  • Every crime involves a victim and an offender. The offender, from the start of the criminal investigation, is considered as a suspect. After prosecution, he/she becomes the accused, and under consitutional law and criminal procedural law, has the right to enforce the contests of the acts. On the other hand, the victim or his/her family, despite being the person harmed, has very few and comparatively weak rights. To overcome this problem, the Korean criminal justice has recently recognised 'the protection and support of the victim' as a major proposition, and the police as well as the prosecutor's office have been releasing improvement plans for the protection of victims. Setting the above as the background, this thesis deals with the current victim protection acts and discusses the methods to improve them. This study will investigate a more reasonable and effective method of victim support and protection. Currently korea's laws regarding victim protection are not satisfactory, however it is fitting to say that it is certainly an external outline of what it should be. This has been due to the enforcement and creation of 'criminal victim protection' and has acted as a key to more improvements ever since. Despite this, the lack of commitment in human and financial resources to enforce these laws has now produced a possibility of the laws proving to be nothing but an unopened letter. Validation of the Effectiveness of Education for Obtaining Consent in Clinical Study (임상연구 동의서 교육 시행의 효용성 검증)

  • Purpose: To validate the effectiveness of obtaining consent education on errors in the consent process and to develop the education program for researchers. Methods: From February 2019 to February 2022, a 30-minute, 1:1 face-to-face consent education developed using the ADDIE model was conducted on 78 nurses as principal investigators. An informed consent audit tool, which includes 6 items developed by Asan Medical Center Human Research Protection Center, was used to analyze errors in obtaining informed consent process. Data analysis was performed using the SPSS ver. 25.0, and the Mann-Whitney U-test and χ2-test were utilized to verify the difference in errors between the experimental and control groups. Results: The participants consisted of 42 in the experimental group and 36 in the control group, with no statistically significant difference between the 2 groups. Both 2 groups showed the highest frequency of documentation errors, followed by format errors, errors related to a suitability of investigator, participant, or participant's legally acceptable representative, witness and confidentiality issues. After education, there was a significant decrease in both format errors (p=0.002) and documentation errors (p<0.001) in the experimental group. The proportion of participants without any errors in all items was higher in the experimental group (35.7%) compared to the control group (5.6%), and this difference was statistically significant (p=0.001). Conclusion: The obtaining consent education program was found to be effective in reducing informed consent errors. This study emphasizes the importance of education, suggesting the need for its expansion and accessibility, as well as the necessity for all researchers conducting clinical studies to receive the obtaining consent education.

  • In the respect of the environmental protection viewpoint, the $CO_2$ may be regarded as one of the most attractive alternative refrigerants for an automotive air-conditioning system. Control methods for a $CO_2$ system should be newly developed, because properties of $CO_2$ are different compared with those of classical refrigerants. Especially, high-side pressure of a $CO_2$ system should be controlled for the effective operation of the system. In this study, intelligent control algorithms for a $CO_2$ system were developed ‘ These are a high-side pressure control algorithm and an indoor air temperature control algorithm. These algorithms were analysised by using dynamic models of a $CO_2$ system.

  • In the rapidly growing e-business area, the protection of information from hacking or tapping becomes very serious issue. Therefore, the more effective, convenient and secure methods are required to make the e-business more active. in this study, we develop the effective method of protecting digital contents on the public key infrastructure. To do this, we propose the partial encryption scheme to reduce the encryption time, and therefore, to release the server's workload. Our suggested scheme is believed to bring the strong competition to the portal service agents.

  • In China, environmental noise policies are composed of correlated laws adopted by the Standing Committee of the National People's Congress and promulgated by the President of the country, regulations promulgated by the State Council and/or local government, standards issued by the Standardization Administration Committee (SAC) under the State Council. The laws mainly include the 'Environmental Protection Law' and the 'Law on Prevention and Control of Pollution From Environmental Noise' Regulations are often applied to a special noise pollution phenomenon of wide influence. They are generally only effective in a given area and/or a specific period. Tens of correlated standards specify the noise level limits of different functional zones of land use and of different equipment, machines, devices, appliances etc., and the measurement methods. In this presentation, a brief introduction to these policies and their operations is given and discussed. The conclusion is that the policies supply an effective legislative basis for environmental noise prevention and control in China, but still a lot of work should be conducted and completed to strive for a quiet society.

  • Intellectual property law is slowly fighting to keep pace with the rapid growth of the fashion industry. Copyright and patent law have proven only minimally effective in fashion, even in the US and other top fashion nations, forcing designers and fashion companies to rely on their trademarks to protect their work. Litigating trademark disputes in the fashion industry presents a host of problems as witnessed in a recent Christian Louboutin case, leading the parties to resort to Alternative Dispute Resolution(ADR) and Online Dispute Resolution(ODR). ADR methods, especially arbitration, are increasingly emerging as substitutes to litigation. Using these methods, the fashion industry (CFDA in the US case) should sincerely consider a self-regulating program in which its members, both fashion designers and corporations alike, can resolve disputes in a manner mutually beneficial to all parties in order to preserve the industry's growth, solidarity, and esteem In particular, for the US fashion industry, the ongoing Innovative Design Protection and Privacy Prevention Act(IDPPPA) anti-counterfeit legislation could have caused a chilling effect against innovation. New designers with no name and less resources who could normally flourish producing inspired-by designs may find themselves subject to copyright infringement legislation since the IDPPPA may expand the protection of established designers and brands with more resources. This fear and its implication could be solved by the fashion industry itself since fashion experts know best how to handle these fast-paced issues arising in the field. Therefore, stakeholders in the fashion industry should commit to protecting innovation within fashion on a long-term basis by establishing a panel handling an ADR process. This can mitigate the uncertainty created by the IDPPPA or any other legislation from elsewhere, which could result in a shying away from experimentation with inspired-by designs.

  • The purpose of this paper is to provide basic data for construction methods of leakage pretaction for estuary barrien which is constructed to in take restoration water from irigative use and a river flow in its ultimate dsicharge to ward to sea, The water, accordingly, has reviewed the discrepancis between theories and experiments based on the hydraulic analysis of ground water through a series of sourveys on equi-patential line of seepage flow and a series of some experiments. apparently, however, the research results herein might reflect in some part not more than inference since those experiments are not conducted in a real foundation but from an indoor experiment or calculation, conclusion in brief are itemized here-under. 1. small-scale barrier require cut-off wall, which should reach the complete impereable layer, 2. Duplication barrier is provided effective in protection saline water seepage. 3. a barrier with broad crest might enable protection of massive seepage by fresh water lens formed from precipitation.

  • This thesis investigated accidents in relation with hazardous materials such as university laboratories in our country. In addition, this thesis investigated how the courses, hazardous materials, are managed, centering on Seoul, Gyeonggi, Busan, Gwangju, Gyeongbuk, and Chungbuk Fire Service Academy as well as National Fire Service Academy, and investigated how the courses, hazardous materials, are managed, centering on the courses in relation with fire service in universities, too. This thesis, also, performed a questionnaire survey on the education in relation with hazardous materials, objecting fire service officers on working who took education in respective provincial fire service academies and National 119 Rescue Services. This thesis analyzed the results of questionnaires, found problems in the current education about hazardous materials, and presented effective learning methods as the courses, hazardous materials, management methods, centering on new experiments. In addition, this thesis tried to present education plans with which people could prevent from the accidents in relation with hazardous materials.

Perceptions of Residents in Relation to Smartphone Applications to Promote Understanding of Radiation Exposure after the Fukushima Accident: A Cross-Sectional Study within and outside Fukushima Prefecture

  • Background: We conducted a cross-sectional study of residents within and outside Fukushima Prefecture to clarify their perceptions of the need for smartphone applications (apps) for explaining exposure doses. The results will lead to more effective methods for identifying target groups for future app development by researchers and municipalities, which will promote residents' understanding of radiological situations. Materials and Methods: In November 2019, 400 people in Fukushima Prefecture and 400 people outside were surveyed via a web-based questionnaire. In addition to basic characteristics, survey items included concerns about radiation levels and intention to use a smartphone app to keep track of exposure. The analysis was conducted by stratifying responses in each region and then cross-tabulating responses to concerns about radiation levels and intention to use an app by demographic variables. The intention to use an app was analyzed by binomial logistic regression analysis. Text-mining analyses were conducted in KH Coder software. Results and Discussion: Outside Fukushima Prefecture, concerns about the medical exposure of women to radiation exceeded 30%. Within the prefecture, the medical exposure of women, purchasing food products, and consumption of own-grown food were the main concerns. Within the prefecture, having children under the age of 18, the experience of measurement, and having experience of evacuation were significantly related to the intention to use an app. Conclusion: Regional and individual differences were evident. Since respondents differ, it is necessary to develop and promote app use in accordance with their needs and with phases of reconstruction. We expect that a suitable app will not only collect data but also connect local service providers and residents, while protecting personal information.

Application of Cold Weather Concreting with Accelerator for Freeze Protection to Full Scale Structures (내한촉진제를 사용한 한중콘크리트의 실구조물 적용에 관한 연구)

  • In this study, the results of applying cold weather concreting mixed with Accelerator for Freeze Protection(AFP) to full scale structures are presented. Since the determination of W/C and amount of AFP significantly have an effect on strength gain and protection of frost damage in early, a full investigation is needed to determine these values at stage of nux design. The flowability of fresh cold weather concreting with AFP was similar to the same W/C. Lower loss of workability and initial slump flow of concrete using superplasticizer of polycarboxylic ester than that of melamine sulphonate showed that polycarboxylic ester was more effective on elapsed time. Temperature histories of specimens located in insulation boxes at the site was similar to that of structures. Thus, it is cleared that simple adiabatic curing method is effective for evaluating in-place concrete strength than specimens cured by sealing method. The investigation results of development of compressive strength of cold weather concreting included AFP with curing methods by logistic curves indicated that AFP can be effective to gain strength at lower temperature than normal curing temperature. In field testing, vinyl sheets were placed over the concrete sections and AFP enabled concrete to gain $5N/{mm}^2$ to protect frost damage in early ages and specified compressive strength of concrete at 28 days under average temperature of $-2^{\circ}C$ (lowest temperature was $-12^{\circ}C$) during site application.
