Over the last several years, regarding to the strategic items, the international community has seen governments make more formal commitments to adopt and implement effective export controls to counter the proliferation of weapons of mass destruction(WMD). United Nations Security Council Resolution 1540(that is "S/RES/1540") stands as the most important of these commitments. Many UN members already have export control laws and regulations in place to prevent the proliferation of weapons of mass destruction. Many members also participate in a variety of formal and informal international arrangements to coordinate their export control efforts. Nonetheless, each of these countries has its own unique legal framework for export controls. This generates considerable diversity in the construction of the specific national legal authorities. Over the last few years, however, a consensus over what constitutes the key elements of effective legal authorities for export controls has begun to emerge. Evidence for this development comes in the identification of best legal authorities or principles at several multilateral conferences on export controls.

On the stage of an international trade with well-developed transportation, communication system and proliferation of free trade, global companies who are eager to sustain business growth by cutting cost and pioneering new market are facing a new challenge named "Global Compliance" of business transparency, export and import regulations, and potential international business environment. The purpose of a global compliance is to monitor and regulate a company's trade activities to reduce the risk of transactions that might violate relevant countries' laws, regulations, or standards. After the 911, for strengthening the non-proliferation of the export control goods, UNSCR1540(United Nations Security Council Resolution 1540(2004)) was declared in order to enforce the members to adopt the rules in the resolution into their national laws and regulations. Companies does not realized that they need to get rid of the risks because they underestimate the importance of international security, caused by their careless management. That is why currently the export control program is not fully observed by the most. Lack of awareness for the export control and the poor system of each members could be the reason for this unstable operating status. With this background, this thesis will study on the meaning of export control, schemes for companies to recognize its importance and governmental guideline to support global companies.

본 연구는 국제수출통제규범을 고찰하고 국내 수출통제 법제를 분석하여 문제점을 도출하고 발전방안을 제시함으로써 우리나라 수출통제제도의 발전을 도모하는데 목적이 있다. 2005년 이후 본격 시행된 국내 수출통제 제도는 법체계와 목적, 상황허가 요건, 수출통제 대상 '물품등' 등의 용어에 대한 정의와 범위, 중개허가의 실효성 및 미국 재수출통제 대응 등의 측면에서 중대한 문제를 내포하고 있다. 그 발전방안으로 현행 대외무역법령에서 수출통제 부분을 분리하여 가칭 '수출통제법'으로 입법화, 수출통제 대상을 '전략품목'으로 통일, 상황허가 요건의 명료화, 중개허가 실효성 제고를 위한 등록제 도입 및 수출통제 관련 각종 용어에 대한 정비 등을 제안한다.

Export controls on strategic items has been an international standard of trade. We should understand the global trend of this and perform clean policies in the international community. This article examines the Improvement of Competitiveness and International Export Control System of Strategic Items for focusing to Internal Compliance Program(ICP). Therefore, this study would like to suggest for build to ICP. Each member of company have to convert their perception for controling strategic items. Also, they have to build controling system in ERP system and extend Incentive for CPs. the support to the trustworthy controling system. Korea is actively trying to control strategic items export for world peace and national security. So the related enterprise needs to manage voluntary export system.

Trade can be greatly influenced by the change of international trade environment due to the characteristics of remote transactions. Furthermore, in the circumstance of emphasizing the national security again, the importance of the risk management of special materials has been increasing. As it was noted at Chapter 4, significant results such as the threat of enterprises' sustainable growth can be occurred when companies are related to the unlawful export of strategic materials or experience discouragement of export of main products. As the decision of strategic materials greatly depend on a specialized knowledge there is a possibility of misjudgement of strategic materials in terms of ordinary companies which is not accustomed to them. Furthermore risk management is more difficult due to the inclusion to the items of export license. To prepare such a risk of export of strategic materials, firstly, it should be checked to find whether counter traders are working in the industry which is not related to the spread of weapons of mass destruction, secondly, an appropriate process shall be designed and operated for products to be safely delivered to the trade counter. Therefore, our export enterprises have to introduce CP(Compliance Program), AEO or ISO28000 considering suitability for their actual situations not only to promote export and but also to avoid risk of export control and additional expenses. Through these appropriate processes, an efficient and effective management of the trade risk of strategic materials can be accomplished.

수출통제는 1949년 미국주도의 COCOM에서 국제수출통제체제가 시발점이라 볼 수 있다. 그 후에도 많은 국제적 노력이 계속 되었는데, 1969년의 핵비확산조약(NPT), 1970년의 쟁거위원회(ZC), 1978년의 핵공급국 그룹(NSG), 1985년의 호주그룹(AG), 1987년의 미사일기술통제체제(NTCR) 또한 1990년 베르린장벽이 철거되면서 COCOM은 1995년 Wassenaar Arrangement(WA)이 창설되었다. 수출통제의 개념은 특정지역에 대한 무기류 및 그 부품의 수출통제에서 무기류 또는 그와 관련된 민군겸용물품 및 기술이 분쟁지역이나 우려국가 테러집단과 같은 비국가 행위자(Non-state actor)의 손에 들어가지 않도록 예방하거나 차단하는 것으로 변화되었으며 이를 비확산통제 (Nonproliferation Control)라고 표현한다. 수출통제의 품목은 과거의 재래식 무기류 뿐만 아니라 다량살상무기(Weapons of Mass Destruction: WMD) 및 그 운반수단인 미사일의 제조, 개발, 사용 또는 보관 등의 용도로 사용 또는 전용될 수 있는 일반 산업용품(Dual Use Item)까지도 포함되게 되었다. 9.11테러는 국제사회에 영향을 마쳤다. WMD 확산방지를 위한 노력이 국제안보의 최대 현안사항으로 등장하게 되었다. 본 연구는 비확산체제의 국제법상의 쟁점 및 문제점을 도출하고 비확산규범의 효과적인 집행과 비확산체제의 강화에 따른 개선방안을 제시하는데 그 목적이 있다. 또한 남북경제협력에 있어서 남북관계에 쟁점이 될 수 있는 전략물자 수출통제체제제도를 효율적으로 운영하여 국가안보 및 국제평화에 기여하여야 한다. 최근 북한은 미사일 시험, 핵실험 등을 강행함으로써 국제사회에 많은 지탄을 받고 있으며, 지금 국제사회는 유엔결의사항의 이행과 관련하여 중국과 한국을 비롯한 관련 당사국의 수출 통제 준수여부에 많은 관심을 기울이고 있다.

There are over 20 administrative rules related to Korea Foreign Trade Act including Export and Import Notification, Consolidated Notification, Notification for Strategic Materials and so on. The purpose of this research proposes to reform some administrative rules related to Korea Foreign Trade Act. First, the administrative rules are a little many and hidden in part, so the effort need for simplification and publication. Especially Export and Import Notification is no need more, and some articles can be transfer to the similar notification. Second, the prohibited or regulated items are only 135, and the reason is cooperation to world trade policy and Korea trade purpose. The item number of trade limitation are decreased sharply compare to several decades, but we still effort to decrease. Third, There are 2 tracks trade regulation both Korea Foreign Trade Act and 57 specific acts. The number of trade limitation item is over 5,000, so it is impossible to control by Consolidated Notification. The role of Consolidated Notification is the just guides for Export and Import, so trader has to use the specific trade-related law.

본 연구는 한국 전자정부 해외진출 확대를 위한 전략적 접근방향에 관한 연구이다. 한국 전자정부 해외진출 관련 문헌연구를 하고 해외진출 실태를 분석하였으며, 분석을 기초로 전략적 접근방향을 제시하였다. 전자정부 해외진출 실태 분석에서는 해외진출의 필요성과 성과, 저조 원인을 살펴보고, 해외시장 환경과 개도국 상황 및 여건, 개도국 요구 등 해외진출 외부환경을 분석하였으며, 이어 내부역량을 분석하였다. 내부역량 분석 결과, 관련 법령의 분산과 총괄 법령 부재, 부/처 기관별로 조직의 분산, 해외진출 프로세스 미흡, 솔루션 부재, 자금획득 및 지원 미흡 등이 도출되었다. 한국 전자정부의 해외진출을 확대하기 위한 전략적 접근 프로세스는 해외진출 목적을 확인하고 주도 형태를 결정하며, 추진전략을 수립하고 분야별 접근방향을 제시하는 것으로 하였다. 이에 따라 한국 전자정부 해외진출을 위한 전략을 대외전략과 대내전략으로 구분하여 제시하였으며, 분야별 접근방향으로는 관련 법령들을 총괄하고 조정 통제할 수 있는 법령의 정비, 분산된 조직을 기능적으로 조정 통제할 수 있는 컨트롤타워 운영, 사업발굴에서 추진까지 프로세스의 체계적인 발전, 표준화된 모듈화 솔루션 개발, 자금 획득 및 지원 방향 등을 제시하였다.

본 논문은 이동표적에 대해서 고정형 탐색기(Strapdown Seeker)가 장착된 유도탄의 지향각 제한을 고려하여 충돌각(Impact Angle)을 제어하는 유도법칙을 제안하고 있다. 제안한 유도법칙은 슬라이딩 모드를 기반으로 하고 있으며, 탐색기에서 제공하는 지향각과 항법 정보를 통해 얻을 수 있는 시선각 정보와 발사 초기 표적 획득장비 등을 통해 제공 받는 표적 속도와 표적 이동경로각을 이용하여 가속도 명령을 생성한다. 제안한 슬라이딩 surface의 수렴을 통해 표적 요격과 충돌각 제어가 가능하다. 또한, 최대, 최소 지향각에서 지향각의 미분결과의 부호가 지향각의 부호와 반대가 된다는 것을 보임으로써 지향각 제한을 넘지 않는다는 것을 확인할 수 있다.

This article is a study on the A Study on the Export and Import Public Notification System for Efficiency of Trade Item Management. The purpose of this article shall be studies to the trade control regulation in korea foreign law. this article are two most important elements in strategic item and rule of origin. that is, economic profit and nation industries protect have been obtain trade control system. The trade public notification system achieve efficiency of trade item control and nation industry development and domestic customer protect and trade order for trade system and control scheme. Therefor, The Result of the article is review to protection of domestic.
