Development of GIS-based EEZ Marine Resources Information System (GIS를 이용한 배타적 경제수역 해양자원정보시스템의 구현에 관한 연구)

  • There has been increasing concerns regarding marine mineral resources as the land energy resources has been depleting from worldwide energy crisis. Also, all the coastal countries around the world are getting into the high competition as EEZ implemented to widen each country's marine autonomy. Especially, the adoption of EEZ in UN's marine regulation agreement at the January of 1996 has aggravated conflicts among coastal countries and eventually resulted in critical agenda to determine the boundaries of EEZ among such countries. It is imperative for us to have negotiation with neighboring countries to determine the boundaries of EEZ. For the preparation of such negotiation, it is essential to have data such as mineral distribution, deep-sea geology, related agreement and marine laws, etc. Therefore, this study mainly concentrates on analyzing existing data of resources exploration and establishing standards for each type of data and manipulating data based on such standards, thereby building a database for more efficient management of EEZ data from marine resources survey. MRIS has also been developed to diversely analyze and visualize graphic and attribute data considering data usage and inter-relationship in the database. This system can provide various spatial analysis and spatial searching techniques to enable easier comparison of cost-benefit analysis and data provision of any area in EEZ thereby facilitating major policy making. In addition, the system can support sustainable management of marine resources of EEZ regions and data supply for systematic management of national marine resources. Furthermore, this will be very useful for negotiating with neighboring countries to determine EEZ boundaries to lead more favorable results.

  • 본 연구의 주요 목적은 기존의 연구에서 구축된 배타적 경제수역(EEZ) 해양자원정보시스템(MRIS)을 근간으로 다양한 해양자원의 정보를 효율적으로 표출하고 EEZ 관련 의사지원과 정책결정을 위한 GIS기반의 EEZ 정책결정지원시스템을 개발에 있다. 이를 위하여 기존에 구축된 MRIS를 이용하여 분산되어 관리되던 기존의 데이터와 매년 탐사 과정을 거쳐 추가되는 데이터의 관리를 위한 표준화를 수립하고 관리방안을 확정하였다. 또한, 기존에 개발된 다양한 해양데이터의 표출방안을 이용하여 EEZ 경계획정 협상 및 정책 결정에 있어 실질적 판단근거가 되는 EEZ에 대한 법령과 각국의 정책 및 EEZ 경계획정 사례 등을 데이터베이스화하였다. 나아가 GIS를 이용하여 표출된 공간데이터를 다양한 공간 검색과 공간분석 기능을 이용하여 분석함으로써 과학적인 방법으로 EEZ에 대한 중요정책 결정에도 활용하도록 하였다. 본 시스템을 이용하여 향후 EEZ 내 자원분포 및 지 역 별 경제성 비교와 쟁점지역에 대한 정확한 분석이 가능함에 따라 국가 간 협상에서 우리나라에 보다 유리한 협상결과를 도출하는데 기여가 클 것으로 판단된다. 아울러 주변국과 경계획정에 있어 유리한 협상 결과를 도출하기 위한 제반 정보의 제공과 함께 보다 효율적인 정책 수립을 위한 다양한 의사결정의 지원이 가능할 것으로 사료된다.

A study on the transformation of the fisheries relations in accordance with the changes in Japan and Russia Fisheries Agreement (일본과 러시아 간 어업질서의 재편에 따른 양국 어업관계의 변모)

  • This research examined the transformations of the fisheries relations between Japan and Russia since the establishment of the Exclusive Economic Zone (EEZ) system. The author reviewed the transformations with investigation on mutual fishing access to EEZ including salmon & trout catches. The Japan-Russia fisheries relations have evolved through multiple developmental stages, which include mutual fishing access to EEZ, the reductions of a fishing quota to balance catches of the nations, provision of financial and technical support, and a payment system of EEZ fishing access fee. The Japanese salmon industry also has done similar practices, continuing to catch salmon and trout in the Russian EEZ. Additionally, Japan and Russia have attempted to develop joint fisheries projects and to assure fishing operation safety around Kuril Islands. The case of Japan-Russia mutual fishing access shows that a country that has authority over crucial fisheries resources tends to establish specific conditions of mutual fishing access so that it maximizes its national interest. Thus, this case gives us implication what could be future directions of Korea-China-Japan multinational fishing access. The principle of same number of fishing vessels and quantities of catches has worked in existing mutual fishing access to EEZ among Korea, China, and Japan. However, it is expected that a nation that is endowed with abundant fisheries resources would limit counterpart's fishing access to its EEZ. Therefore, Korean fisheries administration should prepare for all possible situations like a dramatic cut in fishing quota and the termination of fishing access. International fisheries cooperation and payment of fishing access could be viable options for such a situation.

On the Countermeasures against Korean Fishing Boat being seized in Japan′s EEZ (일본 EEZ에서 우리 어선나포에 대한 대응방안)

  • This study aims to analyse the actual conditions of Korean fishing boat being seized in Japan's EEZ and to provide the countermeasures against that problem. According to the analysis of that actual conditions, Korean fishermen are trespassing Japan's EEZ in which fishery resources are abundant because of exhaustion of fishery resources and polluted water in Korean coastal sean. In the past, That behavior was not illegal. Now, however, it became illegal with the effectuation of the United National Conventions on the Law of the Sea(1994) and the Korean-Japanese Fisheries Agreement(1999). In order to resolve that problem on a long-term basis, it is necessary to turn over national fishery policy, to provide fishing people with other means of living, and to establish the Korean-Japanese cooperation system of fishery management. Most of all, it is urgent to mitigate and remit a penalty which was executed in Japan, to amplify personal and material resources need to guide and control fishery, and to construct a close cooperation system between the National Maritime Policy Agency and the Ministry of Maritime and Fisheries Affairs.

The Future Tasks for Reorganization of International Fisheries Order between Korea, China and Japan in Northeast Asian Seas (동북아 수역의 신 어업질서 성립과 향후 과제)

  • This study aimed to review the reorganization of fisheries and the future tasks in accordance with the establishment of new fishery order in the Northeast Asian Seas. As the United Nations Convention on the Law of the Sea, which recognized the sovereign rights of Coastal States in a 200-nautical mile exclusive economic zone (EEZ), entered into force in 1994, the three countries of Korea, China and Japan ratified the United Nations Convention on the Law of the Sea in 1996 and started negotiations to establish a new fishery order consistent with the EEZ system. However, a conflict of interest occurred because of differences in fisheries between countries, negotiations many times have proceeded, resulting in the signing of fishery agreement between China and Japan in 1997, Korea and Japan in 1998, and Korea and China in 2000. Each fishery arrangement consists of a dual system of EEZ and provisional waters (middle waters, provisional waters). The two countries are engaged in mutual fishing based on coastal states in EEZ, and in the fishing operation under the principle of flag state in provisional waters. There are overlapping or ambiguous jurisdictions in the intermediate waters and provisional waters that are jointly available to both fisheries. The presence of these seas is a challenge to the establishment of a reasonable international fisheries management system for the entire Northeast Asian Seas. In this context, the challenges of the reorganization of the new fisheries order are as follows: 1) conversion to a fishery order for coexistence of fisheries, 2) expansion to an international fishery management system, and 3) establishment of a multilateral fishery cooperation system. Although the jurisdiction of their own waters has been expanded through the establishment of EEZ according to new fishery order, the need for mutual cooperation grows when considering the movement and migration of fishery resources, fishery management, fish consumption and trade. In addition to the fisheries cooperation between the governments, it is also necessary to revitalize the civil cooperation focused on fishermen who exploit fishing grounds together.

An analysis of the fishing characteristics of Korean large purse seine fisheries in Japanese waters (우리나라 대형선망어업의 일본수역 조업특성 분석)

  • The breakdown of the Korea-Japan fishing negotiations since 2016 has made it impossible for many domestic fishing vessels to operate in the Japanese EEZ water, and large purse seine fishing vessels are one of them. Mackerel is a highly migratory fish species, circulating in the East China Sea, South Sea, West Sea and East Coast throughout the year, and goes through a period of wintering, spawning, growth and feeding migration. In this study, in order to find out the dependence of large purse seine fishing vessels on mackerel fishing in the Japanese EEZ waters, we analyzed the characteristics of mackerel by large purse seine fisheries in the Japanese EEZ waters from 2010 to 2016. The catch and fishing details were investigated. The total catch of mackerel by large purse seine fishery, the average catch rate of mackerel in Japanese EEZ is 4 percent per year. The amount is estimated at 10.2 billion won per year. Although there was an effect, it was not judged to be a significant factor, and it was found that the amount of catch and fish price in the domestic waters had a greater influence on the total catch than the Japanese EEZ waters.

A Study on International Disputes with Korean Distant-Water Sea Fisheries (한국의 원양어업관련 국제분쟁 사례연구)

  • The primary objective of this thesis is to study, case by case, the international disputes for fishing rights between fishing nations and costal states never imagined till the introduction of the UN Convention on the Law of the Sea adopted in 1982 and came into effect in November 16, 1994, which governs the high seas and EEZ in a new manner. Such a study is to provide help in the understanding on this new marine system and how to deal with. This is addressed by the perspectives of disputes (a) in the high seas between fishing nations having traditionally enjoyed the principle of the freedom of the high seas and costal states, (b) in the EEZ between fishing nations and costal states possessing the exclusive jurisdiction over living marine resources and sovereign rights for determining allowable catch and the surplus in its EEZ. The article can be divided into four main parts. First, both the general principles of the settlement of international disputes, and the nature and procedures described in the UNCLOS are introduced. Second, it gives cases of tuna long-liner, North Pacific trawler and squid jigger occurred in the coastal states EEZ, and analyses the problem in both terms of its background and final judgment. It further describes the possible issues in case it depends on the International Tribunal for the Law of the Sea for its settlement. Third, closely tied to above, important points such as the right of hot pursuit, prompt release of vessel and crew, and the limits of cooperation with costal states inspector on board fishing vessels are considered mostly based on the UNCLOS, Bilateral Agreement and UNIA. Finally, the article concludes as follows ; The need for broad analyses on the nature of international suits and legal system for the settlement, to win the case before the International Tribunal for the Law of the Sea or coastal states court, is really acknowledged. However, considering the lack of previous studies about it, it is preferably recommended that governmental efforts for making legal standards to cover the judicial costs, for helping industry out of becoming bankrupt.

Establishment and future prospects of new international fisheries regime in Northeast Asian region (동북아지역 국제어업협력체제의 구축과 운영방향)

  • In the Northeast Asian region fisheries agreements of the past regarding high seas as an agreement area were transformed or new agreements were introduced in order to conform to the EEZ regime. However, the existing joint regulatory zone which “open” status is somewhat similar to the high sea not only disappear, but also two new systems were established. To begin with, parties of the agreement claimed their EEZs to be from the territorial sea baselines to the extent set forth, problem of the fishery access of the other party under the agreement is to be solved on the principle of reciprocity and on recognizing of the catch results achieved in the past. In regards to the overlapping zones like neutral zone of the East Sea of Korea(Sea of Japan) and neutral zone to the south of the Cheju Island, provisional measures zones in the Yellow Sea and in the East China Sea, and transitional zone of the Yellow Sea special fisheries management systems reflecting the legal character of the zone involved are applied. Moreover, as fisheries agreements defining open sea as an agreement zone are not able to conform to the EEZ regime, so new fisheries agreements must be taken out from old systems and conceptions, and must be understood and enforced from the new point view. Therefore, countermeasures needed to do so should be developed, and their basic structure is as follows. Firstly, the basic concept of the EEZ regime requires that the coastal states have sovereign rights on their sea zones' natural resources and bear responsibilities appropriate to their allowed jurisdiction. Each Northeast Asian state should adjust the structure of fishing industries and employ advanced fisheries management system, and should make efforts toward such issues of the state policy as increasing fishery resources and preserving ocean environment. Secondly, measures should be developed to solve the international fisheries disputes which are to occur under enforcement of the new fisheries agreements system. In regards to the acts of violation the fisheries laws in the foreign EEZ the principle of jail sentence prohibition is established by the UN Convention on the Law of the Sea, and every fisheries agreement reflects this principle. Therefore, the present question is to consider concrete measures to enable the easy release of the seamen, who violated fisheries laws slightly and well-intently, through establishment and management of the guarantee fund needed to make collateral reasonable. Thirdly, Korean-Russian and Russian-Japanese fisheries relations were formed on the basis of the EEZ regime, since 1992 and 1977 respectively, and are expected to maintain mutually beneficial cooperative character. As for Korean-Chinese-Japanese fisheries relations, the operational problems of overlapping zones, and problem of the permits for EEZ mutual access should be solved on the basis of the principle of reciprocity and equity rather than unilaterally from any side.

A Study on the Fisheries Control System of the Fisheries Act of Korea (수산관련법상(水產關聯法上) 어업관리제도(漁業管理制度)에 관한 연구(硏究))

  • The fisheries control system being now enforced in all countries may be generally classified as three types - the input control system, the output control system, and the technical control system. In Asian countries that have relatively small fishery scales, diverse object species and the fisheries resources has been regarded as "governmental possessions", fisheries have been controled subsidiarily using the technical control system based on the input control system traditionally. While in Europe and America that have relatively large fisheries scales, simple object species and the fisheries resources has been regarded as "common property", fisheries have been controled subsidiarily using the input control system and the technical control system based on the output control system. In Korea, fisheries have been controled subsidiarily using the technical control system based on the input control system traditionally, nevertheless overexplotation and overcapitalization have not been solved. Recently the EEZ was promulgated, the total allowable catch system was introduced to control the EEZ. But the output control system is totally different from the input control system of the Korea traditional fisheries system, simultaneous availableness of both system is considerably difficulty. Therefore a study on new systems to make both systems harmonized has to be performed. The thesis is aimed at presenting the general improvement direction of the Korea fisheries control system as the basis for establishment of the new fisheries control system.

Study on the Possibility of Implementation of TAC Management System in China (중국의 어획량관리제도 도입가능성에 관한 소고)

  • The existing Law of fisheries Management of China was firstly established on October 30th, 1986 and revised in October, 2000. The new Law of Fisheries Management provided a basis for introduction of the TAC (total allowable catch) system into China. Introduction of the TAC system is a natural result of the practise of EEZ (exclusive economic zone). In addition, the inability of the traditional fishery management system and the promising results obtained by conductions of TAC system in some countries with advanced fishery also make the introduction of TAC system a necessity, However, the contradictions between the unrealistic introduction of the fisheries management systems, the small-scale operation, higher expense of the conduction and supervision of the systems, and the insufficiencies of human power, financial fund, and scientific technique of the underdeveloped country resulted in the ineffectiveness of the new systems. So this study is to discuss the background and the possibility of TAC system implementation in china. The results of this study showed that many factors restrict the implementation of TAC system into China at present. It will take a long time to practise the new system. meanwhile, reforming and improving the functions of the existing systems to provide a better environment will play an important role in the introduction of the TAC system into china.
