중국 건설 법률과 BOT 정책에 대한 조사 연구;해외 EPC 건설업체의 관점 (A Study of the China Construction Laws and BOT Policies from Overseas EPC Contractor's View)

  • 일반적으로 국가별 PPP/BOT 사업 정책과 건설 관련 법률체계는 개별 PPP/BOT사업의 사업구도와 사업성에 직접적인 영향을 준다. 2001년 12월 중국의 WTO 가입후 2003년과 2004년도에 공포한 건설관련 법안과 최근 공포된 주요 PPP/BOT 관련 정책 등은 특히 해외 건설투자기업의 개별 사업의 가능성 (Viability)에 직접적 영향을 주는 요인으로 이러한 해외기업의 시장진입을 지배하는 법안과 정책 (Market Access Condition)들로 인해 현재 새로이 중국 시장 진입을 시도하고 국내의 안정적 사업수행 환경에 근거해 개발된 투자지침에 익숙한 국내 기업은 중국내 PPP/BOT 사업 추진시 참여업무 Scope 설정과 투자여부에 대한 의사결정시 내부 공감대 형성에 많은 어려움을 겪고 있다. 본 연구는 우선적으로 중국내 시장진입 관련 법, 제도 및 정책이 해외 EPC 기업의 PPP/BOT 사업 수행에 미치는 영향을 분석하고 최종적으로 실제 사례분석을 통해 중국내 PPP/BOT 시장 참여를 위한 Lessons Learned를 도출하는데 주 목적이 있다.

미국(美國)의 정부구매(政府購買) 관련법규(關聯法規)에 관한 고찰(考察) (A Study on the Regulations of U.S. Government Procurement)

  • The governments of almost countries have the rules and procedures that the purchasing entities have to follow, in order to ensure that the best value for money spent is obtained in procuring goods and services. However, there are often some of important problems in their rules relating to government procurement. Namely, almost countries have a variety of discriminatory regulations for foreign suppliers in the government procurement laws with the object of national security, economic welfare, and protection of domestic market from international competition. For this reason, several advanced countries had reached the Plurilateral Agreement on Government Procurement during Tokyo Round(1973-1979) and Uruguay Round(1986-1994). However, the provisions of two agreements do not apply to all products made by the government but only to those made by purchasing entities specified by each member country in its list in the Appendix. Accordingly, the size of goods and services purchased from foreign suppliers were comparatively not large. As we know well, the United States have spent a large amount of money from federal and state government budget. But the portion of procurement from foreign suppliers is still small, compared with the portion of procurement from domestic suppliers. The main reason are that U.S. has applied for long time the so-called Buy American Act to government procurement positively and maintained many kinds of other domestic regulations which have discriminatory provisions for foreign goods and foreign suppliers. On the recognition of these points, this thesis deals with the Buy American Act and other U.S. domestic laws, regional and bilateral, and plurilateral agreements including WTO Agreement on Government Procurement. As a result, the author found that there are several concerns and problems in the U.S. regulations relating to government procurement. It include the provisions on priority procurement of U.S.-produced products, local contents requirements, set-aside procurement from small business, and exclusion of preferential procurement from the developing countries.

파키스탄의 상사중재제도에 관한 실무적 접근 (A practical approach to commercial arbitration system in Pakistan)

  • 상사중재는 문제를 해결하고 사업 파트너간 분쟁에 대한 해결책을 찾는 신속하고 효과적인 방법이다. 상사중재 발전을 위해 이론 뿐 만 아니라 실무차원에서 중재연구의 접근이 필요하다. 본 논문은 파키스탄 국내 중재법과 파키스탄에서 적용되는 국제상사중재제도에 대한 상황과 접근방법 등을 제시하였다. 파키스탄에서 새롭게 정비된 2009년 중재법은 국내중재, 국제상사중재, 외국 중재판정의 집행뿐 만 아니라 국제투자분쟁의 해결에 관한 법률을 통합하는 것을 목표로 한다. 더 나아가 2011년에 파키스탄 투자자의 신뢰를 회복하기 위해 외국인 투자자를 보호할 수 있는 법을 도입하기도 하였다. 본 논문은 파키스탄의 중재법의 과거부터 현재까지 진전된 관계를 설명하고 새로운 법령에 의해 적용된 변경사항을 설명하고 중재계약 및 판정을 다루는 파키스탄 중재 법률, 규칙 및 절차를 실무차원에서 포괄적으로 제시하였다. 잠재시장인 파키스탄관련 통상정보가 부재한 상황에서 한국무역학자들에게 파키스탄 상사중재제도에 관한 실무적 이해를 돕기 위하여 작성되었다.

중국, 홍콩, 마카오, 대만 상호 간 중재판정 국적결정 기준에 관한 연구 (A Study on Nationality Criteria for Arbitral Awards between China, Hong Kong, Macao and Taiwan)

  • China, Hong Kong, Macao, and Taiwan have a singular political relationship. This distinctive relationship creates a unique impact on the nationality of the arbitral awards among the said countries. Each of these regions does not adopt the arbitral award of the other party as either a foreign arbitration award or a domestic arbitration award, but separately adopts the arbitral award in different jurisdictions within the same country. Therefore, in order to approve and enforce their arbitral awards in other areas, they have no choice to apply special laws or the conventions concluded between them, neither the New York Convention nor the individual arbitration laws in those areas. Therefore, this paper reviewed the convention and self-established laws among China, Hong Kong, Macao, and Taiwan regarding the approval and execution of the other arbitral awards. In addition, the domestic laws in China, Hong Kong, Macao, and Taiwan are compared with the New York Convention to ascertain the criteria for distinguishing domestic and foreign arbitral awards. This study also compared and analyzed what criteria were established for the determination of the nationality of the arbitral awards in the domestic law or the convention concluded in pan China. Through the analysis of these contents, the characteristics and problems of criterion for the determination of nationality among China, Hong Kong, Macao, and Taiwan were identified. Based on the results, this study examined the precautions Korean companies entering these regions should use in the arbitration system in these areas.

결혼이주여성이 지각하는 고부갈등과 대처 경험에 관한 연구 (A Study of Immigrant Wives' Perceived Conflicts with their Mother-in-laws and Coping Experiences)

  • This study is performed to verify immigrant wives' perceived conflicts with mother-in-laws and coping experiences. In order to understand in-depth conflicts between female immigrants and their mother-in-laws, we selected 8 foreign daughter-in-laws who have stayed over 5 years in Korea. We applied van Manen's phenomenological methods. After the data analysis, 7 fundamental themes were derived and these are as follows: First, mother-in-laws as a prison guard, second, living a conscious life of other's eyes, third, annoying words from mother-in-laws, fourth, treat married female immigrants as invisible woman not as family members, fifth, saying we are one finger which can overcome pains from biting, sixth, mother-in-laws can't let her son go, seventh, not distributing love. In addition, coping behaviors were as follows: they just deal with living a conscious life of other's eyes, making a feeble complaints, accepting it with understanding, resisting the situation, evading and enduring the circumstances. Husband was most reliable supporter and secured hiding place. Her friends were her spirit supporters.

UN해양법 협약상의 추적권에 관한 연구 (A Study on the Right of hot pursuit of UNCLOS)

  • 추적권은 추적국의 영해, 접속수역 기타 관할수역내에서 외국선박이 추적국의 법령을 위반한 경우 동 선박을 나포하기 위하여 공해상까지 계속하여 추적할 수 있는 권리로서 연안국이 영해나 기타 일정수역내에서 위법행위를 한 외국선박을 공해로 도주하기 전에 나포하는 것 이 용이하지 않으므로 도주하는 범법외국선박을 공해상까지 추적하여 나포하고 동선박을 연안국에 인도하여 연안국의 재판관할권을 행사하는 제도가 인정되어 왔으며 이러한 권리를 해양법상의 추적권 (the Right of hot pursuit) 라고 한다. 이에 우리나라의 해양관할권의 현황과 불법행위의 특성 등을 연구하여 해상집행력을 고찰해 보고 추적권에 관한 연구를 기술해 보았다.

외국중재판정의 승인거부사유에 관한 연구 -공서양속에 관한 논의를 중심으로- (A study for the refusing enforcement on Foreign Arbitral Awards - Focus on the International Public Policy -)

  • All over the country tries to clarify the content of 'Public Policy' in recognition and implementation of Foreign Arbitral Awards : it makes comments of the international consensus of Geneva Convention(1927), New York Convention(1958) and the UNCITRAL Model Law on Public Policy, and it takes a general view of domestic laws how they deal with Public policy and Foreign Arbitral Awards. Foreign Arbitral Awards should be appropriately respected and implementation by the courts of countries encourage parties in a legal procedure to refuse enforcement by invoking "Public Policy." In order to cope with such invocations, the purport of the above recommendation on Foreign Arbitral Awards should be internationally recognized and the exceptional circumstances should be restricted unless the International Court of Arbitral Awards is not established a Dr. Holtzmann/Schwebel brought forward. In this paper suggests the list of the exceptional circumstances. Korean Arbitration Law stipulates as the Civil proceeding Law did, "good morals and the social order of the Republic of Korea" as a ground for refusing enforcement of Arbitral Awards. Studies on counteraction against invocations of Public Policy to refuse enforcement of Foreign Arbitral Awards should be developed.

Interim Measures in Arbitration and Enforcement of Arbitral Awards in Korea and China

  • In an era where the international investment and trade between Korea and China grow daily, the importance of international arbitration cannot be overstated. The Korean Arbitration Law was enacted with reference to the UNCITRAL Model Law. When the Chinese Arbitration Law was being enacted, the UNCITRAL Model Law was also referred to, but there are some discrepancies between the two. This article conducts comparative analysis based on the Korean and the Chinese Arbitration Laws, the Chinese Civil Procedure Law and the KCAB and the CIETAC arbitration rules. In order to adopt the UNCITRAL Model Law amended in 2006, Korea revised its Arbitration Law in 2016. The revised Law includes a more comprehensive legal regime regarding interim measures, emergency arbitrator, etc. In China, the enforcement of foreign-related arbitral awards and foreign arbitral awards is carried out mainly by intermediate people's courts. In China, the report system to the higher people's court for refusing the enforcement of foreign-related arbitral awards and for refusing the recognition or enforcement of foreign arbitral awards has the effect of safeguarding foreign-related arbitral awards and foreign arbitral awards in China. Both Korea and China joined the New York Convention, and domestic courts may refuse the recognition and enforcement of foreign arbitral awards according to the New York Convention.

파키스탄의 외국인직접투자 관련법에 관한 고찰 (A Review of Laws Relating to Foreign Direct Investment Policy in Pakistan)

  • 본고는 파키스탄의 외국인직접투자 정책에 영향을 미치는 관련법에 관한 고찰이다. 그동안 세계경제에서 소외되어 왔으나 글로벌 투자와 외국인 직접투자의 증가로 주목받는 파키스탄의 투자제도와 관련법규의 변천과정 등을 살펴보고 이와 관련된 주요법안인 외국인 민간투자(촉진.보호)법, 경제개혁의 보호법, 외화계좌(보호)법 등을 중점적으로 분석하였다. 본고에서는 이러한 법안들이 후속 실행되지 못하고 종종 정책의 변화가 일어나는 과정에 주목하였으며 외국인 직접투자의 주요 정책과 제도의 소개를 통해 현지 진출시 외국기업들이 숙지해야 하는 핵심사항을 법과 정책적 차원에서 고찰하였다.

무역중재의 특성과 개정중재법의 효율성에 관한 고찰 (A Study on the Efficiency of Trade Arbitration by the New Arbitration Law of Korea)

  • Arbitration, which involves a final determination of disputes, has elements of the judicial process. Although an alternative to formal court litigation, it does not replace it in all aspect, but rather coexists with court procedure as an adjunct and part of administering justice. As the international trade has the basic problems of business managed between the parties of other countries having different laws, customs, cultures, currencies and religions. It has been known that these defects caused the commercial disputes and suspended economic fluence in world economic development through the foreign business. The United Nations launched 'the United Nations Convention on the Enforcement and Recognition of the Foreign Arbitral Awards' in 1958 to give effect to the international commercial arbitration. However, the convention has the limitation in excluding the legal obstacles originated from domestic arbitration systems of every states. As the result, the UN succeeded in making world wide arbitration law named 'The UN Model Law on International Commercial Arbitration' in 1983 and recommended all member countries to accept it to revise their domestic arbitration laws thereafter. Korea revised national arbitration law accepting 100% of the model law in 2000. In this respect korea became to have the international dispute settlement system. Korea will be able to settle more business disputes arisen from the international trade and enjoy the world credibility through the new arbitration system.
