terms of international trade relation, WTO/DDA negotiation is proceeding in difficulty, but FTA has been growing and extending in the world, and the two country, china and korea, have been competitively trying wide and active FTA negotiation promotion. After Financial crisis in 1997, according to the requirement of local economic cooperation, China has shown the interest to several countries since the conclusion of FTA treaty with ASEAN in 2005. China also makes the active afford to conclude FTA with Korea. Last May 28th, this was mentioned in the meeting between president Lee and Premier Wen Jiabao, so it is anticipated that the negotiation for FTA will be started in the near future. There are many political suggestions and concerns in terms of way of negotiation korea would choose. Some economist said that "'Continuous FTA aimed at long-term protocol should be promoted between korea and China and negotiated includingly'" However, this research claims that commodity exchange, service, and investment areas should be included and it has to be comprehensive package settlement style in negotiation. This research has found out the characteristics of China's negotiation and implications through the China's existed FTA negotiation examples. Currently, China has taken Continuous or a phase-negotiation method to ASEAN, Pakistan, Chile and some other developing country and to advanced countries like New Zealand or Singapore, comprehensive package settlement method is used in FTA negotiation. In consider of the FTA negotiation between Korea and China, Korea has some problems in the commodity change area in agriculture maket's opening. While, for china, the issues would happen in service trade area, especially when encountering finance and communication industries are opened, China's economy could be exposed to some risk. In result, Korea should expand its negotiation range from commodity trade to service trade, in order to exchange both issues, then the negotiation will be concluded more easily. In other word, for FTA, korea should follow comprehensive package settlement way that is similar to New zealand and Singapore case. Through this kind of method, Korea can expect effect of creating trade, conversion of it and preoccupancy of service field in china's market against the advanced countries like Usa, Europe and Japan. Also, to have a successful FTA negotiation, korea should find out china's policy for FTA negotiation. With this information, korea will be able to suggest the way to make a profit. Systematic analysis and comparison about previous negotiation cases of china are needed before the negotiation begin.

  • 본 연구에서는 국내 7개 기업에서 생산되고 있는 PET POY와 일본과 대만에서 생산되고 있는 PET POY 시료를 준비하여 이들 사의 열수축 특성을 hank 실험방법과 Toray FTA-500 계측기를 사용한 실험 data를 비교 분석하여 최근 도입되어 사용되고 있는 Toray FTA-500 열 수축률 측정계측기의 타당성을 조사하고자 한다. 본 연구를 위해 사용한 시료는 PET POY 85d/72f 그리고 120d/36f 그리고 120d/36f 2가지를 준비했으며 국내 합섬 maker 7개회사별로 각각 같은 굵기의 POY 사를 준비하였다. 그리고 국내 POY와 외국 소재로서 대만과 일본에서 생산되고 있는 소재의 열 수축률 특성치를 Toray FTA-500과 hank 방법을 비교 분석하므로서 감성의류 제조용 PET POY 사의 국내ㆍ외 소재의 차이점을 계측기계와 계측방법의 상이로 나누어 data화가 가능케 함으로서 감성의류소내 개발에 기초자료를 활용코자 한다.

  • 본 논문에서는 가압형 액체 추진 로켓인 KSR-III의 위험도 관리에 Fault Tree Analysis (FTA)를 적용한다. 미니멀 컷 set과 같은 FTA 구조 분석 방법을 소개하고, KSR-III 비상엔진중단 상황에 대해 정성적 FTA를 적용한다. 정성적 FTA를 통해서 KSR-III 추진기관 시스템의 구조적 특성을 명확히 하고 비상엔진중단을 야기시키는 컴포넌트 레벨에서의 실패와 작동 시퀀스의 조합에서의 문제 등을 명확히 하였다.

  • As Chinese insurance market grows rapidly due to market reforms, China got recognition as second-largest insurance market in the world in 2016. However Korean insurance companies have had difficulties to grow in Chinese insurance market despite Chinese participation in the World Trade Organization (WTO) and the growth of chinese insurance market. The reason for the decline in Korean insurance companies is economic retaliation due to the deployment of THAAD in Korea. However, this is not a fundamental reason. The underlying cause of the effects of economic retaliation is the result of insufficient negotiations in Korea-China FTA services sector. In Service sector of Korea-China FTA, the level of concession between Korea and China differs greatly, when comparing China and South Korea's FTA. In addition, it has only been a few years since China collected the position of the WTO Doha Agenda, which currently deals with concessions on intellectual property rights and services. More important is that the Korea-China FTA service sector, as it stopped short of being protected by the most-favored-nation state treatment level when Korean insurance companies entered China. Further negotiations to supplement the weak points in the Korea-China FTA service sector were promised in December 2017, but international tensions over THAAD deployment made it impossible to hold such negotiations. However, due to changes in international affairs in 2018, the first additional negotiation was decided and held. This paper implicates strategies of further negotiation between Korea and China for service and investment chapter. Consequently, the aim of this paper suggests directions how to re-enter Chinese insurance market to Korean insurance companies.

The Diffusion of Rumor Via Twitter : The Diffusion Trend and the User Interactivity in the Korea-U.S. FTA Case (트위터를 통한 루머의 확산 과정 연구: 한미 FTA 관련 루머의 자극성에 따른 의견 확산 추이와 이용자의 상호작용성을 중심으로)

  • This study explored how rumor is diffused via Twitter and how the characteristics of rumor affect the interactivity among users in the Korea-U.S. FTA case. A key word search located three issues as major ones related to the Korea-U.S. FTA: appendectomy myth, collapse of health insurance, and increases in medicine prices. The arousal of rumor has two dimensions: fact and expression. The fact arousal was the highest in the issue of 'appendectomy myth', and the expression arousal the highest in 'increases in medicine prices'. The rumor diffusion took the 'explosive wave' in the issue of appendectomy myth, the 'latent wave' in the issue of increase in medicine prices, and the 'repetitive wave' in the issue of collapse of health insurance. Correlation analyses revealed a high correlation between the arousal intensity of rumor and the user interactivity in the issue of collapse of health insurance. The study showed that Twitter took a role of diffusing negative messages about the Korea-U.S. FTA. Results implies that government officials and journalists pay attention to Twitter for sensing the public opinion when building policies and managing crises.

An Analysis on the Damage Compensation of Hanwoo Farmers as a Result of the Korea-U. S. Free Trade Agreement (한.미 FTA 체결에 따른 한우농가 피해보전효과 분석)

  • To help improve the current government practice of direct damage-compensation policies, resulting from the loss of profit, sustained by Hanwoo farmers, as a result of the recent Korea-U. S. Free Trade Agreement (FTA), this research aims to examine any problems or issues caused by said policies. To accomplish this task, we have established Hanwoo-SIMO model and estimated the damage of Hanwoo farmers, one without the implementation of the FTA and another with the FTA, to compare and contrast the two. We then analyzed the efficacy of the current government policies. According to our analysis, the current direct compensation policies for the loss of profit on the part of Hanwoo farmers are insufficient. To address this problem, we recommend the government enact a new direct damagecompensation law to address the following issues. First, as the base formula of damage-compensation, the government should use current price of the beef rather than the annually changing flexible price. Second, the flexible control index should remain fixed at 1.0 rate while the government prepares the adequate amount of the damage compensating direct payment resulting from the FTA. Third, the direct government compensation policy should extend beyond the current 15 years (2013-2026) as the profit loss is expected to increase after the midpoint of the FTA.

A Comparative Study on the Foreign Corrupt Practices Act (FCPA) and Article 21.6 of the KORUS FTA (미국 해외부패방지법(FCPA)과 한미 FTA 제 21.6 조 비교연구)

  • Numerous discussions on the KORUS FTA has been centered around issues on trade in goods, services, or dispute settlement mechanisms. On the other hand, little attention has been given to Chpater 21 of the KORUS FTA on transparency, especially Article 21.6 which states about anti-corruption. Article 21.6 and the Foreign Corrupt Practices Act shares the common purpose to prevent corruptive business practice, and they show similarities in many aspects. The FCPA enforcement has dramatically increased over the past ten years by the U.S. Department of Justice and Securities Exchange Commission stretching its jurisdiction to foreign nationals and companies. Korean business professionals and corporations are exposed to both Article 21.6 and the FCPA on corruption issues. Thus, it is imperative to understand Article 21.6 to be equipped with anti-corruption compliance programs. This paper examines the FCPA and Article 21.6 through comparative analysis and proposes appropriate measures for Korea to take.

  • In this paper, we estimated the economic impacts of Korea-EU FTA on the agricultural sector in GyeongGi-Do. In particular, we estimated the economic impacts of agricultural production decrease resulting from Korea-EU FTA for 31 sub-regions in GyeongGi-Do by 15 industrial sectors. We employ a regional economic impact model combining a regional input-output model with a spatial allocation model. We found that the size of inter-industrial impacts are quite different across regions. Our results suggest the importance of agricultural and industrial policy considering the impacts of industrial sectors at the regional level.
