환동해 어업의 지형 변화: 중국어선의 동해 진출이 어업생산과 고용 및 생존 위협에 미치는 영향 (The Terrain Transformation of the Fishing Industry in East Sea Rim: Impact of Entering Chinese Fishing Fleets into East Sea on the Fishery Production, Employment and Life Threat)

  • This study aims to face common threats from the depletion of fish resources, the decline of production and employment as well as the increase of life risk in East Sea Rim countries, North Korea, South Korea, Japan and Russia due to the Chinese fishing fleets entering East Sea. The recent competition in fishing among fishing vessels and fleets of national origin operating in the East Sea has induced a significant change in the ecological landscape of the fishing fleets cluster while having influenced production and employment in the fishing industries of South Korea and Japan as well as life threat on the fishermen in North Korea. It seems that the population organizational ecological theory can be applied to this change. It can be seen as the isomorphism of the selection process over the exclusive economic zone (EEZ) to avoid the environment in which these North Korean fishing vessels are pushed against the Chinese fleet in the North Korean part of the East Sea. To resolve the fishery disputes or conflict in the common waters in East Sea, first of all, Chinese fishing fleets will be required to put international pressure so as to solve the unfairness of the illegal fishing and overfishing by the International Fishery Organization or the UN violations of the sanctions against North Korea selling fishing rights to China. Although it is not easy for South Korea to cooperate with North Korea in the short term, South Korea will be able to support the fishery infrastructure in North Korea in the mid- to the long-term to prevent the loss of innocent lives for their fishermen and to raise their incomes.

남서대서양 한국 원양 저연승 어선의 조업 분포 및 비막치어(Dissostichus eleginoides) CPUE 변화 (Distribution of Fishing Grounds of Korean Bottom Longline and Annual Change of CPUE of the Patagonian Toothfish Dissostichus eleginoides in South West Atlantic)

  • This study used the commercial fishing data of Korean high sea bottom longline vessels in the South West Atlantic Ocean from 2013 to 2019 to identify the distribution of fishing grounds of Korean longline vessels. We estimated the CPUE of the Patagonian toothfish Dissostichus eleginoides and the changes in its stock status. The fishing grounds of Korean longline vessels were observed to concentrate on the exclusive economic zone (EEZ) boundary between Argentina, Uruguay, and Falkland owing to the high seas of 41-55 °S in the south and 49-60 °W in the west. A high intensity of fishing was seen in the middle area, which was horizontal from the 3.1 subarea. In all the three subareas, CPUEs have had the tendency to decline since 2013. Although the CPUEs in the 3.2.1-2 subareas were the highest in each subarea, there was no significant difference in each subarea (P>0.05). It is believed that the establishment of a regional fisheries organization or the strengthening of the management of FAO is necessary for the management of Southwest Atlantic fisheries and sustainable fishing, because the portion and scope of Korean longline vessels are very low in the Southwest Atlantic; however, the CPUE is estimated to have declined.

대서양 한-가나 합작법인 소속 다랑어 선망어선의 조업실태 분석 (Analysis on the fishing conditions of tuna purse seiner belonging to the Korea-Ghana joint venture in the Atlantic Ocean)

  • The research was analyzed the catch data of the five years (2016-2020) for six joint venture company tuna purse seiners in the Atlantic Ocean, with the aim of suggesting improvement measures for responsible and sustainable fishing according to changes of recommendation by International Commission for the Conservation of Atlantic Tuna (ICCAT) on the tropical tunas. In the last five years, the average catch of six tuna purse seiner gradually increased to 7,745 tons, 8,364 tons and 9,053 tons from 2016 to 2018, but decreased to 7,761 tons in 2019 and 6,214 tons in 2020. The reason for the decrease in fishing volume in 2019 and 2020 was the fluctuation of the formation of the cold water zone (22-23℃), and the total ICCAT convention area of FAD closure in January and February due to the expansion of the FAD closure area and poor free school catching during two months period, respectively. The analysis on fishing area showed that the percentage of fishing in the high sea was about 85% although the FAD closure area included the EEZ zone in coastal countries; the rise of the fishing license in coastal countries is also believed to be a factor. In order to overcome such situations and improve catching volume, it will be possible if excellent manpower is secured, school fishing is expanded, and the production of high value-added catch (purse seine special: PS).

해양환경보전과 이용·개발의 상충 분석과 해양공간계획에 대한 시사점 (Diagnosis of Conflict Problem between the Marine Environmental Conservation and Development, and Policy Implication for Marine Spatial Planning)

  • 최근 해양에서 이루어지고 있는 해역이용 개발 현황 분석을 통해 입지의 적정성과 환경영향 측면에서 상충될 수 있는 대표적인 개발사례를 진단하여 해양공간계획수립의 필요성에 대한 시사점을 제공하였다. 해양 신재생에너지개발(조력 및 해상풍력), 바다골재채취, 공유수면매립, 연안골프장 조성, 온배수 및 고염수 배출, 침식영향 개발사업 등의 주요 사례 분석결과, 해당 공간이용 및 관리방향 간의 상충성이 빈발하고, 누적환경영향에 따른 해양환경과 생태계 훼손, 어장이용과 이행당사자사이의 갈등이 지속적으로 나타나고 있는 상황이다. 이러한 이유는 개발 입지 및 주변 공간영역에 대한 충분한 현황 파악이 부족하고, 공간이용과 관련된 개별법의 상호성 및 연계성 평가가 미흡한 것과 관련되어 있다. 사전예방적인 해양환경관리 정책을 강화하기 위해서는 입지 적정성과 개발규모에 대한 평가 검토를 강화해야 할 것이다. 특히, 전략환경영향평가 등 상위계획 심의단계에서 입지와 규모의 적정성에 대한 평가 시, 해양공간이용 현황, 상위계획과 지역계획간의 연계성(특히, 연안관리지역계획과 통합계획), 해양수산규제지역과 보호대상 해양생물 분포 등 핵심 평가사항을 제시하도록 하여 보다 철저한 진단이 이루어져야 할 것이다. 지속가능한 보전과 개발의 조화를 위해서는 TOP-DOWN 방식의 해양공간계획 전략(연안과 EEZ, 광역과 협역 해역 등 전체적 Zoning과 Sector 연계성을 강화, 3차원 정보 포함 등)을 마련해야 하고, 이 과정에서 체계적이고 최신의 해양공간정보 속성자료 파악 및 공유를 위한 통합 정보시스템 구축이 필요할 것으로 판단된다. 해양수산과 관련된 전 부문, 즉, 항만 어항, 수산, 연안관리, 해양환경과 생태계 분야에서 해양공간이용의 상호적이고 일관성있는 전략이 필요할 것이다.

해양환경영향평가 관련 협의에 의한 연안이용분석 (Analysis of Coastal Area Utilization by Consultation of Marine Environmental Impact Assessment Related-Systems)

  • This study presented politic proposals and diverse utilization-type in coastal areas by analyzing results of reviewed related-statements of marine environment during the one year period of 2007 by Marine Environmental Impact Assessment Center. Total of 358 cases were reviewed, which was a significant increase from 270 in 2006. Consultation on the utilization of sea areas (CUSA) accounted for the largest number of 165 (46.1%) and it was followed by 104 cases of environmental impact assessment (EIA) (29.0%) and 89 cases of prior environmental review (PER) (24.9%). As such, evaluation statements (EIA+PER) related to consultations of the Ministry of Environment accounted for approximately 54% of the entire cases reviewed. To analyze the overall results of reviewing marine-related evaluation statements, utilization and planning were conducted by 47.9%, 38.4% and 13.7% in the South Sea, West Sea and East Sea of Korea, respectively. In evaluation statements (EIA+PER), port construction, industrial complex construction, urban management plan and road construction took up most of the part by 40.9%, 20.2%, 10.4% and 7.3%, respectively. In terms of CUSA-statement, it was evaluated that consultations were mostly carried out on use and reclamation of public water surface in coastal areas and on sea aggregate extraction process in EEZ. The largest number of plans for coastal use were established for Jeollanam-do, followed by Gyeongsangnam-do, Chungcheongnam-do, Gyeongsangbuk-do and Gyeonggi-do. In particular, development plans were concentrated on Jeollanam-do and Gyeongsangnam-do with stable marine environment and outstanding view of the nature. In most cases, these regions are adjacent to the areas designated as a sea area for environmental management and fisheries resources protection zone. Therefore, conflicts exist between development and preservation. Also, rather than random development, more detailed marine environmental impact assessment, gathering of public opinions and politic harmony are essentially required. For efficient coastal management and environmentally sound and sustainable development, fulfilling consistent and transparent coastal policies as well as active and reliable decision making to center on coastal environment by management bodies will be important.

울릉분지 남동부 시추 퇴적물 내에 함유되어 있는 천부가스의 특성 (Geochemistry of Shallow gases taken from the core sediments in the southeastern Ulleung Basin)

  • 동해 울릉분지에 분포하는 천부 가스의 특성을 파악하기 위해서 분지 남동부 해역에서 채취한 시추 코아 (98EEZ-3)에서 가스를 포집하여 탄화수소 가스의 함량, 성분 및 탄소 동위원소 분석을 실시하였다. 또한 가스의 함량과 시추 코아 퇴적물의 연관성 및 특성을 파악하기 위해서 시추 퇴적물에 대해서 유기 지화학 분석을 실시하였다 시추 코아에서 포집된 천부가스 중 탄화수소 가스의 함량은 755.3 ppm에서 6176.7 ppm을 나타났다. 탄화수소 가스로는 메탄의 함량이 가장 우세해서 $697.9{\~}6054.4 ppm$을 포함하였고 메탄 외의 탄화수소 성분으로는 에탄, 프로판, 부탄, 헥산이 소량 분석되었다. (100 ppm 이하). 퇴적물 분석 결과 총 탄소는 $1.84{\~}5.11{\%}$,유기탄소는 $0.29{\~}2.65{\%}$의 함유량을 나타냈다. 총 유기탄소와 총 질소의 비율은 분석 구간 중 일부를 제외하고는 10 이상으로 육상 기원 유기물의 유입이 우세했음을 시사한다. 포집된 총 탄화수소 가스 중 메탄의 성분비와 탄소 안정 동위원소 비를 고려하면 울릉분지 남동부에 분포하는 천부가스는 열기원 가스가 우세하고 일부는 생물기원 가스와 흔합되어 나타나는 양상을 나타낸다. 시추 퇴적물 중 유기물의 열적 성숙도는 동위원소 결과에 따른 가스의 열성숙 단계 보다 낮게 나타나서 시추구간보다 심부에서 생성된 열기원 가스가 이동하여 현재의 위치에 집적되어 있는 것으로 해석된다.

한반도 주변의 영해기점 및 기선에 관한 연구 - 한국, 중국, 일본을 중심으로 (The study on the Base point and baseline in Korea, Japan, and China)

  • 각국은 유엔 해양법 협약의 규정 하에서 자국의 영해, 어업수역, 배타적 경제수역을 확장할 수 있는 방법을 모색하고 있다. 이를 위한 노력은 두 가지 측면에서 나타나는데 그 하나는 기점을 최대한 해안선에서 멀리 떨어진 곳으로 정하는 것과 다른 하나는 수직기준면의 조정이 자국의 수역확장에 도움이 되는가에 대한 분석과 자료수집이다. 우리나라는 유엔 해양법 협약의 발효에 따라 1996년부터 꾸준히 영해를 마주보고 있는 일본 중국과 해양경계 획정 회담을 해 오고 있으나 한 일, 한 중 간의 해양경계협정에 많은 장애가 있으며 그 과정에서 우리나라의 해역확장을 위해 기점과 수직기준면 설정이 매우 중요하며, 이에 대한 철저한 대비가 필요하다. 본 논문에서는 인접국의 기점과 기선관리 실태를 파악하고 문제점을 분석하고 우리나라의 기점과 영해확장을 위한 방안을 모색하였다. 직선기점의 설정과 관련하여 국제해양법 협약에 위배되지 않으면서 영해확장을 도모할 수 있는 기점에 대한 검토와 국제수로기구(IHO)에서 권장하는 수직기준면에 대한 검토는 우리나라의 영해확장을 위해 반드시 필요하다. 이는 경계획정 회담에서 우리나라의 영해 획정의 기술적인 근거가 될 수 있다.

"해양경비법" 검토와 발전방안 (The Examination and Development Plan of Maritime Policing Act)

  • 2012년 8월 23일에 시행예정인 "해양경비법"은 해상에서의 경찰권 발동의 근거법을 제정했다는 점에서 그 의의가 있으나 다음과 같은 한계가 있다. 첫째로, 해양경찰의 조직법적 근거가 미약하다. 이는 행정조직 설치의 근거를 법률이 아니라 하부령인 대통령령과 국토해양부령에 위임하는 형태로 엄격한 의미에서 행정조직법정주의에 어긋나는 측면이 있다. 둘째로, "해양경비법" 제14조의 항해보호조치 규정은 이미 발생한 해상집단행동에 대한 조치 중심으로 기술되어 있으므로 사전예방적인 측면을 더 강화하여 "해상집회시위의 사전신고제", "해상집회시위의 금지구역설정" 등의 규정의 신설이 필요하다고 생각된다. 셋째로, "해양경비법" 제22조 과태료는 과중한 측면이 있다. 해양경찰의 해상검문검색에 대한 불응에 대하여 200만원을 부과하는 것은 과중한 편이다. 해상의 특수성을 인정하더라도 과중한 측면이 있으므로 100만원 정도를 부과하는 것이 합당할 것으로 생각된다. 넷째로, 해양경찰내에 자원관리부서를 신설하여 해양조사 및 자원관리 역량을 강화하고, 다른 기관의 해양조사선박을 지원하고, 해양경찰이 직접 조사할 필요성이 있으며, 주변국과 해양자원 관련사항을 발생한 경우 효율적 대응이 필요하다.

동북아 수역의 수산자원 보존관리 협력체제에 관한 연구 (A Study on International Cooperation System for Fisheries Resources Conservation & Management in the Northeast Asia)

  • This study is designed to propose the ways of the multilateral cooperation system for effective management of fisheries resources in the various overlapping zones established by bilateral fisheries agreements between Korea, China and Japan in North East Asia as semi-enclosed sea. It is necessary to build multilateral fisheries cooperation between Korea, China and Japan in North East Asia because conservation & management of transboundary fish stocks could not be guaranted effectively by the management of fisheries resources in the area where piled up the current-fishing-pattern zone, as white zone and the various grey zone as middle zone, and the interim measures zone of bilateral fisheries agreements between Korea, China and Japan are piled up. Fisheries management in Korea, China and Japan by the bilateral fisheries agreements in North East Asia is faced with difficulties manage fisheries resources. International relationship on fisheries is maintained by bilateral fisheries agreements based on UNCLOS. However fisheries resources are over-exploited and the recovery of the fisheries resources is very slow because proper conservation and management of transboundary fish stocks which article 63(1) of UNCLOS defines have not prepared yet. Thus close cooperation among the coastal States for a proper conservation and management of transboundary fish stocks is necessary. Since the transboundary fish migrate within the EEZs of two or more coastal States, there is a need to manage the fish stocks in the region between Korea, China and Japan through a multi-lateral mechanism at ccircumference area of the current-fishing-pattern zone as white zone. Coastal States must guarantee sustainable maintenance of transboundary fish stocks through the regional cooperation for a proper conservation & management because one coastal State alone could not guarantee conservation and management of fish stocks. Thus there is a need to build multilateral fisheries cooperation between Korea, China and Japan in North East Asia. There are many successful instances including the Barents' sea for a proper conservation & management of transboundary fish stocks. The Barents' sea is one of the best research object to study the regional cooperation for a conservation & management of transboundary fish stocks in North East Asia. In conclusion, it is necessary to build a multilateral fisheries cooperation system between Korea, China and Japan in North East Asia to conserve and manage transboundary fish stocks effectively. It seems desirable that the range of the area to conserve and manage fish stocks should may be any partial area in the current-fishing-pattern zone and interim measures zone between Korea and China, Jeju middle zone between Korea and Japan, interim measures zone of bilateral fisheries agreements between China and Japan.

해상에서의 우발적 조우 시 신호 규칙(CUES)의 제한점과 개선을 위한 제언 (Code for Unplanned Encounters at Sea(CUES): Its Limitation and Recommendations for Improvement)

  • Adopted in Western Pacific Naval Symposium(WPNS) 2014, Code for Unplanned Encounters at Sea(CUES) has been the most valuable output of WPNS history. Written and suggested by Australian Navy in 1999, the goal of CUES is to decrease the possibility of the naval conflict by establishing the code among international navies in the Western Pacific region. Facing many oppositions and requirement of People's Liberation Army Navy(PLAN) in WPNS 2012 and 2013, but it finally adopted in WPNS 2014, with many changes in detailed provisions. From then, navies in the Western Pacific region have followed CUES to prevent maritime conflicts in the region, CUES, however, sometimes does not work correctly. Contents of CUES is the mixture of the parts of Multinational Maritime Tactical Signal and Maneuvering Book(MTP) and International Regulations for Preventing Collision at Sea 1972(CORLEGs). There are means of radio communications such as frequency and signals, instructions for maneuvering and so on. Thus, it is not a new document for the U.S. Navy and its allies, but it requires training to implicate at sea for navies other than U.S. allies, like PLAN. Lots of provisions in CUES were changed because of the opposition of PLAN, and CUES has many shortcomings and practical limitations. First, since CUES is non-legally binding, and there are no methods to force the naval assets on the sea to follow. Second, CUES is only applied to naval assets; naval ships - warships, naval auxiliaries, and submarines - and naval aircraft. Third, the geographical scope in CUES is not clear. Fourth, there is no provision for submerged submarines. Finally, CUES has no time-based framework or roadmap for training. In this regard, there would be six recommendations for improvement. First, CUES should be reviewed by WPNS or other international institutions, while keeping non-binding status so that WPNS could send signals to the navies which do not answer CUES on the sea. Second, the participation of Maritime Law Enforcements(MLEs) such as coast guard is inevitable. Third, navies would use full text of MTP rather than current CUES, which extracts some parts of MTP. Fourth, CUES needs provisions with respect to submerged submarines, which recognizes as offensive weapons themselves. Fifth, the geographic scope of CUES should be clear. Since there are some countries in which claim that a rock with a concrete structure is their territory, CUES should be applied on every sea including EEZ and territorial seas. Finally, the detailed training plan is required to implicate CUES at sea. Rim of the Pacific (RIMPAC) is a good exercise to train CUES, because almost all WPNS member countries except six countries are participating in RIMPAC. CUES is a meaningful document not only for navies but also for nation-states in the region. To prevent escalation of conflict in the region, potentially caused by an unplanned collision at sea, CUES should be applied more strictly. CUES will continue to be in subsequent WPNS and therefore continue to improve in the effectiveness as both an operational and diplomatic agreement.
