제품안전 및 신뢰성 향상을 통한 제조물책임 예방대책 (Product Liability Prevention Policies through the Improvement of Product Safety and Reliability)

  • Product Liability(PL) is a legal policy to deal with global competition by improving domestic industrial competitive power and to reduce the cost of defect products. The purpose of this paper is to address the state of the art solutions to dispute on PL, in reality of a frequent occurrence of global product exchange focussing on product safety that is one of the most important functions of PL and to improve solution of the product safety and reliability responsive to PL. To minimize PL exposure, manufacturers should reflect comprehensive product safety and reliability concepts in establishing PL prevention policies. Total PL prevention policies are composed of total quality management and product safety management system in respect of safety design, risk, and reliability. These PL prevention activities should be performed consistently during the total product life cycle, especially product research and development periods.

시동불능 자동차에서 발생한 화재의 원인 분석 연구 (A Study on Cause Analysis of a Fire that Broke Out on a No-start Motor Vehicle)

  • It is often thought that because no-start motor vehicles cannot start an engine, a fire cannot occur for motor vehicle causes. However, although the engine cannot start up, some parts may be live with electricity if a battery is connected. If the parts have problems, a fire can occur. This study analyzed the causes of fires occurring when a motor vehicle was loaded onto a tow truck to service no-start. It is suggested that no-start motor vehicles should separate a battery terminal to prevent a fire. And this fire is related to automotive products liability.

강원도 중소기업의 제조물책임법 대책에 대한 연구 (A Case Study on PL Management in Small and Medium-Sized Firms of Gangwon-Do Province)

  • Product liability(PL) is the producer's compensation to customers for damage incurred by product defects. This paper studies on the organizational culture, promotion process, system construction, system level, product safety review, product safety assurance, system operation, and its effectiveness and necessity of recognition for the PL system of small and medium-sized firms in Gangwon-Do province. The results show that the firms have product safety regulations, but the number of firms which its employees understand the regulations is less than the number of firms which do not understand. Also the number of firms which is preparing PL prevention and insurance, and counterplan for accidents seems to be not in large numbers.

무인항공기 결함에 대한 제조물책임의 적용 연구 (A study on the product liability for defects of unmanned aerial vehciles)

  • 우리나라는 '민간 무인항공기 실용화 기술 개발 사업' 수립하고 이행 중이다. 이러한 정책의 주요 내용은 민간무인기 시제기 개발과 운영체계 원격통제소 등을 개발 구축 후 시범운영을 거쳐 국내 상용화 하는 것이다. 민간 무인항공기 산업의 활성화는 우리나라 뿐 아니라 외국에서도 수년전부터 개발을 진행해왔다. 그러나 민간 무인항공기 산업은 동전의 양면처럼 이득과 사고 위험이 공존하고 있다. 무인항공기 산업은 미래 항공산업의 핵심요소이지만 항공기 관련사고를 피할 수 없다. 무인항공기도 일반 항공기와 동일하기 때문에 사고발생의 위험이 있으며, 사고가 발생했을 경우 인명 피해(부상 사망)와 물적 피해(재산 손해)가 발생될 것이 분명하다. 특히 무인항공기는 인간이 생산하는 제품인바 기체의 결함으로 인하여 무인항공기를 구입하여 사업을 영위하는 회사(소비자)가 사고가 발생하는 경우 이에 대한 법적책임의 적용이 필요하다. 무인항공기 제조상의 결함사고가 문제될 경우 피해자는 직접 제조물이 원래 의도한 설계와 다르게 제조되었음을 입증여부가 가장 문제이다. 이는 무인항공기(제조물)가 원래 어떠한 의도로 설계되었는지는 피해자가 알 수 없으며, 제조업자의 영업비밀에 속하기 때문이다. 그래서 소비자에게 제조자가 의도한 설계를 입증할 책임을 부과하는 것은 정당하지 않으며 오히려 소비자로서는 제조물이 통상적으로 기대할 수 있는 안전성이 결여된 위험한 물건인 것만을 입증하는 것이 필요하다. 이는 무인항공기가 의도된 대로 제조되었음에도 위험요소가 존재하는지, 의도된 대로 제조되지 못하여 위험한 것인지 여부 등에 대한 결함의 판단에 대한 세부적인 문제는 제조자 측에서 설명의무를 부담하는 것이다. 무인항공기 표시상의 결함이 문제되는 사건에서 합리적인 표시 지시 경고 기타 의표시를 하였더라면 피해를 막을 수 있었음을 피해자에게 입증하도록 요구하는 것은 옳지 않으며 피해자로가 단지 무인항공기(제품)가 표시 지시 경고가 기대를 충족하지 않아 위험성이 있음을 보이면 족하다고 할 것이다.

  • The ending of the warranty under the current Multi-Housing Management Act has a lot of problem as it is very disadvantageous to the business entity and it makes hard for the contractor to finish the repair work. It is almost none for the business entity to get the written confirmation of the expiration of warranty liability from the client even though it sincerely completed their warranty obligation. It is because the client asks for the works other than fair repair arising from the defect in the work, such as the upgrade work for the enhancement of the value of their assets and the repair work which the client should take care before it issues the written confirmation of the expiration of warranty liability to the contractor. "So, though there is the law specifying this matter, the parties are relying on the unnecessary civil agreement. This leads to the big social and economic losses. If there is no agreement made between the client and the contractor, that leads to the legal dispute. This research on cases of 10 apartments shows that the types of works which the apartment residents ask for depend on the characteristics and conditions of the apartments and that they ask for various kinds of compensational works. In addition, it was found that there were many cases in which even the civil agreement is not recognized as the ending of the warranty obligation even if the proper procedure is taken for the ending of warranty by the contractor or business entity. If the collateral is to be offered to the client, the contractor would get more hard because there is the additional cost other than the warranty obligation, thus damaging the legal objective of the laws trying to minimize the damage made to the resident of the apartments. It means that the increase in the unnecessary warranty cost would lead to the increase in the selling price of apartment and the ending of the dispute through the civil procedure would make the Multi-Housing Act ineffective.

美.日 선진기업의 PL 대응 시스템에 대한 연구 (A Study of PL Prevention System in the USA and Japanese Leading Enterprises)

  • On November, 1998, Ministry of Finance and Economy in Korea announced officially to enforce the PL(Product Liability) Law within the country at the first half of the year 2000. Therefore, a companys responsibility for customers who are damaged by a defect in the products safety will be gradually strict and impose burden on management. This paper presents suggestions about PL prevention of domestic enterprise through the research of PL prevention strategies and prevention systems in the USA and Japanese leading enterprises.

  • 우리나라는 2000년에 제조물책임법이 제정하여 2002년 7월 1일부터 시행하였으며, 제조물의 제조, 설계, 표시등의 결함으로 인하여 발생한 손해에 대한 제조업자 등의 손해 배상책임을 규정하고 소비자의 결함 입증부담 경감과 피해자의 보호를 도모하자 하고 있다. 제조물의 표시등의 결함은 지시결함이나 경고결함에 관한 것으로 제조자는 그 위험에 의한 사고를 방지 회피할 수 있도록 소비자에게 정보를 제공하여야 하나 이를 이행하지 않아 발생된 결함이다. 본 논문에서는 A사(社)의 공기정화기 B모델 사용설명서에 나타난 정보제공사항을 주의 경고표시 가이드 등에 따라 검토하였으며, 그 결과 일부 지시 및 경고사항에서 보완해야할 사항이 발견하였다. 보완사항은 제안사항으로 기업내부 에서 처리하되 전문성이 부족한 분야는 외부의 PL전문가의 협력하에 바람직한 개선안이 도출될 수 있을 것이다.

  • 2002년부터 시행되어오고 있는 제조물 책임법에 의해 사고케이블의 원인분석과 사고패턴에 대한 데이터베이스화가 중요하다. 더욱이 가속열화상태에서 전력케이블 사고의 패턴 및 모의실험은 데이터베이스 시스템 구축에 필요하다. 본 논문에서는 열 열화 따른 22.9[kV]이하 케이블의 열 충격시험을 수행하였다. 이 시험은 IEC60811-3-1에 따른다. 시험결과로부터, 22.9[kV]급 A사 전력케이블은 표면이 변색되었고 길이방향으로 급격하게 감소되었다. 특히, A사 전력케이블의 열 중량 특성이 심하게 변함에 따라, 케이블 제조상의 문제일 것이라 추측된다. 만약 전력케이블의 제조상의 결함에 의한 것이라면, 피해자들은 PL환경 하에 손해배상을 받을 수 있을 것이다.

  • While the medical supplies have positive functions such as extending lifespan, recovering health, and preventing diseases, they also cause unexpected tragic consequences due to their side effects, and the magnitude of such damage inevitably increases due to the mechanism of mass production, mass distribution, and mass consumption of those medical supplies. Therefore, needless to say, the optimal way to prevent or reduce such damage is rather through medical supply manufacturers' producing non-defective products, or through the government's controlling production and sales of medical supplies with more aggressive exercise of regulatory authority on medical supply manufacturers, than through a remedy by a legal relief after using medical supplies. In this case, although the victim died due to the defect of the cold medicine, 'CONTAC 600', the drug company's responsibility to cover damages was not recognized because a defect could not be found in the then-manufacturing process. Thus, while pharmaceutical companies are gaining economic profits by producing and selling a medical supplies, if they do not take any remedy measures for the victims of their products' side effects, the victims have to use medical supplies under their own responsibility of taking a risk, and they have to accept the full damage of the potential consequence. Therefore, to remove such absurdity and contradiction, and to practically remedy the victim of medical supplies' side effects, the pharmaceutical side effects remedy project pending in the the Drugs, Cosmetics and Medical Instruments Lawneeds to be actively implemented.

CONSTRUCTION DEFECTS AND MONETARY RETENTIONS IN CONSTRUCTION PROJECT: A REVIEW OF CASE LAW

  • Retentions are generally considered to be intended to act as a powerful tool to incentivize contractors/subcontractors to remedy defective work in cases of non-performance. This study attempts to establish the extent to which retentions can be used for this purpose by investigating case law connected with insurance and defective work. One of the significant questions is whether retentions are sufficient to deal with construction defects or value of retentions in the rectification of defects is illusory. The cost to repair a defect may vary depending on a number of components including type, cause, magnitude and the construction stage at which the defect occurs. It is expected that a review of existing cases on defective workmanship will provide an insight on the issues and whether retentions are effective in their intended function. In order to establish their functionality, the study described in this paper investigated 6 construction insurance cases to identify the critical issues and the causes of dispute. It was found that the nature and the cause of defects were different in each case. It was also established that certain defect types not covered by insurance may be covered by retentions - potentially one of the key uses of a retention strategy. It is expected that the findings will assist in forming a view on the quantum of money that may be required paving the way for a first time understanding on a rational basis for setting up retention regime.
