Ethical Issue of Physician-Assisted Suicide and Euthanasia

  • With the implementation of Act on Hospice and Palliative Care and Decisions on Life-Sustaining Treatment for Patients at the End of Life, interests of the general public on self-determination right and dignified death of patients have increased markedly in Korea. However, "self-determination" on medical care is misunderstood as decision not to sustain life, and "dignified death" as terminating life before suffering from disease in terminal stage. This belief leads that physician-assisted suicide should be accommodated is being proliferated widely in the society even without accepting euthanasia. Artificially terminating the life of a human is an unethical act even though there is any rational or motivation by the person requesting euthanasia, and there is agreement thereof has been reached while there are overseas countries that allow euthanasia. Given the fact that the essence of medical care is to enable the human to live their lives in greater comfort by enhancing their health throughout their lives, physician-assisted suicide should be deemed as one of the means of euthanasia, not as a means of dignified death. Accordingly, institutional organization and improvement of the quality of hospice palliative care to assist the patients suffering from terminal stage or intractable diseases in putting their lives in order and to more comfortably accept the end of life physically, mentally, socially, psychologically and spiritually need to be implemented first to ensure their dignified death.

간호사의 생명의료윤리에 대한 의식 (The Perception of Biomedical Ethics in Nurses)

  • Purpose: This study was to describe the perception of biomedical ethics in 210 nurses working at a hospital in Busan. Method: Data were collected from September 1st to 9th, 2008 using a 4-point Likert scale which was designed by Kwon. Results: The average score of perception of biomedical ethics was $2.88{\pm}0.22$. The highest score, $3.13{\pm}0.35$, was seen in the category of the ethics for right to life, the lowest, $2.49{\pm}0.33$, was seen in the category of ethics of death. There was no significant difference in perception of biomedical ethics according to marital status, participation in religious activity or career length. There was a significant difference in reproductive ethics according to marital status (F=3.559, p= .001) and participation in religious activity (F=3.914, p= .011). There was a significant difference in ethics of death according to career length (F=3.779, p= .011). Statistically significant differences were shown in ethics for right to life according to the ethical values (F=4.421, p= .005) and attendance of a conference for biomedical ethics (F=4.133, p= .018). The difference of the perception of biomedical ethics was significant in ethical values (F=3.859, p= .010) and attendance of a conference for biomedical ethics (F=3.783, p= .025). Conclusion: Continuing educational programs need to be developed and more reinforced education should be offered.

동물 해부실험에 대한 중학교 교사와 학생들의 인식 (The Awareness of Secondary Teachers and Students toward Animal Dissection in Biology Class)

  • The ethical issue is one of the most important themes in both science and environmental education. Especially related to the right of other species, animal dissection has been brought about two contradictory attitudes. In spring 1996, a survey was conducted to assess the status of animal dissection in secondary schools and the awareness of 94 biology teachers and 422 secondary students toward animal dissection. And the meaning of animal dissection in biology class was discussed in terms of environmental education. The findings were as follows: First, most of students(96.6%) had participated once or twice to animal dissection experiments(eg. fish, frog, shellfish, cuttlefish and chicken). And about half of teachers (57.4$\sim$64.9%) and some students(41.9%) felt ethical conflict in animal dissection. Second, many teachers(81.0%) and students(87.1%) thought that animal dissection was effective method to achieve the goal of biology education, but they needed more consideration on the respect for life in animal dissection experiment. Third, many teachers(88.3%) had students, who objected to animal dissection, participate obligatorily or passively. Fourth, teachers and students thought that audio-visual media such as video(teachers 63.5%, students 39.7%), computer simulations(teachers 31.7%, students 28.1%) and models(teachers 22.2%, students 24.1%) could be effective as alternatives. These findings suggest that animal dissection experiment, although it is needed to achieve the goal of biology education, requires careful consideration on the rights of animal and the respect for life, and alternatives for students who object to animal dissection in biology class.

수부 및 족부 동종이식에 대한 위험 승인도와 기대치 조사 (Investigation of Risk Acceptance and Expectations in Hand and Foot Allotransplantations)

  • Purpose: Composite tissue allotransplantation is a new therapeutic modality to reconstruct major tissue defects of the head and neck region and extremities. However, there is a serious ethical debate about whether the risks posed by the life-long immunosuppression that a recipient would have to take justify the benefits of receiving this non-life saving procedure. The purpose of this study is to examine differences between expert and non-expert groups in risk acceptance and expectations regarding hand and foot allotransplantations. Methods: The author conducted a survey of 345 subjects in total (lay public n=110; medical students, n=120; doctors, n=115), using a questionnaire-based instrument, the Louisville Instrument for Transplantation (translated to Korean). Results: Of the three groups studied, risk acceptance was found to be lowest in the doctor group and highest in the non-expert group, and the difference was significant (p < 0.05). The expectations of aesthetic and functional improvement from the procedure, however, were found to be highest in the non-expert group and lowest in the doctor group, and the differences were also significant (p < 0.05). Conclusion: The results of this study shows that the three populations have noticeable differences in risk acceptance and expectations regarding hand and foot allotransplantations. Therefore, accurate and sufficient information on these procedures should be provided to patients from both medical and ethical perspectives.

낙태죄와 생명보호 (A Criminal Abortion and Protected in the Right to Life)

  • In Korea, Abortion in the Criminal Law is an illegal act in exception of on which abortion may be carried out through the grounds are very limited and related such a emergency situation of women's physical health, rape, incest and genetic diseases. The Criminal Law regulates the mother's act of abortion and the doctor's surgical performance of abortion. The Mother and the Child Health Law prescribes the medical, ethical, and genetic grounds for the legal permission of abortion. Many people tend to abuse of abortion even though they are fully aware of its illegality. The law lead to be inconsistent with its enforcement. In this paper, I would like to suggest some proposals about the legal analysis of the Abortion Regulations th reform the existing regulation and increase th effectiveness of the regulations. Recently, in a case of the a maternity hospital where a midwife left alone a diabetes pregnancy women who had a baby, and the overweight baby(5.2Kg) died in the uterus due to hypoxic states. Supreme Court of Korea 2007.6.29. 2005do3832) had given a verdict of "not guilty". It looked like there were very fair with current crime law. But, we want this case to be investigated if there weren't any logical contradictions as well as concurrent translation within Constitution Law. Now the Mother and the Child Health Law prescribes the medical, ethical, and genetic grounds for the legal permission of abortion. But this law does not include social and economic grounds.

  • 우리는 이 논문에서 존 스타인벡(John Steinbeck)의 "에덴의 동쪽(East of Eden)"에서 중요한 역할을 하고 있는 주인공 캐릭터인 Caleb Trask (또는 Cal)의 삶을 통해 얻은 교훈을 연구한 결과를 제시한다. 요양병원 간호사의 연명치료중단에 대한 태도에 미치는 영향 요인 (Factors affecting the attitude toward withdrawal of life-sustaining treatment of nurses working at long-term care hospitals)

  • Purpose: This study was a descriptive study to identify factors affecting the attitude toward life-sustaining treatment of nurses working at long-term care hospitals. Methods: Data were collected through structured questionnaires from August 2nd to 27th, 2019. Study participants consisted of 163 nurses who were working for at least 6 months from 7 long-term care hospitals in B and K city. Data were analyzed using t-test, ANOVA, Scheffe' test, Pearson's correlation coefficients, and hierarchical regression with SPSS WIN v 21.0. Results: There were significantly positive correlations between awareness of good death (r=.46, p<.001) and perception of patients' rights (r=.32, p<.001). The factors affecting participants' attitude toward life-sustaining treatment were awareness of good death (β=.35, p<.001) and their own view of death (β=.24, p=.001), which explained about 27.0% of the attitude toward life-sustaining treatment. Conclusion: Based on these results, it is necessary to develop nursing educational materials that can establish values for deaths, and cultivate legal and ethical knowledge related to attitude toward life-sustaining treatment. In addition, since the severity of a patient's condition varies and the characteristics of the institution vary depending on the type of hospital, a study is needed on the relevance of variables considering the hospital environment.

응급구조과 학생의 윤리적 가치관에 관한 연구 (A Study of the Ethical Values of EMT students)

  • This study is aimed at examining the ethical values of EMT students. The results below are based on the revised questionnaires, which can be applicable to EMT from the original questionnaires developed by Lee(1990), with a sample of 124 students consisting of 63 first and 61 second year students, conducted November 2-8, 2001. Data were analyzed using SPSS in terms of means, standard deviations, t-test, ANOVA, Pearson's correlation coefficient. The results are as follows: 1. In the area of Human life, all subjects showed utilitarian disposition. All respondents perceived the item "When patients recognizing there is no hope for survival ask for euthanasia, it is ethically right to accommodate their opinions." as the most utilitarian item, whereas they perceived the item "When an hopeless patient is on cardiac arrest, it is ethically right to do CPR as the most deontoogical item. 2. In the area of patient relationship, all students of two groups took on deontoogical characteristics, but there were no statistically significant differences between two groups. All students perceived an item "EMT have to keep it secret if patients disclose their suicide intentions and ask for absolute secrecy" the most utilitarian item, whereas they perceived an item "Even though patients act and speak in a very rude manner, EMT people should do their best to provide care for patients." as the most deontoogical item. 3. In the area of task relationship, first year students perceived an item "Given time limitations, it is ethically right to give priority to the patients who can be rehabilitated over the patients who can't be fully recovered." as the most utilitarian item, whereas second year students perceived an item "Under no circumstances should any placebo be administered to patients." as the most utilitarian item. All students perceived an item "When EMT students see an unconscious person lying in the street, they have to give him/her emergency treatment." as the most deontoogical item. 4. In the area of coworker relationship, all students of two groups took on deontoogical disposition, but there were no significant differences between two groups. All students of two groups perceived an item "Suppose you are regarded as the person who would be promoted. However, you think that your coworker is more competent than you. In that case you should tell your supervisor about your coworker." as the most utilitarian item. First year students perceived an item, whereas second year students perceived an item "When you observe coworkers' misconduct at work, it is ethically right to ignore their misdeeds." as the most deontoogical item. 5. This study demonstrated that for the first year students, there is a correlational relationship between areas of human life and task relationship, and between areas of task relationship and coworker relationship, whereas for the second year students, there is a correlational relationship between areas of human life and task relationship. 6. In areas of human life and task relationship, there are significant differences according to attitudes toward EMT and attendance at ethics training sessions. In the area of coworker relationship, there are significant differences according to religion, attendance at ethics training sessions, and a code of ethics. Recommendations for future research, 1. Sample items to measure ethical values and the instrument tailored to the needs of EMT should be developed. 2. A longitudinal study to track ethical value changes according to the amount of work experience is needed. 3. A code of ethics and/or ethics training, which could apply in actual situations, should be implemented.

간호대학생의 경제의식에 관한 연구 (A Study on the Consciousness of Economic Ethics in Nursing Students)

  • Purpose : The present study attempted to consider the degree of consciousness of economic ethics in nursing students and the factors affecting these perceptions. Method : A survey was conducted to a total of 874 nursing students from the freshmen and seniors of 11 depts of nursing science nationwide selected by convenience sampling (one for each province, and as for Gangwon-do, two schools were selected from Yeongdong area and Yeongseo area ; 13 male students were excluded). A structured questionnaire was used to collect data on their demographic characteristics and economic ethical perceptions. Collected data were analyzed using the SAS V8.1 statistical package. Result : (1) The score for the economic ethical consciousness of the subjects was $36.76{\pm}10.20$. As for each sub-categories, the score for industry was $7.67{\pm}2.77$; thrift, $7.42{\pm}2.37$; cooperation, $7.41{\pm}2.21$; occupational consciousness, $7.18{\pm}2.20$; and, for consumption, $7.02{\pm}1.90$. The score for the consciousness of consumption was the lowest. (2) Among the demographic characteristics of the subjects, age was found to have a statistically significant positive relation to the consciousness of economic ethics(r=.13, p<.001). The next significant factor was grade: seniors seemed to have a higher economic consciousness in all the sub-categories than freshmen(t=-4.32, p<.001). The number of in-home family has a statistically significant negative correlation with economic attitudes(r=-.15, p<.001). In addition, their economic ethical perceptions were significantly higher with no religion (t=2.14, p<.05); have an unemployed father (t=2.78, p<.05); have credit cards under their own names (t=3.04, p<.05); have ever had overdue card bills (t=4.25, p<.001); have ever had part time job(t=1.74, p<.1) and when they don't live with their parents (t=-2.01, p<.05). 3) A multiple regression analysis was conducted to examine the influential power of the factors affecting the consciousness of economic ethics of the subjects. The factors had more influence on the economic attitudes of the seniors than those of freshmen; in those who having credit cards under their own names than under others; and, in those who have ever experienced credit default than those haven't. Though these factors raised average 3.0 points of economic consciousness, their expository power for the consciousness were low. Conclusion : The nursing students had medium-high consciousness of economic ethics and they seemed to have low consciousness of the proper consumption practices. Their actual life experiences had an influence on their economic attitudes. Therefore, practical programs on economic knowledge should be developed and taught to students systematically at school so that they could have sound consciousness of economic ethics and appropriate knowledge closely related with their real life.

낙태죄 허용한계에 관한 규범해석과 사회인식도 (The Study on Legal Analysis of the Abortion Regulations and National Survey)

  • In Korea, abortion in the Criminal Law is an illegal act in exception of limited cases stated in the Mother and the Child Health Law. There are grounds on which abortion may be carried out - though the grounds are very limited and related such as emergency situation of woman's physical health, rape, incest and genetic diseases. The Criminal Law regulates the mother's act of abortion and the doctor's surgical performance of abortion. The Mother and the Child Health Law prescribes the medical, ethical, and genetic grounds for the legal permission of abortion. Many people tend to abuse of abortion even though they are fully aware of its illegality. The law lead to be inconsistent with its enforcement. In this paper, I would like to suggest some proposals about the legal analysis of the Abortion Regulations to reform the existing regulations and increase the effectiveness of the regulations. A national survey was carried out using telephone interview with Korean citizens from August 1th to August 31th in 2005. A total of 1,025 citizens (male: female = 49.2%:50.8%) were randomly sampled in proportion to the number of population of 17 regions. The major findings of this survey were as follows. First, 91.4% of the respondents approved of abortion based on the medical grounds. Second 83.3% of the respondents perceived that abortion may be carried out based on ethical grounds for example rape. Third, 74.3% were agreed to abortion based on genetic diseases. Forth, 64.7% were approved the abortion that unmarried woman may be carried out. In contrast 45.0% were approved the abortion that girls may be carried out, whereas 46.4% were perceived that the abortion may not be permitted. Fifth, 58.3% were disagreed the permission of abortion based on social and economic grounds. According to the survey Korean citizens seem to have positive perception on the abortion that may be carried out based on medical, ethical and genetic grounds. Whereas they worried about the abortion based on social and economic grounds. Now the Mother and the Child Health Law prescribes the medical, ethical, and genetic grounds for the legal permission of abortion. But this law does not include social and economic grounds. In cases of when the mother has a impossibility to breed her child because of her social situations and financial conditions, we should accepted the legal acceptance of abortion due to social and economic grounds.
